6 Information Related to Attracting International Patients Introduction to Attracting international Patients Permission for Attracting international Patients through the Amendment of the Medical Service Act (2009) Through an amendment of the Medical Service Act (Article 27, Paragraph 2), attracting institutions or agents registered with the Ministry of Health and Welfare (MOHW) may attract international patients who do not live in Korea through introduction, invitation, recommendation, etc. Meaning of the Registration Policy of an international Patient Attracting Institution By registering institutions that want to attract international patients with certain criteria, it can prevent uncontrolled international patient attraction, etc. in order to manage the medical service quality. The Medical Service Act defines the registration criteria for international patient attracting institutions (medical institutions and inviting agents), and requires those institutions to report the results. To minimize effects on the domestic medical service, the number of beds of upper-level and general hospitals for international patients is limited. Invitations of domestic insurance companies are also limited. Act on Support for Overseas Expansion of Healthcare System and Attraction of international Patients Established (2016) The Act on Support for Overseas Expansion of Healthcare System and Attraction of international Patients is established to provide high-quality healthcare services such as support for overseas expansion of healthcare system, protection of international patients rights, improvement of convenience and safety, etc. It supports the activation of attracting international patients through proactive and post-managements of international patients, policy of evaluating attracting institutions, and preparing a basis for conducting medical advertisements that target international patients. It provides an environment for high-quality healthcare services on international patients by limiting excessive attraction commission, providing information on protecting international patients rights, etc. Definition and Scope of Attracting International patients (Article 2, Paragraph of Act on Support for Overseas Expansion of Healthcare System and Attraction of international Patients) Attracting international patients is an activity of 1 making treatment reservation, contract or such act; 2 providing international patients with treatment information; and 3 providing treatmentrelated conveniences such as transportation and lodging information, etc. to promote the utilization of domestic medical institutions by international patients. <Scope of Attracting international Patients> 1 Activities such as consultation, treatment reservation, and treating patients introduced by attracting agencies or overseas medical institutions 2 Providing international patients with treatment information through websites written in their native tongues 3 Activities of providing conveniences such as hiring employees (medical translator, coordinator, etc.) who are exclusively for international patients, issuance of medical tourist visa, transportation and lodging information, etc. Registration Criteria The Act on Support for Overseas Expansion of Healthcare System and Attraction of international Patients (Article 6, Paragraph 1) specifies registration criteria of attracting institutions (medical institutions and agencies). Medical Institutions 1 There must at least be one specialist for each medical department to which the international patients are attracted. 2 They must have insurance for medical accident liability or have joined a medical liability mutual benefit association. Attracting Agencies 1 They must have guaranteed insurance. 2 They must possess a capital of KRW 100 million. 3 They must have an office in Korea. Registration and Registration Renewal Process Registration application and required documents need to be sent to the Korea Health Industry Development Institute by mail or applied through the website. Please register the institutional information in the international patient attraction information system (medicalkorea.khidi.or.kr) electronically. Institutions that want to continue the attraction business need to renew their registration before the effectivity period expires. If institutions do not renew their registration, yet continue the attraction business, it is regarded as unregistered attracting activities. Therefore, penalty and imprisonment for less than 3 years, or a penalty of less than KRW 30 million can be imposed. Maintenance Criteria, Etc. of Attracting Institution Registration Registration criteria maintenance is required during the registration period. If registration criteria are not met, correction order from the Minister of Health and Welfare will be notified. Receipt and Processing Step Reviewing whether the registration criteria are satisfied Registration process completion A re-registration process is required when the business registration number of a medical institution is changed. Information amendment is required for institutional information such as representative, name, address, contact information, medical departments, etc. Information of person in charge of the attracting institution and other institutional information can be amended at any time through the information portal system of the attracting institution. If an attracting institution registration withdrawal is desired, an application for discarding must be submitted to the Korea Health Industry Development Institute. 8 Attraction Business Overview 9

7 Information Related to Attracting International Patients Information on Attracting international Patients Registration Certificate Reissuance Application If a person for whom a registration certificate is issued, loses or damages the registration certificate and needs to have it reissued, an application for a registration certificate reissuance must be submitted to the Korea Health Industry Development Institute. The original copy of the issued registration certificate must be returned (if lost, a statement of reason for loss must be attached). Reason for Cancelling the Attraction Business Registration A case wherein people who are not qualified for international patient attraction are attracted Introduction of treatment contract with international patients by medical institutions or agencies that are not registered When invited A case wherein the correction order is not followed according to Article 22 of the Act on Support for Overseas Expansion of Healthcare System and Attraction of international Patients For institutions whose registration is cancelled, a re-registration is possible one year after the date of cancellation.
