1 24 September 2008 To: Medical Groups, DHB Hospital Pharmacies and Interested Parties CONSULTATION ON TENDER OF CERTAIN PHARMACEUTICALS ALL RESPONSES DUE BY 5PM, WEDNESDAY 5 NOVEMBER 2008 In accordance with PHARMAC s objective of securing for eligible people in need of pharmaceuticals, the best health outcomes that are reasonably achievable from pharmaceutical treatment and from within the amount of funding provided, PHARMAC is consulting on the possibility of tendering for Sole Subsidised Supply and/or Hospital Supply Status of certain pharmaceuticals listed in Schedule One of this document. Attached to this letter is a list of pharmaceuticals that we are considering tendering for Sole Subsidised Supply to community pharmacies and/or Hospital Supply Status for supply to DHB Hospital pharmacies. Pharmaceuticals are listed alphabetically by chemical, form and strength in therapeutic groups and have a C and/or H next to them to indicate whether they are being tendered for community and/or hospital supply. In general, the proposed Tender process would be similar to the 2007/08 Tender. A copy of the 2007/08 Invitation to Tender is available either on our website: or by contacting PHARMAC. Comments Sought We seek comments on the approach outlined in the following pages, in particular the following: the proposed process and timetable; the actual or potential clinical implications of awarding Sole Subsidised Supply and/or Hospital Supply Status to the pharmaceuticals listed in Schedule One; and for hospital pharmaceuticals what the appropriate Discretionary Variance Limit for each pharmaceutical would be, where a 1% Discretionary Variance Limit is considered clinically unacceptable. All comments, whether on the above described matters or not, received by 5 November 2008 will be considered by PHARMAC prior to finalisation of the 2008/09 Tender process and the list of pharmaceuticals to be tendered for Sole Subsidised Supply and/or Hospital Supply Status. 2 Background Since 1997 PHARMAC has been using the strategy of tendering for sole supply of pharmaceuticals for a fixed period of time. Tendering has proven to be an effective way to encourage competition among suppliers of off patent pharmaceuticals. It is proposed that the community Tender and hospital Tender processes continue to be run in unison, however the pharmaceutical list for community and hospital pharmacies may be different. Key Aspects of Awarding a Tender for Community Pharmaceuticals: For the community pharmaceuticals the Tender winning brand would be the only subsidised brand for approximately 2½ years. The Sole Subsidised Supply period would conclude on 30 June 2012 for all awarded Tenders. The Sole Subsidised Supply brand would be fully subsidised for the Tender period which means a pharmaceutical that currently carries a manufacturer s surcharge (that is the additional patient charge above that of the patient copayment), would become fully subsidised if a Tender was awarded. No other brand of the pharmaceutical could be listed (or subsidised) on the during the Tender period (subject to any Alternative Brand Access, as proposed). Other brands could continue to be marketed, sold and dispensed in New Zealand, however they would not receive a Government subsidy. Key Aspects of Awarding a Tender for the DHB Hospital Pharmaceuticals: For the DHB Hospital pharmaceuticals, the Hospital Supply Status brand would be the only brand DHB Hospitals could purchase (excluding any allowance for alternative brands under the agreed Discretionary Variance Limits) for approximately 2½ years. The Hospital Supply Status period would conclude on 30 June 2012 for all awarded Tenders. No other brand of the pharmaceutical would be listed (or purchased) on Section H of the during the Tender period except as allowed under any DV Limits. The Process The Tender process is run annually; the proposed timelines for the 2008/09 Tender are as follows: Date September/October 2008 A qa12214 Event Consultation with suppliers, medical groups and interested parties on the proposed pharmaceutical list and draft Invitation to Tender. 5 November 2008 Final date for all consultation to be received. November 2008 Meeting of the Tender Medical Evaluation Subcommittee of PTAC to consider clinical issues in relation to the proposed Tender list. 2

3 November/December 2008 Late December 2008 Late February 2009 From March June 2012 Consultation and Board decisions on Alternative Commercial Proposals to tendering from pharmaceutical suppliers. Issuing of the 2008/09 Invitation to Tender. Invitation to Tender closes. Board decisions on the first Tender winners announced. End of the sole supply period for all pharmaceuticals where a Tender is awarded from the 2008/09 Tender. Terms after the End Date may apply. Reference Pricing in the Community Reference pricing is based on the classification of pharmaceuticals into Therapeutic Subgroups. A Therapeutic Subgroup is defined as a set of pharmaceuticals that produce the same or similar therapeutic effect in treating the same or similar condition(s). The draft list contains pharmaceuticals that belong in an existing Therapeutic Subgroup. In some cases, PHARMAC may be considering tendering more than one pharmaceutical in a Therapeutic Subgroup. Where this is the case it gives rise to a number of scenarios in the community market including: 1) It is possible that awarding Sole Subsidised Supply to one pharmaceutical could result in changes to the subsidies for other pharmaceuticals in the same Therapeutic Subgroup. 2) Where more than one pharmaceutical in a Therapeutic Subgroup is included on the list, PHARMAC may award Sole Subsidised Supply to each pharmaceutical (and therefore not apply reference pricing in the usual way) or may only award Sole Subsidised Supply to one pharmaceutical and apply reference pricing to the others. Such scenarios could give rise to new or increased manufacturer surcharges. We ask that you consider any clinical considerations associated with such scenarios. Contractual obligations for suppliers A copy of the draft contractual requirements which would form the terms of the contract with successful suppliers in the 2008/09 Tender is available on the PHARMAC website: or by phoning PHARMAC on Unresolved Tender Bids PHARMAC would review any unresolved Tender Bids from the Invitation to Tender dated 15 December 2006 (2006/07 Tender) and the Invitation to Tender dated 21 December 2007 (2007/08 Tender) prior to issuing the 2008/09 Tender. Should any unresolved Tender Bids be declined, PHARMAC would consider re-tendering those pharmaceuticals when the Invitation to Tender is issued in December Currently unresolved Tender Bids have not been included in the draft pharmaceutical list set out A qa

4 in Schedule One of this document. PHARMAC is currently seeking comments from suppliers about keeping any unresolved Tender Bid(s) open for acceptance. Access to Alternative Brands PHARMAC is continuing work to identify mechanisms that can reduce the impact on patients of brand changes. We will keep you informed as this work continues to progress. In the meantime, PHARMAC has undertaken a preliminary assessment to determine which products are appropriate for inclusion in this years tender. We welcome specific comments in relation to any implications of tendering items included in Schedule Two. The figures for the number of units subsidised in community pharmacies are approximate and are based on the year ending June These figures are indicative only and sales are not guaranteed. Based on information available to PHARMAC, we believe these patents will expire by within the sole supply period.
