This circular authorises changes with effect from 1 April 2000 in the pay and conditions of service of administrative dental officers, community clinical dental officers and salaried dentists undertaking general dental services at health centres. Action 2. 3 A ADMINISTRATIVE DENTAL OFFICERS AND COMMUNITY CLINICAL DENTAL OFFICERS ANNEX A 1. The new rates set out in Appendix 1 supersede the rates of remuneration authorised by NHS Circular No PCS(DD)1999/6 and should be noted as amendment No 11 to the Terms and Conditions of Service. 2. Appendix 3 to this Circular gives details of the new salary scales for Assistant Chief Administrative Dental Officers and Chief Administrative Dental Officers, Bands F to C. This appendix should be renumbered Appendix 4 and inserted into and retained in the Terms and Conditions of Service for Administrative Dental Officers and Community Clinical Dental Officers of Regional and District Health Authorities (Health Boards) published in September 1987, known as the red book. 3. These changes have been approved by Scottish Ministers under Regulations 2 and 3 of the National Health Service (Remuneration and Conditions of Service) (Scotland) Regulations 1991 (SI 1991 No 537) following consultation with representatives of the profession. B SALARIED DENTISTS UNDERTAKING GENERAL DENTAL SERVICES AT HEALTH CENTRES 4. Following consultation with the body representative of the profession, Scottish Ministers have amended the remuneration for salaried dentists and the fees for the provision of emergency dental services set out in Determination II of the Statement of Dental Remuneration. 5. The revised salary scales and sessional fees are set out in Appendix 2. C VIOLENT PATIENTS 6. On 1 August 1998 the National Health Service (General Dental Services) (Scotland) Amendment Regulations, SI 1998 No 1663 came into force. This allowed general dental practitioners to deregister violent patients immediately, and required dentists to notify the Health Board of this decision. Following deregistration by their general dental practitioner, such patients are likely to receive treatment in the Community Dental Service. Therefore, although such information should be treated in confidence by the Health Board, it would be helpful if it was made known to Clinical Directors of the Community Dental Service as a precautionary measure. Health Board General Managers will need, therefore, to make sure that an appropriate mechanism is in place with effect from 1 April DENTALPAY 3. Amendment No 11 - Dental

4 ANNEX B CHANGES TO TERMS AND CONDITIONS OF SERVICE CONSULTANTS IN DENTAL PUBLIC HEALTH Insert new paragraph 325 Additional sessional contract 325. (a) In any of the circumstances specified in sub-paragraph (b) an authority may enter into an additional temporary contract for a period of up to 12 months for a notional half-day a week or fraction thereof, except where specifically stated otherwise, with Consultants in Dental Public Health to undertake work which is outside their contractual duties and such a contract shall be described as an additional sessional contract, and shall be subject to the following conditions: Consultants in Dental Public Health shall be paid at the rate of one tenth of their full-time salary, including any discretionary points granted; and all practitioners in receipt of any Distinction Award shall from 1st April in the year in which they received the Distinction Award be remunerated at point 8 on the Discretionary Point scale; i. the additional sessional contract shall be terminable at three month s notice by either party, unless the practitioner is a locum when the notice of termination required shall be whichever is the lesser of the notice period of their locum contract or three months; ii. the authority shall not, under any of the arrangements specified in subparagraph (b), award a total of more than two additional notional half- days to any Consultant in Dental Public Health; iii. the provisions of paragraph 190 and 191 do not apply to the sessional contract. (b) An authority may enter into a contract for additional sessions where: i. in the opinion of the authority, the circumstances are exceptional; ii. without prejudice to any private practice rights enjoyed by the consultant, a maximum part-time consultant: 1. has been appointed as a part-time general manager but whose clinical sessions have not been reduced sufficiently to take full account of their general manager duties: or 2. is the immediate colleague of a consultant appointed part-time general manager, and is called upon to take on additional work to cover clinical DENTALPAY 4. 5 sessions temporarily relinquished by the general manager; (not applicable to CDPH) iii. 1. where a full-time consultant or consultant working 9/10ths has taken on significant additional duties in adition to his or her contractual duties with his or her normal empoyer(s) in circumstances in which it is not possible to make a compensating equivalent reduction in normal duties. Situations in which such recognition will (may) be appropriate include: providing a consultant input to an additional health board/ NHS Trust/PCG/PCT to cover the temporaty absence from or lack of a CDPH in that other organisation. providing a consultant input to the NHS Executive. Undertaking additional generic public health or commissioning or management responsibilities for the employer(s) Undertaking a postgraduate tutor appointment (or equivalent). 2. a consultant is the immediate colleague of a consultant to whom subparagraph 1 above refers. The additional session contract shall take effect from the date of the agreement of the job plan and may be for up to two additional notional half-days, or fraction thereof, where the duties are particularly onerous; iv. of up to two notional half days and without prejudice to the private practice rights of the associate specialist, it considers an associate specialist to have particularly onerous contractual duties. The supplement should not be paid to those trainees who are currently on protected salary scales unless the salary on the appropriate point of the trainee s salary scale, plus the supplement, exceeds the amount paid by way of protected salary. 2.2 the supplement payable to Assistant Clinical Directors in Health boards which include a dental teaching hospital is increased from 1,810: with effect from 1 April 2000 to 1,870 a year. 2.3 the supplement payable to Clinical Directors in Health Boards which include a dental teaching hospital is increased from 2,050: with effect from 1 April 2000 to 2,120 a year. 3. Where Clinical Directors are appointed with responsibility to more than one Health Board they shall be paid on the salary scale appropriate to the aggregated population. In addition, a supplement shall be paid as follows: 3.1 where responsible for 2 Health Boards is increased from 1,320: with effect from 1 April 2000 to 1,365 a year; and 3.2 where responsible for 3 or more Health Boards is increased from 2,115: with effect from 1 April 2000 to 2,185 a year. 4. 9 *discretionary points for DOs who are performing work above that expected of their grade but not at the level of an SDO. Criteria for the award is contained in Appendix 3 to the terms and conditions of service. 6. The sessional fees payable under paragraph 72 of the Handbook of Terms and Conditions of Service are increased with effect from 1 April 1999 as shown in column 3. The fees for lectures have been amended and the rates from 1 April 2000 are set out below:- With effect From 1April 1999 Paragraph 170 (fees for lectures to non-medical and non-dental staff) for lectures given by administrative dental officers With effect From 1 April For lectures given by clinical dental officers Paragraph 172 (fees for a lecture on a professional subject to a group of doctors and/or dentists) The allowance for dental officers acting as trainers introduced by NHS Circular No 1985(PCS)16 is increased from 1,445 with effect from 1 April 2000 to 1,495 a year. Consultants in dental public health who are appointed to serve as members of an Advisory Appointments Committees should, with effect from 1 April 1998, receive the same fee as hospital medical and dental consultants. 11 REMUNERATION OF SALARIED DENTISTS UNDERTAKING GENERAL DENTAL SERVICES AT HEALTH CENTRES APPENDIX 2 1. With effect from 1 April 2000 the salaries set out in Determination II of the Statement of Dental remuneration are revised as set out below:- Existing Salary Scale Recommended Scale Payable from 1 April ,440 24,215 25,570 26,415 27,700 28,615 29,830 30,815 31,960 33,015 34,090 35,215 37, , The sessional fee for part-time practitioners working 6 3-hour sessions a week or less in a health centre should be increased from a session; with effect from 1 April 2000 to EMERGENCY DENTAL SERVICES 3.1 The sessional fee for practitioners working a 3-hour session under emergency general dental service schemes should be increased from with effect from 1 April 2000 to With effect from 1 April 2000 where a dentist provides emergency dental services in accordance with the provisions of NHS Circular No 1981(PCS)33, he shall be paid at normal NHS mileage rates for every round-trip over 20 miles to an emergency session from the practitioner s home. 4 Two new discretionary points have been added to the salary scale for salaried dentists. 12 APPENDIX 3 This Appendix should be renumbered Appendix 4 and inserted into and retained in the Terms and Conditions of Service for Administrative Dental Officers and Community Clinical Dental Officers of Regional and District Health Authorities (Health Boards in Scotland) published in September 1987, known as the red book. New salary scale introduced for Clinical Directors of the Community Dental Service The Review Body endorsed proposals (page 71) that a new remuneration structure be introduced for Clinical Directors within the CDS. This new salary scale will encompass all Clinical Directors of the CDS, qualified Dental Service Managers and other qualified dentists who are responsible for the management of the CDS. The new salary scale incorporates provision for the creation of Assistant Clinical Directors in services that have an existing Clinical Director. The correct method of remuneration for Clinical Directors is on the new salary scale, therefore Assistant Clinical Director positions must not be created in the absence of a Clinical Directors post. Existing Assistant Chief Administrative Dental Officers in post subordinate to an existing Clinical Director or Dental Services Manager will transfer to the new Assistant Clinical Director salary Scale detailed in Appendix I. All Assistant Clinical Directors must be qualified dentists. The existing arrangements for remuneration are varied with Clinical Directors and managers currently placed on a variety of pay scales. The new scale will replace the existing methods of remuneration, and therefore remuneration by way of the following pay scales and bandings should cease as of 1 April 2000: Chief Administrative Dental Officer pay scales C to F inclusive Assistant Chief Administrative Dental Officer salary scale Chief Administrative Dental Officer Salary Scale (Scottish Isles CADO gradings will remain) The remuneration of Clinical Directors, Dental Service Managers and other managing dentists within the CDS by way of the Senior Dental Officer salary scale should cease as at 1 April 2000 following transfer to the new salary scale. All existing additional allowances paid in consideration of managing the CDS must cease as of 1 April 2000, however all such allowances must be included within the existing salary for the purposes of transfer onto the new salary scale with the exception of teaching and multi Health Board supplements which will continue as before. 13 Transitional Arrangements. The transitional arrangements for the transfer of existing staff onto the new salary scale on 1 April 2000 are as follows: Where the term existing salary is used this should incorporate the 2000/2001 pay award of 3.3% for CDS staff. Where the dentist is on the maximum incremental point of their existing salary scale they will transfer to the next highest spine point on the new salary scale on 1 April Where the dentist is not on the maximum incremental point of their existing salary scale they will transfer to the next highest spine point on the new scale provided that their existing salary is within 400 of the next highest point on the new salary scale on 1 April Where the next highest point on the new salary scale is in excess of 400 of the existing salary the dentist will remain on their existing salary until 1 April 2001 or their next incremental date which ever is sooner. Assistant Clinical Directors Assistant Clinical Directors should be remunerated on the new salary scale below. Health Boards are able to establish such posts in response to local circumstances and the needs of the individual Community Dental Services. The reasons for employers resolving to establish Assistant Clinical Director posts will vary, however an appointment may be considered in the following circumstances: DENTALPAY 3. 15 Where a significant degree of deputising for the existing Clinical Director is required in order to meet the needs of the service Where a large CDS or a service encompassing a large geographical area, requires additional management input in order to meet the needs of the service. Where a Senior Dental Officer is responsible for clinical leadership in areas such as Personal Dental Services Pilot schemes, Dental Access Initiatives or other significant CDS projects. The arrangements for transfer from the existing Chief Administrative Dental Officer and associated pay scales onto the new Clinical Director salary scale will also apply to the transfer of all existing post holders onto the new Assistant Clinical Director salary scale. 16 APPENDIX 4 This Appendix should renumbered Appendix 5 and be inserted into and retained in the Terms and Conditions of Service for Administrative Dental Officers and Community Clinical Dental Officers of Regional and District Health Authorities (Health Boards in Scotland) published in September 1987, known as the red book. Terms and Conditions of Service for Specialist Registrars in Dental Public Health The Specialist Registrar Grade 1. A Guide to Specialist Registrar Training was reissued in February 1998 and gives detailed information on the general arrangements for the introduction of, and transition to, the Specialist Registrar grade. It includes guidance on entry to the grade, appointment procedures, short-term and fixed term appointments, flexible training, overseas doctors and leaving the grade. The broad principles of the Guide, and annex 3 in particular apply to specialist registrars in the dental specialities, including dental public health, and therefore should be read in conjunction with this document. 2. NHS Circular PCS(DD)1997/6 introduced terms and conditions of service for public health medicine trainees joining the Specialist Registrar grade during that speciality s transitional period up to 31 March It advised that transition to the specialist registrar grade for trainees in dental public health would take place separately. It was subsequently announced on 7 October 1997 in NHS MEL(1997)68 that the Specialist Registrar grade in dental public health would be introduced from 1st October The NHS Executive advised health authorities, on 15 October 1997, that until new terms and conditions of service for SpRs in dental public health had been negotiated with the dental profession, the previous terms and conditions for senior registrars should continue to be used. This guidance supersedes that advice. Specialist Registrars in Dental Public Health 3. Service and training for Specialist Registrars in dental public health will be controlled by four documents : a. Contract of Employment a legally enforceable two way agreement of the rights and obligations of employer and Specialist Registrar. A new model contract for Specialist Registrars in dental public health conferring national terms and conditions of service is attached at Annex A to this document. Arrangements for the management of the DENTALPAY 1. Amendment No 11 - Dental

17 employment contracts of dental public health trainees should follow that already issued in Annex 3 to the Guide to Specialist Registrar Training, with employment contracts held by health boards. b. Work Programme an adjunct to the Employment Contract setting out specific rights and obligations of employer and Specialist Registrar. This document will be specific to a particular training placement and will be reviewed annually. Periods to be spent in education and service commitments should be specified in the job description. c. Training Agreement. An agreement that should include all the main parties with an interest in the effective delivery of Specialist Registrar training in dental public health the Postgraduate Dental Dean/Director, employer, Specialist Registrar, the training programme director and the chairman of the Deanery dental public health specialty training committee (or Faculty Specialty Adviser in dental public health for the Deanary where there is no specialty training committee). This document should contain an annual forward plan specific to an individual trainee and an agreement to allow the trainee leave to take examinations where achieving the qualification is a necessary part of a structured training programme. Further details are contained in A Guide to Specialist Registrar Training Section 4. d. Educational Contract. An agreement between the Postgraduate Dental Dean/Director and the employer of their responsibilities in providing dental education and training. Under the educational contract Postgraduate Dental Deans/Directors acting on behalf of Scottish Ministers will arrange for employers to provide training for dental public health trainees in the Specialist Registrar grade as required under Section 63 of the Health Services and Public Health Act This arrangement will be a contract under Section 4 of the 1990 NHS and Community Care Act. If there were to be a breach of the terms of the arrangement, the arbitration procedure laid down in Section 4 of the 1990 Act would apply where necessary. The purpose of the educational contract and monitoring arrangements is to form a sound foundation for the relationship between Postgraduate Dental Deans/Directors, employers and Specialist Registrars designed to safeguard educational standards and appropriate levels of training. Tensions between service and educational objectives will be resolved at local level. If necessary, discussion should take place with the employer and the Postgraduate Dental Dean/Director with reference to the contract and training and development plans. The Postgraduate Dental Dean/Director has the power to withdraw recognition and trainees from placements, after appropriate consultation, where training is inadequate. Specialist Registrars should have access to the educational contracts which cover their training programmes. Where a Specialist Registrar is placed with a health authority other than their employer there shall be an agreement between the employing health authority and the placement health authority(ies) (if different) setting out the educational obligations of the placement DENTALPAY 2. 18 health authority in delivering aspects of the Training Agreement. This contract will be shaped by the outcome of the annual assessment of the trainee. e. The National Terms and Conditions of Service for Administrative Dental Officers and Community Clinical Dental Officers of Regional and District Health Authorities, as amended. Tenure of post 4. A dental public health trainee during specialist training shall be known as a specialist registrar. On first appointment as a specialist registrar in dental public health a dentist must meet the minimum entry requirements for the grade set by the Specialist Advisory Committee (SAC) in Dental Public Health of the Joint Committee for Specialist Training in Dentistry (JCSTD), which advises the Specialist Training Advisory Committee (STAC) to the General Dental Council (GDC), the GDC being the sole competent dental authority. The General Dental Council is legally required to decide entry criteria to ensure compliance with the relevant European Primary and Specialist Dental Qualifications Regulations (when enacted). 5. On appointment to the Specialist Registrar grade, a Specialist Registrar will be allocated a National Training number (NTN). This guarantees continued availability of a place in a CCST training programme for dental public health. Training placements will be arranged by the Postgraduate Dental Dean/Director in consultation with employers and with the advice of the Deanery specialty training committee or relevant Faculty specialty advisor in dental public health. The expected outcome of training is the award of a Certificate of Completion of Specialist Training (CCST) but, in some instances (as explained in A Guide to Specialist Registrar Training), trainees may be removed permanently from a training programme. The procedure for appeals against removal from a training programme are detailed in A Guide to Specialist Registrar Training Section The duration of the employment contract will be the duration of the training placement with a particular NHS employer or the duration of the whole training programme where an authority places dental public health trainees with other bodies for training purposes but remains the employer throughout. The contract will specify which period of the CCST training programme it covers (e.g. year 1, year 2 etc.) and refer to the expected overall duration of the Specialist Registrar s participation in the training programme. Section 218(8) and (9) of the Employment Rights Act 1996 and the Employment Protection (Continuity of Employment of National Health Service Employees) (Modification) Order 1996 makes provision for the employment by different NHS employers of Specialist DENTALPAY 3. 19 Registrars undergoing professional training to be regarded as continuous in the circumstances set out in those provisions. The final placement in a training programme will end 6 months after the date of completion of training, or 6 months after the date on which trainees are notified formally by the Postgraduate Dental Dean/Director, taking advice from the SAC in Dental Public Health, that their training is complete and that they are eligible for the award of a CCST, whichever date is the later to allow the Specialist Registrar time to obtain a CCST and secure a consultant post. The employer, on the advice of the Postgraduate Dental Dean/Director, may extend the employment contract in limited, specified circumstances e.g. to cater for changes from and to part time training patterns and for trainees who are making slower but acceptable progress. 7. It is recognised that from time to time the supply of and demand for consultants in dental public health will not be precisely balanced and that it may necessarily take longer than 6 months after completion of training to secure a consultant post. In this event, the Postgraduate Dental Dean/Director, in consultation with the prospective employer, is able to recommend the issue of a new employment contract for a Specialist Registrar placement as described in paragraph 8 below. 8. The employer may issue a new employment contract for a Specialist Registrar placement following the completion of the employment contract during which the Specialist Registrar was notified that CCST training had been completed to those practitioners who have gained a CCST but who have not secured a consultant post. Normally only one new contract will be allowed for a Specialist Registrar placement of a specified limited period. The length of this contract will be decided at the outset, on the advice of the Postgraduate Dental Dean/Director in consultation with the Faculty specialty adviser in dental public health and with the prospective employer and in light of all circumstances relating to the demand for consultants in the specialty. Before qualifying for this limited term arrangement Specialist Registrars must demonstrate that they have done everything reasonable to secure a consultant post. The employer and Postgraduate Dental Dean/Director will have given them reasonable assistance. In this process the Postgraduate Dental Dean/Director will seek advice, where necessary, from the dental public health specialty training committee or, where such committee does not exist, the Faculty specialty adviser in dental public health. The practitioner will be required to undertake training (whether formal or experiential) during the period of this new contract to attract continued funding from the Postgraduate Dental Dean/Director, and a new training contract will need to be prepared. Further details are contained in A Guide to Specialist Registrar Training Section 13. Pay 9. The basic salary will reward 40 standard hours per week exclusive of out-of-hours work, but inclusive of reasonable time for meals. There is a nine-point salary scale (see Annex B) with automatic annual progression through the first seven points. The final two points are discretionary and will be available where : DENTALPAY 4. 20 i. on the due date, a practitioner s training is not complete and the continuation of training is deemed necessary by the Postgraduate Dental Dean/Director and is not due to unsatisfactory performance, or, ii. other circumstances at the discretion of the employing health authority. 10. In addition to the basic salary, supplements for out-of-hours commitments (including attendance at committees and meetings) will be payable at 15% of basic salary. The supplements form part of total remuneration and are payable during periods of annual and study leave. Increment on first appointment to the grade 11. Starting salaries and incremental dates shall be determined as specified in paragraphs of the Terms and Conditions of Service for Administrative Dental Officers and Community Clinical Dental Officers of Regional and District Health Authorities (Health Boards in Scotland)), as amended. Excepting those receiving protection under paragraph 131, credit for service in an equivalent grade shall be limited to a maximum of 4 years in respect of appointments to the grade for the purposes of Specialist Registrar training. 12. Where a Specialist Registrar requests that a period in research or academic dentistry be counted as Specialist Registrar service it is necessary to examine the nature of the research or academic appointment and the preceding and subsequent NHS appointments. If the research or academic appointment was closely related to the Specialist Registrar s programme of higher specialist training, it may be counted as Specialist Registrar service for incremental purposes. Salary Protection 13. Salary protection will be provided where appropriate as specified in paragraph 131 of the Terms and Conditions of Service for Administrative Dental Officers and Community Clinical Dental Officers of Regional and District Health Authorities (Health Boards in Scotland), as amended. 14. Where a Specialist Registrar in Dental Public Health is appointed who, for a continuous period of at least 12 months prior to the appointment, has worked as a general dental practitioner providing general dental services then the starting salary of such a Specialist Registrar shall be no less than the average amount of remuneration derived purely from the NHS, excluding expenses and excluding income from any private work, earned by the Specialist Registrar as a general dental practitioner in the preceding 12 months, provided that that figure does not exceed the maximum amount of salary payable on the Senior Dental Officer salary scale which is current at the time, as notified by the Health Department in the appropriate Circular.. DENTALPAY 5. Amendment No 11 - Dental

Where a Specialist Registrar in Dental Public Health is appointed who, for a continuous period of at least 12 months prior to the appointment, has worked as a dentist within the NHS on a salary [but not an officer in the community dental services for whom paragraph 13 above would apply], then the starting salary of such a Specialist Registrar shall be no less than the salary he or she received in the salaried post immediately before becoming a Specialist Registrar in Dental Public Health, excluding overtime and bonuses, provided that that figure does not exceed the maximum amount of salary payable on the Senior Dental Officer salary scale which is current at the time, as notified by the Health Department in the appropriate Circular. 16. The Specialist Registrar in Dental Public Health should be informed as soon as possible at, or before, the outset of the contract as Specialist Registrar for Dental Public Health that salary protection is available and asked whether previous earnings during the twelve month qualifying period could be of a level where such protection is appropriate: that is greater than the minimum point of the salary scale for trainees in dental public health, which is current at the time, as notified by the Health Department in the appropriate Circular. 17. In order to qualify for salary protection in accordance with the foregoing paragraphs, it is for the Specialist Registrar in Dental Public Health to submit, within six months of taking up the Specialist Registrar post or being informed of the availability of salary protection, whichever is the later, either: i. evidence of the net superannuable remuneration earned from the general dental services during the qualifying period of twelve months, or, ii. (if salaried during the twelve month qualifying period) evidence of salary excluding overtime and bonuses during the qualifying period. 18. Salary protection should take effect from the start of the appointment as Specialist Registrar in Dental Public Health and paid, with any arrears, from the next manageable payroll date following the date when the above evidence of income is provided to the employer. Incremental Dates 19. The incremental date for existing registrars and senior registrars in dental public health who are eligible and chose to transfer into the Specialist Registrar Grade during the transition period for dental public health will remain the same as before transfer, and will not be re-set to the date on which they enter the Specialist Registrar Grade. The incremental date for all practitioners entering the grade will be the date on which they take up their initial Specialist Registrar appointment. DENTALPAY 6. Amendment No 11 - Dental

22 Transition Arrangements 20. Dental public health trainees who, with effect from the dental public health commissioning date, met the entry criteria, will have chosen to either accept a Specialist Registrar employment contract or to retain their existing employment contract and continue their training in the registrar and senior registrar grades. Where they have chosen to retain their existing contracts they will have been issued with a National Training Number. New registrar and senior registrar contracts will be issued after the dental public health commissioning date only if required to enable an existing trainee to complete training or to facilitate movement between regions or a change of employer. If an employment contract which a trainee chose to retain expires before training is completed. the holding of a National Training number will allow them to opt to enter the new grade and a Specialist Registrar contract will be offered to allow training to be completed in the new grade. 21. Dental public health trainees who do not meet the entry criteria retain their existing registrar or senior registrar employment contract until they terminate. The existing employment contract may be extended by at least a further 2 years in order to qualify to enter the Specialist Registrar grade. Flexible Trainees 22. The existing provisions relating specifically to flexible training in the terms and conditions of service will apply to the Specialist Registrar Grade. Further details about flexible training in the new grade is contained in A Guide to Specialist Registrar Training Section 9 and its Interim Dental Supplement. Review 23. The agreements reached on the terms and conditions for Specialist Registrars in dental public health will be reviewed at an opportune point after 1 January Other Terms and Conditions Issues 24. Where existing terms and conditions of service provisions apply equally to the Senior Registrar and Registrar Grades in the Terms and Conditions of Service for Administrative Dental Officers and Community Clinical Dental Officers of Regional and District Health Authorities (Health Boards in Scotland), as amended, they will also apply to the Specialist Registrar Grade. Where existing terms and conditions of service vary in their application to the Senior Registrar and Registrar Grades the following provisions for the Specialist Registrar Grade will apply : DENTALPAY 7. Amendment No 11 - Dental

23 Fees for lectures 25. A fee is payable for lectures to nurses and other non-medical and non-dental staff at the following rates : For lectures given by Specialist Registrars on or above the third incremental point For lectures by other Specialist Registrars Any fees shall be limited to the number of lectures authorised for the subject in question. Contractual Minimum Period of Notice 26. The agreed minimum period of notice by both sides for practitioners in regular appointments shall, unless the statutory minimum periods are longer, be three months. Annual Leave 27. Specialist Registrars shall be entitled to leave at the rate of 6 weeks a year. Study Leave 28. Specific Provision i. Specialist Registrars should receive either day release with pay and expenses to enable them to attend a full/part time approved academic course during the academic element of their appointment; or leave with pay and expenses within a maximum calculated at the rate of thirty days in a year (the year for this purpose being counted from the date of appointment). This allowance may accumulate over the period of the training programme, provided that the total amount due in the period of the training programme is not taken until one year of the training programme has been completed. 24 approved by the SAC in dental public health should form a separate part of the employment contract. ii. iii. Specialist Registrars shall, in respect of the Inter-Collegiate Assessment for a maximum of two occasions, also receive leave with pay and expenses (other than examination fees) for the purpose of sitting an examination for a higher qualification where it is necessary as part of a structured training programme. Specialist Registrars may also receive leave with pay and expenses (other than examination fees) for the purpose of sitting other examinations for a higher qualification or for further attempts (beyond two) at the Inter-Collegiate Assessment. The authority may refuse leave where they consider this would be contrary to the interests of the individual or the service, (for example, repeated sitting and failing of the same examination could be held to be an unjustifiable use of the paid leave). Section 218 (8) and (9) of the Employment Rights Act 1996 and the Employment Protection (Continuity of Employment of National Health Service Employees) (Modification) Order 1996 makes provision for the employment by different NHS employers of Specialist Registrars undergoing professional training to be regarded as continuous in the circumstances set out in those provisions. 5. The placement is subject to the Terms and Conditions of Service of Specialist Registrars in dental public health as amended from time to time. 6. The appointment is pensionable and your salary is subject to deduction of superannuation contributions in accordance with the NHS (Superannuation) Regulations 1980 unless you opt out of the scheme. Details of the NHS scheme are given in the scheme guide, which is enclosed. 7. (a) Your duties are defined in the attached job description.
