1 MINUTES Regular Meeting of the Lompoc City Council Tuesday, December 17, 2013 City Hall, 100 Civic Center Plaza, Council Chambers CLOSED SESSION OPEN SESSION 6:30 P.M. Council Chambers Council Members Present: DeWayne Holmdahl, Dirk Starbuck, Bob Lingl, Ashley Costa, and Mayor John Linn. Staff Present: Interim City Administrator Teresa Gallavan, City Attorney Joseph Pannone, and City Clerk Stacey Alvarez. ORAL COMMUNICATIONS: None CLOSED SESSION Employee Break Room BUSINESS ITEM: 1. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION Paragraph (1) of subdivision (d) of Section Name of Case: Rachel Delkener, Gail Densmore, Mathew Paine, Trish Warfield and Leah Chase v. City of Lompoc. OPEN SESSION - 7:00 P.M. Council Chambers Council Members Present: DeWayne Holmdahl, Dirk Starbuck, Bob Lingl, Ashley Costa, and Mayor John Linn. Staff Present: Interim City Administrator Teresa Gallavan, City Attorney Joseph Pannone, City Clerk Stacey Alvarez, Police Chief Larry Ralston, Contract Building Official Michael McGivney, Acting Economic Development/Community development Director/Planning Manager Lucille Breese, and Assistant Public Works Director/City Engineer Michael Luther. Others Present: Sid Haro, Trevor McDonald, Ken Ostini, Carl Creel, Dale Welch, and Robert Schmeidke. REPORT ON ACTION TAKEN DURING CLOSED SESSION: Mayor Linn stated there was no reportable action taken during the Closed Session. Bernie Federmann gave the invocation and Mayor John Linn led the Pledge of Allegiance. PRESENTATIONS: Lompoc Unified School District (District) Superintendent Trevor McDonald and Assistant Superintendent of Instruction Sid Haro gave a presentation on community outreach efforts from the District, regarding common core standards in the district schools, explaining the District has invested a large amount of money and time in embedding technology into classrooms and preparing its teachers and administrators with professional development. Mr. McDonald thanked Council Member Costa for serving on the Community Connections Committee and invited Council to contact the District Offices if they would like to tour any of the school campuses. Council Member Lingl asked if the District provides testing for a General Education Development (GED) Certificate. Mr. McDonald explained the District does not currently provide the testing for a GED but does provide instruction. Mr. Haro stated the District is working with Allan Hancock College that may allow for partnership to provide GED testing in the future. Council Member Costa thanked Mr. McDonald and Mr. Haro for their presentation and invited them back for future updates. 12/17/2013 Lompoc City Council Minutes Page 1 of 5
2 PRESENTATIONS: (cont d) presented a Power Point Presentation update Report on the Bike Skills Park. Dave Baker, representative from the Lompoc Valley Parks, Recreation, and Pool Foundation (LVPRPF) distributed a current timeline of completed accomplishments and sponsorship list. Mr. Baker thanked the public, the sponsors and the Council for the time and effort put into this project and stated he is hopeful this park will open in the next few months. Council thanked Mr. Baker for his continued effort and hard work on this project. presented a Power Point Presentation update Report on the Kids Moto Park. Carl Creel, Motorsports Park Committee Co-Chairman thanked Council and Staff for the continued work on this park, requested consideration of amendments to the current Memorandum of Understanding regarding the size of the motorcycles allowed on the track and the age of the riders. Recreation Manager Joanne Plummer stated the park is obligated to keep the sound at 65 decibels or lower and the City is working with the Committee to find a consistent and fair location at the park to take sound readings. presented a Power Point Presentation on an Amendment Proposal to the Agreement between the City and the Lompoc Valley Chamber of Commerce, to develop Future Marketing Strategies. Lompoc Valley Chamber of Commerce C.E.O. Ken Ostini spoke in favor of the presented amendment proposals. Council thanked Mr. Ostini for the provided information and asked for the Chamber to continue to work with the local business community to help capture the upcoming influx of participants at the Hancock College Public Safety Complex. CITY ADMINISTRATOR STATUS REPORT: (Information only) Interim City Administrator Teresa Gallavan announced there will be a media event on Friday, December 20, 2013, at the corner of Central Avenue and V Street, Lompoc announcing commercial development of that property. STAFF REQUESTS AND ANNOUNCEMENTS: Assistant Public Works Director/City Engineer reported the traffic signal at R Street and Ocean Avenue is now operational. ORAL COMMUNICATIONS (Maximum of 5 Minutes): 1. Lompoc Valley Chamber of Commerce C.E.O. Ken Ostini announced the Chamber will be hosting a meeting on Friday, January 3, 2014, at 10:00 A.M., at the Lompoc Council Chambers regarding the Countywide Broadband Task Force. CONSENT CALENDAR: ACTION: Costa/Lingl: with a 5-0 vote, Council: 1. Approved the Minutes of the Lompoc City Council Regular Meeting of 11/19/ Approved the expenditures for: Payroll of 11/20/ $1,317, Voucher Register of 11/22/ $254, Voucher Register of 11/27/ $1,262, Memorandum of Understanding with the International Brotherhood of Electrical Workers, Local Union 1245, AFL-CIO. Adopted Resolution No. 5887(13) which: approves the Memorandum of Understanding ( MOU ) for the period of July 1, 2013, through December 31, 2014, between the International Brotherhood of Electrical Workers, Local Union 1245, AFL-CIO ( IBEW 1245 ) and the City of Lompoc; approves supplemental appropriations for the FY Budget cycle; approves supplemental revenues for the FY Budget cycle; and makes the Resolution effective on the day of its adoption. 12/17/2013 Lompoc City Council Minutes Page 2 of 5
3 CONSENT CALENDAR: (cont d) 4. Adoption of Ordinance No. 1594(13) - Amending Chapter 8.28 of the Lompoc Municipal Code Relating to Fireworks. ACTION: Starbuck/Costa: with a 3-2 vote, (Council Members Lingl and Holmdahl Voted No) Council waived further reading and approved Ordinance No. 1594(13). APPOINTMENTS: 5. Council Appointment to Beautification Commission (1 Vacancy) ACTION: Holmdahl/Mayor: with a 5-0 vote, Council appointed Steve Bailey to the Beautification Commission with a term ending 12/2016. PUBLIC HEARING: 6. Adoption of Ordinance 1596(13) To Adopt by Reference the Mandatory State Building Codes, as Amended, and Amend the Lompoc Municipal Code To Reflect the Same. Contract Building Official Michael McGivney presented the Staff report and recommendations and announced the City will host a workshop within the next couple of months to help educate the public on the changes of the Amended Building Codes. Council Member Holmdahl stated he is pleased to hear that a public workshop will be held in the future and requested that Staff post notices of the workshop as soon as a date is confirmed. Council Member Costa requested Staff provide a summary report to Council at a future meeting after the public workshop has been held. None The Mayor indicated the language of subsection D. 2. on page 4 of Ordinance No. 1596(13) will be amended and brought back for Council review and approval. ACTION: Mayor Linn/Holmdahl: with a 5-0 vote Council waived further reading and adopted Ordinance No. 1596(13), which adopts by reference the mandatory State Building Codes and amends the Lompoc Municipal Code regarding the same. BREAK: At 8:07 P.M. Mayor Linn announced a break. At 8:17 P.M., the meeting reconvened with all Council Members present. COUNCIL REQUESTS: 7. Introduction of Aggressive Solicitation Ordinance No. 1597(13). Mayor Linn expressed his gratitude to Crescent City CA, for providing its panhandling ordinance to the City of Lompoc for review. Larry Ralston, Chief of Police presented the Staff report and recommendations. 1. Bernie Federmann gave suggestions to Council on ways the public may be able to donate funds in a more worthwhile way other than giving a few dollars to individuals on a corner and stated he has seen other communities use refurbished parking meters as charity collection sites. 12/17/2013 Lompoc City Council Minutes Page 3 of 5
4 COUNCIL REQUESTS: (cont d) Item No. 7 Council Member Lingl thanked Staff for this item, stated the public needs to be educated on better ways of funding programs that are proven to help individuals who are in need of food and/or shelter and asked Staff to confirm this Ordinance will not pertain to genuine religious activities or gatherings. ACTION: Mayor Linn/Lingl: with a 5-0 vote Council introduced Ordinance No. 1597(13), by first reading, to regulate aggressive solicitation and solicitation in certain locations in the City. UNFINISHED BUSINESS: 8. Introduction of Ordinance 1598(13) Banning the Possession of Synthetic Spices and/or Synthetic Bath Salts. Police Chief Larry A. Ralston presented the Staff report and recommendations. Council Member Costa asked Staff to confirm the proposed Ordinance will ban the possession of these substances. Police Chief Ralston answered yes, and stated the State recently enacted a law banning the sale of these substances. Council Member Holmdahl stated he believes Santa Barbara County needs to pass a similar ordinance banning the possession of these substances. 1. Dale Welch spoke about his personal story in dealing with family members who have used these substances, thanked Council and Staff for this proposed Ordinance and stated he is encouraging Council to approve Ordinance No. 1598(13). 2. Robert Schmeidke spoke in support of the proposed ordinance. Council Member Starbuck thanked Police Chief Ralston for working to bring this ordinance to Council. Chief Ralston thanked City Attorney Joseph Pannone for the work he and his firm did to bring this comprehensive ordinance forward quickly. ACTION: Mayor Linn/Holmdahl: with a 5-0 vote Council introduced Ordinance No. 1598(13), by first reading, to ban the possession of synthetic spices and/or synthetic bath salts. NEW BUSINESS: 9. Consideration of Second Annual Lompoc Valley of the Flowers Criterium Race on Sunday, May 11, Recreation Manager Joanne Plummer presented the Staff report and recommendadtions. Council discussed the proposed event, the first Lompoc Criterium Race held in June 2013, ideas for outreach to the local businesses on the race route, and possible ways to include special events for all moms as the 2014 Criterium Race will be held on Mother s Day. 1. Bernie Federmann suggested Staff provide special gifts or events for moms during the 2014 Race, stated he is looking forward to the event and will ensure Foursquare Church will provide as many volunteers as possible. ACTION: Costa/Holmdahl: with a 5-0 vote Council authorized the City Administrator to sign an agreement (to be prepared by staff) with Mike Hecker of Stump Grinder Productions, to conduct a Criterium event on May 11, 2014, in Lompoc; and approved a $5,000 cash contribution necessary for the event; and approved an in-kind contribution of labor for support from the Police Department, Fire Department, Recreation and Streets Divisions. 12/17/2013 Lompoc City Council Minutes Page 4 of 5
5 WRITTEN COMMUNICATIONS: None ORAL COMMUNICATIONS (2 Minutes Maximum): None COUNCIL REQUESTS, COMMENTS, AND MEETING REPORTS: Council Member Lingl requested Staff research the ability for the City to enact a smoking ban at any and all places where children congregate. The request was seconded by Council Member Costa and carried by Council Member Starbuck. Mayor Linn stated he attended several meetings and events. Council Member Holmdahl reported he recently took a tour of the Lompoc Federal Corrections Institute s low security dairy farm and cattle ranch. Council Member Costa reported she had lunch inside the Cabrillo High School cafeteria and stated she was completely impressed by the high level of nutritious and appetizing meal choices available. ADJOURNMENT: At 9:26 P.M. Mayor Linn adjourned the Lompoc City Council to a Regular Meeting on Tuesday, January 7, 2014, at 7:00 P.M., at City of Lompoc City Hall Council Chambers.
