1 Claims That Can Get You in Trouble What s New in Advertising Claims for Dietary Supplements Steve Mister President & CEO, CRN

2 FTC Requirements for Advertising Claims must be truthful, not misleading and substantiated with adequate support Competent and reliable scientific evidence Applies to express and implied claims Flexible standard for evidence FTC also has authority to challenge unfair trade practices that cause or likely to cause substantial injury to consumers Sections 5, 12, and 15 of the FTC Act 2

3 Competent and reliable scientific evidence defined as tests, analyses, research, studies, or other evidence based on the expertise of professionals in the relevant area, that have been conducted and evaluated in an objective manner by persons qualified to do so, using procedures generally accepted in the profession to yield accurate and reliable results. 3

4 Lane Labs 2000 FTC case with LaneLabs for BeneFin and SkinAnswer FTC found Lane Labs to have misled consumers and required a consent decree Standard consent order admitted wrongdoing and promised not to sin again 4

5 The Consent Decree The decree forbade express or implied misrepresentations regarding the existence, contents, validity, results, conclusions, or interpretations of any test, study or research in connection with the manufacturing, labeling, advertising, promotion, offering for sale, sale, or distribution of any food, dietary supplement, or drug. Lane Labs must refrain from making any representation about the effect of [a] product on any disease or disorder, or the effect of such product on the structure or function of the human body, or about any other health benefits of such product, unless, at the time the representation is made, it possessed and relied upon competent and reliable scientific evidence that substantiates the representation. Classic fencing in language to prevent future violations 5

6 Fast forward to 2009 Lane Labs New FTC action against Lane Labs -- AdvaCal and Fertil Male FTC argued that LL violated the earlier consent decree, but NJ federal court held that scientific minds could differ studies presented were competent and reliable scientific evidence. FTC announced the standard consent order language would change! 6

14 FDA Requirements for Labeling Claims Dietary Supplements may make nutrient content claims, structure/function claims, and with FDA approval, certain health claims. Supplements may not make claims to prevent, treat, cure, diagnose or mitigate a disease. Mfrs of dietary supplements must posses substantiation that any claims they make are truthful and not misleading 21 U.S.C. 343(r)(6). 14
