Reason for the enactment The reason for this enactment is to provide a nutrition labelling standard and method in order to prevent children from becoming obese and to contribute to a healthy dietary environment; pursuant to Article 11 (Displaying Nutrient Content) of the Special Act on Children s Dietary Life Safety Management and Article 8 of the Enforcement Ordinance of the same Act. 2. Key elements A. Established the labelling standard of nutrient contents and labelling method for children s favourite food offered for sale in a food service establishment (Article 3 of the Proposal). (1) Stipulated the food and the nutrient contents subject to labelling, and provided a labelling standard of children s favourite food that is prepared and sold by food service establishments. (2) Provided a method to label nutritional information such as calories for children s favourite food that is prepared and sold by food service establishments; thereby expecting an impact in prevention of child obesity and to contribute to creating a healthy dietary environment.

Presenting written opinions Any individual or group who has opinion(s) about the Proposed Enactment of Standard on Nutrition Labelling and Labelling Method for Children s Favourite Food in Food Service Establishments is welcome to present opinions in writing to the Commissioner of the Korea Food and Drug Administration (Address: 194 Tongilro, Eunpyeong-gu Seoul, CC: Nutrition Policy Division, Phone: Fax: ) with the following information by December 7 th, 2009: A. 3 Korea Food and Drug Administration Public Notice No We hereby announce, the Standard of Nutrition Labelling and Labelling Method for Children s Favourite Food, pursuant to the provisions in Article 11 (Displaying Nutrient Content) of the Special Act on Children s Dietary Life Safety Management and Article 8 of the Enforcement Ordinance of the same Act as follows. November 17 th, 2009 Commissioner, Korea Food and Drug Administration Proposed Standard of Nutrition Labelling and Labelling Method for Children s Favourite Food in Food Service Establishments Article 1 (Purpose) The purpose of this notice is to provide a nutrition labelling standard and method in order to prevent children from becoming obese and to contribute to a healthy dietary environment; pursuant to Article 11 (Displaying Nutrient content) of the Special Act on Children s Dietary Life Safety Management and Article 8 of the Enforcement Ordinance of the same Act. Article 2 (Definitions) For the purpose of this notice, the definitions of terms shall be as follows; The term menu means the list of food (food or beverage) from which consumers make their selection at the point of ordering that is provided by the food service establishments subject to the nutrition labelling under Article 8 of Enforcement Ordinance of the Special Act on Children s Dietary Life Safety Management (hereinafter referred to as the Ordinance ) (e.g. Menu board, Poster and Bulletin board etc.).

4 Article 3 (Nutrition labelling and labelling method in food service establishments) The standard of labelling nutrient contents and labelling method are specified in the Attachment. Article 4 (Keeping the data used to calculate nutritional quantity) When displaying the nutrient contents, the food service establishment shall use actually measured values or values calculated with a scientific basis as the nutritional information, and shall keep those data. Article 5 (The other Acts concerned) Terms such as amount per serving, nutrition standard apply correspondingly to Labelling Standard of Foods (Korea Food and Drug Administration Public Notice) and Labelling Standard of Livestock Products (National Veterinary Research and Quarantine Service Public Notice), unless they were defined in this notice. ADDENDUM This notice shall take effect from January 1 st, 2010.

5 [Attachment] Standard of Nutrition Labelling and Labelling Method for Children s Favourite Food in Food Service Establishments (In relation to Article 3) 1. Subject foods to label nutrient content A. Among food service establishments who sell food items specified in the Subparagraphs below, those stipulated in Article 8 of Enforcement Ordinance of the Special Act on Children s Dietary Life Safety Management shall label nutrient content. 1) Confectionery and bakery 2) Ice cream 3) Hamburgers and pizzas 4) Other prepared food for sale that may be labelled 2. Subject nutrient contents to be labelled A. The nutrient contents specified in the following Subparagraphs shall be labelled. 1) Calories 2) Sugar 3) Protein 4) Saturated fat 5) Sodium 6) Other nutrient contents that may be emphasized

6 3. Labelling standard and method A. The nutrient contents shall be labelled in accordance with specified standards in the following Subparagraphs. 1) Food that is on the menu for at least 90 days per calendar year shall label its nutrient contents. The quantity contained of each nutrient per serving shall be labelled. Additionally, the percentage (%) of the recommended daily requirements may also be indicated. 2) The quantity of each serving shall be indicated as a unit such as portion, piece, cup or number of items with the weight in parentheses. When offering more than 2 servings, the total shall be declared (For example, 2 pieces (00g)/ Total 8 pieces). 3) For a set menu that consists of more than 2 kinds of food, the total calories of the food combination shall be labelled. If a menu has multiple combinations of food, the total calories may be labelled as a range of the minimum and maximum values (For example, 100~500 Kcal/serving (00g)). B. The nutrient contents shall be labelled in accordance with specified methods in the following Subparagraphs. 1) The nutrient contents shall be labelled in a clear and conspicuous manner using a colour that is distinguishable from the background colour. 2) The calories shall be labelled at at least 80% of the type size of the name or the price of food on the menu offered at the point of ordering, and other detailed nutritional information should be indicated using means such as leaflets, posters, websites etc. 3) If the food service establishment provides a delivery service (for orders taken online or by telephone etc.), it shall offer consumers nutritional information using a flyer, sticker, etc. upon delivery. 4) A food service establishment that is capable of providing information via the internet shall label calories and other nutritional information in the proximity of the food name (or price) to allow consumers to identify nutritional information when they select the product. C. The detailed labelling method shall apply correspondingly to the detailed labelling method by nutrient contents stipulated in the Labelling Standard of Foods.
