5 Authority This meeting is the result of legislation allowing broad public community notification regarding those who are released after civil commitment as a Sexual Psychopathic Personality (SPP) or Sexually Dangerous Persons (SDP) Based on the idea that a well informed community is a safer community 5

6 Community Notification Meetings MSOP clients Applies to Scope of notification is same for all other Level III predatory offenders, regardless of actual assigned level, for civilly committed sex offenders Enacted in 2011 MN State Statute 253D.32 / SCOPE OF COMMUNITY NOTIFICATION 6

7 Registration of Offenders MSOP Clients The Bureau of Criminal Apprehension (BCA) is in charge of the Predatory Offender Registry, which was established July 01, 1991: As of January 1, 2016, there were approximately 17,500 predatory offenders registered in Minnesota Approximately 1000 (17%) offenders are in prison at any given time Approximately 725 (4%) clients are committed to MSOP The remaining approximate 15,775 (80%) offenders are living in our communities Sex offenders have always been among us 7

8 Civil Commitment in Minnesota Courts commit clients as either a sexually dangerous person (SDP) or sexually psychopathic personality (SPP) Courts in, courts out process Most clients have served prison sentences for their sex crime Counties refer some individuals for civil commitment 8

9 Continued Clients participate in treatment, work, education, and recreation within a therapeutic community MSOP clients are provided sex offender treatment (Three Phases) MSOP is a treatment program and not a prison 9

Treatment: Promote self-management, address underlying issues of offending behavior. Protective factors: Safe secure housing, community supports, employment, prosocial relationships, purposeful belongingness 14

15 Provisional Discharge Conditions GPS Active Treatment in the community Random Drug & Alcohol testing Random searches of residence and personal property No use or possession of drugs or alcohol No unsupervised contact with minors, use of the Internet and etc. unless approved 15

16 MSOP Reintegration Specialists Manage and supervise no more than 8-clients at any given time Conduct random searches and test for alcohol/drug use Conduct unannounced visits to the client s residence, work, etc. Oversee client s compliance of court-ordered provisional discharge conditions Conduct overt and/or covert surveillance of clients as needed 16

17 MSOP Clients Ben Braylock, Marvin Breland, and Demetrius Mathews all petitioned the courts to move from their current MSOP placement to the community and the petition was granted All three MSOP clients must follow their provisional discharge plan which includes many conditions of supervision MSOP is responsible for all three MSOP clients and has the authority to return them to MSOP at any time 17

18 Ben Braylock Birth date: 10/23/1931 (84 years old) Current Risk Level: 2 Height: 5 5 Weight: 185 lbs Eye Color: Brown Hair: Grey/bald Residence location: Dayton, MN Background: Has cognitive deficits and carries a diagnosis of dementia 18

19 MSOP Facility History Court civilly committed Mr. Braylock to MSOP on April 12, 2006 as a Sexually Dangerous Person (SDP) Court granted a provisional discharge on September 19, 2016 and as a result will be moving from MSOP to the community Non-Sex Offense Convictions 1968 Burglary Conviction 1981 Murder 2nd Degree - Mr. Braylock stabbed his wife several times, resulting in her death and sentenced to 116 months in prison Sex Offense Convictions 1988 Conviction of Criminal Sexual Conduct in the 1st Degree - Mr. Braylock sexually assaulted a 13-year-old girl known to him 1991 Conviction of Criminal Sexual Conduct in the 1st Degree / prison sentence of 268 months executed - Mr. Braylock sexually assaulted his 14-year-old relative 19

20 Marvin Breland Birth date: 03/20/1957 (59 years old) Current Risk Level: 3 Height: 6 1 Weight: 239 lbs Eye Color: Brown Hair: Bald/Black/Greyish Residence location: Dayton, MN Background: Has cognitive deficits, diagnosis of paranoid schizophrenia, borderline intellectual functioning, antisocial personality disorder, & major depression disorder. 20

21 MSOP Facility History Court civilly committed Mr. Breland to MSOP on November 05, 1992 as a Sexually Psychopathic Personality (SPP) Court granted a provisional discharge on September 16, 2016 and as a result will be moving from MSOP to the community Sex Offense Convictions 1976 Criminal Sexual Conduct in the 1st Degree / 10-year prison sentence executed - Mr. Breland entered the home of an adult female stranger and sexually assaulted her 1985 Kidnapping / 26-month prison sentence executed - Mr. Breland grabbed a 16-year-old female stranger by the arm and threatened to kill her with a knife 1989 Aggravated Robbery / 60-month prison sentence executed - Mr. Breland pointed a long-barrel pistol at an adult woman stranger at a department store 21

22 Demetrius Mathews Birth date: 10/29/1963 (52 years old) Current Risk Level: 2 Height: 5 10 Weight: 185 lbs Eye Color: Brown Hair: Black Residence location: Dayton, MN Background: Has cognitive deficits, carries a diagnosis of Sexual Abuse as a Child, Cognitive Disorder, Dementia, Mixed Expressive Language Disorder, Polysubstance Dependence, Borderline Intellectual Functioning and Paranoid Personality Disorder. 22

23 MSOP Facility History Court civilly committed Mr. Mathews to MSOP on February 09, 1995 as a Sexually Psychopathic Personality (SPP) Court granted a provisional discharge on September 16, 2016 and as a result will be moving from MSOP to the community Sex Offense Convictions 1983 Criminal Sexual Conduct / Executed prison sentence - Mr. Mathews sexually assaulted a 12-year-old relative 1990 Criminal Sexual Conduct / 70-month prison sentenced executed - Mr. Mathews sexually assaulted a 3- year-old relative 23

24 Noteworthy MSOP has 6 clients on provisional discharge residing in our communities, resulting in no calls to law enforcement regarding our clients behaviors. MSOP s first client granted a provisional discharge has been out for almost 5-years with no behavioral issues or police contact Majority of sex offenders do not find victims at parks, schoolyards, or playgrounds 24

25 Noteworthy Research is clear, sex offenders living together in shared housing programs are less likely to reoffend In the majority of cases, abusers gain access to their victims through deception and enticement, seldom using force Only about 10% of perpetrators of child sexual abuse are strangers to the child, almost 90% have a current relationship with their victims 90% of child victims know their offender, with almost half of the offenders being a family member 25

26 Noteworthy Biggest challenge for successful reintegration of MSOP clients and other civil commitment programs is the fact the public has many misconceptions about these clients Common misconceptions may interfere with MSOP clients treatment and reintegration into the community as well as influence legislatures to pass laws that are misguided and inefficient Public safety can and will be enhanced managing and supervising MSOP clients based on current best practices and research 26
