1 May 2018 Resit Paper English and Welsh Students only Candidates answering the questions from the Welsh law viewpoint: Please ensure you write "Welsh" on the front of your examination booklet. The examiners may expect candidates to show knowledge of legislation which is in place but not in force (i.e. has been enacted) and regulations which have been made but are not yet in force, if they are directly relevant to the subjectmatter of the examination. There are three sections to the examination paper: Section A Section B Section C Consists of five questions. Candidates should attempt to answer all questions. Total allocation of marks is 25 marks. Consists of three questions. Candidates should attempt to answer two questions. Total allocation of marks is 50 marks. Suggested time allocation is 90 minutes. Total time allowed three hours (plus ten minutes reading time). The Agriculture paper is a closed book; no materials are permitted to be taken into the examination room. The examination paper has seven pages, including this front sheet. 1

2 Section A Candidates should attempt to answer all questions - total of 25 marks. 1. Briefly explain, with the aid of examples, what is meant by the terms labelling and placing on the market, in the context of feed law. 2. Outline the facilities and equipment requirements, under Annex II of Regulation (EC) No 183/2005 laying down requirements for feed hygiene, placed on a manufacturer of compound pig feed containing trace elements with maximum permitted limits. 3. Your line manager asks you to prepare your authority s annual feed sampling programme. List the factors and issues that you would need to consider in devising the plan. 4. Briefly explain, with the aid of examples, the circumstances in which it may be appropriate to use voluntary procedures to remove a health risk condition. 5. Outline the role of the Food Standards Agency (FSA) in respect of feed law enforcement and its relationships with local authorities and National Trading Standards (NTS). End of Section A. 3 Section B Candidates should attempt to answer one from two questions - total of 25 marks. 6. Answer both parts. (a) Discuss the powers and enforcement options available to an authorised officer to enforce specified feed law and consider their effectiveness. (13 marks) The Feed Law Code of Practice (England), issued in April 2014, introduced earned recognition, whereby those feed business operators who demonstrably maintain high standards of feed safety, by taking appropriate steps to comply with the law, may have these standards recognised by the competent authority, when determining the frequency of their official controls, and therefore earn recognition. (b) Discuss to what extent earned recognition has been a positive step in safeguarding public and animal health. (12 marks) 7. Incorporating the National Enforcement Priorities (NEPs) for animal feed and food hygiene at the level of primary production into a programme of official feed and food controls helps drive up sustained improvements in levels of compliance, by Feed Business Operators (FeBOs), through intelligence-led enforcement. 4 Section C Candidates should attempt to answer two from three questions - total of 50 marks. 8. Answer all parts You carry out an inspection at a dairy farm, in your area, owned by A J Jones & Son. According to the last inspection records on file, the farm makes silage without using additives (other than silage additives) and mixes it with grain (grown on the farm dried using gas), fodder beet and a complementary feed containing additives - for the exclusive feeding to the farm s livestock. The complementary feedingstuff is bought in from a local feed mill, Feed Mix Ltd, based 40 miles away but within your authority s boundary. Your premises database records show that A J Jones & Son is appropriately registered for R11 and R14 activities, but you have no record of Feed Mix Ltd. During your inspection of A J Jones & Son, you discover the following: 1. There are no pest control measures in operation and you find rat droppings in numerous places around the farm. 2. The bags of mineral feedingstuff are being stored next to 100L drums of diesel, which have leaked on several opened bags. 3. The bags are labelled with a batch code, name and address of Feed Mix Ltd, and the description Complementary Feed for Dairy Cows. No other labelling is present on the bags. 4. There is a serious accumulation of refuse near to the animal production unit. 5. No records are kept of any feed bought in by Feed Mix Ltd. 6. The guttering to the barn holding feed materials is in a poor state of repair, allowing rain water to seep through the roof and on to the feed. (a) In respect of A J Jones & Son and Feed Mix Ltd, detail the steps you would take, including the evidence you would gather and any enforcement action you would take, and why, to investigate the matter further. (12 marks) (b) What offences may have been committed by A J Jones & Son and Feed Mix Ltd? (6 marks) You subsequently conduct an interview recorded under the Police and Criminal Evidence (PACE) Act 1984 with the Company Secretary of Feed Mix Ltd. 5 9. Answer all parts. You are contacted by a concerned pet owner who recently purchased a 10kg bag of prepacked dry cat food from a countryside store, Animal Small Holdings Ltd, in your area. She tells you over the phone that her cat has been taken seriously ill and hospitalised at the local veterinary surgery. The vet suspects that the cat has suffered lead poisoning and the recently purchased feed may be to blame. (a) Indicate the information that you would require from the complainant to investigate this matter further, and for inclusion in a witness statement. Your enquiries reveal that Charming Cat Food Ltd, based in your area, is the manufacturer of the feed, but you have no record of the business on your database. (b) Detail the steps that you would now take and the evidence you would gather to investigate the matter further. (10 marks) Having submitted a formal sample of the product to your Agricultural Analyst for testing, you subsequently receive a certificate which states that the level of lead found is outside the maximum permitted level and, in his opinion, the feed is unsafe. (c) What offences may have been committed by Charming Cat Food Ltd? (4 marks) The Company asks for your advice on drawing up an appropriate notice to consumers. 6 10. Answer both parts: You are due to conduct an inspection of Happy-Go-Lucky Pets Ltd. The Company has recently started sourcing, direct from the USA, compound feed products for cats and dogs. The Company manufactures its own range of pet treats which are sold online via its website. This is the first inspection carried out at the premises. (a) Describe fully how you would carry out an inspection, from preparation through to returning to your office, including any records that you would inspect, and why, to ensure that the business is complying with feed law, and any post-inspection administration.
