Eng. 22nd Session - H6-05 Brussels, 21 October DRAFT RECOMMENDATION CONCERNING OZONE LAYER DEPLETING SUBSTANCES Reference documents : (HSC/21) 42,100, Anne D/3 (HSC/21 - Report) (Item IV. 2 on Agenda) I. BACKGROUND 1. At its 21st Session, the Harmonized System Committee discussed the UNEP request for the separate identification of additional ozone layer depleting substances in a new Council Recommendation concerning national statistical subdivisions. 2. The UNEP proposal contained two categories of substances : (1) HCFCs manufacturers and distributors and use of chemical analysis and (2) mitures containing Ozone Depleting Substances (ODSs). While the former (HCFCs) contained a list of 11 chemicals classified in subheading and was straight forward, the latter (ODSs) was rather comple to be included in a Recommendation as the UNEP had provided only information concerning compositions of illustrative eamples of mitures. As it would not be possible to include specific compositions of a large number of mitures in a WCO Recommendation, the Secretariat asked the UNEP to provide a short list of the most commonly used mitures or groups of mitures. Since it required a long time to obtain the necessary information on the mitures from producers and eperts, the UNEP requested the Secretariat to proceed with the proposal concerning the 11 HCFCs first. Therefore, the proposal concerning the separate identification of HCFCs was submitted to the last Session of the Harmonized System Committee. 3. The Committee agreed, in principle, to prepare a new WCO Recommendation which should include the substances covered by the 1995 Recommendation, as well as the new substances (HCFCs) requested for inclusion by the UNEP. However, the Committee also agreed that the following modifications would be necessary to the draft Recommendation proposed by the Secretariat in Anne II to Doc : File No For reasons of economy, documents are printed in limited number. Delegates are kindly asked to bring their copies to meetings and not to request additional copies.
2 E (I) (ii) (iii) The Preamble to draft Recommendation should incorporate a clause to establish a link with the eisting 1995 Recommendation. The new Recommendation should indicate that a Contracting Party which had accepted the eisting 1995 Recommendation would automatically cease to apply it when it notifies the acceptance of the new Recommendation. The clause, Recognizing further amendments to the Harmonized System... in the Preamble to the draft Recommendation should be deleted since it was not proposed to make legal amendments in the HS concerning the substances in question. 4. With respect to the new recommended national subdivisions for 11 HCFCs, one delegate pointed out that it would be technically difficult to incorporate so many items in its national statistical nomenclature under a single HS code. In this regard, the UNEP representative agreed to submit a shorter list of more important HCFCs to the Secretariat. 5. The Committee agreed to re-eamine this question at its net session on the basis of a new document containing draft Recommendation to be prepared by the Secretariat, taking into account the conclusions above (see Anne D/3 to Doc ). II. INTER SESSIONAL DEVELOPMENTS 6. On 23 March 1998, the Secretariat received the revised list of HCFCs from the UNEP. It contained 8 categories of chemicals to be identified under subheading The list is reproduced in Anne I hereto. 7. On May , the UNEP provided the Secretariat with si broad categories of mitures based on their uses as follows : (1) Refrigerants and blowing agents, (2) Mobile air-conditioning service blends, (3) Fire etinguishants, (4) Methyl bromide mitures, (5) Solvents, and (6) Others. It also provided the Secretariat with illustrative lists of mitures of these si categories (Table 1 to 6), which are set out in the Anne II to this document. 8. After eamining the revised proposal concerning mitures, the Secretariat responded to the UNEP as ecerpted below : (1) Refrigerants and blowing agents (2) Mobile air-conditioning service blends The first category of mitures (table 1) are classifiable in subheading and contain HCFC-22 or HCFC-124 as their principal ODS component. The second category of 2.
3 E mitures (table 2) are also classifiable in subheading as they contain HCFC-124, HCFC-142b or HCFC-22 as their principal ODS component. Since the products of the first category (Refrigerants and blowing agents) and the second category (Mobile air-conditioning service blends) seem to have similarities in their uses and compositions, it would be difficult to distinguish between them at the point of importation. Therefore, it would be appropriate to combine the first and second categories in the category of Refrigerants and to create a new subdivision ( Refrigerants, containing chlorotetrafluoroethane, chlorodifluoroethane or chlorodifluoromethane ) under subheading for the classification of them. (3) Fire etinguishing agents As all the products in the illustrative list of mitures (table 3) are classifiable in subheading and contain HCFC-124, HCFC-22 and HCFC-123 as their principal ODS component, it would seem that a new subdivision ( Preparations and charges for fireetinguishers containing chlorotetrafluoroethane, dichlorotrifluoroethane or chlorodifluoromethane ) could be created under subheading for the classification of the products concerned. (4) Methyl bromide mitures As most of the products in the illustrative list of mitures (table 4) are classifiable in subheading and contain methyl bromide as their principal ODS component, it would seem that a new subdivision ( Mitures containing methylbromide ) could be created under subheading for the classification of the products concerned. (5) Solvents The information provided on the principal component indicates that all these mitures are classifiable in subheading Since it would be difficult to distinguish mitures used as solvents from other mitures, it is not feasible to identify them separately in a Recommendation. (6) Others As all the products in the illustrative list of mitures (table 6) are mitures containing acyclic hydrocarbons perhalogenated only with fluorine and chlorine and are classifiable in subheading , which has been specially created in the HS for separate identification of mitures containing certain ODSs, it would seem unnecessary to create a new subdivision for these products. 9. The Secretariat, on 31 July 1998, received a reply from the UNEP that it could agree with the Secretariat s suggestion for creating three subdivisions in a WCO Recommendation for the separate identification of mitures specified at (1) to (4) above. However, it was suggested to modify the tet for subdivision under subheading , concerning items (1) and (2) above, to read as Refrigerants and blowing agents, containing chlorotetrafluoroethane, chlorodifluoroethane or chlorodifluoromethane, since blowing agents could not be considered as refrigerants. III. SECRETARIAT COMMENTS 3.

Regarding the modifications to the Preamble to the draft Recommendation agreed by the Committee (see paragraph 3 above), the Secretariat would like to propose to delete the clause Recognizing further amendments to the Harmonized System..., and to insert the following two clauses : HAVING REGARD TO the Recommendation of 20 June 1995, and NOTING that Member administrations and Contracting Parties to the Harmonized System Convention which had accepted the Recommendation of 20 June 1995 would automatically cease to apply that Recommendation when accepting this Recommendation, 11. As regards the new subdivisions for the HCFCs under subheading , the revised list proposed by the UNEP enables to provide nine subdivisions including the residual one (see Anne I) and, therefore, it should be possible to insert them in the national statistical nomenclature under a single HS code. 12. Concerning the mitures containing ODSs, the creation of three subdivisions suggested by the Secretariat would meet the UNEP s requirements subject to a modification to the tet of the first subdivision under subheading (see paragraph 9 above). The Secretariat has no objection to this modification. However, the Secretariat feels that it would be more appropriate to modify that tet to read as Mitures containing chlorotetrafluoroethane, chlorodifluoroethane or chlorodifluoromethane, rather than specifying refrigerants and blowing agents, since it would be difficult to check their uses before Customs clearance. 13. Therefore, the Secretariat suggests to incorporate the following three additional subdivisions into the new Recommendation for mitures containing ODSs : - Preparations and charges for fire-etinguishers containing chlorotetrafluoroethane, dichlorotrifluoroethane or chlorodifluoromethane (subheading 38.13); - Mitures containing chlorotetrafluoroethane, chlorodifluoroethane or chlorodifluoromethane (subheading ); - Mitures containing methylbromide (subheading ). 14. On the above basis, the Secretariat has prepared a new draft Recommendation and set out at Anne III hereto. This draft incorporates the substances covered by the 1995 Recommendation as well as the new HCFCs and mitures containing ODSs requested for inclusion by the UNEP. 4.
5 E IV. CONCLUSION 15. The Committee is invited to eamine the new draft Recommendation concerning ozone layer depleting substances set out in Anne III to this document. 5.
