FDA alleged that the company did not register the process with it, and failed to conduct tests for traces of ethylene oxide in the powder. The company challenged the order, but in June the cancellation of license was upheld by the FDA's appellate authority. Senior counsel Rafiq Dada, appearing for the company, said the company was not using ethylene oxide treatment process anymore. FDA counsel Ashutosh Kumbhakoni had, however, opposed the petition and said the company had not expressed any remorse even after the issue came to light.

In the year 2007, J&J manufactured 1,60,000 batches of talcum powder using cancerous substance ethylene oxide without the prior permissions to sterilize the powder. In return, the FDA had taken strict action against Johnson & Johnson and cancelled their manufacturing license for all products and took strict action against them. Post FDA s decision, J&J had filed an appeal in the High Court against cancellation of their license. The hearing was done in front of Judges SJ Vazifdar and MS Sonak. Post the decision, the judges has asked to complete the case with the appellate authority. Senior Advocate Ashutosh Kumbhakoni appeared for FDA in this case. Post receiving the directives from the High Court, J&J spokesperson informed, we will soon start the production of all their products at their Mulund Plant. 9 Hindu Business Line Online September 25, 2013 Bombay HC permits Johnson & Johnson to restart Mulund unit operations OUR BUREAU MUMBAI, SEP 24: The Bombay High Court has allowed Johnson & Johnson to resume its manufacturing activities at the Mulund plant in Mumbai. Johnson & Johnson (J&J) had lost its license to manufacture cosmetics at the plant, with the Maharashtra Food and Drug Administration finding the company guilty of using ethylene oxide in a limited number of batches of baby powder in Ethylene oxide is known to be a chemical that causes cancer. On the basis of a complaint, the Maharashtra Food and Drug Administration (FDA) had cancelled the company's Mulund plant licence. In 2007, 15 finished batches of Johnson baby powder were found to have higher ph levels than the prescribed limits. These batches were reprocessed for ph correction, to meet the quality specification. However, due to the excessive manual handling of these 15 batches during reprocessing, the batches at the finished goods stage were treated with ethylene oxide to reduce the anticipated increase in bio-burden. The product had an expiry date of However, on April 10, 2013, J&J received an order from the Maharashtra FDA cancelling its Cosmetic Manufacturing license at the Mulund plant, with effect from June 24. The company said the FDA did not issue a show cause notice to J&J before cancellation of the license. An appeal against the order was filed with the Ministry of FDA in Maharashtra, requesting for an immediate stay, but was rejected by the FDA Minister of Maharashtra. The company subsequently filed a writ petition on July 12, 2013 in the Bombay High Court challenging the FDA order. With the Bombay High Court setting aside the Maharashtra FDA order, the company has said it would resume cosmetic manufacturing at its Mulund plant in Mumbai in due course. ``We will continue to work closely with Maharashtra FDA, and provide safe, high quality products,'' said a J&J India spokesperson. The FDA action was specific to the cosmetics production at the Mulund plant in India and did not impact global manufacturing or any other plants in India, the company said.

The FDA had alleged that the company sterilized 15 batches of baby powder boxes in 2007 with 'carcinogenic' ethylene oxide and did not check for its residue. J&J, on their part, said that as part of an audit conducted in 2009, they had checked samples of three batches and found no residue. Reiterating their stand, they said, 'We will continue to work closely with Maharashtra FDA, and to provide India with safe, high quality products that help people care for themselves and their families.' J&J told the High Court that the 15 batches were brought back to its facility and tested according to a validated process before release into the market. Reacting to the High Court decision yesterday, J&J, in a statement released today, said, 'We are very pleased to inform you that the Bombay High Court has set aside the Maharashtra FDA order and we will be resuming cosmetic manufacturing at our Mulund plant in Mumbai in due course.'
