They plan to restrict all flavored ENDS products (other than tobacco & menthol) from being sold in places that are not age-restricted, increase online sales verification, eliminate most flavored cigars, restrict ENDS marketing to youth, and eventually ban menthol from combustible tobacco products. FDA is seeking public comment on eliminating youth e-cigarette use, with a focus on cessation support by Feb 1, TFW Leadership plans to submit a comment and will forward to TFKC Leadership. Tobacco Free Parks & Trails We are moving forward and have the support of several City Council Members and city staff. TFW Leadership members will be meeting with Park & Rec staff soon. A campaign calendar draft will be created and distributed to ensure we are taking advantage of opportunities and prepared for obstacles. April 22 nd is Earth Day. TFW could plan an event in place of our usual meeting on 4/19. Media blitz in a park or something flashy. TFW Leadership to draft and submit public comment to FDA by Feb 1, Meet with Troy Houtman, Director of Wichita Park & Rec to discuss possibilities and next steps. Partner Updates Elena is building our local resist youth chapter that will assist with TFW s tobacco free parks & trails initiative, retailer efforts, and statewide T21 advocacy. edevora@kafponline.org Lisa suggested a few edits to the Parks Summary page. Lisa asked about other city properties, such as the new library & stadium. They have cigarette receptacles close to the entrance. Carolyn know the Library Director and can reach out to her. Everyone agreed we should draft a letter to the library. Raise the Age KS: Tobacco 21 TFW is supporting the statewide effort, as many local decision makers are not supportive of T21 as a local ordinance. Wichita will be an important voice during the upcoming legislative session, so it will be important for TFW to lead local advocacy efforts. TFKC has an online Individual/Organization Support form that can be signed, you will receive updates. With some of the new leadership in Topeka, it is unclear if a bill will be presented or if efforts will focus on education with a goal for the 2020 session. Upcoming Events/Announcements Resist Youth Chapter meeting Sat, Jan 26 th to plan Kick Butts Day activities and discuss upcoming events. Community Health Promotion Summit will be held Jan in Manhattan. Kim, Tara, Elena & Lisa will be attending. We will share resources from the breakout sessions. TFW Thunder Hockey Night March 23 rd TFW s youth will be sharing resources and heading out on the ice in celebration of Kick Butts Day. We are looking for volunteers. Open Streets ICT NOMAR May 5 th TFW has been invited to participate in the next event! The event will close 21 st Street North from Broadway to Woodland Park. We will plan an event in the park. Vi & Paulyna, Friends University, mentioned that they are looking for new ways to engage and inform students and visitors about their tobacco free grounds policy and the harmful effects of tobacco. TFW Leadership will be sending a Coalition Member Assessment survey link for anonymous feedback. Results will be shared in April. Elena will update the Parks Summary page. Tara will check on the City of Wichita s ordinance to see if they adopted the 25 from entrances. TFW will send a letter to the library. Kim will check with the city staff re: the stadium. Tara will share TFKC s T21 materials as soon as they are made public! District 4 Southview Park Over 70 cigarette butts District 2 Eastview Park containers, wrappers, lighters, etc.) Tobacco litter was located within a 20-foot perimeter of a park playground in each of the six Wichita City Council districts and Sedgwick County Park. Litter was collected using nitrile gloves and ziplock bags for skin protection. A flag was placed to mark the location of each piece of collected tobacco litter. At the close of the scan, all flags were collected & litter was properly disposed. The time spent cleaning each park is approximately 1 hour. TFW defines tobacco litter as any item associated with the use of tobacco (cigarette butts, Our Process: TFW RESIST members, Mayor s Youth Council, and adult volunteers collected over 1,348 cigarette pieces of litter seven area parks and trails. The purpose is to demonstrate the amount of litter near children playing & the dangers tobacco poses to families visiting our parks Environmental Scans

6 FDA Commissioner Scott Lieb One of highest priorities Flavored ENDS products that are not sold in an age-restricted, in-person location. o Have all flavored ENDS products (other than tobacco, mint and menthol flavors or non-flavored products) sold in age-restricted, in-person locations. All ENDS products, including e-liquids, cartridge-based systems and cigalikes, in flavors except tobacco, mint and menthol, would be included. o To advance this goal, the FDA is revisiting the compliance policy on PMTA authorization for such flavored products sold in physical locations where people under the age of 18 are permitted. o The FDA is not revisiting the compliance policy with respect to ENDS products sold exclusively in age-restricted locations such as a vape shop) that adequately prevents persons under the age of 18 from entering the store at any time; or, a section of an establishment that adequately prevents entry of persons under the age of 18 and the flavored ENDS products are not visible or accessible to persons under the age of 18 at any time. o At this time, ENDS products with tobacco, mint or menthol flavors, as well as any non-flavored ENDS products, sold in any location, would not be included in any policy revisions. o The FDA, however, will not ignore data regarding the popularity of mint- and menthol-flavored ENDS among kids. We will continue to use all available surveillance resources to monitor the rates and use patterns among youth and adults for these products, and we will reconsider our policies with respect to these products, if appropriate. Flavored ENDS products (other than tobacco, mint and menthol flavors or non-flavored products) that are sold online. o Curtail the sale of applicable flavored ENDS products that are sold online without heightened age verification processes. o The FDA will be working to identify these heightened measures for age verification and other restrictions to prevent youth access via online sales. These best practices would be available soon, so sites can quickly adopt them. Flavored cigars. o Eliminating flavors from cigars would likely help prevent cigar initiation by young people. o I believe flavored cigars should no longer be subject to the extended compliance date for premarket authorization regardless of the location in which the products are sold. o The FDA s proposal to revisit the compliance policy for flavored cigars that are new tobacco products does not apply to the entire product category, as some

7 products were considered grandfathered. Accordingly, the FDA intends to propose a product standard that would ban flavors in all cigars. ENDS products that are marketed to kids. o The FDA will pursue the removal from the market of those ENDS products that are marketed to children and/or appealing to youth. This could include using popular children s cartoon or animated characters, or names of products favored by kids like brands of candy or soda. Menthol in combustible tobacco products. o Informed by the comments from our ANPRM, the FDA will advance a Notice of Proposed Rulemaking that would seek to ban menthol in combustible tobacco products, including cigarettes and cigars. o started this process several years ago; will accelerate the proposed rulemaking process to ensure that our policies on flavored tobacco products protect public health across the continuum of risk.
