28 Trauma & Justice Strategic Initiative: Goals Develop a comprehensive public health approach to trauma. Make screening for trauma and early intervention and treatment common practice. Reduce the impact of trauma and violence on children, youth, and families. Address the needs of people with mental disorders, substance use disorders, co-occurring disorders, or a history of trauma in the criminal and juvenile justice systems. Reduce the impact of disasters on the behavioral health of individuals, families, and communities. 5
29 SAMSHA and Criminal Justice SAMHSA s criminal justice grant activities center around treatment services related to drug courts, offender reentry, early diversion from jails, early intervention to prevent deeper systems penetration, community behavioral health flexibility. CSAT s criminal justice budget has expanded in the past few fiscal years from approximately $23 M to $69 M; even in present budget cutting mode current budget is $67 M of which approximately $45 M is committed to treatment - drug court activities. CSAT has committed over $250 M towards grants supporting the expansion and enhancement of treatment services for drug court clients. 6
30 SAMHSA/CSAT and Drug Courts SAMHSA/CSAT has supported drug courts almost from their inception with the first drug courts such as Miami-Dade County s drug court through technical assistance and expertise regarding behavioral health issues; SAMHSA has supported the NADCP conference for over a decade; SAMHSA links its drug court grantee meeting with the NADCP annual conference 690 participants this year. 7

35 Joint Adult Drug Court Solicitation to Enhance Services, Coordination, and Treatment , SAMHSA/CSAT and the U.S. Department of Justice, Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA), collaborated in creating a new joint opportunity: Enhancing Adult Drug Court Services, Coordination, and Treatment. The program allows grantees to develop one comprehensive strategy for enhancing drug court capacity, with access to both criminal justice and substance abuse treatment funds through one application. 36 FY 2013 Joint Adult Drug Court Solicitation SAMHSA and BJA Purpose: Allow applicants to submit a comprehensive strategy for enhancing drug court services and capacity and compete for both criminal justice and substance abuse treatment funds with 1 application. Due Date: June 13, 2013 Available Funding: Up to $3.1 M BJA; $3.25 M in SAMHSA funds Estimated Number of Awards: 10 Estimated Award Amount: Up to $300,000 in BJA; $325,000 in SAMHSA funds (per yr. for SAMHSA $) Length of Project Period: Up to 3 years 13
37 Jointly Funded Initiative: SAMHSA and BJA Applicants are limited to states or state courts applying on behalf of a single jurisdiction; local courts; counties; other units of local government; or federally recognized Indian tribal governments (as determined by the Secretary of the Interior). Indian tribal governments may apply directly or through other public or not-for-profit private entities. Eligible jurisdictions must have a fully operational (at least 1 year) adult drug court. 14
38 Coordination Requirements Non-tribal applicants must include a letter from the State Substance Abuse (SSA) agency Director or designated representative that they support the application and confirm that the proposal conforms to the framework of the State Strategy of Substance Abuse Treatment. Applicants must include this letter as part of application. Non-tribal applicants must also submit a letter from the Chief Justice of the state s highest court, the State Court Administrator, or a designee (for example, the state drug or problem-solving court coordinator) describing how the proposed application would enhance the statewide efforts related to problem-solving courts. Applicants must include this letter as part of their application. Tribal applicants submitting on behalf of a tribe/tribal organization must submit a Tribal Authorizing Resolution in lieu of a letter of support from the state as an attachment of their application. 15
39 Program Goals and Objectives Overall goal of the Joint Adult Drug Court Solicitation is to expand and/or enhance the drug court capacity of state, local, and tribal levels to reduce crime and substance abuse among high risk/high need offenders. This evidence-based approach includes the key elements of judicially supervised treatment, drug testing, community supervision, appropriate sanctions, and recovery support services. Grant funds must be used to serve high risk/high need populations diagnosed with substance dependence or addiction to alcohol/other drugs and identified as needing immediate treatment. Grant funds may be used to provide services for co-morbid conditions, such as mental health problems, as long as expenditures remain consistent with the drug court model which is designed to serve individuals needing treatment for substance dependence or addiction to alcohol/other drugs. 16
40 TI : FY 2013 SAMHSA Adult, Juvenile and Family Drug Court Grant Program Title: Grants to Expand Substance Abuse Treatment Capacity in Adult, Juvenile, and Family Drug Courts (SAMHSA Treatment Drug Courts). Funding Available: $12.98M reduced to $9.3 M Funding Amount: period. Up to $325,000 per year x 3 year Number of Grants: Up to 41 awards (subject to sequestration reductions). Reduced to 29 awards. 17
41 FY 2013 SAMHSA Treatment Drug Courts RFA: TI Description of Program/Target Populations: Expand and/or enhance substance abuse treatment services in existing* adult, juvenile, and family "problem solving" courts which use the treatment drug court model in order to provide alcohol and drug treatment (including recovery support services supporting substance abuse treatment, screening, assessment, case management, and program coordination) to defendants/offenders. *Applicant must certify in operation by October 1. 18

43 Important Keys in Eligibility Eligible entities include State/local government entities with direct involvement with the drug court; Tribal Court Administrator, federally recognized tribes and tribal organizations Individual adult, juvenile, and family dependency/drug courts. When State/local/tribal gov t units apply on behalf of drug court applicant they will be grant recipient and responsible for satisfying grant requirements. When applying for multiple DC letters of support from each DC judge must be included. 20
44 Focus on Clinical/Treatment Services $ to serve high risk, high need populations with SA or CO Disorders; Expand and/or enhance treatment and recovery services. Screen/Assess for Co-Occurring Disorders/Develop Tx approach for those so identified MAT-Up to 20% of funds may be used Encouraged to provide HIV rapid testing ($ up to 5%) Viral Hepatitis testing (Up to $5000) Must utilize all available revenue sources first-payor of last resort 21
45 Using Evidence-Based Practices Grants are intended to fund services/practices that have a demonstrated evidence based and appropriate to the population of focus. EBP refers to approaches to treatment that are validated. Applicants need to identify the EBP to be implemented Identify and discuss the evidence that the EBP is effective for selected population; If using more than 1 EBP provide a justification and which modality and population each practice will support; and Discuss the populations the EBP is effective and how it is appropriate to your population. 46 Grant Funds Breakdown Up to 20% may be used for data collection, GPRA performance measurements, performance assessment/evaluation. Up to 15% may be used for infrastructure development partnering; MIS/EHR, training/workforce development Remainder may be used for all direct/indirect substance abuse treatment and recovery services project direct, staff, contracts, clinical services, recovery support services. No more than 20% for Medications No more than 5% may be used for HIV rapid testing. 23
47 Affordable Care Act and Health Information Technology Issues: Given the strong emphasis on adoption of electronic health record technology, applicants are asked in the program narrative: (Relates to BH providers not court!) If you currently have an existing EHR system, identify it and include a copy of your EHR vendor contract with ONC; If you do not currently have an existing EHR system, describe plan to acquire an EHR system plan should include staffing, training, budget requirements, and timeline for implementation. 24
48 VIP: Application to several SAMHSA and BJA Drug Court RFAs Applicants may submit an application in response to one or all grant solicitations from SAMHSA and/or BJA; BUT Neither SAMHSA or BJA will make more than one award for the same proposed drug court project in the same jurisdiction/court. 25
49 Grants.gov In FY 2013, SAMHSA restricts all grant applications to electronic submission; previously one of last agencies to allow paper submission. Does my organization have a DUNS number? Has my organization registered with the System for Award Management (SAM; formerly CCR)? Have the Authorized Organization Representatives (AOR) who will submit the application registered to obtain a user name and password? 26

53 Grant Program Differences: BJA vs. SAMHSA Drug Court grants SAMHSA s primary focus is on the expansion and enhancement of behavioral health prevention and treatment for individuals with substance abuse, mental health and co-occurring disorders; Don t fund the administration of the drug court or inherently judicial or law enforcement activities/staff; No match to federal $; 3 year grants amount of award is for EACH year; No restriction on eligibility for violent offenders ; Peer review process is more complicated/lengthy. Awards made in last week of September of FY. 30
