Jammu and Kashmir Legislative Assembly 12 th Legislative Assembly (2 nd Session) B U L L E T I N Tuesday, October 09, 2015 The House met at 10.00 A.M in the J&K Legislative Assembly Hall, Srinagar. Shri Kavinder Gupta, Hon ble Speaker in the Chair. At the commencement of the day s proceedings, Hon ble Member, Mr. G.M.Saroori requested the Hon ble Speaker to allow the discussion on Adjournment Motion Notice whereof given by him and other Members of his party regarding the unabated border firing which causes tremendous loss to the life and property of the inhabitants of border areas. Hon ble Member, Mr. Ranbir Singh Pathania informed the House regarding the unsatisfactory reply furnished by the Chief Secretary related to the education department, adding that it amounts to the contempt of the august House. Taking cognizance, the Hon ble Speaker directed the Hon ble Minister for Education to hold an impartial enquiry into the matter within a period of 15 days. Meanwhile all the Members of the Congress party including M.Y. Tarigami and Hakeem Mohammad Yaseen started protesting against the demand of not allowing a debate on the Adjournment motion regarding unabated border firing and pressed for taking up the said issue being of serious nature for discussion. Taking cognizance, the Hon ble Speaker informed them that he has disallowed the Adjournment motion, consequent upon which all the Members of the Congress party staged a walkout from the House in protest. In the meanwhile, Hon ble Member, Hakeem Mohammad Yaseen raised the issue of regularization of Daily wagers and sought a statement from the Government in this behalf. BILL FOR INTRODUCTION Mr. ABDUL REHMAN VEERI, HON BLE MINISTER FOR HORTICULTURE, HAJ & AUQAF on behalf of JENAB MUFTI MOHAMMAD SAYEED, HON BLE CHIEF MINISTER introduced A Bill to provide for the regulation of private security agencies operating in the State of Jammu and Kashmir and for the matters connected therewith or incidental thereto (L.A. Bill No. 8 of 2015) already published in an extraordinary issue of the Government Gazette. ZERO HOUR The following Hon ble Members raised their issues during Zero Hour:- 1. Mr. Omar Abdullah, NC The Leader of Opposition, Mr. Omar Abdullah while speaking during Zero Hour condemned the other day s incident and lamented over the intolerant attitude shown by some Hon ble Members and said that it has tarnished the sanctity of this august House. He eulogized the concept of secularism being observed in the State and said that such incidents should not be repeated in this House in future. He quoted the father of the Nation, Mathama Gandhi who had seen a ray of hope during testing times in the State when the entire sub-continent was in flames, adding that there is no place for extremism in the State. He requested the Chair to pass a unanimous resolution regarding strengthening of brotherhood and mutual understanding among people of the State belonging to different religions, castes creeds and communities. Endorsing the views put forth by Hon ble Member, Mr. Omar Abdullah, the Hon ble Chief Minister, Jenab Mufti Mohammad Syed recounted the history of Kashmir and drew the attention of the House towards the Sopore Conference formulated in 1938 headed by Sher-e-Kashmir Sheikh Mohammad Abdullah which was changed into National Conference, adding that a new map was drafted wherein all the religions were given absolute acknowledgment. Furthermore, he thanked late Mrs. Indhra Gandhi, the then Prime Minister of India who brought Sher-i-Kashmir Sheikh Mohammad Abdullah to rule the State of J&K and an atmosphere of Page 2 of

secularism was formulated by her move. He backed the suggestion given by the Leader of the opposition, Mr. Omar Abdullah regarding the resolution of sending a message from the House to the people of State of not leaving any space for extremism and extremist elements. The Hon ble Speaker got the resolution putforth by the Hon ble Leader of the Opposition and strongly endorsed by the Hon ble Chief Minister passed by the House. All the Hon ble Members raised their hands in support of the Resolution. 2. Mr. Abdul Rahim Rather, PDP Shri Bali Bhagat, Hon ble Minister for Social Welfare and Forests replied the points raised by the Hon ble Member. 3. Mr. Usman Abdul Majid, INC Hon ble Member, Mr. Usman Abdul Majid raised the issue of negating a security to Ex-Legislators and sitting legislators and requested the Hon ble Speaker to take the cognizance of the matter. 4. Zulfkar Ali replied the issue raised by Mr. Rajiv Jasrotia regarding procurement of ration in his Constituency. (ii) The Hon ble Speaker informed the House regarding the hoisting of Indian Flag at Lal Chowk by a person who was arrested by the Police and directed the D.G to release the said person. Page 4 of

(iii) At this stage, the Hon ble Speaker read out the following Resolution passed by the House unanimously:- Resolution This House unanimously resolves to reiterate the firm and unshakable faith of the people of Jammu and Kashmir in its age old tradition of secularism, pluralism and tolerance. This House as the representative body of the will of the people of Jammu and Kashmir re-asserts the need for strengthening further the bonds of brotherhood and fortify the values that have distinguished Jammu and Kashmir in the entire sub continent in the most trying circumstances that led the Father of the Nation, Mahatama Gandhi, to see a ray of light from here. This House further urges leadership at the national level across the party lines and seeks the support of the people throughout the country in creating an environment of peace and harmony so that all sections of the society become real stake holders in the idea of India. CALLING ATTENTION TO MATTERS OF URGENT PUBLIC IMPORTANCE i. MR. JAVED AHMED RANA called the attention of the Hon ble Minister Incharge Education towards a matter of urgent public importance namely; the situation that has arisen due to clubbing/closing of Primary Schools by the Education Department in the State with below 16 strength particularly in District Poonch. Mr. Nayeem Akther, Hon ble Minister for Education read out a reply Statement. ii. MR. ABDUL MAJID BHAT (LARMI) called the attention of the Hon ble Minister Incharge PHE, Irrigation & Flood Control towards a matter of urgent public importance namely; the situation that has arisen due to damages caused to River banks and breaches of bunds due to last year s floods. Ch. Sukhnandan Kumar, Hon ble Minister for PHE, Irrigation and Flood Control read out a reply Statement. iii. MR. AJAY NANDA called the attention of the Hon ble Minister Incharge Public Works (R&B) towards a matter of urgent public importance namely; the situation that has arisen due to the dilapidated condition of various Roads in Reasi Constituency causing great inconvenience to the public there. Syed Mohammad Altaf Bukhari, Hon ble Minister for Public Works (R&B) read out a reply Statement. Note: At this stage, the Hon ble Chief Minsiter Mufti Mohammad Syed while addressing the Chair requested all the Hon ble Members to adhere strictly to the Page 5 of

business rules and listen the replies properly. He also raised certain points and sought clarification from the concerned Minister in this behalf. iv. MR. MOHAMMAD ABASS WANI called the attention of the Hon ble Minister Incharge Revenue towards a matter of urgent public importance namely; the situation that has arisen due to apprehensions of loss of life and property as a result of dry Walnut and Chinar trees. Shri Sunil Sharma, Hon ble Minister of State for Revenue read out a reply Statement. v. MR. SHAKTI RAJ PARIHAR called the attention of the Hon ble Minister Incharge Public Works (R&B) towards a matter of urgent public importance namely; the situation that has arisen due to the dilapidated condition of various roads in Doda Constituency. Syed Mohammad Altaf Bukhari, Hon ble Minister for Public Works (R&B) read out a reply Statement. vi. MR. M. Y. TARIGAMI called the attention of the Hon ble Chief Minister (Incharge Home) towards a matter of urgent public importance namely; the situation that has arisen due to cover up of murder case of Neelam Devi and Ganesh Kumar of Gura Kalyal Morha Sarni, Tehsil Billawar, District Kathua by the concerned police. Mr. Abdul Haq Khan, Hon ble Minister for Rural Development read out a reply Statement on behalf of Hon ble Chief Minister. At this stage, the Hon ble Chief Minister, Mufti Mohammad Syed assured the Hon ble Member of a credible and time bound enquiry into the case. vii. MR. RAJESH GUPTA called the attention of the Hon ble Minister Incharge PHE, Irrigation & Flood Control towards a matter of urgent public importance namely; the situation that has arisen due to the scarcity of drinking water in some areas of Jammu East Constituency. Ch. Sukhnandan Kumar, Hon ble Minister for PHE, Irrigation and Flood Control read out a reply Statement. viii. MR. MUMTAZ AHMAD KHAN called the attention of the Hon ble Minister Incharge Public Works (R&B) towards a matter of urgent public importance namely; the situation that has arisen due to the closure of Angrala Gulab Garh Road besides the delay of proposed construction of bridges on Lar and Sadal Nallahs in Gulab Garh Constituency. ix CHOUDHARY MOHAMMAD AKRAM called the attention of the Hon ble Minister Incharge Health and Medical Education towards a matter of urgent public importance namely; the situation that has arisen due to the shortage of Doctors/para-medical staff at Sub District Hospital, Surankote. Ch. Lal Singh, Hon ble Minister for Health and Medical Education read out a reply Statement. x MR. RAJIV JASROTIA called the attention of the Hon ble Minister Incharge Youth Services and Sports towards a matter of urgent public importance namely; the situation that has arisen due to the non-establishment of Indoor Stadium at Kathua. Ch. Zulfkar Ali, Hon ble Minister for CA&PD read out a reply Statement on behalf of Hon ble Minister Incharge Youth Services and Sports. BILL FOR INTRODUCTION SYED BASHARAT AHMED BUKHARI, HON BLE MINISTER FOR LAW, JUSTICE AND PARLIAMENTARY AFFAIRS introduced A Bill to amend the Jammu and Kashmir Legal Services Authorities Act, 1997 (L.A.
