ANCO and the Medical Oncology Association of Southern California (MOASC) are members of the California Medical Association s (CMA) Council on Legislation, House of Delegates, and specialty delegation. ANCO meets regularly with these and other organizations to discuss issues of importance to hematology/oncology practices and people living with cancer. We continually seek input from members on agenda items for these meetings. Send your issues to the ANCO office.] ACCC, ASCO, ASH, COA, and National Legislative & Regulatory Issues Medicare claims processing contractors (MACs) have published the 2015 Medicare Physician Fee Schedule on their websites and released 2015 claims for payment. The legislation Congress passed in early 2014 creating another patch for the fundamentally flawed Sustainable Growth Rate (SGR) formula for reimbursing physicians under Medicare also delays the adoption of the ICD-10-CM coding system. CMS has confirmed that ICD-10-CM will be implemented on October 1 st. ASCO s ICD-10 resources are available at ASCO encourages practices to continue preparing for the transition to ICD-10-CM. Physicians that do not participate in the Physician Quality Reporting System (PQRS) in 2014 will face a 2% cut in Medicare payments in In addition, the practice may face a further 2% cut because of the value-based modifier (VBM). ASCO has signed a contract with CECity to provide a substantial discount to eligible professionals (EPs) who use CECity s CMS-approved PQRSwizard registry to fulfill their 2014 reporting requirements. Finally, CMA has created a new resource entitled Medicare Incentive and Penalty Programs: What Physicians Need to Know available at CMA, MOASC, and State Legislative & Regulatory Issues The California Oncology Political Action Committee (or CalCancerPAC), formed by ANCO and MOASC, supports candidates sensitive to the needs of hematologists/oncologists and people living with cancer in California. ANCO membership dues include a contribution to CalCancerPAC. SB128, The End of Life Options Act, has been introduced in the State Senate. The bill would give patients with terminal illnesses the right to seek life-ending medication from their doctor and requires that the medication

3 Page 3 of 9 ANCO FAX News ( January 23 rd, 2015 be self-administered; that the patient be mentally competent; that two physicians confirm the prognosis that the patient has six months or less to live; that the patient s physician discusses alternatives and additional treatment options; that the patient submits a written request and two oral requests made at least 15 days apart; and, that two witnesses attest to the request. Pharmacists and physicians would be given legal immunity for participating and would be able to opt out. The Department of Insurance has issued an emergency regulation that establishes stronger requirements for health insurers to create and maintain sufficient medical provider networks to provide timely access to medical care. The regulation strengthens current rules and regulations and adds new medical provider network requirements. For more information, go to /january /#1. CMA is interested in hearing from practices that have experienced difficulties using the new Prescription Drug Authorization Form that became effective October 1 st. If your practice has run into any problems with the form itself, integration into your EHR, submission of the form to the payor, multiple requests for medical records from the payor, delays in processing by the payor, etc., please contact CMA at (916) or economicservices@cmanet.org to share your experience. Many bills impacting medicine wind their way through the Capitol on their journey to the Governor s desk. And, many of these bills threaten the medical profession with the backing of powerful lobbyists and PACs. It s critical that physicians have an advocate at work for them every day and who knows how to speak on their behalf. That advocate is the California Medical Association (CMA). While physicians keep a close eye on their patients, CMA is keeping a close eye on those bills and more. Got payment delays? Feeling victimized by payers and overwhelmed by the process? Noridian/JEMAC is requiring physicians to revalidate their Medicare enrollment and will continue reaching out to physicians notifying them of the need to revalidate through March 23 rd. Physicians who receive a request for revalidation must respond within 60 days or face the possibility of being deactivated. Do not do anything until you get a letter instructing you to revalidate. If you are listed and have not received the request, then contact Noridian/JEMAC at (855) Medicare Recovery Audit Contractors (RACs) identify fraud and waste in the Medicare system. Audit contractors are expected to focus on companies and individuals whose billings for specific Medicare services are higher than the majority of providers in their communities. RAC auditors are limited as to the number of patient records they can request (see recovery-audit-program/). CMA has developed a tool kit to help physicians understand the program and, if necessary, navigate the audit process. The tool kit is available free to CMA members. Until the implementation of ICD-10 on October 1 st, the ICD indicator 9 must be included when submitting an ICD-9 diagnosis code. Claims that do not include the ICD indicator will be returned via the Resubmission Turnaround Document (Form 65-1). Anthem (formerly Wellpoint) is offering California oncologists a monetary incentive for each patient who receives treatment for breast, colorectal, and lung cancers, and some hematological malignancies as specified by one of the insurer s recommended regimens. Sign up at Clinical Trial News A new report from the Institute of Medicine provides recommended guidelines about what data should be shared at key times in a clinical trial. In its report, Sharing Clinical Trial Data: Maximizing Benefits, Minimizing Risks, an IOM committee concludes that sharing data is in the public interest, but a multi-stakeholder effort is needed to develop a culture, infrastructure, and policies that will foster responsible sharing. ASCO and its wholly owned subsidiary CancerLinQ LLC will use the SAP HANA platform in the development of ASCO s CancerLinQ, a groundbreaking health information technology (HIT) platform that will harness Big Data to deliver high-quality care to patient with cancer. It is one of the only major cancer data initiatives being developed and led by physicians with the primary purpose of improving patient care. When complete, CancerLinQ is expected to unlock real-world patient care data from millions of electronic health records and more securely process and analyze the data to provide immediate highquality feedback and clinical decision support to providers. The first version of CancerLinQ is scheduled for release in late Marin Cancer Care, an ANCO member practice, is among eight oncology practices around the United States that have signed agreements with CancerLinQ to provide patient records for the first version of CancerLinQ. ASCO and the American Association of Cancer Research (AACR) released a joint statement outlining a guide for policymakers to minimize the negative consequences of ecigarettes without undermining their use as a smoking cessation tool. Read the statement at CMS has approved ASCO s Quality Oncology Practice Initiative (QOPI) as a pathway for oncologists to meet the agency s quality reporting requirements.
