Barcaskey, Executive Director Drug and Alcohol Abuse Program REMINDER The Association wants to remind contractors of the important components found in the Drug and Alcohol Abuse Program, which is contained in the CAWP Labor Agreement. The most significant component is the three-strike policy. The purpose of this is to provide rehabilitation for employees testing positive for the first time, and to restrict individuals who continue to violate the drug and alcohol program from working for CAWP members. In order for the CAWP Drug and Alcohol Program to prove effective, CAWP contractors must ensure they are following the proper procedures for testing and notification. Please be advised, in the event the contractor does not follow the procedures of the CAWP Drug and Alcohol Program, and a grievance is filed by the union, CAWP will not be able to defend the company, and all legal and arbitration costs will be borne by the Company. As such, please remember these important details: Updated Consent Form The Association has developed a Consent and Release Form, which permits the applicable Union and CAWP to receive the substance test results. If you have not already done so, we recommend you insert this new consent form into your new hire packets to cover newly hired employees, and have all current employees complete the form now, or prior to the time of a drug and/or alcohol test. Letter to the Unions The Association has also developed a sample letter for CAWP Contractors to use when notifying the applicable Union that the company has conducted a substance test and confirmed that an individual has tested positive for drugs and/or alcohol. The letter notifies the Union that the individual violated the Joint Labor-Management Drug and Alcohol Abuse Program contained in the CAWP Labor Agreement. Please note, CAWP Contractors must attach proof of the confirmed substance result to the letter they send to the Union, unless the violation is due to an individual refusing to submit to a test. A confirmed positive test result indicates the alcohol level was.04 BAC or above and/or the laboratory and Medical Review Officer (MRO) has confirmed an illegal/unauthorized drug(s). I hereby waive any objections that I may have to the results being provided to those two separate entities. I hereby expressly release, discharge, and hold harmless the Union and CAWP and any of their officers, employees, agents, and representatives ( Released Parties ), from and against any and all liability, claims, and causes of action of any kind, that I may have resulting from or in connection with my agreement and/or consent, as expressed in the previous paragraph.
