2 Description of the Office of the State Auditor The Office of the State Auditor serves as a watchdog Minnesota taxpayers by helping to ensure financial integrity, accountability, and cost-effectiveness in local governments throughout the state. Through financial, compliance, and special audits, the State Auditor oversees and ensures that local government funds are used the purposes intended by law and that local governments hold themselves to the highest standards of financial accountability. The State Auditor perms approximately 250 financial and compliance audits per year and has oversight responsibilities over 4,300 local units of government throughout the state. The office currently maintains five divisions: Audit Practice - conducts financial and legal compliance audits local governments; Government Inmation - collects and analyzes financial inmation cities, towns, counties, and special districts; Legal/Special Investigations - provides legal analysis and counsel to the Office and responds to outside inquiries about Minnesota local government law; as well as investigates allegations of misfeasance, malfeasance, and nonfeasance in local government. Pension Oversight - monitors investment, financial, and actuarial reporting over 700 public pension funds; Tax Increment Financing (TIF) - promotes compliance and accountability in local governments use of TIF through financial and compliance audits; The State Auditor serves on the State Executive Council, State Board of Investment, Land Exchange Board, Public Employee s Retirement Association Board, Minnesota Housing Finance Agency, and the Rural Finance Authority Board. 7 2004 Criminal Forfeitures Overview Minnesota criminal statute , subd. 6, directs law encement agencies to report to the State Auditor all property seized subject to feiture, with the exception of DWI related feitures. 1 This report provides inmation on the amount of cash and property seized subject to feiture in Forfeitures are considered complete in the year in which a final decision is rendered on the seized property regardless of the date the property is initially seized. At that time items are sold, retained law encement purposes, destroyed, warded to other law encement agencies, or returned to the owner. In previous years, reporting only encompassed those incidents involving mal court proceedings where the property was feited by court order (judicial action). The statute clearly states that all feiture incidents must be reported. This includes administrative feitures. The State Auditor clarified that a feiture incident, reporting purposes, includes property that is seized with the intention of feiting it, regardless of the final disposition. For example, an agency could seize a vehicle due to a fleeing offense and prepare to feit the vehicle. If it is discovered that the person who fled in the vehicle was not the owner, the vehicle may be returned to the owner but would still be reported as a feiture incident as the original intention was to feit the vehicle. In November of 2003, the State Auditor sent new ms to all law encement agencies reminding them of the reporting requirements and provided new ms that clarified the type of incidents they should report. Seized Subject to Forfeiture In 2004, 186 Minnesota law encement agencies reported a total of 4,660 incidents of property seized subject to feiture to the State Auditor 3. There were 2,025 more feiture incidents reported in 2004 than in 2003, a 77.0 percent increase. 4 The reported amount of total gross sales of feited property totaled $3,130,577, with total administrative expenses and lien holder s obligations totaling $188,275. This means that total net proceeds totaled $2,942,302. Tables 1 and 2 illustrate all property seized subject to feiture listed by agency and by total net proceeds. 1 Criminal and firearm feitures area authorized by Minnesota Statutes DWI offenses are done pursuant to Minnesota Statute 169A.63 and are not reported to this office. 2 In previous years, firearms were analyzed separately from other feiture incidents because the Minnesota Department of Planning collected other qualitative inmation about firearms that was not part of statutory reporting. Beginning in 2003, firearms are analyzed together with all other property and collected on the same m. 3 Some feiture incidents submitted were incomplete to the extent that there was not enough data on the ms to include them. Agencies with incomplete inmation were contacted follow up. The feitures those agencies that did not respond are not included. While most feiture incidents are complete, there are a few missing some inmation, but not enough to warrant removal. An example is firearms reported by the Minneapolis police department do not have seizure dates but are otherwise complete. 4 This large percentage increase may not necessarily indicate a true increase in the number of feitures, but rather is most likely the result of a concerted eft by the State Auditor s Office to inm agencies of their statutory responsibility in reporting feiture incidents. It is still likely that more agencies are completing feiture incidents and not reporting them to the State Auditor s Office. 1 1

8 Net proceeds involving agencies receiving cash or selling property ranged from negative $3,540 to $69, Net proceeds per feiture averaged $951. Of the 4,660 feitures reported, 2,861 were cash or sold property. Table 3 illustrates net proceeds distribution by cash and property sold, sorted by net proceeds. An analysis of the net proceeds of these incidents in which the agency received funds cash, property, or other reasons showed the following: 609 (21.2 percent) feitures were less than $100 (including losses). 1,150 (40.2 percent) feitures ranged from $100 to $ (17.0 percent) feitures ranged from $500 to $ (18.4 percent) feitures ranged from $1,000 to $4, (3.0 percent) feitures were greater than $5,000. The following chart shows the type of property seized subject to feiture in Cash accounted 50.0 percent of property seized, followed by firearms (32.6 percent), vehicles (16.3 percent), other property (1.5 percent), jewelry (0.5 percent), and houses (0.1 percent). Agencies also received cash property returned to an owner by agreement, where owners would pay a set amount agreed upon by both parties. 2 2

9 Criminal activity involving a controlled substance accounted 3,569 (76.1 percent) of the 4,687 feiture incidents reported in The remaining incidents involve fleeing, murder, theft, weapons, prostitution, assault, robbery, criminal sexual conduct (CSC), criminal vehicular homicide (CVH), and other crimes. Forfeiture Incidents by Drugs Weapons Assault Other Fleeing Theft Robbery Burglary Murder Prostitution CSC CVH State Proceeds From Criminal Forfeitures Pursuant to Minnesota Statutes, , subd. 5, cash or proceeds from the sale of feited property are distributed in the following manner: 70 percent to the appropriate law encement agency; 20 percent to the county attorney or other prosecuting agency that handled the feiture; and 10 percent to the Department of Finance. 6 In 2004, 4,056 incidents resulted in feitures, 265 resulted in an agreement, 263 incidents resulted in court ordered return to the owner, and 76 resulted in other disposition. Of the 4,056 incidents that resulted in a feiture of property, the net amount distribution was $2,555,231, of which 10 percent goes to the state Victim s Compensation Fund. Agreements that are completed by the agency and the property owner may involve the agency keeping 100 percent of the proceeds, or the relevant county or city attorney receiving 20 percent of the proceeds. Those types of agreements result in no funds being warded to the state. 10 property bee the feiture incident is completed and have no proceeds to distribute. Criminal Forfeiture Activity By Law Encement Agency The 186 law encement agencies reporting criminal feiture incidents in 2004 included county sheriff s departments, city police departments, various drug task ces, the Minnesota Gang Strike Force, the Minnesota State Patrol, and the Bureau of Criminal Apprehension. Forty-six more agencies reported feiture incidents than in The agencies with the most feiture incidents in 2004 were; Minneapolis Police Department (1,404), St. Paul Police Department (319), and the Minnesota State Patrol (291). Forfeiture incidents are an infrequent occurrence most law encement agencies, with many smaller agencies warding feiture incidents to a narcotics task ce. Forfeited Destroyed, Retained, or Forwarded to Another Agency In addition to selling feited property, law encement agencies have the authority, to destroy property that is harmful to the public, to retain property official use by the agency, or ward property to a federal agency (usually the Drug Encement Administration). The value of property used law encement is not included in the net proceeds of criminal feitures or the funds transmitted to the Department of Finance until the property is sold. In 2004, 101 feiture incidents resulted in property being retained, and 944 resulted in property being destroyed. was warded to another agency 259 times, while 32 feitures went to resolve liens against the property. Law encement agencies working on a case often share the cash proceeds from drug-related criminal feitures. The cash proceeds are divided among the cooperating agencies after the proceeds are distributed in accordance with Minnesota Statute , subd. 5. This is most apparent in narcotics task ces, where proceeds are split amongst the contributing agencies. Agencies Reporting No Forfeitures in 2004 Not all law encement agencies in the state process property feiture. For 2004, 118 agencies reported that they did not process any property under the feiture statutes (see Appendix 1). As previously mentioned, this does not include DWI related feitures. This does not mean that feitable offenses do not occur in these jurisdictions, but rather it is often costprohibitive these agencies due to their limited size. 11 the task ce in their jurisdiction. Appendix 2 contains a map of the narcotics task ces throughout the state. Recommendations It is apparent that the true extent of feitures is still not complete in the state. This is based on conversations that occur on a regular basis with law encement agencies and staff at the State Auditor s office. Many agencies are still unaware of not only their reporting obligations, but also their requirement of remitting feiture proceeds to the state where applicable. As the intent of the feiture reporting legislation was to track the nature and extent of feitures in the state, the State Auditor has the following recommendations to ensure that this intention is met. #1 -- Law encement agencies should ensure that there are written policies and procedures feiture reporting in their offices. Many agencies have high turnover rates in the position that is responsible tracking feitures. As a result, there is often a gap in reporting when a new staff person is given the duties. Often, it is not communicated to the new staff person the required details the reporting feitures. The State Auditor recommends that law encement agencies develop written polices and procedures so that any staff responsible reporting feitures will have a clear understanding of the requirements to ensure that the agency is complying with the law. #2 -- City and county officials should ensure that law encement agencies under their jurisdiction are reporting their feitures by classifying feiture proceeds as a special revenue fund. Since the intent of the feiture legislation is to track the nature and extent of feiture activity, the State Auditor recommends that feiture proceeds be removed from general fund activity and placed in a special revenue fund or, at a minimum, in segregated accounts within the general fund with separate department or program numbers all assets, liabilities, revenues and expenditures of the feiture activities. This way the true revenues and expenses from feiture related activity could be clearly tracked by the agency, the local government entity, the legislature, and the taxpayer. Local officials would also be able to remind law encement agencies of their legal obligation to remit funds and report their feiture activity. DWI related feiture activity should be classified in a different special revenue fund, or different set of department or program accounts within the general fund. 5 5
