CALL TO ORDER Pursuant to regulations, the Common Council of the city of Waupaca met on the above date and time. 2. PLEDGE OF ALLEGIANCE 3. CLERK TO READ OPEN MEETING STATEMENT Sandy Stiebs, Deputy Clerk stated this meeting and all other meetings of the Common Council are open to the public. Proper notice has been posted and given to the Press, in accordance with Wisconsin State Statutes so that the citizens may be aware of the time, place, and agenda of this meeting. 4. APPOINTMENT AND SWEARING IN OF ALDERPERSON TO REPRESENT THE 4 TH ADLERMANIC DISTRICT, WARDS 4 AND 6 MOVED by Ald. Hagen, SECONDED by Ald. Hackett Council APPROVES of appointing Lori Chesnut to the 4 th Aldermanic District, Wards 4 and 6 to replace Ald. Deb Fenske who had resigned. 9 ayes, 0 nays, 0 absent. MOTION CARRIED ON A VOICE VOTE. Ms. Lori Chesnut was sworn in as Alderperson by Mr. Henry Veleker, City Administrator/Clerk. 5. APPROVAL OF CONSENT AGENDA All items listed below are considered routine by the City Council and will be enacted by one motion. There will be no separate discussion on these items unless a Council member or City staff so requests it, in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the Regular Agenda. The items selected for the Consent Agenda are as follows: Regular and Special Meeting Minutes, Monthly Income Report for the Parks and Recreation Department, Airport Hangar Reports, Monthly Department Head Reports, Payrolls and Bills, Quarterly Weights and Measures Reports, Quarterly Room Tax Reports, Second Reading of Ordinances, if received a unanimous recommendation at the previous meeting, project invoices for projects previously approved by City Council, any low bid budgeted operating or capital expenditure under

2 $25,000 approved by the appropriate Board or Committee and any expenditure of non-city funds that received a unanimous recommendation. A. Kjelland Council APPROVES of the Regular Agenda as presented. 10 ayes, 0 nays, 0 absent. MOTION CARRIED ON A VOICE VOTE. 8. NON-AGENDA ITEMS AND ANNOUNCEMENTS A. ANNOUNCEMENTS AND CORRESPONDENCE: 1. Award of the National Public Works Week Coloring Contest Henry Veleker, City Administrator/Clerk: Tionna Miller Mrs. Seifert, WLC Carter Fermanich Mrs. Hanke, WLC Mr. Veleker introduced and asked the children to point out their pictures. Mr. Veleker explained that their pictures will be displayed in the City Hall lobby and handed them gift certificates. 2. Presentation of Plaque to Teri Moe for 24 years of service to the City 3. Presentation of Plaque to Rick Martin for 38 years of service to the City Mayor Smith read the plaques and asked Mr. Jenson or Ms. Stiebs to make sure Ms. Moe and Mr. Martin receive their plaques for their years of service. Both were unable to attend. B. PUBLIC INPUT-NON AGENDA ITEMS Ald. Dave Peterson said that as a homeowner on the edge of both Hillcrest Drive and Fulton Street and stated that the progress of the redevelopment of those streets have been fast and efficient. He commends all of the City crews for doing a great job and staying long hours. 9. UNFINISHED BUSINESS: 1. Renewal of Charter Communications Contract Josh Werner, IT Communications Specialist (to be distributed)

3 Mr. Werner said he is waiting for a contract from Charter Communications and updated Council. He requested that Charter include a price per Mbps in the new contract. He said if the City wanted to upgrade or downgrade internet speed, Charter would revise the contract at that time. Mr. Werner addressed the concern from the last Council meeting why the discount was less this time for another 2 ½ cycle. The Charter rep told him that they had discounted their regular rate for 70Mbps and had to go back for special approval for the contract presented at the last meeting. He said he asked if the City could get 80Mbps for the same amount of $1,700 per month. That request is in front of Charter s management and the representative was not able to get an answer for tonight s meeting. Mr. Werner briefly reviewed if there were any other options available for internet service. He said in 2012, both he and Mr. Veleker had met with Earthlink which was around the same time that the City decided to keep Waupaca Online in operation. He no longer has much documentation from that meeting, but recalls that Earthlink was only able to offer phone services. Shortly after that, they met with Charter Communications who was able to give great pricing due to the bundling of phone and internet services. No action was taken. 2. Discussion/Approval of changing the deadline for Council Agenda items Ald. Steve Hackett Mayor Smith briefly reviewed Ald. Hackett s request to change the deadline for Council Agenda items to have enough time to be able to read and understand it fully. His concern is that they do not end up with a lot of addendums or handouts at every meeting and feels that there should be some guidelines set. If someone misses the deadline, the report would be included at the next meeting. Ald. Hagen mentioned that he would like the pages cross-referenced within the packet and gave examples. Ms. Stiebs replied that there are bookmarks included in the packet. Mr. Kane suggested that the format could be in a portfolio style, meaning that when you click on an agenda item it only opens that document without scrolling through all pages. He said you could then separate the agenda on one side and the document on the other as another option. Ms. Burington said that the library meetings would be difficult to meet the Wednesday deadline since the meetings are held on Tuesday evenings. The library minutes would end up in the first meeting of the month instead. Mayor Smith suggested highlighting in some manner (bold or box), any action items that are required within the minutes. Mr. Veleker said that all department heads struggle regarding giving enough background without overwhelming Council with too much information.

4 Ald. Hackett made a motion to send out packets on Wednesday, seconded by Ald. Petersen. After some brief discussion, Ald. Petersen withdrew her second. Mayor Smith asked for a second on Ald. Hackett s motion. Hearing none, the motion died. There was general discussion of Ald. Hackett s intent of the packet being available one or two days earlier. MOVED by Ald. Hagen, SECONDED by Peterson, Council APPROVES of making the packet available Thursday afternoons with the deadline of noon on Wednesday. 10 ayes, 0 nays, 0 absent. MOTION CARRIED ON A VOICE VOTE. 3. Offer to Purchase 1 acre in Business & Technology Park Sunny Day Child Care and Preschool Henry Veleker, City Administrator/Clerk Mr. Veleker said Sunny Day Child Care & Preschool accepted the counter-offer to purchase 1 acre on Godfrey Drive, Waupaca. Sunny Day would like to get a Payment in Lieu of Taxes (PILOT) Agreement in place and has been accepted by their board of directors. MOVED by Ald. Hackett, SECONDED by Ald. Hagen, Council ACCEPTS the Offer to Purchase for 1 acre in the City s Business & Technology Park from Sunny Day Child Care and Preschool in the amount of $25,000. ON THE CALL OF THE ROLL Ald. Peterson, Council APPROVES of entering into a Payment in Lieu of Taxes (PILOT) Agreement with Sunny Day Child Care and Preschool for a Term of 20 years through December 31, ON THE CALL OF THE ROLL Ald. 5 Mr. Kane said the City Plan Commission approved all of the applicants for Scrap Dealer Licenses that in attendance. The commission also gave Mr. Kane authority to review applicants that were not in attendance at the City Plan Commission meeting. Those applicants not in attendance have been reviewed by Mr. Kane and are in conformance. MOVED by Ald. Peterson, SECONDED by Ald. Hackett, Council APPROVES Scrap Dealer Licenses for: Alter Metal Recycling Waupaca Regional Recycling & Composting Center H&H Recycling United Milwaukee Scrap Siegel Recycling D4 Metals Napuck Salvage of Waupaca 10 ayes, 0 nays, 0 absent. MOTION CARRIED ON A VOICE VOTE. 2. Senior Center Coordinator Job Description Aaron Jenson, Parks and Recreation Director Mr. Jenson said that they have met with numerous parks and recreation departments to compare duties and job descriptions that fit the Senior Center Coordinator or equal positions and have made a few changes that best fit the position. Mr. Jenson explained that the job description is included in the packet and follows the GovHR format. Mr. Jenson said this position was changed to a salaried position approximately one year ago because Ms. Moe and her staff worked on weekend events and fund raisers. After the Affordable Care Act (ACA) was in effect, staying below 30 hours per week was difficult at times. With making the change for the Senior Center Coordinator is more of a working supervisor, e.g., art classes, computer classes, physical activity classes, etc. and discussions with GovHR, they felt the position was not exempt. He said the hourly wage of $17.50 is competitive with other area positions. Items added are: Nonexempt employment status: o This position will no longer be salaried and will start at an hourly wage of $17.50 per hour. o This position will be limited to 29 hours per work week. This position will lead instructional classes for senior citizens and coordinates other leader and speaker for senior classes. Mr. Jenson asked Council to approve the job description. MOVED by Ald. Whitman, SECONDED by Ald. Peterson, Council APPROVES of the Senior Center Coordinator Job Description. 10 ayes, 0 nays, 0 absent. MOTION CARRIED ON A VOICE VOTE.

6 3. Request for Proposal (RFP) Downtown Business District Parking Study Brennan Kane, Development Director Mr. Kane said that after approval of the Downtown Visioning Plan, Staff is requesting to move forward with a Request for Proposal (RFP) for a Downtown Parking Analysis of the City s current on-street and off-street facilities and make recommendations for current and future needs. Mr. Kane said they are asking for three separate one week parking audits are conducted a minimum of 3-4 times per day during the following times: August 2015 (prior to Labor Day, to capture summer tourism) September November 1, 2015 (sample of a typical one week non tourism period) November 23-December 31, 2015 (Holiday Shopping season) Mr. Kane said they are seeking to use between $10-15,000 and is requesting the monies allocated toward the Downtown Masterplan be utilized for this parking study that was allocated by Council while we wait on our other grant applications for the larger downtown master plan and project. Ald. Purchatzke asked Mr. Kane why he chose those time frames and not after the beginning of the year. Mr. Kane felt that we are capturing a comprehensive review and feels that the period after Labor Day still captures a relatively good understanding of what our parking needs are. He said that the winter time is a little more challenging but there is less of a demand for downtown parking in the area. He said the RFP also asks for an hourly rate in case we want to capture data during an event. Ald. Hagen asked if there is a list of companies that the RFP will be sent to. Mr. Kane said he is still working on that list and has contacted Stevens Point, Wausau, Appleton and Oshkosh for companies that have submitted for their recent parking studies. There will approximately engineering firms or parking consultants anywhere in the Midwest region. MOVED by Ald. Kjelland, SECONDED by Ald. Whitman, Council APPROVES the City of Waupaca Request for Proposals (RFP) for the Downtown Business District Parking Analysis and Long Term Public Parking Strategy. 10 ayes, 0 nays, 0 absent. Mayor s Appointments: Lori Chesnut to the Historic Preservation Commission Lori Chesnut to the Historical Society Lori Chesnut to the Library Board Lori Chesnut to the Emergency Planning Committee Ald. Mayou read the appointments to various commissions, boards and committees. MOVED by Ald. Olson, SECONDED by Ald. Kjelland, Council APPROVES of the Mayor s Appointments of Lori Chesnut to the Historic Preservation Commission, the Historical Society, the Library Board and the Emergency Planning Committee. 10 ayes, 0 nays, 0 absent. MOTION CARRIED ON A VOICE VOTE.

Low Power FM Radio Station Josh Werner, IT Communications Specialist Mr. Werner said that after receiving approval at the December 2, 2014 City Council meeting, enough funding has been raised for startup costs through sponsorships, donations and grant for a low power FM radio station to join Win-TV. The city of Oshkosh has been operating one for almost 10 years and the city of Stevens Point will be putting theirs on the air this summer. He is asking Council for approval to move forward with this project. Ald. Peterson asked if there would be any possibility in additional costs to the City. Mr. Werner said the base operation should not require any increase in budget. He will make some changes to how staffing is run on the Win-TV side to free up resources. He said a lot of the programming will include meetings from City Council, County Board, School Board, Winchester Academy, library programs, etc. MOVED by Ald. Kjelland, SECONDED by Ald. Discussion on changing Municipal Code Section 12.01(7) Delinquent Financial Obligations to the City - Mayor Brian Smith Mayor Smith said this ordinance is dealing with licenses and permits that are given out in the City. Before licenses can be granted to individuals they have to have any financial obligations to the City paid in full. He is asking if the ordinance can be changed to say paid in full or allow an agreement to make payments on a monthly basis until the obligation is completed to not create a hardship for those individuals. Ald. Chesnut said that many times individuals are given this opportunity in the court system and sometimes do not make the payments. It then falls on the courts to recover those fees. Ald. Kjelland asked how often does this happen. Mayor Smith said he cannot answer that question. His concern is that if someone owes a larger amount and are only making $8-$9 per hour, they will lose their job if they cannot pay that amount in full. Atty. Hart said that you would have to put something into the ordinance that if they missed a payment their license would be revoked. He said a liquor license would be different. He said it could get extremely complicated. Ald. Mayou agreed with both Mayor Smith and Atty. Hart on both issues. Mr. Veleker asked if an applicant agreed to a payment plan could we ask them to agree to waive their right to a hearing for that year. Atty. Hart said that is written in the statutes that the City is allowed to obtain those waivers. Not for liquor licenses. Ald. Peterson asked if they could work with suspension verses revoked.

8 Ald. Petersen suggested that if payments were missed the applicant would not be approved in the following year to avoid complicating the ordinance. Mr. Veleker said it is most common to setup payment plans for past due utility payments. Ald. Hagen suggested there be a minimum dollar amount allowed for a payment plan and structured to be paid in full in one year. Mayor Smith asked Council if they would like to move forward with an ordinance change. Ald. Hagen said his main concern is regarding liquor licenses. Atty. Hart will prepare the ordinance and bring it back to a future Council meeting. 7. Pay Increase Consideration for Two Employees Working at the Wastewater Treatment Plant to recognize their successful completion of WDNR Wastewater Exam for Operators in Training (Grade T) Henry Veleker, City Administrator/Clerk Mr. Veleker said Cody Bank and Eric Johnson have passed their first DNR wastewater exams and are now considered by the State to Grade T or Operators in Training. They have completed their six-month probationary period with the City and earn $21.03 per hour. He is asking the City to increase their wage by $.35 per hour to reflect past increases gained by operators in the same position. If Council approves their wage would increase to $21.38 per hour effective as of Council vote. MOVED by Ald. Hackett, SECONDED by Ald. Kjelland, Council APPROVES a Pay Increase for Cody Bank and Eric Johnson, WWTP Employees of $0.35 per hour, both employees have completed the WDNR Wastewater Exam for Operator s in Training (Grade T Level), effective upon approval by Council to $21.38 per hour each. 9 11. ISSUES/PROJECT DISCUSSION (30-MINUTE MAXIMUM NO ACTION REQUIRED) None 12. COMMUNICATIONS AND RECOMMENDATIONS OF THE MAYOR Mayor Smith said there were still vacancies on some committees. He said a city member is still needed for the library which could be another Council member. There was a resignation on the Board of Appeals. A citizen at large is needed. They only met once or twice last year. Also, one member is needed on the OZ Property Ad Hoc committee. If there is any interest, please contact Mayor Smith. 13. ADJOURNMENT MOVED by Ald.
