Alcohol & Drugs Drinking and driving remains one of the top contributing factors in fatal collisions in Saskatchewan. Federal and provincial driver s licence suspension periods of one to five years apply if a driver is convicted of driving with a Blood Alcohol Content (BAC) level over.8, impaired driving or failure to provide a breath sample. Court fines for these offences start at $1,, with no maximum, and there is a minimum $1,25 penalty under the Safe Driver Recognition program. If a driver is at fault for a collision while driving impaired, they have no insurance coverage for damage to their vehicle, or to the vehicles or property of others involved. In June 214, traffic safety laws were changed to toughen consequences for impaired driving, including longer licence suspensions, immediate roadside vehicle seizures ranging from three to 6 days, and mandatory ignition interlock in certain cases. Before a driver s licence can be reinstated, the driver must attend a mandatory impaired driving education program and have an ignition interlock device installed in their vehicle for the required amount of time (one to five years). New drivers and drivers under 19 years of age who consume any amount of alcohol or drug and drive receive a 6-day suspension, and must attend a Driving Without Impairment (DWI) course for the first occurrence. Second offences result in a 12-day suspension and the driver must attend Alcohol and Drug Education (ADE). Subsequent occurrences result in an 18-month suspension and an addiction assessment must be completed. Program requirements must be completed before the driver s licence will be reinstated. Also, the vehicle will be impounded for three to seven days based on how many offences within the last five years. Experienced drivers that register a BAC level between.4 to.8 will lose their licence for three to 9 days and could face other consequences such as vehicle impoundment and mandatory ignition interlock for multiple offences. All drivers who are charged with a BAC level exceeding.8 or refusing a breath test will be subject to an immediate indefinite suspension. The suspension will remain in effect until the driver is convicted of the charges in court or the charges are stayed, dismissed or dropped by the Crown. Also, the vehicle they are driving will be impounded for up to 6 days. In fall of 216 the Government of Saskatchewan introduced the following new amendments to The Traffic Safety Act to build on the changes the province made in 214: A three-day vehicle seizure for experienced drivers who are charged for the first time with having a BAC over.4; Zero tolerance for drugs and alcohol to drivers 21 and under; and Mandatory ignition interlock for drivers who register a BAC over.16 or refuse to provide a breath sample (1st offence - two years; 2nd offence - five years; 3rd and subsequent offence - 1 years). These new laws take effect on January 1, 217. For more details on Saskatchewan s drinking and driving laws please visit www.sgi.sk.ca. 71
