1 EXPRESSION OF INTEREST SENSITIZATION OF ADVOCATES ON TB AND HUMAN RIGHTS Amref Health Africa in Kenya in partnership with KELIN and the Ministry of Health through the National Tuberculosis, Leprosy and Lung disease Program (NTLD-Program), with support from the Global Fund (GF) plan to conduct sensitisation of 100 lawyers on Tuberculosis (TB) and human rights in the months of October and November The sensitisations will be done in three regions: Eastern/Nairobi, Coast and Western/Nyanza. The sensitisation meeting seeks to develop a critical understanding among legal practitioners on TB, the law and related human rights in order to influence an increase in legal services for TB related violations, and sound case laws on this issue in Kenya. Amref Health Africa in Kenya is the non-state Principal Recipient (PR) for the Global Fund TB grant for Kenya. Established in 1957, Amref Health Africa is Africa s largest indigenous health non-governmental organisation (NGO) headquartered in Nairobi. Amref Health Africa s vision is lasting health change in Africa, and its mission is to increase sustainable health access to communities in Africa through solutions in human resource for health, health services delivery and investments in health. KELIN is an independent Kenyan civil society organisation working to protect and promote Health related Human rights in Kenya. We do this by; Advocating for integration of human rights principles in laws, policies and administrative frameworks; facilitating access to justice in respect to violations of health related rights; training professionals and communities on rights based approaches and initiating and participating in strategic partnerships to realize the right to health nationally, regionally and globally The National Tuberculosis, Leprosy and Lung Disease Program is under the Division of Communicable Disease Prevention and Control in the Directorate of Preventive and Promotive Health Services of the Ministry of Health. Its vision is to reduce the burden of lung disease in Kenya and render Kenya free of tuberculosis and leprosy; its mission is to accelerate the reduction of TB, leprosy and lung disease burden through provision of people-centred, universally accessible, acceptable and affordable quality services in Kenya. The Program is linked to the County level through 47 County TB and Leprosy Coordinators (CTLCs), who provide technical and implementation support to close to 300 Sub-County TB and Leprosy Coordinators (SCTLCs).

2 The overall development of the technical aspects of TB control, including policies, is mandated to the NTLD Program under the umbrella of the Ministry of Health. The NTLD Program has the additional role of setting standards (including providing technical specifications), identifying and mobilising resources. The Global Fund is supporting Kenya to implement initiatives that will maximize the impact of its investments to make an even greater contribution towards the vision of a world free of HIV/AIDS, TB and malaria. Through this arrangement, Amref Health Africa in Kenya receives direct funding from Global Fund and engages civil society organisations (CSOs) as Sub Recipients (SRs) through a competitive process. Global Fund TB Project The project goal is to accelerate reduction of TB Leprosy and Lung disease burden through provision of people-centred universally accessible, acceptable and affordable quality services in Kenya. One of the key interventions in this grant is removing human rights and gender-related barriers to TB care. The key activities under this include: 1. One sensitisation forum for cross sectional stakeholders from justice, labour and housing, poverty and social protection on TB related human rights. 2. Sensitisation of 100 lawyers on TB related human rights and legal issues and develop a legal support network of pro-bono lawyers to support cases and attend legal aid clinics. 3. Provision of legal aid clinics to TB patients through their support groups It is worth noting that Kenya has developed a policy for isolation of TB patients and is developing a social protection framework to protect TB patients from incurring catastrophic expenditures in the course of seeking care and ensure protection against discrimination. Kenya has also finalized and disseminated the first National TB patient cost survey that showed the magnitude to which the patients and their households face catastrophic costs and social exclusion due to TB. The survey found that Overall, 26.5% of TB affected households, including 86.4% of DR-TB affected households experienced catastrophic costs. To cope, 27.8% of TB patients used negative coping mechanisms like taking a loan, use of savings and sale of assets to meet the expenses. The survey also showed that households affected by TB incurred severe socio-economic consequences; 62.5% of Drug Resistant TB and 39.1% of Drug Sensitive TB patients lost jobs due to TB, children in 9.3% of households affected by TB had their education disrupted, between 27.1% and 53.7% of TB affected households experienced food insecurity due to TB and 36% experienced social exclusion. In order to reverse these negative findings, there is need

3 of a human right based approach in the social protection framework and labour protection laws that will ensure TB patients are not discriminated because of the disease. Expression of Interest Expression of interest is welcome from only Lawyers who show an interest in working on issues around health and Human rights and will be available to provide legal services in this regard, including participating in legal aid clinics and litigation that will be conducted by Amref Health Africa and KELIN, in 2018 and thereafter. Eligibility Criteria The call for application is open to advocates who litigate or have an interest to litigate on health-related human rights. Must have a demonstrated interest in and/or knowledge on health-related human rights issues in Kenya. Must also have a demonstrated interest in and/or knowledge of international and regional human rights law. Must be resident in, and actively engaged in practice, in the Coast region, Nyanza/Western region, Eastern region and Nairobi. Members of the LSK s Public Interest Committee and the Medical Legal Committee will have an added advantage. Must be committed to attending the entire two days seminar. After the training Lawyers interested in offering pro bono lawyer services will be requested to sign up to be included in the Amref Health Africa and KELIN databases to provide legal services, including participating in legal aid clinics and litigation, in 2018 and thereafter.
