2 Staff Report ND and ZOTA (Electronic Cigarettes) August 10, 2015 Page 2 of 6 EXECUTIVE SUMMARY The proposed amendments would require a Conditional Use Permit for electronic cigarette retailers and manufacturers in various zones or districts. On September 23, 2013, the City Council adopted Urgency Ordinance No. 1254, imposing a moratorium on the establishment of electronic cigarette retailers, electronic cigarette manufacturers, and other electronic cigarette businesses within the City. By law, Ordinance No could only be effective for 45 days. On October 28, 2013, the City Council adopted Urgency Ordinance No which extended the moratorium for an additional period of 10 months and 15 days (or September 22, 2014). On September 8, 2014, the City Council extended the moratorium for an additional year. RECOMMENDATION Adopt Resolution No. 15-XX and introduce Ordinance No. 12XX. FISCAL IMPACT None PUBLIC NOTICE On July 30, 2015, public hearing notices were posted at City Hall, Brakensiek Library, Bellflower Substation, Thompson Park, and Simms Park. A notice of public hearing was published in the Press Telegram newspaper on July 31, Mail notification was also provided to all known retail establishments. CEQA STATUS An environmental assessment has been conducted for this project in compliance with the California Environmental Quality Act (CEQA) guidelines. An Initial Study and Negative Declaration have been prepared. BACKGROUND On July 20, 2015, the Planning Commission recommended approval of requiring Conditional Use Permits for electronic cigarette retailers and manufacturers. The Planning Commission also recommended for City Council consideration at a later date: 1) Treating electronic cigarettes like other cigarettes, and treating the vapor or gases emitted from electronic cigarettes like cigarette smoke. That means anywhere smoking is prohibited in the City, the use of an electronic cigarette would also be prohibited. 2) Define smoke shop as a comprehensive term for establishments that sell tobacco products, cigarettes, cigars, and e-cigarettes and require a CUP. 3) Establish a Tobacco Retail License Ordinance that would allow for: a. Licensing all retailers; to sell tobacco products; reviewed annually

Distancing New establishments would need to be a minimum distance from existing retailers as well as sensitive uses (schools, public parks, public library, etc.) d. Prohibit sales of drug paraphernalia e. Limit the number of available licenses based on population f. Penalties a violation of regulations (federal, state, or local) would be a violation of the license resulting in suspension or revocation of the license DISCUSSION An overview of smoking regulations, smoking prevalence/youth access, electronic cigarettes, electronic cigarette regulations, and existing businesses is provided below. For a more detailed review of each topic, please refer to the July 20, 2015, Planning Commission Staff Report (Attachment C). Laws Pertaining to Smoking It is illegal to smoke on school campuses, in government buildings, at daycare facilities, within 25 feet of playgrounds, restaurants, and in health care facilities or any enclosed place of employment. Cities have the authority to enact local regulations that are more stringent than state law regarding secondhand smoke. Local regulations on smoking are intended to address both the health impacts of the activity to nonsmokers and the undesired impacts (odor, irritants, etc.) of smoking. Some newer research has shown the vapor released from electronic cigarettes may be harmful to nonsmokers, and, therefore, cities are starting to regulate those as well. Such ordinances are within the authority of a city to pass laws to protect the public health and welfare, as well as a city s authority to regulate public nuisances. The City of Bellflower does not have a smoking ordinance. The City established regulations (Ordinance No. 760) prohibiting smoking in public places, restaurants, hotels, and places of employment in In 1992, the City repealed the ordinance that prohibits smoking in certain places (Ordinance No. 779). Smoking Prevalence and Youth Access In June 2010, the Los Angeles County Health Department published a report that estimates the number of cigarette smokers in Bellflower is over 15%, which ranks Bellflower at the high end of the 127 cities studied with a rank of 102 out of 127. That translates to an estimated 8,300 smokers in the City. The Asian American Drug Abuse Program (AADAP) has reached out to the City of Bellflower in an effort to prevent youth access to tobacco. A youth purchase study was conducted by AADAP in 2015 to identify tobacco retailers who were willing to sell to minors. Twenty-two out of seventy-five (29%) tobacco retailers surveyed were willing to sell tobacco to a minor. Additionally, a non-scientific Youth Risk Behavior Survey, between July 18, 2014, and April 29, 2015, indicated strong support (84%) for a tobacco retail license and concluded 94% of respondents believe retailers who continue to sell to youth should have their license revoked.

4 Staff Report ND and ZOTA (Electronic Cigarettes) August 10, 2015 Page 4 of 6 Electronic Cigarettes E-cigarettes are plastic devices made to look similar to regular cigarettes that heat up liquid nicotine or other flavored product, which turns into vapor when smokers inhale or exhale. The device is battery operated, can be recharged, and is reusable. The device can also resemble everyday items such as pens and USB memory sticks. The product was introduced to the United States in 2007 as a device to help tobacco smokers wean off tobacco products. Despite the potential use of e-cigarettes as an aid in smoking cessation, there are questions about the safety of e-cigarettes for users. A limited analysis by the FDA found e-cigarettes contain carcinogens, as well as toxic chemicals ( Very little research exists as to the safety of the vapor for those who may inhale it second-hand. There is also growing concern over the appeal of e-cigarettes to young consumers and their access to the product. Some e-cigarettes appear designed to appeal to youth due to the added colors and candy-like flavoring such as bubble gum, cotton candy, and cola, and e-cigarettes are being provided as free samples at some events. A recent national survey by the Centers for Disease Control and Prevention revealed use of electronic cigarettes by middle and high school students is increasing. Electronic Cigarette Regulations On June 9, 2014, the City of Bellflower passed an ordinance whereby e-cigarettes were defined as any electronic or battery operated device that can deliver an inhaled dose of nicotine or other substance, including, but not limited to, any device manufactured, marketed, or sold as an electronic cigarette, cigar, cigarillo, or pipe. E-cigarettes are not allowed in any enclosed space owned by the City or operated by or on behalf of the City, including, but not limited to, any vehicle owned by the City or operated pursuant to a contract with the City for the purpose of public transit. The County also added electronic cigarettes to their definition of tobacco or nicotine delivery products in March of State law prohibits the sale or furnishing of electronic cigarettes to minors, but does not extend smoking prohibitions to electronic cigarettes. In California s last legislative session, legislation proposed to partially regulate the sale of e-cigarettes was not approved. Additionally, the U.S. Food and Drug Administration ( FDA ) currently does not regulate e-cigarettes. The FDA has proposed a rule that would extend the agency s tobacco authority to cover electronic cigarettes, which could make them subject to requirements for ingredients listing, user fees, and manufacturing requirements. With the lack of State and federal legislation, local municipalities have been left to fill the gap in legislation and craft ordinances to address e-cigarettes. Existing Businesses In Bellflower, there are four establishments that deal primarily with electronic cigarettes or electronic liquid and no manufacturers of electronic cigarettes or electronic liquid. An additional 80 establishments may sell electronic cigarettes or electronic liquid on a limited basis, based on business license records. Under the proposed ordinance, those establishments can remain until the building utilized by any such use are, at any time, partially destroyed, there is any enlargement or expansion of such buildings, structures or uses or the use is discontinued for 180 days or more.

5 Staff Report ND and ZOTA (Electronic Cigarettes) August 10, 2015 Page 5 of 6 Proposed Regulations All proposed e-cigarette businesses (retailers and manufacturers) will require a Conditional Use Permit ( CUP ), which will be subject to review and approval by the Planning Commission. Any approval or denial of the Planning Commission can be appealed to the City Council. The requirement of a CUP will give the City authority to ensure e-cigarette businesses operate in a manner that protects the best interests of the surrounding properties and neighborhood, which in turn ensures the protection of the public health, safety, and welfare of the community. DISCUSSION Format of Report Furthermore, the proposed revisions to the various portions of the Zoning Code will be illustrated with italics for existing language, italic strikethrough for existing language that is proposed for elimination and bold and underlined for proposed new language. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BELLFLOWER DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find, determine and declare: A. An Initial Study (IS) and Negative Declaration (ND) of Environmental Impact were prepared for Zoning Ordinance Text Amendment Case No. ZOTA in accordance with the provisions of the California Environmental Quality Act (CEQA), State CEQA Guidelines, and the City of Bellflower s Procedures for Implementing CEQA. The Initial Study and Negative Declaration were made available to the public for review and comment from July 1, 2015, to and including July 20, C. A duly noticed Public Hearing was held by the Planning Commission of the City of Bellflower on July 20, 2015, at which time evidence was heard on the Initial Study and Negative Declaration and Staff Report. At the hearing, the Planning Commission fully reviewed and carefully considered them, together with any comments received during the public review period and determined that the Negative Declaration was consistent with CEQA. D. A duly noticed public hearing was held by the City Council of the City of Bellflower on August 10, 2015, at which time evidence was heard on the Initial Study and Negative Declaration. The City Council fully reviewed and carefully considered the Initial Study and Negative Declaration, together with any comments received during the public review period. SECTION 2. Based upon the above findings and determinations, Negative Declaration No. ND prepared for Zoning Ordinance Text Amendment Case No. ZOTA is hereby approved, as presented. SECTION 3. The Mayor, or presiding officer, is hereby authorized to affix his signature to this Resolution signifying its adoption by the City Council of the City of Bellflower, and the City clerk, or her duly appointed deputy, is directed to attest thereto. There are changed conditions since the existing Code became effective to warrant modification and/or addition to Bellflower Municipal Code Chapters (Definitions), (C-G General Commercial Zone), (Town Center [TC] District), (M-1 Light Industrial District), (Bellflower/Alondra Mixed-Use [BAMU] Overlay Zone), (Bellflower Village Overlay Zone [BVOZ]), and (Bellflower Village Overlay Zone North [BVOZ-N]) relative to the establishment of electronic cigarette retailers, electronic cigarette manufacturers, and other electronic cigarette businesses. B. The proposed Zoning Ordinance Text Amendment modifies and/or adds provisions to Bellflower Municipal Code Chapters (Definitions), (C-G General Commercial Zone), (Town Center [TC] District), (M-1 Light Industrial District), (Bellflower/Alondra Mixed-Use [BAMU] Overlay Zone), (Bellflower Village Overlay Zone [BVOZ]), and (Bellflower Village Overlay Zone North [BVOZ-N]) relative to the establishment of electronic cigarette retailers, electronic cigarette manufacturers, and other electronic cigarette businesses without adversely affecting property values or establishing adverse land use precedent. C. The changes effected by the proposed Zoning Ordinance Text Amendment to Bellflower Municipal Code Chapters (Definitions), (C-G General Commercial Zone), (Town Center [TC] District), (M-1 Light Industrial District), (Bellflower/Alondra Mixed-Use [BAMU] Overlay Zone), (Bellflower Village Overlay Zone [BVOZ]), and (Bellflower Village Overlay Zone North [BVOZ-N]) relative to the establishment of electronic cigarette retailers, electronic cigarette manufacturers, and other electronic cigarette businesses will contribute to the preservation of the public, peace, health, safety, and welfare by effectuating City policy regarding land use. D. The proposed Zoning Ordinance Text Amendment to Bellflower Municipal Code Chapters (Definitions), (C-G General Commercial Zone), (Town Center [TC] District), (M-1 Light Industrial District), (Bellflower/Alondra Mixed-Use [BAMU] Overlay Zone), (Bellflower Village Overlay Zone [BVOZ]), and (Bellflower Village Overlay Zone North [BVOZ-N]) relative to the establishment of electronic cigarette retailers, electronic cigarette manufacturers, and other electronic cigarette businesses is consistent with the General Plan. SECTION 2. Based on the above findings, the City Council of the City of Bellflower approves Zoning Ordinance Text Amendment Case No. ZOTA as presented herein. SECTION 3. Section of the BMC is hereby amended by adding the following definitions in correct alphabetical order: E-cigarette or electronic cigarette shall be defined as in Section of this Code.

SECTION 4. Subsection of Chapter of the BMC is hereby amended to read as set forth in the attached Exhibit A. SECTION 5. Subsection B.25.a of Chapter of the BMC is hereby amended to read as set forth in the attached Exhibit B. SECTION 6. Subsection of Chapter of the BMC is hereby amended to read as set forth in the attached Exhibit C. SECTION 7. Subsection A of Chapter of the BMC is hereby amended to read as set forth in the attached Exhibit D. SECTION 8. Section A of Chapter of the BMC is hereby amended to read as set forth in attached Exhibit E. SECTION 9. Section A of Chapter of the BMC is hereby amended to read as set forth in attached Exhibit F. SECTION 10. This Ordinance shall take affect thirty (30) days after its adoption. The City Clerk, or her duly appointed deputy, shall certify to the adoption of this Ordinance and shall cause this Ordinance to be posted as required by law.
