Sealed tenders are invited under Two bid system (Part-I Earnest Money and Technical bid & Part-II Financial bid) from prominent Tenderers, who having running experience in Patient Diet Kitchen/Catering Services in a reputed organization (preferably in Hospitals) for at least three years in one or more hospitals of repute having minimum of 100 beds. 2. The cost of Tender Document is Rs.525/-(Five Hundred Twenty Five only) (Non Refundable) including VAT@5%.Tender document can be had in person from the undersigned on any working day from to during 10:00 to Hrs on payment of said cost in the form of Demand Draft in favour of Director, AIIMS Bhopal, payable at Bhopal. Cheque/Cash will not acceptable. The Tender Document can also be downloaded from the AIIMS website ( In this case it is necessary for the Tenderer to pay the cost in the form of Demand Draft drawn in favour of Director, AIIMS Bhopal, payable at Bhopal and is kept in the Technical Bid Envelope. The reference of the DD is to be super scribed on the main envelope of Technical Bid. 3. The Parties interested for any clarification, requested to attend the Pre-Bid Conference on 28 th March 2014 at 1500 Hrs. and also should send their Pre Bid enquiries (if any) through to stores@aiimsbhopal.edu.in before upto Hrs.. The Pre-Bid clarification will be uploaded by upto Hrs. on AIIMS Bhopal website copy of clarification downloaded should be enclosed, duly signed and stamped along with Technical Bid Document in Technical Bid Envelope during submission of bids to AIIMS Bhopal. However, Bidders, who want to visit the site location where the Patient Diet Kitchen will require running are allowed to visit the AIIMS Bhopal under intimation to Store Officer. 4. The amount of Earnest Money Deposit (EMD) is Rs.60,000/-(Sixty Thousand only ) (Non-Interest bearing). Since it is a complete Patient Diet Kitchen Service Contract, tender for any or part of the required services will not be accepted. The rate of the total Patient Diet Kitchen Service Contract package will ONLY be considered. The Bidder along with other documents in the Technical Bid MUST submit a declaration on the letter head of the Company to the effect that they are participating in the bid for the total 250 bed Hospital Patient Diet Kitchen Service Contract Package in the AIIMS Bhopal, Saket Nagar, Bhopal. In the event of non-submission of the same with the Technical Bid, the Bidder will be disqualified and the Financial Bid of such bidder shall not be opened. Earnest money deposit is compulsory for the requirement list given in Chapter- Tender No.90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.6 )

7 7 of this Tender Enquiry Document by any bidder want to participate in this Tender. The Bidder is required to deposit Earnest Money along with their Technical Bid document in Technical Bid Envelope in the form of Demand Draft/FDR from any Nationalized Bank and the same should be drawn in favour of Director, AIIMS Bhopal payable at Bhopal. Any tender without EMD would be considered as "DISQUALIFIED" and hence would be REJECTED. 5. The Tenderer is required to prepare two sealed cover super scribed as (i) Cover-I- Technical Bid, and (ii) Cover-II Financial Bid. Both covers should be kept in one main sealed cover super scribed as Tender for Providing Kitchen Services on Contract basis for 250 Bedded Hospital at AIIMS Bhopal due on The tenderer has to drop the cover sealed in above manner in the Tender Box kept at the Office of the Store Officer, 1 st Floor, E-Wing, Medical College Building, AIIMS Bhopal, Saket Nagar (MP) on or before by Hrs. positively. The tender shall not be accepted beyond the stipulated date and time under any circumstances whatsoever. 7. The Technical bid will be opened on the same day at hrs by a Committee constituted by the Competent Authority of AIIMS Bhopal, in its office in the presence of the Tenderers or their authorized representative who wish to be present. The date and time for opening of financial bids of the technically qualified tenderers shall be communicated later as per convenience of this office. 8. The Competent Authority of AIIMS Bhopal reserves the right to reject/cancel any or all the tenders at any time or to relax/amend/withdraw any of the terms and conditions as contained in the Tender Documents without assigning any reason, thereof. Any inquiry after submission of the tender will not be entertained. 9. Bidders shall not approach for refund of EMD till the finalization of the tendering process and award of contract to qualifying Tenderer. The offer should remain valid from the date of opening of the Tender (i.e. Technical Bid) for a minimum period of 3 Months. EMD shall be refunded to the unsuccessful bidders within 30 days of award of contract to the successful bidder. 10. AIIMS Bhopal reserves the full rights to increase/decrease the number of Patient Bed in the time of award of Patient Kitchen Service Contract to successful tenderer as per requirement. 11. 9 Chapter I GENERAL INSTRUCTIONS TO BIDDERS 1. Scope of Work: The Patient Diet Kitchen service shall be meant for serving & making meals only for patients admitted in the Hospital as per the written instructions of Hospital Dietician/Ward Sister-In-Charge at AIIMS Bhopal, Saket Nagar, Bhopal (MP). It includes providing all raw material like Grocery, Spices, Fresh Vegetables, Fresh Fruits, Egg, Milk, Utensils, Cooking Burners range, LPG Cooking Gas, Working Tables, Kitchen Equipment, Garbage/Kitchen waste collection bins, Garbage/Kitchen waste disposal etc. for preparation of Food) and required the distribution of the prepared fresh Food items to the Patients Wards in each Patient Bed wise with efficient Patient Diet Kitchen Manpower and Supervisory Management necessary for the smooth running of Patient Diet Kitchen Services as per the approved Time Schedule of Diets given by the Competent Authority of AIIMS Bhopal from 6.00 am to pm x 7 day basis for a period of one year from the date of commencement of award. If the performance is found satisfactory, the contract will be extended further for a period as may be agreed mutually (not beyond 1 year) by both the parties. Participating Bidders, who are in this business are well aware that diets are different for different categories of patients. There are three major categories of patients: 1. Those who can eat normal foods like rice, breads, eggs, fruits etc 2. Those who can eat semisolid foods like khichadi, dalia etc 3. Those who are very sick (n= patients) and can take only liquid diet (mil or curd based with about Kcal/ml energy). It may be high protein or low protein diet depending on patients (modification can be done under the guidance of dietitian) 2. Tenderer shall visit the site: Intending tenderer shall visit the Hospital Patient Diet Kitchen Site and make himself thoroughly acquainted with the site condition, nature and requirements of the work, facilities of transport conditions, effective labour and materials, access and storage for materials and removal of rubbish/kitchen waste. The rate quoted by the contractor shall take care of all contingencies required for operating efficient Patient Diet Kitchen Services as per the approved Time Schedule of Diets given by the Competent Authority from 6.00 am to pm X 7 day basis to the entire satisfaction of the AIIMS Bhopal. The successful tenderer will not be entitled to any claim of compensation for difficulties faced or losses incurred on account of any site condition which existed before the commencement of the work or which in the opinion of the AIIMS Bhopal might be deemed to have reasonably been inferred to be so existing before commencement of Patient Diet Kitchen Services Contract. 3. Eligible Bidders: This invitation for Bids is open to all eligible bidders, who deals in the Patient Diet Kitchen/Catering Services in a reputed organization (preferably in Hospitals) for at least three years. (i) Tenderer should have a minimum average annual turnover of Rs.15 Lakh per year in the last 3 financial years i.e , and Tender No. 90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.9 )

10 (ii) Copies of work orders and certificate of satisfactory Completion of work shall be submitted from reputed Hospitals / Hotels / Institutions / Organizations/ Public Sector undertaking / State or Central Govt. departments or undertakings etc. for the work done during the last 3 financial years as stated above. In case, the work done is for private organization, TDS certificate shall be submitted in support of work completion certificate issued by the private organizations. The Minimum qualification requirement for eligibility to be seen at Chapter-2, General Terms and Conditions in this Tender document. 4. Bid Validity, Currency of Contract, Price remain valid for One Year:-All tenders should remain valid for acceptance for a period of Twelve months from the date of opening of the tender or for such period as stated in Chapter-2, Special Terms & Conditions. (i) The contract / tender, if awarded, shall be valid initially for ONE YEAR from the date of award of Contract or deployment of Patient Diet Kitchen staff recruited by the Contractor at AIIMS Bhopal, whichever is earlier subject to continuous satisfactory performance and on failure on this aspect by the Contractor, the Competent Authority will reserve the right to terminate the contract. (ii) The rate quoted by the selected Agency, and as approved by the AIIMS Bhopal, shall remain valid throughout the period of contract and the request for increase the rates for any reason, during the currency of contract (i.e. for initial period of 1 year from start of the Patient Diet Kitchen Services at AIIMS Bhopal), shall not be entertained at any stage. The rates once accepted by the AIIMS Bhopal shall remain unaltered throughout the period of contract, including any extended period. (iii) The period of the contract can be extended for further period at the discretion of the Competent Authority, to a maximum of one year, on terms and conditions of the hospital, while accepting the tender. However the Competent Authority of AIIMS Bhopal on his discretion can increase the price up to maximum 10% of the rate quoted, if it is felt that there has been excess genuine price rise in dietary items in than prevailing market on receiving the written request from Contractor, supported by the such documentary proofs. (iv) Quotations qualified by such vague and indefinite expressions such as subject to immediate acceptance ; subject to prior sale etc. will not be considered. (v) A bid submitted for a bid validity of shorter period may be rejected as non-responsive. (vi) Late Bid: Any bid received by the AIIMS Bhopal after dead line as prescribed in the tender notice will be treated as late bid and will not be considered. (vii) Acceptance and Rejection of the Bid: The right to shortlist/reject any or all the tenders and/or to accept the whole or any part of the tenders without assigning any reason whatsoever will be vested upon the Committee as would be constituted by the Director, AIIMS Bhopal for the purpose. Opening of Tenders: The tenders will be opened on the same day (i.e. on ) in Office Room of the Designated Officer at 1 st Floor, Medical College Building, AIIMS Bhopal, Saket Nagar, Bhopal (MP) at 15:00 hours in the presence of such tendering Firm/Agency/Company or their authorized representatives (only One representative from each of company shall be allowed) who wish to be present/witness at the time of opening of bids. If the Opening day of the tender has been suddenly declared as a holiday tenders will be opened on the next working day. 6. Price: (i) Prices quoted must be meaningful in the context. (ii) Price should be quoted in original Price Bid proforma given in Chapter 7 Financial Bid (iii) Prices quoted in other proforma will not be accepted. 7. Service Delivery Terms:The delivery of the Patient Diet Kitchen Services are required within a period as specified and as the place mentioned therein. 8. Assistance to Contractor: The contractor shall not be entitled to get assistance either from AIIMS Bhopal, in the procurement of raw materials required for the fulfillment of the contract or in the securing of transport facilities. 9. Other Terms: (i) Responsibility for Executing Contract: The contractor is to be entirely responsible for the execution of the contract in all respects in accordance with the terms and conditions as specified in the acceptance of tender. (ii) The contractor shall not sublet transfer or assign the contract to any part thereof to any other party without the written permission of the Competent Authority of AIIMS Bhopal. In the event of the contractor contravening this condition, Competent Authority of AIIMS Bhopal shall be entitled to place the contract elsewhere on the contractor s account at his risk and contractor shall be liable for any loss or damage, which the Competent Authority of AIIMS Bhopal may sustain in consequence or arising out of such replacing of the contract. (iii) Tender Document Fee: The cost of Tender Document Rs.525/-(Five Hundred Twenty Five only) (Non Refundable) including VAT@5% must be accompanied with Technical Bid Document in the form of DD drawn in favour of Director, AIIMS Bhopal, payable at Bhopal, if the Tender Document has downloaded from the AIIMS Bhopal website Tenderer must accompanied above mentioned Tender Cost with their Technical Bid document. (iv) Earnest Money Deposit: The tenderer shall have to deposit Rs.60,000/- (Rs. Sixty Thousand Only) non-interest bearing as earnest money with their tender, failing which the tender is liable to be rejected. The earnest money is to be paid by the way of Demand Draft/FDR from any Nationalized Bank and the same should be drawn in favour of Director, AIIMS Bhopal payable at Bhopal. NO CHEQUES/CASH WILL BE ACCEPTED. In the event of the withdrawal / revocation of tenders before the date specified for acceptance, the earnest money shall stands forfeited. 12 acceptance of the tender the earnest money may be refunded after the receiving of Performance Security (Rs. 2,00,000/-) in the Form of FDR/Demand Draft/ Bank Guarantee in favour of Director, AIIMS Bhopal, payable at Bhopal, deposited by the contractor in terms of Clause mentioned below. The Earnest Money Deposit will however, be returned without interest to the unsuccessful bidders after the 30 days of award of contract to the successful bidder. (v) Performance Security Deposit: On acceptance of the tender and issuing of Notification of Award to the successful Tenderer, the successful Tenderer will deposit the Rs. 2,00,000/- (Two Lakh only) in the form of Performance Security Deposit (non-interest bearing) within the 15 days time to AIIMS Bhopal for the period of 15 Months from the Date of issuing of NOA. The Competent Authority of AIIMS Bhopal shall be entitled to forfeit the Performance Security Deposit or any part thereof without prejudice to any other remedies provided in the contract or available under the Law. The security shall be in the form of Demand Draft/FDR/Bank Guarantee in favour of Director, AIIMS Bhopal, payable at Bhopal. If the Tenderer want to be submit his Performance Security Deposit in the form of Bank Guarantee, the format for Performance Bank Guarantee given in Chapter-6. Nointerest will paid to any Tenderer against the Performance Security Deposit by AIIMS Bhopal. 10. Termination of the Contract: If the contractor fails in fulfilling above-mentioned terms and conditions, such failure will constitute a breach of the contract and the Competent Authority of AIIMS Bhopal shall be entitled to terminate the Contract and make other arrangements at the risk and expense of the Contractor. 11. In case of failure to comply with the provisions of the terms and conditions mentioned, by the agency that has been awarded the contract, the Competent Authority AIIMS Bhopal reserves the right to award the contract to the next higher tenderer or outside agency and the difference of price will be recovered from the defaulter agency s due bills/performance Security Deposit, who has been awarded the initial contract and this will be binding on the tenderer. 12. Refund of Performance Guarantee: On due performance and completion of the contract in all respects, the Performance Security Deposit will be returned to the Contractor without any interest after the 90 days of successful completion of Contract period on presentation of an absolute No Demand Certificate in the prescribed form and upon return in good condition of any specifications, samples or other property belonging to the AIIMS Bhopal, which may have been issued to the Contractor. 13. Recovery of Sums Due: Whenever any claim for the payment of a sum of money arises out of or under this contract against the contractor the AIIMS Bhopal shall be entitled to recovery of such sum by appropriating in part or whole the Performance Security Deposit, deposited by the contractor, when the balance or the total sum to be recoverable, as the case may be, shall be deducted from any sum then due or which at any time thereafter may become due to be recovered under this or any other Contract with the AIIMS Bhopal. Should this sum not be sufficient to cover the full amount recoverable, the Contractor shall pay to the AIIMS Bhopal on demand the remaining difference amount without fail within 15 days of such event, if any, occurred during the Contract period. 14. Insolvency and Breach of Contract: The Competent Authority of AIIMS Bhopal may at Tender No.90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.12 )

13 any time by notice in writing summarily terminate the contract without compensation to the contractor in any of the following events, that is to say:- (i) (ii) (iii) If the contractor being at individual or if firm, any partner in the contractor s firm, shall at any time be adjudged insolvent or shall have a receiving order or orders for administration of his estate made against him or shall take any proceedings for liquidation or composition under any insolvency not for the time being in force or shall make any convenience or assignment of his efforts or enter into any arrangements or composition with his creditors or suspend payment of if the firm be dissolved under partnership act, or If the contractor being a company shall pass a resolution or the court shall make an order for the liquidation of the affairs or a receiver or Manager on behalf of the debenture holder shall be appointed or circumstances shall have arisen which entitled the court or debenture holders to appoint a receiver or Manager. If the contractor commits any breach of this contract not herein specifically proved for: Provided always that such determination shall not prejudice any right of action or remedy which shall have accrued or shall accrue thereafter to the purchaser and provided also that the contractor shall be liable to pay the purchaser for any extra expenditure, he is thereby put to but shall not be entitled to any gain on repurchased. 14. Arbitration: In the event of any question, dispute or difference arising under these conditions or any special conditions of the contract mentioned in Chapter-2, or in connection with this contract, except as to any matter the decision of which is specially provided for by these on the special conditions, the same shall be referred to the sole arbitration as appointed by the Director, AIIMS Bhopal. It will be no objection that the arbitrator is a Govt. servant, that he had to deal with the matter to which the contract relates for that in the course of his duties as a Govt. servant he had expressed views on all or any of the arbitration dispute or difference. The award of the arbitrator shall be final and binding on the parties to the contract, it is a term of this contract:- Any dispute or difference of opinion shall be dealt under provision of the Arbitration Act.1996 and the rules their under and any statutory modifications thereof for the time being in force shall be deemed to apply to the arbitrator proceeding under this clause. The venue of arbitration shall be at Bhopal. 15. Bids are invited under Two Bid System: The offer/bids are to be submitted under a two bid system, namely (i) Technical Bid and (ii) Financial Bid. The Technical Bid must contain all the details as specified in the schedules along with the terms and conditions whereas Commercial Bid must indicate rate only. PLEASE NOTE, THERE MUST NOT BE ANY COST INDICATION IN THE TECHNICAL BID. 16. Procedure for Submission of Bid to AIIMS Bhopal: a) Tenders in the form of hard copies duly signed, stamped and page numbering on each page will be considered. b) The tenders shall be placed in Sealed Envelopes with a name of work and due date of opening written on the envelope and addressed to "The Director, AIIMS Bhopal, Saket Tender No. 90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.13 )

14 Nagar, Bhopal (MP)" c) The 1 st envelope (Technical Bid) shall contain the DD of Tender Fee and EMD by the way of DD/FDR as above and the documents as mentioned below under Technical Bid. d) The 2 nd envelope (Financial Bid) shall contain priced schedule of Quotation, duly signed, Stamped and page numbering by the authorized signatory of the bidder. Both the above envelopes should clearly be marked on top of envelope about type of envelope i.e., details of contents in envelope (Technical Bid/Commercial Bid as the case may be), name of agency submitting the bid and addressed to "The Director, AIIMS Bhopal, Saket Nagar, Bhopal (MP)". e) All these envelopes are to be put in a bigger envelope duly sealed and super-scribed with the name of the work, and addressed to "The Director, AIIMS Bhopal, Saket Nagar, Bhopal (MP)" and also the name and detailed address of the bidder on the bottom left of the envelope. If the outer envelope isnot sealed and marked as above, the Institute will assume no responsibility for the misplacement or premature opening of Bid. 17. Other requisite details must be furnished by the Bidder in Technical Bid:- a) The tenderer should have its own Bank Account, PAN, TAN/TIN/VAT and Service Tax Registration Number. Payment will be made electronically only. b) Trade license essential for the carryout the activities under this contract, please furnish its certified copy along with Technical Bid. c) The bidders will quote the rates for providing the Patient Diet Kitchen Services on FOR- Destination (i.e. AIIMS Bhopal, Saket Nagar, Bhopal) basis only. However, their breakup is necessary. d) The tenderer should submit self-attested copies of the Income Tax Returns for the last three financial years (i.e. for , and ).Financial statements should include Balance Sheets, Profit & Loss Account and Cash Flow Statement. e) A copy of Registration Certificate under Contract Labour (R & A) Act, 1970, must accompanied with Technical Bid Document. f) Copy of Minimum Wages Payment Certificate from Local Labour Enforcement Office, must be accompanied with Technical Bid document. g) The tenderer should give an Affidavit duly Notarized on Stamp Paper worth Rs. 50/- in clear and un-ambiguous language that it has never been black listed/no criminal case pending by any of the organization with whom, it had dealing for running similar Patient Diet Kitchen/Catering Services during last Three years nor has been penalized for inferior or poor quality in their services. 15 18. Financial Bid: (i) The Financial Bid of the Technically Qualified Bidder will ONLY be opened. (ii) The price schedule of quotation as per format enclosed, duly signed, stamped and page numbering by the authorized signatory of the bidder is to be submitted. The unit rate and prices shall be quoted by the bidder entirely in Indian Rupee to be entered in words also. (iii) The breakup of Basic Price, VAT, other taxes/charges, if any to be clearly mentioned in Indian rupee only. (iv) SINCE, IT IS A PATIENT DIET KITCHEN/CATERING SERVICES CONTRACT PACKAGE, TENDER FOR ANY PART OF THE SERVICES WILL NOT BE ACCEPTED. THE RATE OF THE TOTAL PATIENT DIET KITCHEN/CATERING SERVICES WILL ONLY BE CONSIDERED. (v) Financial Bid in any other form except in the specified format given in Chapter-7,will not be accepted and shall be SUMMARILY REJECTED. 19.Right to Accept / Reject: The Competent Authority of AIIMS Bhopal reserves the right to reject any or all tender without assigning any reason whatsoever. Also, the Competent Authority of AIIMS Bhopal reserves the right to award any or part or full contract to any successful agency at its discretion and this will be binding on the tenderer and increase/decrease the number of bed as per the requirement. 20. Director, AIIMS Bhopal, does not pledge himself to accept the lowest or any tender and reserve to himself the right of accepting the whole or any part of the tender or portion of the quantity offered and you shall supply the same / execute the work at the rate quoted by you as well as The Director, AIIMS Bhopal, Saket Nagar, Bhopal (MP) reserves the right to relax/cancel any condition. 21.The tenderer shall quote the rates in respect of jobs / services described above in various paras and shall fill Financial Bid given in Chapter-7, calculating all the Factors/Expenditures/Statutory Obligations etc. Tender No. 90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.15 )

16 Chapter -2 GENERAL TERMS AND CONDITIONS 1. The tenderer must fulfil the following conditions (all documentary proofs, self-attested and stamped (seal), are required to be submitted along with the technical bid): MINIMUM QUALIFICATION REQUIREMENT IN TECHNICAL BID: Original Patient Diet Kitchen/Catering Service provider agencies bidding for qualification should fulfill the following minimum requirement. a) Should have completed following Patient Diet Kitchen/Catering Services Contract satisfactorily during last Three (3) years by or before the date of submission of the tender: 1. Three similar Patient Diet Kitchen/Catering Services Contract each costing not less than Rs.12 Lakh OR 2. Two similar Patient Diet Kitchen/Catering Services Contract each costing not less than Rs.15 Lakh OR 3. One similar Patient Diet Kitchen/Catering Services Contract each costing not less than Rs.24 Lakh Similar Work mean running of Patient Diet Kitchen/Catering Services for minimum 100 Patient Diet Kitchen handling capacity in any Hospital/PSU/Educational Institutional Complex/Industrial Canteen/Govt. Canteen/Mess with high quality of workmanship etc. b) Should have had Average Annual financial turnover at least Rs. 15 Lakh during the last 3 years, ending 31stMarch of the previous financial year. Copy of relevant stipulated proof along with Profit & Loss Account duly Certified by Chartered Accountant/Company Secretary may also be enclosed with Technical bid. c) Should not have incurred any loss in more than two (2) years during the last Three (3) Financial years ending on 31 st March, 2013 of the previous financial year. Copy of relevant stipulated proof may also be enclosed with Technical bid. d) The tenderer should give an Affidavit duly Notarized on Stamp Paper worth Rs. 50/- in clear and un-ambiguous language that it has not been black listed/no criminal case pending by any of the organization with whom, it had dealing for providing Patient Diet Kitchen/Catering Services of similar nature work mentioned above during last Three years nor has been penalized for inferior or poor quality in delivery of services. IMPORTANT QUALIFICATION CRITERIA: (i) Since it is a Patient Diet Kitchen/Catering Services Contract Package, tender for part of the requisite services will not be accepted. The rate of the total Patient Diet Kitchen/Catering Services will ONLY be considered. The Bidder along with other documents in the Technical Bid MUST submit a declaration on the letter head of their Tender No.90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.16 )

17 Company to the effect that they are participating in the bid for the Total Patient Diet Kitchen/Catering Services Contract Package for the 250 bed Hospital at AIIMS Bhopal, Saket Nagar, Bhopal. In the event of non submission of the same with the Technical Bid, the Bidder will be disqualified and the Financial Bid of such Bidder shall not be opened. (ii) The Technical Responsive bidders, Financial Bid shall only be opened and L-1 bidder shall be decided on the basis of overall Total Patient Diet Kitchen/Catering Services Contract Package value basis (i.e. not for each individual services/item wise basis). ESSENTIAL TERMS & CONDITIONS: 1. Specification of Materials:-The contractor will ensure and confirm that only new original and genuine Kitchen utensils/equipment will be used as per following:- i) All equipment shall be fabricated out of first quality IS-304 food-grade non- magnetic 18/8 Stainless steel material, and all the joinery will be done by argon arc welding duly ground and polished. ii) iii) iv) All burners of cooking ranges shall be Indian Oil Corporation s approved burners. All other L.P. Gas parts shall be of branded company. All compressors for refrigerators and water-coolers etc. shall be hermetically sealed compressors of branded company. All legs of working tables, storage racks, etc., shall be made of 1.5 x 16 SWG stainless steel pipe and cross bracings of 1 x 16 SWG Stainless Steel pipe. v) All working tops shall be sound dampened by suitable method. vi) All equipment shall be complete in all respects and ready to use to the entire satisfaction of the AIIMS Bhopal, including all accessories fittings etc. Nothing extra beyond the quoted rate/s shall be paid by the AIIMS Bhopal. vii) All electrical equipment and electrical part(s) of the equipment shall be of ISI mark approved reputed makes. viii) All equipment shall be pre-plumbing tested for electrical insulation and earthing. 2. Payment Term: The Bills in triplicate for month wise Patient Diet Kitchen services provided to AIIMS Bhopal, should submitted by the Contractor in the end of each month, supported with the all of the diet order/request signed and forwarded by the Dietitian/Ward Sister-In-Charge during the claim period (i.e. each month wise), along with detailed abstract sheet containing the brief information regarding the each patient wise nos. of diet wise with the date, time of the supply etc. to the HOD, Patient Diet Kitchen Services AIIMS Bhopal and he shall forward the same after necessary examination/verification to the Account Department of AIIMS Bhopal for processing of the Contractor s Bill Payment within 30 days time. Payment shall be released after deducting TDS as per Income Tax Rules and any other deductions as per prevailing Tender No. 90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.17 )

18 Government rules and payment shall be released only after it is ensured that the claimed nos. of diets matched with the diet order/request signed and forwarded by the Dietitian/Ward Sister-In-Charge on each date and each patient wise (a Key Performance Register in prescribed format given in Chapter-2 Special Terms and Condition Clause No. 34. of the Tender Document should be maintained by Agency on daily bases). If any discrepancy found, for which no extra payment shall be made by AIIMS Bhopal. The bills raised by the selected Patient Diet Kitchen Services providing Agency should have all tax registration numbers printed on bill. The bill shall be signed by the authorized signatory of the firm across a revenue stamp. Validity of the tax registration during the currency of contract shall be the sole responsibility of the selected Firm/Agency/Company. 3. Taxes and Duties: In case of any enhancement in any applicable Government Taxes due to notification of the Government after the date of submission of tenders and during the tender period, the quantum of additional amount on account of this effect should be reimburse by the Competent Authority of AIIMS Bhopal to the Contractor on the submission of relevant Government Orders in writing. Patient Diet Kitchen Service provider agency shall be entirely responsible for all Taxes, Duties, Food License Fees, etc. incurred until delivery of the contracted Services to the Purchaser. However, Sales tax/vat (not surcharge in lieu of Sales Tax/VAT) in respect of the transaction between the Purchaser and the Supplier shall be payable extra, if so stipulated in the Letter of Award/Service Contract. 4. Liquidated Damage: The Patient Diet Kitchen Services should be delivered to destination and in the manner of entire satisfaction of Competent Authority of AIIMS Bhopal and the Quality and the Quantity of Food with the necessary hygiene maintenance during the preparation and supply of food should be entire responsibility of Service provider if he fails to be deliver any or all of the requested Patient Diet Kitchen Services found to be below the Standard intimated by the Competent Authority of AIIMS Bhopal, the services by the specified date, Liquidated per month or part thereof in respect of the value of the such services in monetary terms shall be calculated and will be deducted from the bill of the Contractor, subject to a maximum of the Total cost of the Service Contract. Alternately, the Letter of Award/Contract will be cancelled and the undelivered services will be hired from elsewhere at the risk and expenses of the Contractor. 5. Applicable Law:The Contract shall be interpreted in accordance with the laws of the Union of India. 6. Dispute and Jurisdiction: Any legal disputes arising out of any breach of contract pertaining to the whole process of this tender shall be subject to the jurisdiction of Civil Court Bhopal. 7. Force Majeure: The service provider shall not be liable for forfeiture of its performance security, liquidated damages, penalty or termination for default, if and to the extent that, its delay in performance or other failure to perform its obligations under the Contract is the result of an event of Force Majeure. 19 For purpose of this Clause, Force Majeure means an event beyond the control of the Service Provider Agency and not involving the Service Provider Agency s fault or negligence and not foreseeable. Such events may include, but are not limited to, acts of the AIIMS Bhopal either in its sovereign or contractual capacity, wars or revolution, fires, floods, epidemics, quarantine restrictions and freight embargoes. If a Force Majeure situation arises, the Service Provider Agency shall promptly notify the AIIMS Bhopal in writing with adequate proof of such conditions and the cause thereof. Unless otherwise directed by the AIIMS Bhopal in writing the Service Provider Agency continue to perform its obligations under the Contract as far as it is reasonably practical, and shall seek all reasonable alternative means for performance not prevented by Force Majeure event. 8. Inspection of Service Provider Agency s work place: If purchaser wishes: a) The inspections shall be carried out by the Hospital Committee or Inspection Committee constituted by Director, AIIMS Bhopal at the premises of the Hospitals/Govt. Institutions/PSUs Mess/Canteen, where the Service provider Agency presently operating their Patient Diet Kitchen/Catering Services. Inspection charges (if any) for the above purpose shall be borne by the Contractor. b) Inspection note will be issued by the Inspection Committee verifying the Food Quality, Hygiene conditions during food preparation/distribution, Performance of Contractor, Details of services with the assessment of behavior and etiquettes of Contractor staff handling the services in such organization. 9. When the inspection conducted on the Contractor s work place, all reasonable facilities and assistance including access to Food preparation, Storage, General Patient Diet Kitchen Records and distribution area shall be provided to the inspectors at no charge to the Purchaser. 10. Payment of Wages to Engaged Personnel by the Service Provider Agency should be conforming to the prevailing Govt. Labour Rules: The Agency shall be solely responsible for compliance to provisions of various Labour, Industrial and any other laws applicable and all statutory obligations, such as, Wages, Allowances, Compensations, EPF, Bonus, Gratuity, ESI, etc relating to Patient Diet Kitchen personnel deployed in the Patient Diet Kitchen of AIIMSBhopal. The AIIMS Bhopal shall have no liability in this regard. Please note since the AIIMS Bhopal has a Central Govt. premier Institutions, it is the responsibility of the Contractor, should pay Labour wages as per the Central Govt. approved Labour Wages as per prevailing rules to his deployed personnel on monthly basis on or before 7 th of each month wise in the presence of designated officer appointed by the Competent Authority of AIIMS Bhopal for observation. 11. Insurance and Accidental Claim:The Agency shall be solely responsible for any Insurance/accident/medical/health related liability/compensation for the personnel deployed by it at Patient Diet Kitchen of AIIMS Bhopal for its smooth functioning. The AIIMS Bhopal shall have no liability in this regard. 12. Contractor to Provide Everything Necessary: The contractor shall provide everything necessary for the proper execution of the Patient Diet Kitchen Services according to the Tender No. 90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.19 )

20 intent and meaning of all raw material like Grocery, Spices, Fresh Vegetables, Fresh Fruits, Egg, Milk, Utensils, Cooking range Burners, LPG Cooking Gas, Working Tables, Kitchen Equipment, Garbage disposal bins etc. for preparation of Food) and required the distribution of the prepared Food items to the Patients Wards in each Patient Bed wise with efficient Patient Diet Kitchen Manpower and Supervisory Management necessary for the smooth running of Patient Diet Kitchen Services as per the approved Time Schedule of Diets given by the Competent Authority of AIIMS Bhopal from 6.00 am to pm x 7 day basis,whether the same may or may not be particularly shown or described therein provide that the same can reasonably be inferred there from and if the contractor finds any discrepancies therein he shall immediately and in writing, refer the same to the Employer (i.e. Director, AIIMS Bhopal), whose decision shall be final and binding. The Employer shall on no account be responsible for the expenses incurred by the contractor for electricity or any other item. The rates quoted against this Patient Diet Kitchen Contract will be inclusive of everything necessary required for efficient Patient Diet Kitchen Services within the contemplation of the contract, and beyond the quoted price no extra payment will be allowed for incidental or contingent work, labour and/ or material inclusive of all taxes and duties whatsoever except for specific services, if any, stipulated in the tender document. The contractor shall provide at his own cost, for the execution of efficient Patient Diet Kitchen Service Contract required not only for the proper execution and protection and the said Patient Diet Kitchen Contract but also for the protection of the Personnel, Patient/Public and safety of any adjacent area of Patient Diet Kitchen given by AIIMS Bhopal. 13. Cleaning of Patient Diet Kitchen: The contractor shall keep Patient Diet Kitchen clean as per the standard clear away and remove from the site all constructional plant, surplus materials, rubbish and temporary works of every kind and leave the whole of the site and the works clean and in a workmanlike condition to the satisfaction of the AIIMS Bhopal. The rate quoted by the contractor shall include all such contingencies. 14. Defects rectification after Completion of Work at AIIMS Bhopal: The contractor shall make good at his own cost and to the satisfaction of the AIIMS Bhopal, all defects, shrinkage, settlements or other faults which may appear within 12 months after completion of the work. In the default, the AIIMS Bhopal may employ and pay other persons to amend and make good such damages, losses and expenses consequent thereon or incidental thereto shall be made good and borne by the contractor and such damages, loss and expenses shall be recoverable from him by the AIIMS Bhopal or may be deducted by the employer, in lieu of such amending and making good by the contractor, deduct from any money due to the contractor a sum equivalent to the cost of amending such work and in the event of the amount retained being insufficient recover that balance from the contractor from the amount retained i.e. from Performance Security. 15. Time of Start the Patient Diet Kitchen Services at AIIMS Bhopal: The work shall deemed to be commenced within 15 days from the date of acceptance letter or date of handling over of Patient Diet Kitchen Site at Hospital Complex of AIIMS Bhopal, whichever is earlier. Time is the essence of the contract and shall be strictly observed by the Contractor. 21 1. All India Institute of Medical Sciences (AIIMS) Bhopal shall be the sole authority to cancel or amend the order. 2. The participating Firm/Agency/Company shall be bound by the details furnished by him/her to the All India Institute of Medical Sciences (AIIMS) Bhopal while submitting the tender or at subsequent stage. Upon selection of the tendering Firm/Agency/Company, if at any stage, the documents furnished by him/her is found to be false or the quality of the articles or rates are found of poor quality/ different specifications, it would be deemed to be a breach of terms of contract, the contract shall be cancelled and performance security shall be stand forfeited. 3. The rate quoted by the selected tendering Firm/Agency/ Company, and as approved by the All India Institute of Medical Sciences (AIIMS) Bhopal, shall remain valid throughout the period of contract and the request to increase the rates for any or all items, during the currency of contract, shall not be entertained at any stage. 4. The selected firm(s) shall not be allowed to transfer, assign, pledge or sub-contract its rights and liabilities under this contract to any other agency(ies) without prior written consent of the All India Institute of Medical Sciences (AIIMS) Bhopal. If it is found that the firm has given sub-contract for providing Patient Diet Kitchen Services on the basis of supply order, the contract shall stand cancelled & the performance security shall stand forfeited. 5. The conditional/incomplete bids shall not be considered and shall be declared unresponsive. 6. All entries in the tender form should be legible and filled clearly in the published in the Financial Bid Form (Chapter-7) only. If the space furnishing the information is found insufficient, a separate sheet duly signed by the authorized signatory may be attached. No overwriting or cutting or other than issued forms is permitted in the bid forms. In such cases, the tender shall be declared un-responsive. 7. The tender documents should be sealed and clearly super-scribed with the words Tender for providing Patient Diet Kitchen Services on Contract to AIIMS Bhopal. 8. If a participating Firm/Agency/Company decides to withdraw from the bidding before the financial bids are opened, the AIIMS Bhopal shall have the authority to forfeit the EMD of Rs. 60,000/- (Rupees Sixty Thousand only) of such Firm/Agency/Company deposited with the technical bid to AIIMS Bhopal. 9. All India Institute of Medical Sciences (AIIMS) Bhopal shall not be responsible for any financial loss or other damage or injury to any item or person deployed/supplied by the successful bidder in the course of their performing the duties to this office in connection with providing Diet Kitchen Services on Contract to AIIMS Bhopal. 10. The Competent Authority of All India Institute of Medical Sciences (AIIMS) Bhopal reserves the right to relax/withdraw any of the terms and conditions mentioned in the tender documents, if doing so is in the interest of the AIIMS Bhopal. 22 11. The Tender should be dropped only in the designated Tender Box kept at the Office of the Store Officer, 1 st Floor, E-Wing, Medical College Building, AIIMS Bhopal, Saket Nagar, Bhopal (MP). The closing time and date for acceptance of tenders shall be hrs on/ before by No tender received later the stipulated date & time or from other modes/place shall be entertained & shall be declared un-responsive. 12. The tenders will be opened on the same day (i.e. on ) in Office Room of the Designated Officer at 1 st Floor, Medical College Building, AIIMS Bhopal, Saket Nagar, Bhopal (MP) at 15:00 hours in the presence of such tendering Firm/Agency/Company or their authorized representatives (only One representative from each of company shall be allowed) who wish to be present/witness at the time of opening of bids. 13. The AIIMS Bhopal reserves the right to place an order for providing Patient Diet Kitchen Services on Contract to any other firm(s) in emergency/unavoidable situation. 14. This office shall have the full authority to reject any/all offer(s) without assigning any reason thereof. Any enquiry after submission of the quotation will not be entertained. 15. The contract will be valid from the date; it is awarded/formalities completed. This office will, however, reserve the right to conduct performance review at any time during the contract period and deficiencies, if any, noticed shall be required to be rectified and compliance reported. This office reserves the right to suo-moto terminate the contract by giving one month s notices at any point of time. 16. The rate quoted by the tendering Firm/Agency/Company should not be higher than the rates at which the Patient Diet Kitchen Services are being carryout by it to other Govt. Institutes/Ministries/Departments/PSUs. If subsequently it is found that the firm has providing Patient Diet Kitchen Services at higher rates to the All India Institute of Medical Sciences (AIIMS) Bhopal, the excess amount shall be recovered from the Performance Security of the firm. 17. The tendering Firm/Agency/Company should have its own Bank Account Number, TIN/TAN Number, PAN Number, VAT and Service Tax Registration Number. Selfattested copy of the same should be enclosed. The Bank name and account number should be intimated to Account Officer, AIIMS Bhopal to which all payments for Patient Diet Kitchen Services will be made through ECS transfer in case of the successful bidder. 18. Any complementary scheme offered by the manufacturer shall be provided to the All India Institute of Medical Sciences (AIIMS) Bhopal with no additional cost. 19. In his own interest the tenderer is advised to submit the desired papers/documents with their technical bid as per the specifications indicated in Chapter-5 (Check list) failing which their bids shall be declared un-responsive. SPECIAL TERMS AND CONDITIONS: 1. 23 the Patient Diet Kitchen should provided by AIIMS Bhopal. AIIMS Bhopal should not permitted the electricity on free of cost for Refrigeration and other Cooking accessories/equipment and for this purpose Contractor required to be give the detail of connected load and shall be charged on each month wise (if required the separate Electricity Meter should be installed in the Patient Diet Kitchen by AIIMS Bhopal and as per actual reading certified by the AIIMS Bhopal Engineering Department, the Electricity Charge on each month wise required to pay by the Contractor. 2. The Competent Authority of AIIMS Bhopal shall provide suitable space for operating Patient Diet Kitchen in Hospital Complex Area of AIIMS Bhopal. 3. Patient Diet Kitchen Service shall be meant for Serving & Making meals only for patients admitted in the AIIMS Bhopal Hospital. 4. Contractor will provide the special diets as and when directed and help to the Hospital Dietician for preparation of Diet Menu. 5. The Patient Diet kitchen Services are required to run on all days including Sundays & Holidays. 6. The Contractor selected for providing Patient Diet Kitchen Service, will be required to maintain highest level of cleanliness and standard of hygiene with regard to the persons under his employment and utensils for serving the food. 7. The personnel appointed by the tenderer must have proper, have bear proper Photo ID Card during their duty hours at AIIMS Bhopal issued by Competent Authority of AIIMS Bhopal after reciting their name, address and passport size photo on prescribed format from Contractor. They should bear neat and clean uniform of colour and design approved by Competent Authority of AIIMS Bhopal for their clear identification and they should bear uniform on all working day, without approved uniform, they should not allow to perform their duties at AIIMS Bhopal. Contractor should provide at least two pairs of approved uniform to its all the workers on his own cost. The personnel, so appointed should have the basic knowledge of personal hygiene and safe & clean methods of food handling, they should be of good moral character & decent behavior. 8. The quality of the raw materials to be used for preparation of food should be of highest standard and fresh. 9. The fuel to be used for cooking will only be LPG and shall be arranged by the Contractor. 10. The Contractor will be responsible for maintaining adequate number of persons engaged in cooking, distribution of food and disposal of garbage from Patient Diet Kitchen to designated place in the Hospital and left over food. 11. The Contractor should keep the Patient Diet Kitchen place clean. If, at any point the Diet Kitchen & it s premises are found to be unclean, the Contractor shall be held responsible and action deemed fit shall be taken by the competent authority of AIIMS Bhopal. 12. 24 and the AIIMS Bhopal shall not in any manner be liable for any damage caused due to incidents like theft, burn, fire, electric shock or bear any compensation for damage or injury or injury caused to its workmen while discharging their duty. 13. The Contractor shall not be entitled to use the accommodation allotted by the AIIMS Bhopal for any other purpose or business other than running of Patient Diet Kitchen at AIIMS Bhopal Hospital Complex premises. 14. The Contractor shall not use the name of the AIIMS Bhopal in business dealing with other persons or traders. 15. The Contractor must possess the requisite valid license issued by the Competent Authority for carrying out the business and shall be responsible for complying with all laws pertaining to the services in question as well as those pertaining to employment of persons under him. 16. The persons associated with preparation and distribution of food will be required to undergo periodical medical checkups to rule out the possibilities of communicable disease / infectious diseases and anybody found suffering from such has to be kept out of work till he / she is fully recovered. 17. The list of personnel deployed for food preparation, handling and serving have to be intimated to the Competent Authority of AIIMS Bhopal from time to time and their attendance should be properly recorded by the Contractor. 18. There shall be no compromise on the quality of food supplied by the tenderer and if any such incidence or food adulteration is found, action deemed fit, including black listing the firm, shall be taken by the Competent Authority and all the rules of Prevention of Food Adulteration Act (PFA Act) will apply. 19. The agency will be responsible for complying with payment of minimum wages and other Social Security benefits including prescribed number of leave / holidays and prescribed hours of work Schedule as per Labour Laws in force from time to time to its employees deployed in the Patient Diet Kitchen at AIIMS Bhopal, all laws related to Social Security (ESI & PF etc.), Service Tax, VAT wherever applicable & other Labour legislations, pollution control and such statutory orders from time to time as regards to treatment & disposal of garbage, and the Contractor will be liable for any consequences resulting from violation of any such rule/provision. 20. The Contractor will be responsible for such conduct of the persons engaged by him in the Patient Diet Kitchen at AIIMS Bhopal, which will be conducive for maintaining the harmonious atmosphere in the Hospital and will be responsible for any act of commission & omission of such persons. 21. Periodic Certificate of fitness (preferably quarterly basis during concurrency of Contract) of staff to engage in Cooking/Service of Food, should be properly immunized for TB, Typhoid, HAV and the cost of immunization and Periodic Certification (Medical Fitness) shall be borne by the Contractor. Contractor should mandatorily report to the Concerned Competent Authorities, who are looking the operations of Kitchen Dietary Services from Client Side (i.e. from AIIMS Bhopal) in writing for their Staff absence due to sickness. 23. Hospital Inspection Committee of AIIMS Bhopal Officials will carryout the scheduled, unscheduled/surprise Inspection of Kitchen verifying the Food Quality, Hygiene conditions during food preparation/distribution, Performance of Contractor, Details of services with the assessment of behavior and etiquettes of Contractor staff handling the services frequently at AIIMS Bhopal. 24. Hospital Inspection Committee of AIIMS Bhopal have authority to collect the sample of Food/raw material used in the Kitchen any time for assessment of Food Quality. 25. Periodic Maintenance Certificate of the appliances used in Kitchen (preferably on quarterly basis during concurrency of contract). 26. Contractor should provide and fix the adequate Exhaust System in the Kitchen area on his own cost. 27. The agency, while submitting their tender form shall enclose certified Photostat copies of experience, trade license essential for carrying out the activities under reference, license under Contract Labour Act (if applicable), and 28. Any other documents in support of carrying out the activities under reference from Competent Concerned Labour Authority. 29. The tenderer should obtain valid license under the Contract Labour ( R& A ) Act, 1970 (if applicable) and shall continue to hold it till completion of the contract. The contractor should be registered with EPF, ESI, and Service Tax authorities and shall possess valid Registration Number., the self attested Xerox of the same is to be enclosed with the tender documents. 30. All pages of the tender and related papers are to be duly signed, stamped and page numbered by Tenderer. 31. The contractor should use AGMARK/FPO Or Standard quality food articles fixed by IMC and certificate in that regard should be kept in the Patient Diet Kitchen premises of AIIMS Bhopal. 32. For Patient Diet Kitchen, a HOD of Patient Diet Kitchen shall nominated by Director, AIIMS Bhopal would check the quality of food and hygienic condition as per the Government norms. Firm should enclose duly signed satisfactory performance certificate by the HOD, Patient Diet Kitchen of AIIMS Bhopal for the period for which the bill is presented. The cycle of the bill would of one month. 33. The Successful Tenderer will have to execute an Contract Agreement on Rs.100/- (Rs. One Hundred Only) Non Judicial Stamp Paper with the AIIMS Bhopal, Saket Nagar, Bhopal (MP) in the prescribed format given in Chapter As per the AIIMS Bhopal assessment, the total Patient Diet Kitchen Staff required at Tender No. 90: AIIMS Bhopal/Hospital/Patient Diet Kitchen Services/ /01 Dtd (Pg No.25 )

26 present required is 18 including Supervisor, Head Cook, Cooks, Cook Mates, Masalchi /Distributors & Cleaning personnel, this is the minimum personnel required while tenderer shall make his own assessment for requirement staff for operating Patient Diet Kitchen at AIIMS Bhopal but minimum it should be 18 personnel. 35. Supervisor should be experienced and should have Hotel/Catering Diploma and preferable 3 years in Healthcare Industry. Certificate of the same should be attached. Head Cook & Cook should have at least one year experience of working in Healthcare Industry. Certificate of the same should be attached. 36. Agency has been in Patient Diet Kitchen Services/Catering business for a period of at least last three years. 37. Agency have to arrange the required manpower, material, machine and other resources for the establishment of service within the 15 days of Award of Contract/Letter of Intent. 27 38. Agency has to cater to any additional need of AIIMS Bhopal on short notice (any increase in required manpower, duly paid), if any such need arises in the tenure of the Contract. 39. The firm/agency with similar type of operation with same or some/one of the proprietors being same as of the tendering firm has not been black listed in the past three years by any Govt./private institution. The tenderer should give an Affidavit duly Notarized on Stamp Paper worth Rs. 50/- in clear and un-ambiguous language that it has never been black listed/no criminal case pending by any of the organization with whom, it had dealing for providing Patient Diet Kitchen/Catering Services of similar nature during last three years nor has been penalized for inferior or poor quality in providing the services of similar nature. 40. The Agency shall maintain a Key Performance Register, which will be verified by a HOD, Patient Diet Kitchen of AIIMS Bhopal time to time. At the last of the each month the signature of the HOD, Patient Diet Kitchen of AIIMS Bhopal is to be mandatory on that register, at the time of bill submission, the Xerox copy of the same with the satisfactory performance certificate by HOD, Patient Diet Kitchen, AIIMS Bhopal is to be submitted along with it. 42. While submitting the monthly bill for Patient Diet Kitchen services following documents are to be enclosed with the same:- a) The wages of workers for last month credited to their bank account on and the details of the payment along with bank account number enclosed. b) ESI/EPF/Service Tax/Other statutory dues amounting to Rs.. for the month of (previous month) deposited on. (copy of challans to been enclosed) (along with copy of contribution submitted online in respect of ESI and EPF) c) Undertaking that all statutory labour laws including Minimum Wages Act is being complied with. The service provider must ensure that entitled wages of the workers are credited to their bank account on or before 7 th of each month wise. In-case of an unsatisfactory performance or for any complaint for Patient Diet Kitchen Services, the penalty would imposed as decided by the competent authority and would be admissible by the agency. 29 Chapter 3 Schedule of Requirement 1. The Patient Diet Kitchen Services mentioned in the Financial Bid(Chapter-7) will be required by this office. The demand for these Patient Diet Kitchen Services will be given to the tendering Firm/Agency/Company by way of Award of Work. All India Institute of Medical Science (AIIMS) Bhopal shall demand Patient Diet Kitchen Services over and above the Services mentioned in the Financial Bid (i.e. increase/decrease of Patient Diet Numbers depending upon the Bed occupancy per day basis / other Catering Services) and the Agency will have to provide the same as per the rate mutually agreed upon as per than prevailing market rates. 2. The all required accessories, manpower, raw material required for the providing Patient Diet Kitchen Services the sole responsibility of the Agency, engaged for the carryout the requested services at the destination location (Place) as stated in the Award of Work Order. 4.
