RESOURCES RESOURCE A: Laws and penalties for synthetic cannabis Synthetic cannabinoids are controlled u nder the Psychoactive Substances Act NOTE: as of the 8th of May, 2014 there are no psychoactive substances legally available for sale in New Zealand. Only products approved under the Psychoactive Substances Regulatory system are permitted to be distributed or sold. 1. It is illegal for a person under 18 to buy or possess a synthetic cannabinoid product. Personal p ossession of a product if under 18 will incur an infringement fee of up to $ It is illegal or to sell, or supply, a synthetic cannabinoid product to anyone under 18. Anyone found doing so is liable for fines of $5000 (individual) to $10,000 (body corporate). 3. It is illegal to sell, or possess, an unapproved product. Personal possession of an unapproved product will incur an infringement fee of up to $500. Possession of a quantity of unapproved product of a commercial amount (not for p ersonal use) with intent to supply, sell, or offer for supply or sale, is illegal. Persons convicted of such possession can be imprisoned for up to two years (individual) or fined $50,000 (body corporate). 4. Penalties also include up to eight years in prison for importing, manufacturing, supplying or possession with intent to supply analogues of controlled drugs that come under the Misuse of Drugs Act, and up to two years for import, manufacture, supply or possession with intent to supply unapproved substances. Tama has asked Morgan to get them some weed so they can party hard this weekend. Morgan is in two minds. He hasn t bought weed before and knows it is illegal, but wants to impress Tama. Fred, Morgan s cousin, knows a place a couple of houses down from where he lives that sells synthetic cannabis. Fred recommended it as he buys from there all the time. Morgan recently got a part-time job and has to take part in random drug tests. He thinks the synthetic cannabis might not show up on the test. He has also always been interested about what it feels like to smoke cannabis so is keen to give it a go. 5 (b) Explain the impacts that smoking synthetic cannabis is likely to have on Morgan and Tama s overall well-being. In your answer show how the aspects of well-being are interconnected. (c) Identify TWO ways the law would be broken if Morgan were to access synthetic cannabis for his and Tama s use at the party. Refer to Resource A when answering this question. 6 (e) Rather than taking synthetic cannabis or cannabis to the party, identify and justify a more health-enhancing decision that Morgan can make in this situation. Jessica s Scenario Jessica is 17 years old and has been invited to John s 21 st birthday party at the local rugby club. Her parents know that she has been invited to the party but do not approve of her drinking. Jessica has a crush on one of John s 21-year-old mates Hemi who will be at the party and she wants to make a good impression on him. Jessica arrives at the party and Hemi brings an alcoholic drink over to her. He says cheers, see you at the bottom. (f) Complete the following decision-making process by describing three options below and explaining a possible positive and negative consequence of each option on Jessica s overall well-being.
