The new multidisciplinary national drug strategy still needs to be adopted by the Government. The alcohol and drug abuse prevention programme continues to be implemented. Implementation, however, needs further improvement, including the necessary arrangements for connection of databases, collection and exchange of information and the allocation of sufficient financial resources. Overall, inter-agency co-operation and co-ordination needs to be increased. 3. Description 3.1 Background and justification: Background Statistics (see annexes 6A 6E) describing the drug crimes situation in Estonia in the period are attached to the project fiche. Drug crimes are concealed crimes by nature and the respective statistics mostly describes the more efficient work of the Police in detecting such criminal offences. Opposite to the so-called regular crimes, in case of drug crimes there is no report from the victim to start the procedure. In addition, the statistics also indicate the detections of drug labs and confiscations of large amounts of substances from such labs. Estonia has been used as a drug transit country for the past 10 years and extensive amphetamine-type stimulants producing country for the past 5 years. As drug-related

2 2 criminality reached a critical level several years ago, the fight against drug related crimes has been the priority of the Estonian Police over the past years. Despite successful seizures and other steps to fight drug related crimes there remain still some areas that need to be addressed. During the past year an in-service training system has been launched, which current content, however, in the longer perspective is not a very feasible solution. The training requirement research carried out by the Police Board in 2002 demonstrated that circa 600 officials (ca 8% of all police officials) brought out insufficient drug-related training, which indicates a serious shortcoming in police education. During approximately one year, circa 100 officials have received respective in-service training. Today the basic drug-related training in the Police School is too superficial and not visual enough. The training programme of drug training of the Paikuse Police School 1 is presented in annex 7, but is not in compliance with contemporary requirements and actual needs. The said training programme lays more emphasis on the science of narcotics than on fields related to specific police work. In 2003 there were 98 graduates from the Police School (only basic training, supplementary training not included). In 2004 it is estimated to have 140 graduates. In the Police College of the Public Service Academy drug training is carried out in the framework of the crime prevention subject i.e. there is no separate training programme, the subject is not treated to a satisfactory extent and the programme only focuses on some key issues (safety of a police officer, prevention, etc.) The material treated in the lectures largely depends on each lector s own personal approach to the problems. In 2002 there were 42 graduates from the Police College of the Public Service Academy As a result of this there is also a lack of adequate written study materials and audio-visual aids (such as books, videos, handouts etc) for the study of drug related issues. The issue of training materials for drug officers has been brought up at EU level also several times (e.g. Draft Council Resolution on training for drug law enforcement officers (11052/03 CORDROGUE 67)). Currently the division of drug related topics in training programme is under discussion and most likely basic training will include topics relevant to law enforcement and community policing and advanced training will be specialised on criminal police matters (intelligence, investigation and forensic examination). As the fight against drug crime has been and will be the priority of the Estonian Police also in the future, the topic is obligatory part of the training programme and all the graduates will benefit from the current project. In the future (the exact timeline remains to be specified) it is planned to unite or unify the two educational establishments. However, as the process is still in the starting phase, it is impossible to foresee the compilation of a common training programme in the framework of the present project. 1 There are two educational institutions in Estonian police education system Paikuse Police School that gives basic police education, and Public Service Academy that is a higher educational institution for complementary training of police officials among other duties.

3 3 The part of the project concerning updating drug training programme must be seen as a pilot project for other law enforcement agencies. One of the aims of the current project is to elaborate up-to-date training for police officers. The owner of the training materials elaborated in the framework of the current project will be the Police School and/or the Police College of the Public Service Academy. A part of the handbooks will be handed out to police officers for daily work. Another problematic field in the fight against drugs is the profiling of amphetamine. During the past years several drug laboratories producing amphetamine have been discovered in Estonia, from which a large amount of amphetamine was confiscated. Profiling the confiscated amphetamine is a good opportunity to map international smuggling routes. At the present time the amphetamine profiling in the Baltic Sea region is done in the forensic laboratories of Finland, Sweden and Poland. The amphetamine samples of interest (big seizures, seizures on borders) from Estonia are sent for profiling to Sweden or Finland. It is much easier to send the results of amphetamine profiling for comparison than the amphetamine samples. The sending of narcotic drugs is expensive, time consuming and requires various licences from both sides. Until the present moment the Forensic Service Centre has sent samples 3 times a year, the results arrive within approximately 2 months. The customs procedure costs 1300 EEK (83 EUR) + time spent by one person per day + one person's return trip to Helsinki (approximately 1200 EEK (77 EUR)). Therefore, the total is 3000 EEK (192 EUR) per dispatch. Until the present moment the Finnish lab has not required a separate charge for carrying out the expert examination. The new harmonised method for the profiling of amphetamines was elaborated in 2003 (Project SMT-CT Development of Harmonised Method for the Profiling of Amphetamines, participants were the corresponding laboratories from Finland, Sweden, Switzerland and UK). The new profiling method has established standardised conditions for analysis and the analysis result (amphetamine profiles) from different forensic laboratories so they could be compared. The aim of this method is to identify links between seizures of amphetamine and the clandestine laboratory in which the amphetamine was produced or between different seizures of amphetamine. To start the amphetamine profiling in the Estonian Forensic Service Centre proper analytical equipment and specialist(s) with proper training are needed. The equipment needed consists of a gas chromatograph-mass-spectrometer (see annex 9, price approximately EUR) and other necessary lab equipment for amphetamine profiling (see annex 10, price approximately EUR) and the specialists should be chemists with a university degree and with additional training in amphetamine profiling. Depending on the amount of amphetamine samples of interest (approximately) 2 specialists will be needed if the Forensic Service Centre will conduct amphetamine profiling. The specialist already work in the FSC but they have to receive additional training to conduct amphetamine profiling. Taking into account the present situation 2 in Estonia, Estonia should primarily start profiling amphetamine, which would create the precondition for a faster detection of labs, thereby preventing the narcotic substances from reaching the market (including the international market) and decreasing the opportunities of the criminals to make an illegal profit. 4 4 profiling is to define the laboratories and as Estonia is an amphetamine producing country it would be more efficient to profile amphetamine in Estonia. Amphetamine profiling has been brought up on the level of Baltic Sea Task Force on Organised Crime. The profiling of amphetamine is a new type of analysis in the Forensic Science Centre, which requires a similar device to the one acquired in the course of the previous Phare twinning project Development of Criminalistics and Forensic Science (ES9905/IB-JH 01), but the analytical column on which the dissociation of different compounds takes place, is of a different type. Therefore, it would be possible to use the existing device (after changing the column) for the profiling of amphetamine, but at the same time, the qualitative analysis of narcotic substances cannot be carried out. Presently, there are so many expert examinations of narcotic substances carried out in Estonia that the device is in use almost around the clock. Therefore, it would be impossible to interfere with the normal routine work on the device and use the same device for profiling. In addition, it is quite time-consuming to change the column of the gas chromatograph-mass spectrometer practically one working day is lost before work can be resumed with the device where the column has been changed. In case the trends of drug crimes should change, it will still be possible, after realignments, to use the device procured via the present project for the profiling of other amphetamine-type stimulants (ATS). Justification The more general objective of the present project is to provide assistance in the application into practice of the drug strategy. Not dependant on the adoption of the drug strategy it is essential to enhance the fight against drugs and to start amphetamine profiling in Estonia. The current project focuses on supply reduction and does not cover the demand side. As the result of the Phare project ESOO/IB/JH/01 EU Phare Support to Develop and Implement the National Drug Strategies and Programmes completed in September 2003, the Estonian drug strategy until the year 2012 was compiled where the enhancement of training in order to combat drug related crimes more effectively has been brought out as one of the fields that needs further development. The strategy states following objectives: Long-term objective By 2012: The fight against the supply of narcotic substances is well co-ordinated between competent authorities and the training and technical means are up-to-date and meet the requirements. Short-term objectives By 2007: In general: 1. A joint inter-agency unit is operational in the fight against drug crimes (the Police, Customs, Border Guard, etc.) 2. Each official active in the fight against drug crimes will receive (in-service) training through a common training system. 3. There will be an active national, international and bilateral co-operation, the aim of which is to prevent the production, mediation, usage and international smuggling of drugs. 4. All obligations taken on through various international conventions shall be fulfilled.

The technology used in the fight against and detection of drug crimes (including technology used for special surveillance activities, expert examinations, for carrying out border and customs control duties, for analytical work, etc.) is up-to-date and meets the requirements. 6. The fight against drug crimes is specifically defined between various authorities and the rights and obligations have been determined (including in case of specific surveillance activities, expert examinations, control of consignments, etc) through legal acts and cooperation agreements. Police: 7. Analysis of drug crimes and information related to drugs shall be forwarded to the central drug unit of the police, who will forward the information to the sub-units of the police and other institutions and authorities, who are involved in the fight against drugs. 8. The law enforcement police is active both in the preventive and repressive fight against drug-related crimes. Today this drug strategy had not yet been approved by the Government of the Republic. The Government of the Republic returned the draft strategy to the Ministry of Social Affairs, which is the ministry leading the project, for amendments, as the expenses and measurable results of the application of the strategy were not brought out clearly enough. As main problem, the Government underlined the insufficiency of national means. A new discussion should take place in February The objectives of the present project coincide with the priorities that have been brought out in clauses 2, 3, 4, 5 and 8 of the planned drug strategy. In order to address the mentioned weaknesses and problems, expert assistance is required to elaborate a training programme on fight against drug crimes for two police education institutions (Police School and Police College of Public Service Academy). The programme should provide common approach to fight drug crimes and consider the nature of the school/college. RTA will be responsible for elaborating the training programme. The new training programme must be supported by study aids and a trained trainers programme will also be developed under the current project. Short Term Expert 1 is required to conduct training needs analysis, to develop training programme and to elaborate two handbooks: one for raising awareness in the police in general and another for specialist level. Handbooks will be used for training at school but also for independent studying. In addition Short Term Expert 1 must produce concept for study movie and organise tendering for production. STE 1 will carry out his/ her task on close co-operation with RTA. Short Term Expert 2 is responsible for the part of the project that concerns amphetamine profiling conducting the need analysis for amphetamine profiling and training experts. RTA will prepare the procurement of the equipment. The necessity of setting up a joint inter-agency unit, which has been brought out in clause 1 is one of the main objectives of the Phare Multi-Beneficiary Drugs Programme Phare Regional Drug Law Enforcement Project. During the present stage of the project, middle-level managers from the Customs, Border Guard and Police are dealing with the matter, in order to prepare it for discussions with the leaders of the abovementioned institutions. The possible hindrance at this stage might be the plan for the reorganisation of the abovementioned

6 6 agencies. The financing of the activities and selection and engagement of staff (e.g. whether the officials are posted into joint units or is the joint unit a permanent Police unit in the structure of the Eastern Police Prefecture) for the joint unit is problematic and still remains to be solved. At the same time there is already an existing co operation and joint inter agency unit called Finesto between Estonian and Finnish authorities to fight drug crimes. This group consists of representatives of Central Criminal Police, Customs, Border Guard and Tallinn and Helsinki Police. It is planned to extend this group and to include the respective Russian officials and to station a sub- group of Finesto to the Estonian - Russian border city of Narva. The objective brought out in clause 6 is also covered by the aforementioned project. There are joint trainings for the officials of the Customs, Border Guard and Police, where emphasis is laid among other things also on the planning and practical application of joint operations (controlled deliveries). The central drug unit brought out in clause 7 is the Central Criminal Police, the new structure of which starting from 1 January 2004 will have increased administrative competence in the field under question and will enable a more effective co-ordination. The necessity brought out in clause 8 to increase the preventive work done by the Police in the fight against drug crimes will to a large extent be covered by the compilation and publication of a handbook compiled in the framework of the present project. The first part of the handbook focuses on the work done by the law enforcement police in the field under question. Up to day there are no written training materials / textbook for police officers about drugs. This handbook should contain all necessary information on drugs (legal and medical aspects, safety at work, etc.) Considering the nature of the project, no NGO were consulted during the project preparation process. The project aims at institution building at the central government level and the NGOs are not seen as directly benefiting or having role in the project s activities. 3.2 Linked activities: Projects under Phare horizontal and national programmes: Precursor Project This project started in 1993 and went through several phases. It assisted the CEECs in developing effective control on chemicals, which can be used in the manufacture of illicit drugs. Results for Estonia: seminars and training courses were conducted (Tallinn) involving Customs, Police, Border Guard, labour inspection and private enterprises importers of precursors. Equipment was provided (computers and printers) to customs, State Agency of Medicines, Police and the Ministry of Social Affairs. This project was finished in November The follow-up project was integrated with the Synthetic Drugs Project. The Project was financed by the European Union under the Phare Programme Project on Licit Drug Control and Illicit Synthetic Drugs The Licit Drug Project started in 1996 and was extended to include also Illicit Synthetic Drugs in the summer of In November 1997, an assessment mission was organised in Estonia to evaluate the situation in Estonia in regard to licit drug control and the fight against illicit synthetic drugs. A report on Diversion, Illicit Manufacture and Trafficking in Central and Eastern Europe was prepared. The project ended in July 1998

7 The Project was financed by the European Union under the Phare Programme 7 Development of Criminalistics and Forensic Science (ES9905) The project was carried out As a result of this project Forensic Service Centre conforms to international standards, the Centre has excellent facilities, equipment and trained staff. The aim of the project was to support Estonian authorities in conducting forensic investigations. The Project was financed by the European Union under the Phare Programme in the amount of 2,5 MEUR (the national co financing was 0,65 MEUR). The direct beneficiary and body responsible for the implementation was the Forensic Service Centre. Synthetic Drugs Project (under Multi-Beneficiary Programme) The project started in 2000 and the main aim of the project was to develop necessary legislation, measures and strengthen the structures and capacities of the CEECs to combat synthetic drugs, in compliance with EU standards. The project is focusing the transposition of the EU acquis in the candidate countries. Planned activities were carried out mainly in and in the autumn of 2001 the decision was made to put together two projects Synthetic Drugs and Precursors. The Project was financed by the European Union under the Phare Programme Drug enforcement officer project (under Multi-Beneficiary Programme) The project was carried out in The main idea was through personal contacts of field officers to enhance the co-operation between neighbouring EU Member States and applicant countries. Estonia exchanged bilaterally drug enforcement police officers with Finland, Sweden and Denmark. This project turned out to be a stepping stone for further co-operation between Estonia and Finland as several officers from this project joined the joint investigative team FINESTO (includes officers from Tallinn and Helsinki Police and from Central Criminal Police, Customs and Border Guard of both countries), which is dealing with drug smuggling between Estonia and Finland. The Project was financed by the European Union under the Phare Programme National Drug Strategy The project (ES Support to Balanced Development and Implementation of National Drug Strategies and Programmes) lasted and the idea was to create an Estonian National Drug Strategy, which would consider the EU Drug Strategy. The goal was to create a multilateral approach to the drug phenomena, focusing equally on demand and supply reduction. Also treatment, prevention, rehabilitation and re-socialising issues were dealt with. The project was completed and sent the strategy to the Estonian government for approval in October The Project was financed by the European Union under the Phare Programme Synthetic Drugs and Precursors Project (under Multi-Beneficiary Programme) The project started in 2001 and lasted till the end of The main aim was to develop a multi-agency approach to tackle the manufacturing of synthetic drugs. Several national and regional seminars on precursors and synthetic drugs have been held. Practical exercises on dismantling of clandestine laboratory were carried out, special protective gear was issued. A special interest of the project was to get the private sector (chemical wholesalers, importers, exporters) to have close co-operation with state agencies. The Project was financed by the European Union under the Phare Programme

8 8 Phare Multi-Beneficiary Drugs Programme Phare Regional Drug Law Enforcement Project The project lasts for 18 months The main goal is to enhance the administrative capacity of Estonia on the borders. Three beneficiary agencies are involved - Police, Border Guard and Customs. Several seminars and practical exercises will be carried out (controlled delivery, formation of joint drug unit). This involves the implementation of National Drug Strategy on supply reduction side. The Project is financed by the European Union under the Phare Programme Implementation and Further Development of National Drug Strategy The Phare project 2003/ aims at the demand reduction and is not over-lapping with the current project. All above mentioned projects provided assistance to Estonian authorities focusing in different aspects of fight against drugs. 11 11 - Production ~ Contract 2: Procurement of hardware/equipment ( EUR, TF EUR) The following items will be procured: - Gas chromatograph - Mass-spectrometer, incl. software (GcMs, see annex 9) - Necessary additional lab equipment for amphetamine profiling (Centrifuge, Shaker, Digital pipettes and dispensers, see annex 10 ) GcMs and other necessary additional lab equipment will be used for amphetamine profiling in the Forensic Service Centre. A feasibility study will be conducted by May 2004 at the latest. The Terms of Reference for feasibility study were prepared in January The budget for contract 2 might be revised on the basis of this study. 3.5 Lessons learned: Five Phare projects are currently being implemented under Ministry of Internal Affairs: - Developing the readiness to implement SIS; - Enhancing border control and development of border surveillance at Estonian Eastern border; - Extension of Estonian Automated Fingerprint Identification system; - Improving investigation involving digital evidence and - Support to the creation of witness protection system. All projects cover different fields of justice and home affairs. As regards project implementation the decentralised approach has been most successful. Direct beneficiaries are implementing the projects having designated or employed project managers and assisting staff for proper implementation. The Estonian Police has direct experiences from three finished Phare projects: - Development of Criminalistics and Forensic Science, - Police Training and Education System and - Support to Development and Implementation of the National Drug Strategies and Programme. While programming the current project the following recommendations were considered: precise definition of the expert s profile and tasks, realistic and measurable outcomes of the project, communication and co-ordination between evolved parties, problems in timing of different activities. In addition to Phare national projects Estonian police Board has participated in multibeneficiary programmes and bi- or multilateral projects. In more operational level the police has very good co-operation with Finland in the framework of Finesto working group. Representatives of stakeholders were involved in drafting of all aspects of the project fiche - there is better understanding of expectations of different institutions. Expert's tasks and outcomes were indicated in detail as far as possible, the feasibility study is to be carried out allowing stakeholders to draft earlier more precise technical specifications.

12 12 4. Institutional Framework 5 The Estonian Police is under the jurisdiction of the Ministry of Internal Affairs (see annex 11). There are 4 national authorities subordinated to the Police Board (PB): Central Criminal Police (CCP), Forensic Service Centre (FSC), Central Law Enforcement Police, Police School (PS) and 4 regional authorities Police Prefectures 6 (PP). The PB consists of three main departments: 1. Development Department 2. Service Department 3. Technical Department and three bureaus: Finance Bureau, Public Relations Bureau, Internal Audit Bureau The Drug Crime Division of the Proceedings Department of the CCP investigates drug crimes that cover several counties or the whole state, are very serious, draw special public attention or need international co-operation. The Chemistry and Biology Department of the FSC is responsible for making drug expertise. Crime Department of the PPs are responsible for investigating street level drug crimes. The PS is a police educational institution subordinated to the PB which trains junior and senior police officers giving them a vocational secondary education. The Police School functions on the basis of general secondary education. 7 Public Service Academy is a higher educational institution for complementary training of police (and other law enforcement) officials. In the future (the exact timeline remains to be specified) it is planned to unite or unify the Police School and the Police College of the Public Service Academy. However, as the process is still in the starting phase, it is impossible to foresee the compilation of a common training programme in the framework of the present project. Namely, based on the National Drug Strategy, the Police will be able to declare drug crimes to be an ongoing priority. The broader objective of the whole present project is the practical application of the National Drug Strategy. In view of that, the activities to be performed on the national level have been determined. As the drug strategy has been compiled in view of a period until the year 2012, activities should be covered at least up to the said time. Since 1999 the fight against drug crimes has been one of the priorities of the Estonian Police. Based on the present situation on both the national as well as international level, no tendency of decline can be foreseen for the said type of crime. In the Estonian Police the system of yearly action plans has been adopted. By introducing the results of the present project into the action plan we will create another factor guaranteeing sustainability.

16 16 The training materials (books as well as other resources created/obtained throughout the project) shall be maintained by the Police School and/or the Police College of the Public Service Academy, which will guarantee the sustainability of the education provided in case a lecturer should change. A part of the handbooks will be handed out to police officers for every day work. Trained trainers and developed training programme ensures professional provision of high quality training also after the project is completed. They will formally commit themselves to act as trainers for a certain number of years after the project through written agreement. As the problem related to the illegal production and dissemination of amphetamine has increased in Estonia during the past years, it is possible to foresee that the amount of comparative research will increase in the future. The devices acquired through the present project will therefore find more and more use in the course of time. A maintenance contract for the gas chromatographs acquired through the Phare twinning project Development of Criminalistics and Forensic Science (ES9905/IB-JH 01) has been concluded with the representative of such devices in Estonia, and it will be easy to expand this contract to cover also the new device (gas chromatograph mass spectrometer). The said device needs helium for functioning; the helium-supply system has been worked out in the lab, in the course of building of which the possible acquisition of another device was taken into account. The other devices to be procured (shaker, centrifuge, pipettes, dispensers) are easily maintained by the lab staff and no significant additional expenses will result. The results of the current project will be maintained also in case the institutional framework changes since the stakeholders will be owners of project results: the Forensic Service Centre will be the owner of procured equipment, the Public Service Academy will own developed training programme and study aids. Institutional changes in progress do not foresee significant changes in the work of the mentioned institutions. The devices to be procured have no negative effect on the environment. The staff that will be trained to use the devices will be selected from among the staff of the lab of the Forensic Service Centre who already have enough experience and length of service in the field of analysis of narcotic substances. 9. Conditionality and sequencing Project conditionalities: - Procurement of the equipment (contract 2) is conditional upon demonstration of the need for additional equipment and evaluation of its cost by a Feasibility study to be carried out for the procurements by May 2004 at the latest; budget for contract 2 might be revised on the basis of the results of this study within the limit of for the transition facility contribution, any additional expense to be covered by national co-financing. - Two experts must be assigned for amphetamine profiling in Forensic Service Centre before the start of the project. - National Drug Strategy adopted before the start of the project Sequencing The activity plan of the Police School to be adjusted to the general priorities of the Police by the end of 2004
