Part II : Reports, 1898: 172 In 1898 an observant lady inspector noted: The evil effects of Asbestos dust have also attracted my attention. A microscopic examination of this mineral dust revealed the sharp, glass-like jagged nature of the particles, and where they are allowed to rise and remain in the air of a room, in any quantity, the effects have been found to be injurious as might have been expected

4 Health Hazards Routes of entry. Inhalation. Ingestion. Skin absorption. Asbestos related diseases. Asbestosis - approx 175 cases per year. Lung cancer 2,500 related to asbestos annually. Mesothelioma 1,200 deaths per year expected to double or treble by 2020 Between UK deaths annually

8 LEGISLATION HASAWA 1974 DUTIES Management Regulations 1999 CDM Regulations 2007 CAR 2012 HSE / EHO Enforcing Authorities During a Safety inspection they will look for an active asbestos register and suitable management system

9 CAR 2012 Regulation 4 duty to manage in non domestic premises Regulation 5 identify presence of asbestos Regulation 10 information, instruction & training Regulation 11 prevention or reduction of exposure to asbestos

10 Reg 4 Whose duty? In many cases, the dutyholder is the person or organisation that has clear responsibility for the maintenance and/or repair of non-domestic premises through an explicit agreement such as a tenancy agreement or contract

11 CAR 2012 REG 4 take reasonable steps to find out if there are materials containing asbestos in non-domestic premises, and if so, its amount, where it is and what condition it is in; presume materials contain asbestos unless there is strong evidence that they do not; make, and keep up-to-date, a record of the location and condition of the asbestos containing materials - or materials which are presumed to contain asbestos; assess the risk of anyone being exposed to fibres from the materials identified; prepare a plan that sets out in detail how the risks from these materials will be managed;

12 CAR 2012 REG 4 continued take the necessary steps to put the plan into action; periodically review and monitor the plan and the arrangements to act on it so that the plan remains relevant and up-to-date; and provide information on the location and condition of the materials to anyone who is liable to work on or disturb them
