The WYN procedure is an addendum to the Corporate Procedure and provides additional site specific guidance and requirements. PURPOSE To set forth additional Wyandotte site requirements necessary to comply with BASF Corporation ( BASF ) Procedure, BC , Incident Reporting and Notification. 2. SCOPE This procedure applies to the BASF Wyandotte site and covers all BASF Employees, Contract Employees, Contractors and Visitors. 3. PROCEDURE 3.1. Compliance with Corporate Procedure BC All activities regarding Incident Notification and Reporting must comply with the requirements set forth in BC Additional Site Requirements In addition to compliance with the requirements set forth in BC , this procedure requires compliance with the following additional Wyandotte site requirements: Notifications Direct Notification to EHS via EHS On-Call Phone If it is suspected that a work related injury or illness may be "recordable", same day notification must be made via telephone to the EHS On Call phone. Same day notification to the EHS group must also be made for a significant property loss/process safety incident or near miss in accordance with requirements outlined in BC Due to reporting requirements for crisis management and MIOSHA for serious injuries involving hospitalization and/or fatality, it is required that verbal contact be made to Wyandotte Site Medical Department, Site Security at ext and the EHS On Call telephone at (734) within one hour. Refer to the Wyandotte Site Medical Plan, WYN for detailed reporting requirements. In addition, incidents involving a seriously or fatally injured employee or major fire, explosion or property damage, significant interruptions to operations, or incidents involving mobilizing public sector resources (i.e.: fire and police), or an environmental release with adverse impact, notifications must be made to the Corporate Emergency Response Hotline ( ) immediately. (As a general rule, the Wyandotte EHS Group will work with the Site Manager to initiate this call).

3 Procedure No.: WYN Page: 3 of 5 OSHA Reporting Requirements: Effective, January 1, 2015, the following changes have been made to the OSHA reporting requirements: All work-related fatalities must be reported to OSHA within 8 hours. The Wyandotte EHS group is responsible to ensure the timely reporting requirements are met, thus the need to promptly report all work-related fatalities immediately to the Wyandotte Site Manager, the EHS On-Call phone and the Wyandotte Site Medical Department. Work related inpatient hospitalizations of one or more employees, all amputations and all loses of the eye within 24 hours Reports to OSHA can be made by: Calling OSHA free and confidential number at OSHA (6742). Calling your closest Area Office during normal business hours. BASF North America Flash Reporting Requirements Flash Reporting is the notification of Recordable Injuries within 48 hours for BASF employee, Contract Employee, or Contractor Employee in North America. The statement should be prepared by the management of the site/department where the injury occurred. The communication is sent to the division president, vicepresident of the employee and the SVP of NTU. The Flash Report will be submitted by and should be two paragraphs or less and include: Description of the Incident, Time of Occurrence, Seriousness of the Injury, Primary Cause, if known, and Immediate Response to the Incident. Electronic A/I Database Entry/Notification Incidents that meet the accident/incident definition contained in section 2.2 of BC , Accident/Incident Reporting must be entered by the Unit as soon as practical into the Corporate Electronic Accident/Incident Database.

4 Procedure No.: WYN Page: 4 of 5 4. RESPONSIBILITIES 4.1 Site EHS/OH-MI CAN Hub is responsible for: The issuance, interpretation and update of this procedure. Reporting all EHS incidents to applicable government agencies. Determining OSHA Injury/Illness Recordability and maintaining the Wyandotte Site OSHA Log. Participating, reviewing for completeness/quality and approving incident reports. Initiating and forwarding Ecoweek Summaries of applicable incidents. 4.2 Site Operating Units Each unit is responsible for the administration and implementation of this procedure. 4.3 Unit Management is responsible for ensuring that: Unit Personnel are trained on notification and reporting requirements. Initial notification & reporting of incidents are made in a timely manner. Reports are completed timely and accurately. Follow-up action items are completed timely and accurately. The Unit Manager and Unit EHS Representative shall approve all final reports. Communication of incident investigation results to affected employees. 4.4 Department/Unit Employees Promptly notify immediate supervisor of EHS Incidents. As appropriate are involved in incident investigations to assist with the investigation findings, root causes and corrective actions. 4.5 Contractors Promptly notify their BASF contact as well as their immediate supervisor of EHS incidents. Participate as needed in the incident investigation to assist with the investigation findings, root causes and corrective actions.
