2 A P EER-T O -P EER SAFE T Y PROGRAM FOR COLLEGE YOUTH Car crashes is the # killer of college students in America and for every young adult killed in a car crash, about 00 more are injured. Start the U in the Driver Seat program at your school. Created in 202, UDS is a peer-to-peer traffic safety program that educates young adults about dangerous driving behavior drowsy driving; speeding; distraccons; not wearing a seat belt; and impaired driving. We give students the tools and informaaon to educate one another through campus outreach. How does it work? Texas A&M Transportaaon Insstute gives you the science, guidance and project resources to implement a successful program. The rest is up to YOU to create and sustain an awesome program at your school. First Offense - Class C Misdemeanor Up to $500 fine; Alcohol awareness class; hours of mandatory community service; 60 days driver's license suspension; Ineligible for an occupational license for the first days. 2. Second Offense - Class C Misdemeanor Up to $500 fine; Alcohol awareness class; hours of mandatory community service; 20 days driver's license suspension; Ineligible for an occupational license for the first 0 days. Intoxication must be proven for conviction. Intoxication means not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, or a combination; OR having a blood alcohol concentration (BAC) of 0.0% or more. Minors may be arrested for DWI and are subject to the same penalties as adults.* Penalties First Offense Up to a $2,000 fine; and/or 3-0 days in jail; Driver s license suspension of 0 days to year. Second Offense Up to a $4,000 fine; and/or month - year in jail; Driver s license suspension of 0 days to 2 years. Third Offense Up to $0,000 fine; and/or 2-0 years in jail; Driver s license suspension of 0 days to 2 years. A First Offense DWI in Texas, with a BAC of a 0.5% or greater is a Class A Misdemeanor. You can face up to: a $4000 fine; and/or one year in jail. Zero Tolerance Law It is illegal for a minor to drive a motor vehicle or operate a watercraft while having ANY detectable amount of alcohol in the minor's system. This is also known as DUI (Driving Under the Influence). 3. Third Offense (Under ) 0 days driver s license suspension; Ineligible for an occupational license. 4. Third Offense ( or Older) - Class B Misdemeanor $500 - $2,000 fine; and/or Confinement in jail for up to 0 days; 0 days driver s license suspension; Ineligible for an occupational license. Driving While Intoxicated Additional Penalties With Open Container Up to a $2,000 fine; A minimum of 6 days in jail. With Intoxication Assault Up to a $0,000 fine (for each count); 2-0 years in prison. With Intoxication Manslaughter Up to a $0,000 fine (for each count); 2-20 years in prison. With Child Passenger (under the age of 5) Up to a $0,000 fine; 0 days to 2 years in a state jail. TX Penal Code.02 Murder A defendant can be charged with murder, if while committing a felony, he/she performs an act "clearly dangerous to human life that causes the death of an individual." A third DWI conviction is a felony offense. This means that if a person's act of driving while intoxicated results in a person's death, and the driver has two previous DWI convictions, the driver can be charged with murder. * Minors under will report to Juvenile Court, unless adjudicated as adults. It is illegal for a minor to: possess or consume alcoholic beverages; purchase or attempt to purchase alcoholic beverages; misrepresent their age to obtain alcoholic beverages; be intoxicated in public; operate a motor vehicle or watercraft while having any detectable amount of alcohol in their system. Consequences: Alcohol Penalties for Minors Class C Misdemeanor, punishable by a fine up to $500; Alcohol awareness class; Community service; Driver s license suspension or denial; If the minor is or older, on the third offense, the fine increases to $2,000 and/or up to 0 days in jail, in addition to driver s license suspension. NOTE: A minor will not be charged with possessing or consuming alcohol if the minor: requested emergency medical assistance in response to the possible alcohol overdose or sexual assault of the minor or another person; was the first person to make a request for medical assistance; remained on the scene until medical assistance arrived; and cooperated with medical assistance and law enforcement personnel. Alcoholic Beverage Code and Providing Alcohol to Minors Sale to Minors - Class A Misdemeanor: Fine up to $4,000; and/or Confinement in jail for up to a year. Purchase of Alcohol for Minor/Furnishing Alcohol to a Minor - Class A Misdemeanor: Fine up to $4,000; and/or Confinement in jail for up to a year; Driver s license automatically suspended for 0 days upon conviction. In Texas, a person may provide alcohol to a minor if he or she is the minor s adult parent, guardian, or spouse, and is visibly present when the minor possesses or consumes the alcoholic beverage. However, it is against the law to make alcohol available to any other person younger than 2 even in your own residence, even with the minor s parent s permission. You can be held civilly liable for damages caused by a person younger than if you provided them alcohol or allowed them to be given alcohol while on your property.

19 TxDOT Regions Education Program for 2 and Over TABC developed an education program called Drinking Alcohol Comes with Responsibilities which targets the 2 - to 25 - year-old age group. Participants learn about: Alcohol by volume (ABV); Standard drink sizes; Blood alcohol content (BAC); Intoxication; Binge drinking; Alcohol poisoning; and Texas laws regarding alcohol. TABC presents this program at colleges, universities and community events. TABC agents and auditors are available to present this program in your area. Alcohol By Volume Impacts Standard Drink Size The alcohol in one 23.5 ounce malt beverage (2% ABV) equals the alcohol in 4. beers (5% ABV).* 2% Alcohol By Volume Ale or Malt Liquor 23.5 Ounces = Measurement Definitions Alcohol by Volume (ABV) - Represents the volume of liquid that is ethanol compared to the entire volume of the drink. Alcohol by Weight (ABW) - Represents the weight of the liquid that is ethanol compared to the entire weight of the drink. Alcohol Definitions Texas Alcoholic Beverage Code.04 Ale or Malt Liquor - A malt beverage containing more than four percent of alcohol by weight. (Generally 5.% or more ABV.) Beer - A malt beverage containing one-half of one percent or more of alcohol by volume and not more than four percent of alcohol by weight, and does not include a beverage designated by label or otherwise by a name other than beer. (Generally 5.% and under ABV.) Distilled Spirits - Alcohol, spirits of wine, whiskey, rum, brandy, gin, or any liquor produced in whole or in part by the process of distillation, including all dilutions or mixtures of them, and includes spirit coolers that may have an alcoholic content as low as four percent alcohol by volume and contain plain, sparkling, or carbonated water and may also contain one or more natural or artificial blending or flavoring ingredients. Z e ro T o l e r a n c e Law: Driving Under the Influence (DUI) The Zero Tolerance Law prohibits anyone under 2 to drive with any detectable amount of alcohol in their system. This includes cars, motorcycles, boats and jet skis. (Alcohol Beverage Code and 06.04) Signs of Intoxication - Slurred speech - Impaired balance - Impaired motor ability - Smell of alcohol Binge Drinking can lead to alcohol poisoning. Know the signs and get help, if someone you know has over consumed.
