Approval of Minutes of the June 25, 2013 Meeting (For Possible Action) Ms. Schuman introduced this item and entertained comments from the committee. Ms. Heddy commented that Ms. Munoz s name was incorrectly spelled in different areas of the Minutes and should be corrected to Munoz. Ms. Keever indicated CAMPO needed to be added to various voting items. Ms. Keever stated Minutes would be amended as noted and she would e mail the corrected version the committee. MOTION: Dan Doenges McCarran, NDOT, RTC South, RTC Washoe, Reno Tahoe, CAMPO ACTION: Minutes of the June 25, 2013 meeting were approved as amended. III. Approval of Agenda (For Possible Action) Ms. Schuman introduced this item and entertained comments from the committee. MOTION: Kathy Keever Lydia Bilynsy McCarran, NDOT, RTC South, RTC Washoe, Reno Tahoe, CAMPO ACTION: Agenda for the July 30, 2013 meeting was approved. IV. Public Comment (Opening Period) No public comment. V. New Business a. Nevada Department of Transportation Certification Review: i. Amalgamated Safety Company, Inc. Las Vegas (For Possible Action) July 30, 2013 Meeting Minutes Page 2 of 6
3 Ms. Schuman introduced this item and Ms Torvinen reviewed the agenda materials. Ms. Schuman entertained comments/questions from the committee and there was none. MOTION: Karen Heddy Kathy Keever CAMPO McCarran, NDOT, RTC South, RTC Washoe, Reno Tahoe, ACTION: Approve DBE certification of Amalgamated Safety Company, Inc. ii. Kyle Mountain Fire LLC, dba, Water Pros Las Vegas (For Possible Action) Ms. Schuman introduced this item and Ms. Torvinen reviewed the the committee. NDOT s recommendation was to deny certification based on the gifting of 1% ownership from the nondisadvantaged owner to the disadvantaged owner. Ms. Heddy voiced her concerns on the denial; it was her opinion in that the gift took place in 2011, what was presented to the committee was not enough to deny certification. Ms Schuman stated information was missing from the Certification Summary Report and requested the committee to table this item to the next UCP meeting (August 2013) to allow time to gather all relevant information. Rooftop Digital Imaging LLC, dba, Off the Wall Signs Las Vegas (For Possible Action) Ms. Schuman introduced this item and Ms. Torvinen reviewed the the committee. NDOT s recommendation was to deny because the nondisadvantaged owner gifted 1% to the disadvantaged owner days before applying for DBE Certification, because the disadvantaged owner is the qualified person on the contractor s license and therefore the disadvantaged owner cannot run the company without him. Thus, the applicant does not meet the requirements in 49 CFR Parts and MOTION: Kathy Keever Karen Heddy CAMPO McCarran, NDOT, RTC South, RTC Washoe, Reno Tahoe, ACTION: Deny DBE certification of Rooftop Digital Imaging LLC, dba, Off the Wall Signs v. 5 MOTION: Kathy Keever Catherine Smith McCarran, NDOT, RTC Washoe, Reno Tahoe, CAMPO ACTION: Approve DBE certification of Time Printing, Inc. vi. Vegas Heavy Hall Inc., dba, Big Valley Towing Las Vegas (For Possible Action) Ms. Schuman introduced this item and Ms. Torvinen reviewed the agenda materials. Ms. Schuman entertained comments/questions from the committee. NDOT felt it had no choice but to recommend denial of this application as the 100% disadvantaged owner could not demonstrate control. The company bylaws expressly and repeatedly placed all authority and control in the hands of the Directors. There are 3 Directors, including the owner but a majority vote is required for virtually any action, thereby precluding the owner from exercising control. MOTION: Karen Heddy Dan Doenges McCarran, NDOT, RTC Washoe, Reno Tahoe, CAMPO ACTION: Deny DBE certification of Vegas Heavy Hall Inc., dba, Big Valley Towing VI. Discussion a. Inclusion of Gender and Ethnicity to ACDBE/DBE Profiles on the NDOT DBE Website Database Ms. Schuman indicated all information was received and was uploaded into the DBE database. July 30, 2013 Meeting Minutes Page 5 of 6

Small Business Enterprise (SBE) Application, Certification and Database Ms. Schuman stated NDOT, RTC Washoe and Reno Tahoe Airport Authority held a public meeting on July 17, 2013 in Reno and thanked RTC Washoe for the refreshments they provided. NDOTs public meeting with RTC South on July 25, 2013, in Las Vegas had a good turn out and she noted the comment period is progressing nicely. Ms. Bilynski asked if NDOT would share their proposed SBE contract language. Ms. Keever and Ms. Heddy were interested in the language as well. Ms. Schuman said she would provide SBE Contract language to the Committee. c. Office of Inspector General (OIG) Audit Report of U.S. Department of Transportation DBE Program Committee did not have additional information to provide. d. Other Ms. Bilynski and Ms. Schuman indicated they would not be attending the August 2013 NUCP meeting. Ms. Schuman informed Ms. Keever that she forgot to turn on the recording function for the meeting. Recording of the meeting was not available. VII. Public Comment (Concluding Period) No public comment. VIII.
