1 VIA ONLY December 27, 2016 Alaska Oil and Gas Conservation Commission 333 West 7th Avenue, Suite 100 Anchorage, Alaska RE: SUPPLEMENTAL COMMENTS ON THE PROPOSAL TO REQUIRE PUBLIC NOTICE & COMMENTS ON HYDRAULIC FRACTURING PERMITS Dear Commissioners: Thank you for the opportunity to present before the Commission on December 15, and for taking public comment on Inletkeeper s proposal to require public notice and comment on hydraulic fracturing permits. Please accept these comments as a supplement to Inletkeeper s public testimony and its September 19, 2016, written comments. As a threshold matter, it s important to recognize the Alaska Legislature has wisely made it the policy of the state that the people's right to remain informed shall be protected so that they may retain control over the instruments they have created 1 The Legislature has also found that minimiz[ing] the adverse impact of exploration, development, production, and transportation activity is in the best interest of the state and its residents. 2 Together, these policies create a strong presumption for public engagement in oil and gas activities generally, and hydraulic fracturing operations specifically. This position is further strengthened by the fact many if not most fields where fracturing is planned or may occur receive sizable public subsidies, in the form of tax credits, royalty reductions and/or other mechanisms, and as a result, Alaskan residents are directly invested in these operations. As previously discussed, there are currently no opportunities for Alaskans to review and comment on site-specific hydraulic fracturing operations. While some may consider public involvement a nuisance and a vehicle for delay, the fact is there s legitimate public concern regarding fracturing operations, and public notice and comment can help educate residents about potential risks and benefits. And as discussed during my testimony, this process need 1 AS (a)(5). 2 AS (a)(2)(ii).

Attached please find a statement supporting public notice and comment on hydraulic fracturing permits from nearly 450 Alaskans. 3 In closing, I m compelled to note the tone and tenor of the AOGCC hearing on December 15 lacked civility and professionalism. Inletkeeper has sought to address the issues herein with respect and integrity, and we ask only for similar treatment in return. 3 Dear Alaska Oil and Gas Conservation Commission, Please amend your rules to provide public notice and the opportunity to comment on all hydraulic fracturing applications in Alaska. Fracking has been implicated in a variety of health and environmental problems in the Lower 48, and Alaskans are rightly concerned about the pollution and climate change impacts posed by fracking. The AOGCC already affords public notice and comment for a variety of authorizations, and Alaskans have a right-to-know about fracking operations which may impact our public lands and waters. Please amend your rules and give Alaskans a voice in oil and gas development.
