5 Florida Statute Chapter 190 Established in Provides for units of Special Purpose Government CDD s. General Powers: Power to organize, hire staff, sue and be sued, tax or assess, enter into contracts, adopt rules own property. Restrictions: Zoning, building permits/development orders, law enforcement

6 Benefits of CDD s Provides for a governing Board of qualified electors (residents). Council- Manager form of government (most popular structure of local governments). A CDD provides the services in a focused fashion which creates a vision for what the community will look and feel like. Ensure accountability of public resources since CDD s are government entities held to the same high standards as cities and counties (i.e. Sunshine Law, Ethics, Public Records Law, Financial Reporting and Audits, Financial Disclosure Laws, etc.) Save money by selling tax-exempt bonds, purchasing essential goods and services tax-free, and participating in state programs and initiatives. Maintain the financial integrity of the District by limiting its liability to civil lawsuits and providing state and federal assistance in the event of a financial emergency.

7 CDD vs. HOA CDD Special Purpose Local Government Plans, finances, constructs, operates and maintains community-wide infrastructure and services specifically for the benefit of its residents. HOA Responsible for issues directly related to homeowners properties. Deed Restriction Enforcement Architectural and Landscaping Modification Approval MFN common area maintenance (i.e. neighborhood pools)

9 Board Meeting Procedures Agenda packets are ed to Supervisors the week prior to the Board meeting and posted to the website. Regular meetings are held on the third Thursday of the month, unless otherwise noted. At least three Board members constitute a quorum. The Chairman, Board officer or Executive Director runs the meeting. Each Board had adopted a policy regarding public comment and audience participation. 9

10 CDD Management Team Role Manages day-to-day business. Ensures compliance with government regulations. Plans and manages annual budget. Oversees administrative services and records management. Ensures bond management. Communicates with the Board, Town Hall staff, consultants and residents.

11 Administration Team Comprised of: Executive Director Manages the day-to-day operations of Town Hall including the business of the IDA and its personnel, the CDD s and the HOA s Executive Assistant Provides support to the Executive Director and Chief Financial Officer and Human Resources Clerk to the Boards Produces CDD minutes and agendas; Records Manager; Legal Ads IT Specialist Provides IT support to staff and Board Members

12 Operations The Operations Office maintains the District s common areas & provides customer service to homeowners. Requests for services related to common areas often include: Landscaping (mowing, trees, shrubs & annuals) Irrigation Ponds Preserves Street lights & landscape lighting Signage Summerfield Park, District 2 Park, Adventure Park & the Dog Park Guard Houses and Gate

13 Finance Directs the fiscal functions of the IDA, CDD s, and HOA s including: Administration Budget Payroll Accounts Payable Accounts Receivable Investments Annual Audits Monthly Financial Reporting Assessment Rolls

14 Annual Budget Process Fiscal year budget: October 1 - September 30. Budget Process Cycle: Public Workshops (March through May) Input from Residents through Budget Request Form Approval of Prelim Budgets: IDA (May); CDD s (June) Statutorily required to be approved before June 15 Cannot be increased after this point Mailing of TRIM Notice by County (late Aug) Final Adoption of Budget: IDA (July); CDD s (Aug) Statutorily required to be approved before September 15 Tax bills mailed by Manatee County (Oct)
