1 Drug and Alcohol Policy All undergraduate and graduate students-athletes in the Marymount California University Intercollegiate Athletic Department are subject to jurisdiction of the Student-Athlete Handbook. This includes managers, athletic training students, graduate assistants, scholarship athletes, nonscholarship athletes, and red-shirt athletes. Student-Athletes at Marymount California University are given a privilege to participate in the intercollegiate athletics program. With this privilege comes the responsibility to comply with the policies of the Mariner Athletic Department and the NAIA. The Mariner Athletic Department s first priority is the student-athlete s health, safety, and welfare. MCU is concerned about and committed to supporting the best actions designed to assist studentathletes striving to cope with substance abuse problems. Alcohol The California state legal age for consumption of alcohol is 21. Student-Athletes are expected to NOT consume alcohol 24-hours prior to an athletic event. Coaches have the right to set high standards within their own team Examples of Alcohol violations include but are not limited to: Use, possession, or consumption of alcoholic beverages, or possessing open containers of alcohol, without authorization according to University policy Presence in an area where alcoholic beverages are present Participating or being in the presence of drinking game activities Providing or serving alcohol to minors (less than 21), on or off campus property Possessing kegs of beer, or other large volume containers, that enable consumption of excessive amounts of alcohol, and related paraphernalia Possession or consumption of alcohol at any University function or activity Misconduct of any form as a result of intoxication on campus or at University sponsored activities while under the influence of any amount of alcohol or illegal drug Public intoxication Driving Under the Influence (DUI) of Alcohol/Driving While Intoxicated Drug Marymount California University complies with the Drug-Free Workplace, and the Drug-Free Schools and Communities Act. Illegal possession, use, sale, or distribution of any quantity, whether usable or not, of any drug, narcotic, or controlled substance and/or paraphernalia, as those terms are largely used in the California Statutes, is prohibited on or off campus. Students found present where drugs are being used illegally, whether participating or not, may also be in violation of this policy. The misuse of any drug, including prescription, over-the-counter medications, or inhalants is prohibited. This includes but is not limited to: misuse of over-thecounter drugs; misuse or sharing of prescription drugs; possessing, using, being under the influence of, distributing, or manufacturing any form of illegal drug; possessing paraphernalia (i.e., rolling papers, pipes, bongs, etc.) for intended or implied use of any form of illegal drug.

2 The use or possession of marijuana in any form, including for medicinal use, is prohibited. The California Compassionate Use Act does not apply to administrative cases involving use and possession of marijuana that violate MCU Student Conduct Code. Students are NOT protected by the California Compassionate Use Act. The possession of a 215 medical marijuana card will not be recognized nor honored by Marymount California University nor the NAIA. Prohibited Substances The student-athlete shall be held accountable for all drugs within the banned drug class regardless of whether they have been specifically identified. MCU relies upon the NAIA Banned Substance List for prohibited substances. Individuals are prohibited from use or attempted use, purchase, possession, manufacture, distribution, and/or sale of the following classes of drugs: NOTE: Any substance chemically related to these classes is also banned. The institution and the student-athlete shall be held accountable for all drugs within the banned drug class regardless of whether they have been specifically identified. Please check with the athletics department staff before you consume any medication or supplement. The NAIA bans the following classes of drugs: a) Stimulants - amphetamine (Adderall); caffeine (guarana); cocaine; ephedrine; fenfluramine (Fen); methamphetamine; methylphenidate (Ritalin); phentermine (Phen); synephrine (bitter orange); etc. exceptions: phenylephrine and pseudoephedrine are not banned. b) Anabolic Agents - (sometimes listed as a chemical formula, such as 3,6,17-androstenetrione) boldenone; clenbuterol; DHEA; nandrolone; stanozolol; testosterone; methasterone; androstenedione; norandrostenedione; methandienone; etiocholanolone; trenbolone; etc. c) Diuretics and Other Masking Agents - bumetanide; chlorothiazide; furosemide; hydrochlorothiazide; probenecid; spironolactone (canrenone); triameterene; trichlormethiazide; etc. d) Peptide Hormones and Analogues - growth hormone (HGH); human chorionic gonadotropin (HCG); erythropoietin (EPO); etc. e) Anti-estrogens - anastrozole; tamoxifen; formestane; 3,17-dioxo-etiochol-1,4,6- triene(atd),etc. f) Beta-2 Agonists - bambuterol; formoterol; salbutamol; salmeterol; etc. g) Street Drugs: heroin; marijuana; tetrahydrocannabinol (THC) Drugs and Procedures Subject to Restrictions: Blood Doping. Local Anesthetics (under some conditions). Manipulation of Urine Samples. Beta-2 Agonists permitted only by prescription and inhalation. Caffeine if concentrations in urine exceed 15 micrograms/ml. 3 Medical Exceptions The Athletic Department recognizes that some banned substances are used for legitimate medical purposes. Accordingly, Marymount California permits exception if there is a documented medical history demonstrating the need for consistent use of such a drug. Medical exceptions will be reviewed on an individual basis but will not be granted unless previously mentioned supporting documentation is received by the athletic department and the athletic trainer. MCU and the NAIA do not recognize Medical Marijuana Cards as an exception. Student-athletes need to see a physician for alternative medical needs. Documentation must be on file before the first sample drug test is taken. The Athletic Department will notify the third party who is administrator of the intent to request a medical exception. NOTE: A medical exception for the use of anabolic agents and peptide hormones must be submitted to the Athletic Department and approved before athletics participation. Additional information regarding medical exceptions procedures, including for stimulant medications for ADHD, can be found at Nutritional/Dietary Supplements Warning: Before consuming any nutritional/dietary supplement product, review the product with the athletic trainer. Dietary supplements, including vitamins and minerals, are not well regulated and may cause a positive drug test result. Student-athletes have tested positive and lost their eligibility using dietary supplements. Many dietary supplements are contaminated with banned drugs not listed on the label. Any product containing a dietary supplement ingredient is taken at your own risk. MCU strongly discourages the use of nutritional supplements. Supplements do not undergo federal government approval and are not tested for quality like prescription and over-the-counter medications. There is often little scientific research on these products and have minimal federal government labeling requirements for nutritional substances. Student-athletes should report all medications and supplements they are taking to the athletic trainer. Drug Testing Policy Drug testing will be conducted for performance enhancing and mood-altering substances. The testing is mandatory for all student-athletes and other team members representing the athletics department at Marymount California University (including team managers, etc). As a condition to be a member of any Mariner athletic team, the student-athlete must agree to participate in the Athletics Department drug-testing program. This program is a supplement of the ongoing physical well-being and in the best interest of the student-athlete at MCU. Positive drug test results are cumulative for the student-athletes career at MCU. Any studentathlete found guilty of selling or providing illegal drug(s) or illegally providing other drugs or alcohol to another individual is subject to termination from the team and cancellation of all athletic-related financial aid. Drug Free Sport, the official sponsor for the NAIA drug testing, will be providing ALL drug testing services including the maintenance of records for all studentathlete drug-testing procedures, including positive results.

4 SANCTIONS FOR POSITIVE DRUG TESTS First positive for drug test 1. The student-athlete will be suspended for 25% of the season s competitions. This sanction begins immediately and is carried over to the next season if necessary for compliance to be met. 2. For the remainder of the academic year, the student-athlete will be required to be included in any further drug testing. This will be done at the student s expense (approx. $100) 3. The student-athlete will be required to complete an alcohol and drug education workshop which will be administered at the Student Wellness Center on the Oceanside Campus. 4. A record of the positive result will be kept in the Student s file. 5. The student-athlete will be expected to participate in team activities as determined by their coach and the AD. Second positive drug test 1. If a second positive test occurs during the same or different academic year, the student-athlete will be out of the equivalent of 50% of the season s competitive events. 2. For the remainder of the academic year, the student-athlete will be required to be included in any further drug testing. This will be done at the student s expense (approx. $100) 3. The student-athlete will be required to attend an evaluative session and possible follow-up sessions in the Student Wellness Center at Oceanside Campus for the remainder of the academic year. 4. A record of the second positive result will be kept in the student s file. 5. The student-athlete will be expected to participate with team activities as determined by their coach and the AD. Third positive drug test 1. If a third positive test occurs during the same or different academic year, the student-athlete will be removed from the team. 2. The athletic scholarship will be removed. 3. The student-athlete will be referred to the Wellness Center where recommendations can be made for a continuous counseling program for the remainder of the academic year. 4. A record of the third positive result will be kept in the student s file. 5. The student-athlete will not be permitted to re-join the team. The Athletic Department reserves the right to remove any or all athletic related funding with a positive drug test, whether it be the first or final offense. NOTE: The first positive drug taken by the NAIA will result in an immediate loss of a year of eligibility and the student-athlete will have to sit out 365 days of the failed drug test. After the second offense, the student-athlete will be kicked out of the NAIA. Testing positive with the NAIA may result in a loss of any championship earned individually or as a team. If the student-athlete loses eligibility, they will also forfeit any athletic aid.

5 Each student-athlete must annually sign the Consent to Drug-Testing form and a copy will be retained by the Athletic Director. The form includes the following information: Marymount California University Consent to Drug-Testing I have read and understand Marymount California University as well as NAIA policies on drugs and banned substances. I understand as a member of the MCU athletics department, I must provide consent to drug-testing. I understand Drug Free Sport, the official sponsor for the NAIA drug-testing, will be providing ALL drug testing services at MCU including the maintenance of records for all student-athlete drug-testing procedures, including positive results. If selected, I understand I must appear for testing or be sanctioned for a positive drug test. I also understand my urine sample collection will be observed by a person of my same gender. I understand I am also subject to drug testing through NAIA, and agree to willingly give my consent for NAIA drug-testing should I be selected to do so. With my signature, I (full name), affiliated with Marymount California University (sports) as of (date) hereby agree to allow Marymount California University to drug test me with no advanced notice, and will accept any sanctions for a positive drug test.
