1 For Private & Restricted Circulation Only AYURBIZ- October Vol.1 No. to December 8 October 2012to December A Quarterly Newsletter for Ayurvedic & Herbal Industry From the President s Desk Dear Members, Wishing you all Season s Greetings and A Happy & Prosperous New-Year 2013 You are all aware that our industry is seriously affected with the notifications issued by the Department of AYUSH on Schedule Z, Prefix Suffix and of Labeling issues. We were repeatedly requesting the Secretary, Department of AYUSH for an appointment to resolve the burning issues of the ASU industry. However, department is not showing any interest in having dialogue with industry members. We are still trying our level best to meet the Secretary, Department of AYUSH to resolve the issues at the earliest. The present Executive Committee of the Association will be retiring according to the Constitution of the Association at the Annual General Meeting scheduled to be held on 22 nd February Notice of the AGM along with the nomination forms for election of new Managing Committee members would be sent to all Members shortly. We earnestly request the Members to actively participate in the activities of the Association by sending their nomination forms duly filled, by specified date. I am thankful to all the members for the active support and co-operation extended to the Managing Committee for the successful completion of one term. From October to December 2012, eight new members have been enrolled as a member of our Association. 2 2 AYURBIZ- October to December 2012 From the Secretary s Desk A gist of activities and updates are given below for your information. 1. ADMA had coordinated/associated 5 th World Ayurveda Congress & Arogya Expo 2012 and organized further Road shows with the support of local Associations in the following cities:- i. Thrissur on ii. Hyderabad on iii Bangalore on By this, ADMA had organized nine WAC programmes all over the country. This has resulted on booking good number of stalls especially by members of Gujarat (39 Members 52 Stalls) in addition to the members of other states. 2. ADMA with World Ayurveda Congress had organized Two days Pre-Conference Workshop on 5 th and 6 th December 2012 in collaboration with VNS Pharmacy College at Bhopal. We are thankful to Dr. D.K. Swamiji, Group Director, VNS College for providing us their premises and facilities with personnels for organizing this Workshop. We also wish to state that we have received a good response for this programme. We also appreciate the effort and support by Dr. Kirti Laddha, Dean, ICT & Professor of Pharmacognosy Institute of Chemical Technology, Matunga, Dr. Nagesh Sandu, Technical Head, ADMA, Dr. Gopal Garg, Professor, VNS College (Associate Programme Head), and Dr. Nimish Vador, Technical Committee Member, ADMA, without whom this Programme would not have been successful. 3. ADMA with World Ayurveda Congress had also organized GLP / GMP Workshop on 7 th December 2012 at the 5the WAC & Arogya Expo 2012 at Bhopal in addition to Seminar on Sustainable Management of Bio Resources on 9 th & 10 th December 2012 in collaboration with NMPB. We are thankful to Dr. N.B. Brindavanam for his painstaking efforts in organizing this Seminar. 4. We have received Notification GSR No. 844(E) dated 26 th November 2012 issued by the Department of AYUSH with regard to the amendments in the Drugs & Cosmetics in Rule 161, and we sent our submission to Shri Ganeriwalji, Joint Secretary, Department of AYUSH on 21 st December We have sent our letter dated sent to Mr. Anil Kumar. Secretary, Department of AYUSH enlisting therewith some of the issues and requesting for an appointment for the Interactive meeting with the industry members as per the date convenient for him. However, we have not received any response for the same. 6. As you are all aware that our Association had made a submission on 12 th September 2012 while receipt of Notification GSR 597(E) dated 30 th July 2012 from the Department of AYUSH with regard to Prefix & Suffix. The same was circulated to all the members for their information. Our Association has now received a Meeting Notice from the Department of AYUSH to discuss on the said draft Notification which is scheduled on 10 th January 2013 at New Delhi. We would inform the outcome of the meeting after the meeting takes place. 7. While on request for appointment, the Chairman, National Biodiversity Authority was kind enough to give the appointment for 6 th December However, due to WAC Programmes, ADMA had requested for an appointment after 17 th December 2012 for a Brainstorming Session to resolve issues Regarding Biodiversity Act & Rules. However, we have not yet received the appointment and we are on follow up for the same. 8. We have requested Secretary, Department of AYUSH vide our letter no. 1212/ADMA/530 dated for an Arogya Calendar for the financial year , as some of the members have communicated for the same. We are awaiting for the response. 9. Our Association had received the Minutes of the meeting of Sub-Committee under ASUDTAB regarding examination of proposed Schedule Z held on at CCRUM which was circulated to all the Members. We had received draft minutes of the meeting from Dr. Gaurav Sharma, co-opted member of the Sub-Committee inviting the inputs on the said draft minutes and our Association had sent its comments. However, it was observed that our comments have not been considered while finalizing the minutes. 10. Department of AYUSH had requested to intimate the name of the ADMA Representatives for the Technical Committee constituted to deliberate the

3 AYURBIZ- October to December issue on Order passed by High Court, Jammu & Kashmir with regard to the procurement policy for purchase of Ayurveda drugs under CGHS/ Research Council, and the names of the President Shri Subharthee Dey or Hon. General Secretary Shri Chandrakant Bhanushali were informed for this Committee. Two meetings were held on 23 rd November 2012 and 10 th December Since President and General Secretary could not attend the meeting due to prior commitments, Dr. J.P. Singh represented ADMA in both the meetings. A final meeting has been called by the Department on 28 th December 2012 and ADMA has nominated Dr. J.P. Singh to attend this meeting and the outcome of the meeting would be informed to the members. 11. We are receiving queries from the members with regard to applicability of the Bar coding for the exports of the Ayurvedic products. We wish to clarify that as per the notification of the Commerce ministry implementation of barcoding is effective from January 1, We have given to understand that Mercury usage around the world is being hastily curtailed by which developed countries would declare their environment to be `Mercury free in a few years. As such all use of Mercury in Ayurveda is being banned and the effects of this are seen in phenomenon raise of Mercury prices. We are going to make a submission in this regard to the Department of AYUSH the draft of which is circulated to all members for their feedback Chandrakant Bhanushali Hon. 4 4 AYURBIZ- October to December 2012 Aloe Vera - Classification Kingdom : Plantae Division Magnoliophyta Class: Liliopsida Order : Asparagales Family : Asphodelaceae Genus : Aloe Species: A.vera Zoological name : Aloe Vera are even long and triangular in shape. The tissue in the center of the Aloe leaf contains a gel which yields the aloe gel. Its leaves are rich in water that is why it can survive for years. These leaves have spiky margins and are blotched creams. It is the member of the Lilly family. The roots of the pant are thick and fibrous. The fruit is the triangular capsule containing numerous seeds. Other species of Aloe Vera: There are more than 200 species of Aloe Vera. Aloe Barbadensis Miller, Aloe Saponaria, Aloe Chinensis, Aloe Variegata, Aloe Forex, Aloe Lalifolia and Curacao Aloe are some of the known species of Aloe Vera. Location: Aloe Vera is cultivated throughout India. It is commonly found in Mumbai, Gujarat and South India. It mainly grows in the tropical and sub tropical areas. It grows well on sandy and well drained soil. It is widely grown in the Ranthambore National Park in India. Cultivation methods: Aloe Vera plant is propagated through the seed. It prefers a well drained sandy soil in sunny location. Aloe Vera needs the temperature of above 40 degrees. They should be potted in the spring season and watered carefully until established. It grows in the arid climate. They should be watered regularly in the summers. But over watering can kill the plant. It also grows in partial shade. It reaches the maturity inn four years when the leaves are harvested. Aloe Vera Description: Aloe Vera grows to a height of 12 to 16 inches. It has a fibrous root system. It does not have stems. It has thick freshly leaves with sharp points, which are up to 18 inches long and 2 inches wide at the base. Its leaves Medicinal uses: Aloe Vera is the herbal plant, used to heal the burn marks. Aloe Vera cures the skin diseases. It can also be used to remove dandruff from the hair. Aloe Vera is taken internally for the stomach disorders. The leaves of Aloe Vera are used for the treatment of facial edema or swelling. Its fluid is beneficial in reducing the inflammation and pain. Aloe Vera is used in cosmetics and even in the food industry. Curacao aloe acts as laxative, which is used against constipation. The fresh juice of its leaf blades can be applied directly to the ulcers, burns, sunburns, and fungal infection. Organic Aloe Vera juice reduces acidity. It prevents from fungus, influenza virus, measles, and high fever. Other names: Cape aloe, Aloe curacao, Barbadoes aloe, Venezuela aloe, Indian aloes, Ghirita, Lu hui, Star Cactus are the other names used for the Aloe Vera. It is also called miracle plant, Burn plant, medicine plant and first-aidplant. Other uses: Aloe Vera is a very popular potted plant. It is grown in houses for the decoration. The leaf sap is used to make a soothing and healing moisturizing cream, which is good for the dry skin. It is used in the making of anti wrinkle cream. It is even used in the preparation of shampoos. 5 AYURBIZ- October to December We are reproducing herewith the notification issued by the Department of AYUSH, Ministry of Health & Family Welfare with regard to amendments in the Drugs & Cosmetics Rules 1945 in rule 161. Ministry of Health and Family Welfare [Department of Ayurveda, Yoga and Naturopathy, Unani, Siddha and Homeopathy (AYUSH)] NOTIFICATION New Delhi, the 26th November, 2012 G.S.R. 844(E):- Whereas the draft of certain rules further to amend the Drugs and Cosmetics Rules, I945 was published. vide notification G.S.R. 249(E), dated 22nd March 2012, of the Government of India in the Ministry of Health and Family Welfare, in the Gazette of India, Extraordinary, inviting objections and suggestions from persons likely to be affected thereby before the expiry of a period of forty-five days from the date on which copies of the Official Gazette containing the said notification were made available to the public; And whereas, the said Gazette was made available to the public on the 22nd March 2012; And whereas, objections and suggestions received from the public on the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 33-N of the Drugs and Cosmetics Act, 1940 (23 of I940) the Central Government, hereby makes the following rules further to amend the Drugs and Cosmetics Rules, 1945, namely:- RULES 1. (1) These rules may be called the Drugs and Cosmetics (5th Amendment) Rules, (2) They shall come in to force after one year from the date of their final publication in the Official Gazette. 2. In the Drugs and Cosmetics Rules, 1945, in rule 161,- (a) (i) (ii) in sub-rule (l),- after the words true list of all ingredients the following shall be inserted namely:- with the botanical names of plant based ingredients along with plant part(s) and form of ingredients, in which, these are ; alter the words First Schedule of the Act the following shall be inserted namely:- and in respect of Patent or Proprietary Ayurveda, Siddha or Unani drugs, the true list of all the ingredients with the botanical names of plant based ingredients along with plant part(s) and form of ingredients, in which, these are used in the formulation, with their quantity: PROVIDED that if needed, standardized abbreviations prescribed for part(s) and form of Ingredient(s) in the official Ayurveda, Siddha and Unani Pharmacopoeias and Formularies, may be used on the label; (b) in sub-rule (3), - (i) (ii) after the words and brackets Ayurvedic (including Siddha) or Unani drug the words and Patent or Proprietary Ayurveda, Siddha or Unani drugs shall be inserted; in item (i), for the words For this, the words For Ayurveda, Siddha or Unani Drug shall be substituted. 6 6 AYURBIZ- October to December 2012 ADMA Representation with regard to Gazette Notification (Extra Ordinary) GSR 844(E) dated 26 th November 2012 regarding amendment in Rule 161 of the Drugs & Cosmetics Rule 1945 The Association has made the following representation to Shri Anil Kumar Ganeriwala, Joint Secretary,Department of AYUSH,Ministry of Health & Family Welfare on 21 st December 2012 on the above said Gazette Notification. We are in receipt of letter no.k.11020/05/2012-dcc (AYUSH) dated 10 th December 2012 addressed to our Association (ADMA) by your department enclosing therewith a copy of the Gazette Notification (extraordinary) G.S.R. No. 844(E) dated 26 th November 2012 regarding amendment in Rule 161 of the Drugs & Cosmetics Rules 1945 In this regard, we wish to make our submission as under: i. After going through the draft Rules Notification F.No.K-11020/5/2011- DCC(AYUSH) dated [GSR 249(E)], which was uploaded in the website of department of AYUSH, inviting objection or suggestion on the said Notification, our Association (ADMA) had made its submission to the Joint Secretary, Shri Balaprasadji vide letter no. 0512/ADMA/143 dated 9 th May 2012 giving therewith the practical problems which would be faced by the Industry and requested to consider to revoke the Notification no. F.No.K-11020/5/2011- DCC (AYUSH) dated [GSR 249(E)]. A copy of our letter is attached herewith for your perusal. (Annexure I) * ii. Further on, a Consultative meeting was organized by Department of AYUSH to discuss the matter pertaining to Draft Rule 161 (1) on 13 th June 2012 wherein ADMA Representatives and Representatives of Association of Manufacturers of Ayurvedic Medicine (AMAM), Punjab Ayurvedic Drug Manufacturers Association(PADMA) and Ayurvedic Medicine Manufacturers Organisation of India (AMMOI) were present in addition to Officials of the department of AYUSH and this meeting was chaired by Joint Secretary, Shri Bala Prasadji. iii. The presentation was made in the meeting by our Association (ADMA) explaining therewith the hardship the industry is going to face if the said Notification is implemented. Copy of our Presentation is attached herewith (Annexure II)* iv. Since the meeting held on 13 th June 2012 was an official meeting, we were waiting to receive the minutes of the meeting from the department of AYUSH. We regret to state that till date we have not received the Minutes of the meeting held on for our record. However, we are surprised to receive the final Notification dated by quoting Objections and suggestions received from the Public on the said draft rules have been considered by the Central Government whereas our Association (ADMA) and other Associations like AMAM, PADMA and AMMOI had recommended some suggestions for the draft Rules Notification dated which are not considered. We enclose herewith (Annexure III)* the noting made by us with regard to the matter discussed in the meeting held on for your ready reference. We wish to bring to your kind notice that the Joint Secretary, Shri Bala Prasadji mentioned in the said meeting that he shall discuss the matter again with more Representatives of Industry before finalising the Notification. However, further meeting before issuing the Notification GSR No. 844(E) dated was not taken place.
