3 I. GOALS The overall goal of Lyon College s Student-Athlete Drug Education and Testing Policy is to promote a year-round drug free environment in the Lyon intercollegiate athletic program. Within the overall goal are the following objectives: To protect the health, safety, and welfare of the student-athlete; To identify, address, and treat student-athlete problems and concerns involving drug and alcohol use and abuse; To protect the institution s integrity; and To seek to maintain a fair play in intercollegiate athletic competition by Lyon College athletes. The first priority of this policy is the student-athlete s health, welfare, and safety. The approach is from a medical perspective, with an emphasis on prevention, diagnosis, treatment, and rehabilitation. One focus of the policy is on socially used drugs because of their potential for dependence and harm. In addition, there is evidence to indicate that the use of these drugs may impair performance and reaction time, possibly resulting in injury to the student-athlete or others during athletic activity. A second major focus of this policy is on the consumption of alcohol. Alcohol is involved in over 90% of the undesirable behaviors observed among students on college campuses. Responsible alcohol consumption will be a focal point of the policy. The use of tobacco products (such as cigarettes, chewing tobacco, snuff, e-cigarettes, etc.) have well documented long term health effects on the individual user and those around them. All athletic facilities on the Lyon College campus are tobacco free zones. Education and counseling are the cornerstones of the policy. These activities are conducted to alert studentathletes and coaches to the potential harm of substance abuse. Education and counseling are supplemented with drug testing, since studies have shown that education alone is not a sufficient deterrent to drug use. Substance use and abuse in sports may also compromise the integrity of athletic competition and the ideals of Lyon College. The Lyon College protocol for drug testing is designed to be fair, to achieve reliability of testing results, and to respect the privacy of the student-athlete. Test results are confidential to the extent permitted by law and become part of the student-athlete s medical record. Test results will not be released to anyone except in accordance with this policy or as otherwise required by law. This policy is not to be construed as a contract between the institution and the student-athletes at Lyon College. However, signed consent and notification forms shall be considered affirmation of the student-athlete s agreement to the terms and conditions contained in this policy. The Lyon College Athletic Drug Testing Program is separate and distinct from the NAIA Drug Testing policies, rules, and sanctions. Lyon College may amend this policy at any time in consultation with the National Center for Drug Free Sport. After the policy has been amended the Lyon College Athletic Staff, coaches, and student-athletes will be notified of the change. II. EDUCATIONAL & COUNSELING COMPONENTS A major component of this policy is education. There are two facets to the educational program: 1) explanation of Lyon College s Student-Athlete Drug Education and Testing Policy program to student-athletes and others, and 2) dissemination of information to student-athletes and those associated with athletic teams regarding drugs and alcohol, their use and abuse, and how such use or abuse may affect the student-athlete and his/her team and teammates. 3

4 A. Education of Lyon s program to student-athlete: 1. A presentation will be made to each intercollegiate athletic team in order to outline and review this policy, its purposes and implementation, and sanctions for violating it. 2. A copy of this policy will be given to student-athletes at their annual Student-Athlete Meeting. They will be asked to sign a form acknowledging receipt of the policy and consent to testing. 3. Any student-athlete who does not wish to sign the consent form may choose not to do so and forego participation in intercollegiate athletics. Student-athletes are free to refuse to consent to drug testing under this policy. However, student-athletes who refuse to be tested in accordance with this policy, which is designed to protect the health and welfare of the student-athlete, will not be permitted to participate in intercollegiate athletics at Lyon College and will, therefore, lose their athletic scholarship and/or grant in aid. 4. The National Center for Drug Free Sport has a Resource Exchange Center (REC) that can be accessed as a resource for the student-athletes at Lyon College to obtain information about medications and/or dietary supplements that he/she may be taking to determine how these substances may affect them and whether they contain banned substances, as well as, information on sports nutrition and an athlete recipe box. This resource is available through the Drug Free Sport website ( To login, select NAIA from the drop down menu under Select Your Organization. The password to access the REC is naialive5. B. Education of student-athletes and others about alcohol and other drugs. 1. Each team and coaching staff will meet annually, and at such other times as may be deemed necessary by the Head Athletic Trainer, for educational sessions. These sessions will focus on information regarding the dangers of using performance-enhancing substances, illegal drugs, and alcohol. The NAIA Banned Drug Classes document will be reviewed with the athletic teams during the annual educational session and at any other time as deemed appropriate by the Director of Athletics or his/her designee. 2. Educational programs will be designed with the following goals: a. To inform those associated with intercollegiate athletics how to recognize the warning signs and side effects of specific drugs. b. To educate the student-athlete and other appropriate personnel about the problems of drug and alcohol abuse, and how drug and alcohol abuse may adversely affect the student-athlete and his/her team and teammates. c. To encourage discussion about the use of drugs and consumption of alcohol. d. To describe rehabilitation and treatment programs and to inform about referral centers. 3. Attendance of the student-athlete at scheduled educational sessions is mandatory. Absence will be permitted only if approved by the student-athlete s head coach. The student-athlete must attend a make-up session for each unapproved absence. 4. Athletic trainers, team physicians, and other appropriate Department of Athletics personnel, as determined by the Director of Athletics and Head Athletic Trainer, should participate in these educational sessions. All coaches are expected to participate in at least one educational session each year about alcohol and drugs. C. Counseling 1. The purpose of the counseling component of this policy is to provide assistance, direction, and resources for student-athletes who need support as a result of positive tests, physician referral, or self-referral. 2. Counseling will be provided by trained specialists identified by the Team Physician. Some counseling resources can be found in Appendix A. Referrals will originate with a Team Physician, who shall be involved in developing an appropriate treatment plan. Counseling will be confidential. However, the student-athlete s substance abuse counselor will inform the Head Athletic Trainer and the student-athlete s head coach of the student-athlete s progress and of any incidents of non-compliance. 4

5 3. Self-referrals for counseling may occur at any time. A student-athlete who feels he/she needs to talk to a substance abuse counselor should contact the Head Athletic Trainer or designee, who will notify the Team Physician. If a student-athlete self-refers, the counselor or Team Physician may require that the student-athlete be drug tested. Unless the student-athlete has self-referred after receiving notification of an unannounced drug test, this test result will not be considered a positive result for sanction purposes under this policy. III. DRUG TESTING COMPONENT The Lyon College Head Athletic Trainer is the Drug Testing Coordinator of the Drug Testing Program. Specimen collection will be performed by trained and/or certified collectors. In order to safeguard reliability and accuracy of results, the drug testing analysis will be conducted by a Substance Abuse and Mental Health Services Administration (SAMHSA) accredited laboratory that is experienced in the drug testing of student-athletes. IV. NOTIFICATION AND CONSENT 1. Prospective student-athletes will be informed of the Lyon College Department of Athletics Drug Education & Testing Policy as part of their individual athletic team meetings in the fall. Lyon College student-athletes must abide by the drug policy. 2. The Drug Education & Testing Policy will be provided to each student-athlete and all members of the coaching staff through a link on the Lyon College Athletic Training web page on the Lyon College Athletics website ( A physical copy of the Policy will be given to the coaching staff at the Department of Athletics Staff Meeting at the beginning of each academic year. 3. Prior to athletic participation (practice, game, conditioning, weight lifting, or physical team functions), each student-athlete shall be required to sign the Consent to Perform Urinalysis for Drug Testing Form (Appendix B) stating that he/she has read the policy statement and understands its ramifications and has agreed to participate in the program. 4. Student-athletes shall be informed that failure or refusal to sign the consent forms will results in the prohibition of that student-athlete from participation in the athletic programs at Lyon College and a loss of all athletic scholarships. 5. Notification of a drug test to the student-athlete will be conducted by either the Director of Athletics or the Head Athletic Trainer. 6. The student-athlete may be notified by direct phone call or in person no more than 24 hours before they are scheduled to appear for a drug test. After the student-athlete is notified, the student-athlete will complete the Sport Drug Testing Notification Form (Appendix C). Once verbal notification has been made, the student-athlete must provide a valid urine specimen within 24 hours of the time of notification. Failure to provide a valid urine specimen within 24 hours will be treated as a first positive result (Section XII. Sanctions). V. CONFIDENTIALITY Lyon College s goal is to ensure confidentiality of any student-athlete who: declares safe harbor, is selected for random or reasonable suspicion drug testing, confesses to drug/alcohol/tobacco product use, is found positive for drug/alcohol./tobacco product use through testing, or is otherwise discovered to be using drugs/alcohol/tobacco products. Test results shall be kept in confidential files separate from a student-athlete s permanent educational records. All information and records under the Department of Athletics policy, including test results, will remain confidential to the extent permitted by law and will be released only to the following people: 1. Head Athletic Trainer and/or Staff Athletic Trainer(s) 2. Director of Athletics 3. Team Physician(s) 5

6 4. Head Coach 5. Other college officials, parents, or individuals with a need to know 6. Student-Athlete declaring safe harbor, confessing, and/or testing positive. Improper disclosure of test results by any Lyon College official and/or above mentioned individuals will be grounds for disciplinary action. VI. DRUGS FOR WHICH TESTING WILL BE CONDUCTED All substances tested for may include but not limited to those specified on the NAIA Banned Drug List (Appendix D). Additionally, Lyon College holds the right to test for substances not listed on the NAIA Banned Drug List including street drugs and drugs of abuse, and at different cut-off levels, as well as substances which are not prescribed by a physician or are prescribed by a physician for unauthorized use by the manufacturer of the drug. Refer to the Dietary Supplement & Prescription Medication sections of the Resource Exchange Center (REC) website ( for educational resources on banned substances and supplements. All student-athletes are ultimately responsible for anything they put in their bodies. VII. STATEMENT ON THE USE OF DIETARY SUPPLEMENTS It is to be noted that the Lyon College Department of Athletics does not condone the use of nutritional/dietary supplements. The NAIA stance on nutritional/dietary supplements is that student-athletes should be advised that the most effective and safest way to enhance their performance is to avoid nutritional/dietary supplement products and rely on a combination of a healthy diet, appropriate conditioning, rest and recovery, and avoiding substance abuse. Student-athletes should always bring all supplement products to the designated athletic staff before using, and then checking all supplements through the Resource Exchange Center, REC, staffed by the National Center for Drug Free Sport, the NAIA third party drug testing administrator. The REC is the only authoritative resource for questions related to whether listed ingredients on nutrition supplement product labels or in medications contain NAIA banned substances. Products labeled as dietary supplements sold over-the-counter, in print advertisements, and through the internet are under-regulated by the U.S. Food & Drug Administration (FDA). Dietary supplements are at risk of contamination or may include ingredients that are banned under your drug testing policy. Student-athletes have tested positive and lost their eligibility using dietary supplements. Any product containing dietary supplement ingredients is taken at the student-athlete s own risk. By signing the Lyon College Department of Athletics Drug Education & Testing Policy Consent Form, the student-athlete: 1. Acknowledges that he/she understands that they are to disclose all dietary supplements used to the Head Athletic Trainer and/or Staff Athletic Trainer(s) (This is achieved by completing the Student-Athlete Dietary Supplement Disclosure & Review Form (Appendix E) and taking the dietary supplement container with labeling to a meeting with a member of the Athletic Training Staff to review the Student- Athlete Dietary Supplement Disclosure & Review Form.); 2. Acknowledges the aforementioned policies and statements, and fully accepts the detrimental and possibly permanent defects caused by the use of dietary supplements; 3. Fully accepts that they have been made aware of the Lyon College and the National Association of Intercollegiate Athletics (NAIA) policies with regard to the use of dietary supplements; 6

7 4. Accepts any and all liability if they have in the past used, continue to use, and/or use at any time in the future, dietary supplements in any form; and releases Lyon College, its agents, and all personnel of any and all responsibility related to such use. VIII. METHODS FOR SELECTING STUDENT-ATHLETES FOR TESTING A. Random Testing - All student-athletes (and managers) who have signed the institutional drug-testing consent form and are listed on the institutional squad list are subject to random testing throughout the academic year. Students listed on the squad list that have exhausted their eligibility or who have had a career-ending injury will not be selected for testing. Lyon College reserves the right to perform drug testing on an individual and/or entire team at any given time. For routine random testing, Lyon College utilizes an offsite and independent company (National Center for Drug Free Sport) through the use of a computer random select software program to determine who will be tested. Testing is held often throughout each semester. B. Reasonable Suspicion - Any student-athlete (including managers and trainers) may be subject to testing at any time if an administrator, director, or athletic staff member, having the opportunity to observe the student-athlete s behavior, physical conditioning, or performance, concludes there is reasonable cause to suspect drug/alcohol/tobacco use. Any student-athlete may be required to be drug tested if he/she confesses to being in the presence of other individuals who are using or in possession of illegal substance after being confronted by an administrator, director, or athletic staff member. Before requiring testing procedures under such circumstances, the individual will consult with the Director of Athletics with their concern and complete the Drug Testing Reasonable Suspicion Reporting Form (Appendix F). Reasonable suspicion may include, without limitation, 1) observed possession or use of substances appearing to be prohibited drugs, 2) arrest or conviction for a criminal offense related to the possession or transfer of prohibited drugs or substances, or 3) observed abnormal appearance, conduct, or behavior reasonably interpretable as being caused by the use of prohibited drugs or substances. Among the indicators which may be used in evaluating a student-athlete s abnormal conduct or performance are, but not limited to: class attendance, significant GPA changes, athletic practice attendance, increased injury rate or illness, physical appearance changes, academic/athletic motivational level, emotional condition, mood changes, and illegal involvement. Note: The possession and/or use of illegal substances may be determined by means other than urinalysis. When an individual is found to be in possession and/or using such substances, he/she will be subject to the same procedures that would be followed in the case of a positive urinalysis (e.g., using on-site saliva testing products to determine alcohol consumption). C. Confession Any student-athlete who confesses to banned substance use after being confronted by an administrator, director, or athletic staff member. D. Preseason Screening Student-athletes are subject to preseason drug testing which may be outside of the academic year and they may be notified of such by the Director of Athletics or his/her designee at any time prior to their first competition. E. Postseason Screening - Any participant or team likely to advance to postseason competition may be subject to additional testing. Testing may be required of all team members or individual student-athletes at any time within thirty (30) days prior to the post-season competition. F. Re-entry Testing - A student-athlete, who has been suspended from participation as a result of a drug and alcohol violation, will be required to undergo re-entry drug and/or alcohol testing prior to the lifting of the suspension. The Director of Athletics or his/her designee shall arrange for re-entry testing after the certified counselor or specialist involved in the student-athlete s case indicates that re-entry into the intercollegiate sports program is appropriate. A positive test during re-entry testing will constitute the next offense. 7

8 G. Follow-up Testing - A student-athlete who has returned to participation in intercollegiate sports following a positive drug test under this policy may be subject to follow-up testing. Testing will be unannounced and will be required at a frequency determined by the Director of Athletics or his/her designee in consultation with the certified counselor or specialist involved in the student-athlete s case. IX. SAFE HARBOR PROGRAM A student-athlete eligible for the Safe Harbor Program may refer himself/herself for voluntary evaluation, testing, and treatment for alcohol or drug problems. A student-athlete is not eligible to enter the Safe Harbor Program: 1. More than one (1) time; 2. After he/she has been informed of an impending drug test; 3. After documentation of a positive drug test; or 4. Thirty (30) days prior to NAIA or Conference postseason competition. Lyon College will work with the student-athlete to prepare a Safe Harbor treatment plan, which may include confidential drug testing. The student-athlete and the Director of Athletics or his/her designee will meet and sign the Safe Harbor Policy & Procedures Acknowledgement Form (Appendix G). The student-athlete will be tested for banned substances upon entry into the Safe Harbor Program and such a positive initial test will not result in any administrative sanctions except those listed in this section (i.e. the Team Physician may suspend the student from play or practice if medically indicated). A student-athlete will be permitted to remain in the Safe Harbor Program for a reasonable period of time, not to exceed thirty (30) days, as determined by the treatment plan. If a student-athlete is determined to have new banned substance use and/or alcohol use after the initial Safe Harbor Program test (as determined by follow-up testing), or fails to comply with the Safe Harbor Program treatment plan, the student-athlete will be removed from the Safe Harbor Program and be subject to appropriate disciplinary actions as detailed in the Lyon College Department of athletics Drug Education & Testing Policy. Entering the Safe Harbor Program will be treated as one of the disciplinary action phases and any positive test indicating new banned substance use and/or alcohol use after the initial Safe Harbor Program test will be treated as the next subsequent positive. While in compliance with the Safe Harbor Program treatment plan, the student-athlete will not be included in the list of eligible student-athletes for random drug testing by Lyon College. Student-athletes in the Safe Harbor Program may be selected for drug testing by the NAIA. The Director of Athletics, Team Physician, Head Athletic Trainer, and the student-athlete s Head Coach may be informed of the student-athlete s participation in the Safe Harbor Program. The Staff Athletic Trainer assigned to the student-athlete s sport may also be notified if medically appropriate. The Assistant Coaching Staff may also be informed at the discretion of the Head Coach. Other College employees may be informed only to the extent necessary for the implementation of this policy. X. SPECIMEN COLLECTION PROCESS Collections will be done under direct observation of an institutional collector (same gender) in order to ensure the integrity of the specimen. Staff involved with the collection will be trained by a Drug Free Sport representative and the procedures will be reviewed at least annually. The specimen collection process can be found in Appendix H Urine Collection Guidelines. 8

9 XI. NOTIFICATION OF RESULTS The laboratory performing the drug test analysis will communicate the results of the testing to the Head Athletic Trainer (Drug Testing Coordinator) and the Director of Athletics or their designees via secure web access. If a positive result occurs, the Drug Testing Coordinator and/or Director of Athletics then notifies the Team Physician(s), the Head Coach, and the student-athlete. In the event of a negative result on an initial test, no further communication is made. In the event of a negative result for a follow-up test, communication is made to the Director of Athletics and the student-athlete. XII. SANCTIONS A positive test for alcohol for any student-athlete under 21 years of age will result in the sanctions set forth in this policy. Any student-athlete, 21 years of age or older who tests positive for alcohol may be subject to sanctions pursuant to the rules of the applicable sport. A. First Positive Test Result 1. Director of Athletics notified 2. Director of Athletics will notify the Head Coach 3. Additional testing whenever the Athletics Program conducts testing over the next twelve (12) months with a minimum of two (2) hours notice. 4. Mandatory conference call with parents/guardians and Director of Athletics or his/her designee 5. Suspended immediately upon positive notification for ten percent (10%) of the studentathlete sport s scheduled competitions. Suspension from athletic contests does not relieve the student-athlete from any other responsibility as a team member, including, but not limited to attendance at all practices or other team events. 6. The student-athlete will be required to meet with a designated drug treatment/rehabilitation counselor. If the student-athlete is unwilling to attend counseling sessions he/she will be treated as a second positive. The evaluation and any recommendation must be completed within a two-week period of the incident. The student-athlete is responsible for all costs incurred for these services. B. Second Positive Test Result 1. Director of Athletics notified 2. Director of Athletics will notify Head Coach 3. Additional testing whenever the Athletics Program conducts testing over the remainder of the student-athlete s eligibility, with a minimum of two (2) hours notice. 4. Mandatory conference call with parents/guardians and Director of Athletics or his/her designee 5. Suspended immediately upon positive notification for twenty percent (20%) of the student-athlete sport s scheduled competition. 6. The student-athlete will be required to meet with a designated drug treatment/rehabilitation counselor. If the student-athlete is unwilling to attend counseling sessions he/she will be treated as a third positive. The evaluation and any recommendation must be completed within a two-week period of the incident. The student-athlete is responsible for all costs incurred for these services. C. Third Positive Test Result 1. Director of Athletics notified 2. Director of Athletics will notify Head Coach 3. Termination of team membership 4. Cancellation and non-renewal of Athletic Scholarship 9

10 5. Mandatory conference call with parents/guardians and Director of Athletics or his/her designee XIII. DISCLOSURE OF OTHER MEDICATIONS If the student-athlete is taking any over-the-counter or prescription medications, the testing may produce a positive result. Consequently, the individual submitting to the drug testing must disclose any over-the-counter or prescription medications to the Lyon College Athletic Training Staff prior to being tested. All prescription medications must be documented in the student-athlete s medical file in the Athletic Training documentation software prior to the notification of drug testing. Individual who fail to provide the verification of medication and have a positive result will be subject to the consequences for positive results. XIV. APPEAL PROCESS Student-athletes who test positive under the terms of Lyon College s Policy will be entitled to a hearing with the Director of Athletics or his/her designee prior to the imposition of any sanction. Requests for such a hearing must be made within forty-eight (48) hours of notification of a positive test result. If the forty-eight hours would end on a weekend or holiday, the request must be made by noon on the next business day. Requests must be in writing and received by the Director of Athletics. The student-athlete may not attend any kind of workout sessions, practice or competitions with the team while the appeal is being decided. The student-athlete may have an advocate or other representative present if the student so desires. However, the student-athlete must present his or her own case. The meeting should take place no more than seventy-two (72) hours after the written request is received. Either the student-athlete or the other parties involved may request an extension of time to the Director of Athletics, who will consider whether to grant the extension upon a showing of good cause. These proceedings shall include an opportunity for the student-athlete to present evidence, as well as to review the results of the drug test. Upon the student-athlete s request for additional testing of the sample, the Drug Testing Coordinator will formally request the laboratory retained by the institution to perform testing on specimen B. Specimen B findings will be final, subject to the results of any appeal. If specimen B results are negative, the drug test will be considered negative. The proceedings shall be confidential. The decision by the Director of Athletics or his/her designee regarding the sanction to be imposed shall be final. XV. FAILURE TO COMPLY WITH THE TESTING, COUNSELING, OR TREATMENT PROGRAMS A. Failure to report to a scheduled drug test will result in a positive result with sanctions outlined in Section XII as applicable. Student-athletes are expected to routinely check their messages, , etc. A defense of not receiving and/or intentionally avoiding messages and s sent will not be considered an excuse. B. Failure to comply with the drug counseling program (Section II) or the treatment plan will result in the sanctions for a second or third positive result, respectively,: 1. Failure to meet with the suggested counseling service or individual and/or attend the treatment program within thirty (30) days of the positive test result. 2. Failure to comply with the recommendations of the suggested counseling service and/or individual. C. If the student-athlete tampers with the specimen, attempts to falsify or invalidate the result, interferes with the drug screen s ability to detect banned substances, or makes use of any test altering substance, the result will be considered a positive result followed by sanctions outlined in Section XII as applicable. D. The student-athlete is responsible for the cost of any scheduled follow-up test. Failure to report to a scheduled follow-up test with payment will result in a second or third positive result, respectively, followed by the sanctions outlined in Section XII. 10

11 XVI. LEGAL ACTIONS CONCERNING OR PERTAINING TO LAWS OF THE STATE Any Lyon College student-athlete arrested for the selling of drugs or possession of drugs with intent to distribute according to the laws of the state in which the offense occurs will be immediately suspended from participation pending legal action. Conviction of above will result in immediate termination of financial aid/scholarship and permanent dismissal from Lyon College athletic participation. 15 APPENDIX D NAIA Banned Substances List NAIA Banned Drugs It is your responsibility to check with the appropriate or designated athletics staff before using any substance. A. The NAIA bans the following classes of drugs: 1. Stimulants, 2. Anabolic Agents, 3. Diuretics and Other Masking Agents, 4. Peptide Hormones and Analogues, 5. Anti-estrogens, and 6. Beta-2 Agonists. Note: Any substance chemically related to these classes is also banned. The institution and the student-athlete shall be held accountable for all drugs within the banned drug class regardless of whether they have been specifically identified. B. Drugs and Procedures Subject to Restrictions: 1. Blood Doping, 2. Local Anesthetics (under some conditions), 3. Manipulation of urine samples, 4. Beta-2 Agonists permitted only by prescription and inhalation, and 5. Caffeine if concentrations in urine exceeds 15 micrograms/ml. C. NAIA Nutritional/Dietary Supplements Warning: Before consuming any nutritional/dietary supplement product, review the product with the appropriate or designated athletics department staff. 1. Dietary supplements, including vitamins and minerals, are not regulated and may cause a positive drug test result. 2. Student-athletes have tested positive and lost their eligibility using dietary supplements. 3. Many dietary supplements are contaminated with banned drugs not listed on the label. 4. 18 APPENDIX G Lyon College Safe Harbor Policy & Procedures Acknowledgement Form I,, understand that, according to the Lyon College Department of Athletics Drug Student-Athlete Name Education & Testing Policy, I may self-refer into the Safe Harbor Program once during my intercollegiate athletic career for voluntary evaluation and counseling. I further understand that I am not eligible for the Safe Harbor Program after being informed of an impending drug test, after having received notification of a positive institutional or NAIA drug test, or thirty (30) days prior to NAIA or Conference post-season competition. Lyon College will work with me to provide a treatment plan which may include confidential impermissible substance testing. I will be furnished with a copy of the treatment plan and guidelines after an initial meeting with a substance abuse counselor to evaluate the extent of any of my substance use. I understand that if I test positive for an impermissible substance upon entering the Safe Harbor Program, the initial test result will not result in any administrative sanction, but I may be suspended from play or practice if medically warranted. I will be permitted to remain in the Safe Harbor Program for a reasonable period, not to exceed thirty (30) days, as determined by the treatment plan. If I fail to comply with the treatment plan, I will be removed from the Safe Harbor Program and my initial Safe Harbor positive test will be treated as a first positive and subject to the sanctions as set forth in the policy. While in the Safe Harbor Program, I will not be included in the regular random testing program, but may be selected for drug testing by the NAIA. Upon successful completion of the Safe Harbor Program, I will be subject to additional testing for one calendar year. The Director of Athletics, the Team Physician, the Head Athletic Trainer, and my Head Coach or his/her designee will be informed of my participation in the Safe Harbor Program. My Assistant Coach(es) may be notified at the discretion of the Head Coach or designee. Other College employees may be informed only to the extent necessary for the implementation of this policy. 19 APPENDIX H URINE COLLECTION GUIDELINES 1. Only those persons authorized by the institution will be allowed in the collection room. 2. When arriving to the collection room, the student-athlete will provide photo identification or a client representative will need to identify the student-athlete. The student-athlete will then print his/her name and arrival time on the Roster Sign-In Form. 3. The student-athlete will select a Custody & Control Form (CCF) from a supply of such and work with the institutional collector to complete the necessary information before proceeding with the specimen collection process. 4. The student-athlete will select a specimen collection beaker from a supply of such and will be escorted by the institutional collector (same gender) to the restroom to provide a specimen. The student-athlete will rinse his/her hands with water (no soap) and then dry their hands. Then the student-athlete will place a specimen barcode from the Custody & Control Form onto the beaker. 5. The institutional collector will directly observe the furnishing of the urine specimen to assure the integrity of the specimen. 6. The student-athlete will be responsible for keeping the collection beaker closed and controlled. 7. Fluids and food given to student-athletes who have difficulty voiding must be from sealed containers (approved by the institutional collector), opened and consumed in the collection room. These items must be free of any other banned substances. 8. If the specimen is incomplete, the student-athlete must remain in the collection room until the sample is completed. During this period, the student-athlete is responsible for keeping the collection beaker closed and controlled. 9. If the specimen is incomplete and the student-athlete must leave the collection room for a reason approved by the institutional collector, the specimen must be discarded. 10. Upon return to the collection room, the student-athlete will begin the collection procedure again. 11. Once an adequate volume specimen is provided; the institutional collector will escort the student-athlete to the specimen processing table. 12. The specimen processor will instruct the student-athlete to closely observe the specimen processing steps and will then measure the specific gravity. 13. If the urine has a specific gravity below 1.005, no value will be recorded on the CCF and the specimen will be discarded by the student-athlete with the institutional collector observing. The student-athlete must remain in the collection room until another specimen is provided. The student-athlete will provide another specimen. 14. Once the specimen processor has determined the specimen has a specific gravity above the sample will be processed and sent to the laboratory. 15. If the laboratory determines that a student-athlete s sample is inadequate for analysis, at the client s discretion, another sample may be collected. 16. If a student-athlete is suspected of manipulating specimens (e.g., via dilution, substitution), the institutional collector will collect another specimen from the student-athlete. 19

20 17. Once a specimen has been provided that meets the on-site specific gravity, the student-athlete will select a sample collection kit from a supply of such. 18. The specimen processor will open the kit, demonstrate to the student-athlete the vials are securely sealed, open the plastic and open the A vial lid. The processor will pour the urine into the A and B vials and close the lids. The specimen processor should pour urine into vials above the minimum volume level (35 ml in A vial; 15 ml in B vial) and pour as much urine as possible into the vials using care not to exceed the maximum levels (90 ml in A vial; 60 ml in B vial). 19. The specimen processor will securely close the lids on each vial and then seal each vial using the vial seals attached to the CCF; assuring seals are tightly adhered to the vials with no tears or loose areas. 20. The specimen processor must then collect all necessary signatures (collector, donor, witness, and collector/specimen processor) and date/times where indicated on the CCF. 21. The specimen processor will place the laboratory copy of the CCF in the back pouch of the plastic bag and the vials in the front pouch of the same bag. The bag should then be sealed. The sealed bags with vials will then be placed in the sample box. The box will then be sealed. 22. The student-athlete is then released by the institutional collector. 23. All sealed samples will be secured in a shipping case. The collector will prepare the case for forwarding. When two split samples are collected and packaged, care must be taken to assure one sample is placed in the chipping container for shipment to the drugs of abuse laboratory and one sample is placed in the shipping container for shipment to the anabolic steroids laboratory. 24. After the collection has been completed, the samples will be forwarded to the appropriate laboratory and copies of any forms forwarded to the Sport Drug Testing Department. 25. The samples then become the property of the client. 26. If the student-athlete does not comply with the collection process, the institutional collector will notify the appropriate institutional administrator and Drug Free Sport. 20
