Southeastern University Department of Athletics Drug and Alcohol Policy Policy and Prevention of Alcohol and Drug Abuse Southeastern University recognizes the wisdom of biblical teaching on self-control, indulgent or excessive behaviors, and maintaining the human body; therefore, the University has established that the campus is alcohol, drug, and tobacco free. SEU operates in compliance with the Drug-Free Workplace Act of 1988 and the Drug-Free Schools and Communities Act of In addition to these Acts, the University complies with all state and federal statutes and regulations regarding alcohol and drug use. Substance abuse is a major social and medical problem in the United States. It is known that serious consequences result from abuse for the abuser. Abusers create problems for themselves and also indirectly for employers, coworkers, classmates, family, and society in general. Substance abuse problems can develop in men and women of all ages, races and occupations. The University makes available information for students and employees regarding the dangers of drug and alcohol abuse and provides information on available alcohol and drug counseling, rehabilitation, and assistance programs. The University encourages good decision-making and healthy living and recommends that individuals who have acknowledged abuse seek treatment. When possible, the University seeks to have students confront the abuse and begin a recovery program. A copy of the Student Handbook is available through the Office of Student Development, The Office of Safety and Security, and online at MySEU under the Student Development tab. Standards of Conduct Tobacco, alcohol, illegal drugs, including illegally obtained prescription drugs, are prohibited on the SEU campus. All state and federal laws concerning these are to be strictly observed. In addition, students will not possess, use, or distribute tobacco, alcohol, illegal drugs, including illegally obtained prescription drugs and similar elements, on or away from campus. Attendance at clubs, bars, and similar places is prohibited. Violation of University policy as delineated in the Student Handbook will result in immediate disciplinary action including, but not limited to, suspension, mandatory counseling, or dismissal, as the University may decide that a student can no longer remain a part of the SEU community based on their actions. Notification Southeastern University may release the results of a drug test to the parent(s), guardian(s), and/or spouse of a student-athlete in relation to disciplinary actions of suspension or dismissal from the athletic program and for violations related to alcohol or controlled substances

Types of Drug Testing Those eligible for drug and alcohol testing under the Southeastern University Drug and Alcohol Policy ( the policy ) are those individuals who are participating or involved in intercollegiate athletics as a student at Southeastern University. SEU student-athletes may be selected for drug testing by the following means: institutional random, institutional reasonable suspicion, team, and NAIA Championship. 1. Institutional Random Aegis, or a similar drug-testing laboratory will randomly select the list of student-athletes to be tested. The drug-testing schedule will then be set by the athletic training staff with the approval of the Director of Athletics and may be conducted in two ways. First, a member of the athletic training staff will work in conjunction with the head coach to notify the selected student-athlete(s) the day prior to the scheduled testing. If a student-athlete fails to appear for their testing at the appointed time or refuses to be tested, the result of those actions will be the same as a failed test and the student-athlete will be subject to the penalties listed in the policy. Secondly, the selected student-athletes may be removed from practice or class with no prior notification of testing. If the selected student-athlete refuses to be tested, the result of those actions will be the same as a failed test and the student-athlete will be subject to the penalties listed in the policy. 2. Institutional Reasonable Suspicion Student-athletes will be drug-tested and evaluated if there is probable cause to suspect alcohol, drug use and/or abuse. The coaching staff, an administrator, academic advisor, or athletic trainer, may be aware of or see certain signs, symptoms, or changes in behavior that may cause him or her to suspect substance use and/or abuse. These staff members have a duty to report any suspicions to either the Head Athletic Trainer or Director of Athletics. The Head Athletic Trainer will report suspicions to the Director of Athletics, who will work in conjunction with the head coach of the respective sport to determine the need for testing. Once it is determined that a drug test will be performed, the studentathlete will be summoned and immediately tested. If a student-athlete fails to appear for their testing at the appointed time or refuses to be tested, the result of those actions will be the same as a failed test and the student-athlete will be subject to the penalties listed in the policy. 3. Team The University reserves the right to test any one of the athletic teams as a whole at any time. A member of the athletic training staff will work in conjunction with the head coach to notify the selected team on the day prior to the scheduled testing. If a team member fails to appear for their testing at the appointed time or refuses to be tested, the result of those actions will be the same as a failed test and the student-athlete will be subject to the penalties listed in the policy. 4. NAIA Championship In the event of an individual or team qualifying for NAIA Championship competition the individual or team may be subject to drug testing prior to, during, or post event

Statement on the Use of Tobacco In accordance with NAIA legislation, the use of tobacco products are prohibited by studentathletes and all game personnel (e.g., coaches, athletic trainers, managers, and game officials) in all sports during practices and competition. Statement on the Use of Alcohol Southeastern University is committed to creating and maintaining an environment that is free of alcohol use and complies with state and federal laws governing alcoholic beverages. There are serious health risks and behavioral problems associated with the misuse of alcohol. The use of alcohol or being under the influence of alcohol during an athletic event is potentially dangerous to all parties involved in the program. SEU reserves the right to test for alcohol on the basis of reasonable suspicion prior to athletic participation. In the event that an athletic department staff member or studentathlete suspects an alcohol-impaired student-athlete, they will report their suspicions immediately to the athletic training staff for verification and testing. Upon confirmation that a student-athlete is under the influence of alcohol prior to participation in an athletic event, he/she will be removed from the activity. Notification of a positive finding will be submitted to the head coach, Director of Athletics or designee, and the Office of Student Development. Furthermore, should a student-athlete make decisions that are in direct violation of the Student Handbook in regards to the use of alcohol, whether on or off campus, regardless of relationship to an athletic event, it will be considered a first violation under this policy. Upon a first violation of the alcohol policy, the student-athlete shall be suspended a minimum of the equivalent of 10% of the contests in that season (or into the next season if there are not sufficient games remaining in the current season). Upon a second violation of the alcohol policy, the student-athlete shall be suspended a minimum of the equivalent of 50% of the contests in that season (or into the next season, if there are not sufficient games remaining in the current season). In both cases, the student-athlete shall be referred to the Director of Student Conduct for consideration of further disciplinary action by the University. Additionally, the Director of Athletics and/or head coach may impose further sanctions at his or her discretion, including suspension from practice and/or additional games or permanent removal from the team. Upon a third violation of the alcohol policy, the student-athlete shall be suspended from participation in Athletics at SEU for a period of one year and his or her athletic scholarship shall be rescinded immediately. Return to participation after the one-year suspension and the awarding of an athletic scholarship will be the final decision of the head coach, in consultation with the Director of Athletics. Upon any subsequent return to participation in Athletics, any use of alcohol shall result in the immediate and permanent loss of athletics eligibility at Southeastern University

Consequences for violation of the policy are not limited to a positive test. Admission of alcohol or drug use or the determination of the Covenant Council or the Director of Student Conduct that alcohol or drugs have been used are grounds for suspension or dismissal from the Athletic Program. All student-athletes are responsible for abiding by any state, local or University laws and policies related to the use of drugs and alcohol. For a detailed description and guideline of University requirements and regulations please refer to the Student Handbook. Policy Statement on the Use of Supplements Southeastern University does not condone the use of dietary supplements. Dietary supplements do not undergo federal government approval and are not tested for quality the same way prescription and over-the-counter medications are. In many cases, the product claims made by dietary supplement manufacturers are not based on scientific research. Many dietary supplements have not been subject to research by unbiased independent researchers in order to substantiate performance claims. The potential adverse and/or harmful effects of these substances have not been completely studied, but serious adverse effects have been reported in some instances. As there are minimal federal government labeling requirements for dietary supplements, some products may contain substances banned by Southeastern University, which are not listed on the label. It is important for student-athletes to remember that they will be held responsible for each and every substance which enters their body. By signing Southeastern University's Department of Athletics Drug and Alcohol Policy Consent Statement, the student-athlete: 1. Acknowledges that he/she understands the need to disclose all dietary supplements used to the head athletic trainer or team physician in Appendix A ; 2. Acknowledges the aforementioned policies and statements, and fully accepts the detrimental and possibly permanent defects caused by the use of dietary supplements; 3. Fully accepts that he/she has been made aware of the Southeastern University policies with regard to the use of dietary supplements, as stated above; 4. Accepts any and all liability if he/she has in the past used, continues to use, and/or uses at any time in the future, dietary supplements in any form; 5. Releases Southeastern University, its agents, and all personnel of any and all responsibility and liability related to such use. Medical Exception Process Southeastern University recognizes that some banned substances are used for legitimate medical purposes. Accordingly, Southeastern University allows exceptions to be made for those student-athletes with a documented medical history demonstrating a need for regular use of such a substance. Exceptions may be granted for substances included in the following classes of banned drugs: stimulants (includes inhaler use for asthma), betablockers, diuretics, and peptide hormones

The student-athlete is required to inform the Head Athletic Trainer of all medications he or she is taking. Southeastern University should maintain in the student-athlete s medical records a letter from the prescribing physician that documents the student-athlete s medical history demonstrating the need for regular use of such drugs. The letter should contain information as to the diagnosis (including appropriate verification), medical history and dosage information. In the event a student-athlete fails a drug test, the Head Athletic Trainer in consultation with the medical staff, will review the student-athlete s medical record to determine whether a medical exception should be granted. Confidentiality All members of the Southeastern University Athletic Department are expected to respect a student-athlete s right to privacy. It is essential that anything seen, heard, read, and/or otherwise obtained remain confidential by all parties involved. It is illegal for any personnel to gain access to patient information unless the information is needed in order to treat the patient, or because their job would require such access. All Southeastern personnel are expected to adhere to the confidentiality policy at all times. Violation of the policy may result in disciplinary action at the discretion of the Director of Athletics. Specimen Collection Procedures While the primary testing method used by Southeastern University will be by means of urine analysis, SEU reserves the right to test for banned drugs by any approved industry method. These methods may include, but are not limited to, oral fluid, sweat, or hair as deemed necessary by the Director of Athletics. Urine specimen collection will be based on the National Center for Drug Free Sport Urine Collection Protocol in Appendix D. Testing and Selection Process The student-athlete will be notified about the policy prior to any athletic participation. At this time the student-athlete will sign a consent form acknowledging the procedures set forth in the policy. Drug tests will be administered throughout the year. All studentathletes will be subject to unannounced drug tests throughout the academic year on either a random or a reasonable suspicion basis. For purposes of this policy, random shall mean a process in which the probability of any student-athlete being selected is the same as the probability of any other student-athlete being selected and in which the selection is made without the identity or characteristics of the individual being known. A reasonable suspicion testing will be based on behavioral, personal, physical, or performance changes, which are characteristic of drug use. The drug test shall consist of the collection of a urine sample from the student-athlete under the supervision of a trained collector. Each urine sample shall be analyzed for the presence of banned drugs as noted in Appendix B by Aegis, an independent laboratory licensed - 7 -

by The United States Department of Health and Human Services, the United States Drug Enforcement Administration, and the State of Florida Agency for Health Care Administration. Aegis will test the samples and will report all test results to the Head Athletic Trainer. The Head Athletic Trainer will review the results to determine which, if any, of the tests are considered positive as reported by Aegis. Failed Test Defined A failed test (positive test result) is defined as a urine sample revealing the presence of one or more of the banned drugs or metabolites listed in Appendix B. In addition, failure to arrive at the collection station at the designated time without justification, failure to provide adequate urine sample (e.g., acidic, concentrated, enough volume) as determined by the laboratory or trained collector will be considered a failed test. A failed test may also result from leaving the collection station or holding area without the permission of the test site administrator or alteration of any sample as determined by the collection technician or their designee. All results will be forwarded from the lab to the Director of Athletics and Head Athletic Trainer. Subsequently, the Director of Athletics shall notify the Director of Student Conduct, the head coach of the appropriate sport, and the student-athlete of the positive result. Institutional Procedure Failed Test Following the notification of a positive test, the student-athlete will meet with the Director of Athletics and head coach to review the test results. Additionally, members of the Sports Medicine Staff, Vice President of Student Development, Director of Student Discipline and Mentoring, and/or others may be notified as deemed necessary. As a result of a first positive test, the student-athlete shall be suspended from participation in athletics (practice and competition) at SEU for a period of six months and his or her athletic scholarship will be rescinded immediately. Should the six-month suspension result in missing no contests in the sport s primary season, the student-athlete shall be suspended the first 25% of scheduled contests (exhibition or counting) upon their return to the program. The student-athlete shall be eligible to practice and compete in scrimmages while serving the 25% suspension. As a result of a second positive test, the student-athlete shall be suspended from participation in athletics at SEU for a period of one year and his or her athletic scholarship will be rescinded immediately. As a result of a third positive test, the student-athlete shall be suspended from participation in athletics at SEU permanently and his or her athletic scholarship rescinded immediately. Return to participation after a first or second suspension and the awarding of an athletic scholarship will be the final decision of the head coach, in consultation with the Director of Athletics, and will be contingent on the passing of random drug tests administered during the suspension, as well as a test at the end of the suspension. In addition to the sanctions imposed by the Department of Athletics, the student-athlete shall be subject to the ordinary disciplinary process of the University as stated in the Student Handbook

Appeal Process Student-athletes who test positive for a banned substance may, within seventy-two (72) hours following receipt of notice of the laboratory finding, deliver a written appeal to the Director of Athletics to contest the finding of the positive results and to request a re-test using the B Specimen. There is a $250 fee for this re-test, payable by the student-athlete. The written appeal and $250 payment must be delivered to the Director of Athletics within the same seventy-two (72) hour window. If the seventy-two hours would end on a weekend, or a University recognized holiday, the written appeal and $250 payment must be received by the Director of Athletics by noon on the next business day. Upon receipt of the student-athlete s written appeal and $250 payment, the Director of Athletics will formally request B specimen confirmation. The student-athlete may choose to be present at the opening of B specimen at the laboratory Drug Test at his or her expense. If the student-athlete does not wish to be present at the opening of B specimen, but desires to be represented, arrangements will be made at the student-athlete s expense for a surrogate to attend the opening of B specimen. The surrogate will not be involved with any other aspect of the analysis of the specimen. The student-athlete or his/her surrogate will attest to the sample number and the integrity of the security seal prior to the laboratory opening of B specimen. B Specimen findings will be final, subject to the results of any appeal. If B specimen results are negative, the drug test will be considered negative. Student-athletes who fail a drug test, or who dispute that they have refused or failed to take a required test, under the terms of the policy will be entitled to a hearing with the Review Board prior to the imposition of any sanction. Requests for such a hearing must be in writing by completion of the Appeal Notification Form (Appendix E) and received by the Director of Athletics within seventy-two (72) hours of notification of a positive test result. If the seventy-two hours would end on a weekend, or a University recognized holiday, the request must be made by noon on the next business day. Appeals to the Committee will be heard on the following grounds: Procedural Challenge: The student-athlete may challenge any procedure relating to the collection or testing of the subject samples. If the institution or student-athlete proves it is more likely than not that any substantiated problem with the collection or testing procedures materially affects a sample's integrity, the drug-test appeal subcommittee may find that no violation has occurred. Knowledge Challenge: consumed. However: The student-athlete is responsible for all substances If the student-athlete demonstrates that the student-athlete was not aware they had been administered (defined as placed into the student-athlete s system directly or through food or drink) a substance by another person that later is found to have contained a banned ingredient, then the drug-test appeal committee may determine that no violation has occurred. In this situation, the student-athlete must show that he or she both did not know and could not reasonably have known or suspected (even with the exercise of utmost caution) that he or she had been administered by a third party a substance that is later found to have contained a banned ingredient. Or; - 9 -

If the student-athlete demonstrates that the student-athlete asked specific and reasonable questions about a particular substance, medication or product of the appropriate SEU athletic trainer and the athletic trainer assured the inquiring student-athlete that the substance does not contain a banned ingredient, then the drug-test appeal committee may determine that no violation has occurred. In this situation, the student-athlete must show that he or she both did not know and could not reasonably have known or suspected (even with the exercise of utmost caution) that the information provided by the athletic trainer was erroneous. Reduction of Penalty Based on Mitigating Factors: The following will not be considered mitigating factors in a drug test appeal: the type or amount of banned substance detected through the drug test; evidence of the student-athlete s good character; the degree of remorse demonstrated by the student-athlete; family hardship or history of family dysfunction; and the degree to which the banned substance may or may not affect athletic performance. The Review Board shall consist of any three of the following: Director of Athletics (Chair), Faculty Athletic Representative, Vice President for Student Development, Director of Discipleship and Mentoring, and/or the Head Athletic Trainer. If the Director of Athletics cannot be present, another member of the committee shall be appointed to serve as chair. Other individuals may be needed to provide information; however, these individuals will not vote on the outcome of the appeal. These individuals may include but are not limited to the following: - Aegis Representative / Scientist or designate - SEU Team Physician - SEU Sports Medicine Staff - SEU Coaching Staff The student-athlete may have an advocate or other representative present at the hearing if the student so desires. However, the student-athlete must present his or her own case. The hearing should take place no more than seventy-two (72) hours after the written appeal is received by the Director of Athletics. If the seventy-two (72) hours would end on a weekend, or a University recognized holiday, the hearing should take place on the next business day. All sanctions resulting from the positive test shall not apply until the appeals process is finalized. Either the student-athlete or the other parties involved may request an extension of time to the Faculty Athletic Representative or his/her designees, who will consider whether to grant the extension upon a showing of good cause. These proceedings shall include an opportunity for the student-athlete to present evidence, as well as to review the results of the drug test. The proceedings shall be open to only those persons deemed necessary by the Director of Athletics or his/her designees. The decision by a majority vote of the Review Board regarding the test results or refusal/failure to take a required test shall be final. Sanctions for a positive result or a refusal/failure to take a required test are described in these procedures and are not subject to further appeal

Self-Referral Program A student-athlete eligible for the Southeastern University Self-Referral Program may refer himself or herself to the program for voluntary evaluation and counseling. A student is not eligible for the program after he or she has been informed of an impending drug test or after having received a positive Southeastern University drug test. Southeastern University will work with the student-athlete to prepare a treatment plan, which may include confidential drug testing as determined by the Director of Discipleship and Mentoring, Director of Athletics, Director of Counseling, Team Physician, Athletic Trainer, Faculty Athletic Representative or designees. If the student-athlete tests positive for a banned substance after entering the Self-Referral Program, that positive test will not result in any administrative sanction unless the student tests positive in a subsequent retest or the student fails to comply with the treatment plan. Based upon a medical examination by the team physician, the student-athlete may be disqualified from play or practice if medically indicated. The examination may consist of diagnostic tests to determine any potential risks the drug use poses to the student-athlete s welfare. A student will be permitted to remain in the Self-Referral Program for a reasonable period of time, not to exceed thirty (30) days, as determined by the treatment plan. While SEU encourages student-athletes to submit themselves for evaluation and counseling at any time, a studentathlete will not be permitted to avoid NAIA penalties for a positive test if they enter the Self-Referral program less than thirty (30) days prior to NAIA or The Sun Conference postseason competition. If a student-athlete fails to comply with the Self-Referral treatment plan, the student will be removed from the Self-Referral Program. Once removed from the Self-Referral program, any failed test will be treated as a first positive and the student-athlete will be subject to the sanctions explained in the policy. A student-athlete who has been disciplined for or tested positive for drug or alcohol use at any time while attending Southeastern is not eligible for the Self-Referral Program. While in compliance with the Self-Referral Program treatment plan, the student will not be included in the list of students eligible for random drug testing by Southeastern University. Students in the Self-Referral Program may be selected for drug testing by the NAIA. The Director of Student Conduct, Director of Athletics, Head Coach, Head Athletic Trainer, and Team Physician may be informed of the student s participation in the Self- Referral Program. The athletic trainer assigned to that sport also may be notified, if medically appropriate. Assistant coach(es) may be informed at the discretion of the head coach. Other University employees may be informed only to the extent necessary for the implementation of this policy. Appendix A

Appendix C Sports Drug Testing Urine Collection Procedures 1. Upon entering the collection station, the athlete will provide photo identification and/or a SEU representative/site coordinator will identify the athlete and the athlete will be officially admitted into the collection station. 2. The athlete will select a sealed collection beaker from a supply of such and will record initials on the collection beaker s lid or attach a unique bar code to the beaker. 3. A collector, serving as validator, will monitor the furnishing of the specimen by observation in order to assure the integrity of the specimen until a volume of at least 50 ml is provided (85 ml if testing for anabolic steroids). 4. Validators who are of the same gender as the athlete must observe the voiding process. The procedure does not allow for validators to stand outside the immediate area or outside the restroom. The athlete must urinate in full view of the validator (validator must observe flow of urine). The validator must request the athlete raise his/her shirt high enough to observe the midsection area completely to rule out any attempt to manipulate or substitute a sample. 5. Athletes may not carry any item other than his/her beaker into the restroom when providing a specimen. Any problem or concern should be brought to the attention of the Head Athletic Trainer for documentation. 6. Once a specimen is provided, the athlete is responsible for keeping the collection beaker closed and controlled until the specimen can be adequately processed and packaged for shipment to the laboratory. 7. Fluids and food given to athletes who have difficulty voiding must be from sealed containers (approved by the collector) that are opened and consumed in the station. These items must be caffeine- and alcohol-free and free of any other banned substances. 8. If the specimen is incomplete, the athlete must remain in the collection station until the sample is completed. During this period, the athlete is responsible for keeping the collection beaker closed and controlled. 9. If the specimen is incomplete and the athlete must leave the collection station for a reason approved by the collector, specimen must be discarded. 10. Upon return to the collection station, the athlete will begin the collection procedure again

11. Once an adequate volume of the specimen is provided, the collector who monitored the furnishing of the specimen by observation will sign that the specimen was directly validated and a collector will check the specific gravity and if in range measure the ph of the urine in the presence of the student-athlete. 12. If the urine has a specific gravity below (1.010 if measured with a reagent strip), the specimen will be discarded by the athlete. The athlete must remain in the collection station until another specimen is provided. The athlete will provide another specimen. 13. If the urine has a ph greater than 7.5 (with reagent strip) or less than 4.5 (with reagent strip), the specimen will be discarded by the athlete. The athlete must remain in the collection station until another specimen is provided. The athlete will provide another specimen. 14. If the urine has a specific gravity above (1.010 if measured with a reagent strip) and the urine has a ph between 4.5 and 7.5 inclusive, the specimen will be processed and sent to the laboratory. 15. The laboratory will make final determination of specimen adequacy. 16. If the laboratory determines that an athlete s specimen is inadequate for analysis, at the client s discretion, another specimen may be collected. 17. If an athlete is suspected of manipulating specimens (e.g., via dilution), SEU will have the authority to perform additional tests on the athlete. 18. Once a specimen has been provided that meets the on-site specific gravity and ph parameters, the athlete will select a specimen collection kit and a uniquely numbered Chain of Custody Form or set of Specimen Bar Code Seals from a supply of such. 19. The collector will record the specific gravity and ph values. 20. The collector will pour approximately 30 ml of the specimen into the A vial and the remaining amount (approximately 20 ml) into the B vial (A=60 ml, B=25 ml for anabolic steroid testing) in the presence of the athlete. 21. The collector will place the cap on each vial in the presence of the athlete; the collector will then seal each vial in the required manner under the observation of the athlete and witness (if present). 22. Vials and forms (if any) sent to the laboratory shall not contain the name of the athlete. 23. All sealed specimens will be secured in a shipping case. The collector will prepare the case for forwarding

24. The athlete, collector and witness (if present) will sign certifying that the procedures were followed as described in the protocol. Any deviation from the procedures must be described and recorded. If deviations are alleged, the athlete will be required to provide another specimen. 25. After the collection has been completed, the specimens will be forwarded to the laboratory and copies of any forms forwarded to the designated persons. 26. The specimens become the property of the client. 27. If the athlete does not comply with the collection process, the collector will notify the Head Athletic Trainer who will then notify the Director of Athletics. 28. On occasion, SEU may choose to test using a single specimen kit. The collector will follow the split specimen procedures up to the point where the athlete selects a sealed kit. With a single specimen kit, the collector beaker may serve as the secured vial for transporting the specimen to the laboratory. The collector will instruct the athlete to provide at least 35 ml of urine allowing for a 5 ml pour-off to measure specific gravity and ph on site. A single vial will be processed and transported to the laboratory for analysis
