1 Proposal and Admissibility of granting pre revised scale of Rs to Technicians to maintain Pay Parity with Lighting Assistants of AIR and Doordarshan w.e.f. 01/01/1996, working in Prasar Bharati on deemed deputation in the spirit of verdict of Hon ble Supreme Court dated 10/01/2013. The pay parity of Technician with Lighting Assistants is restored as per verdict of Hon ble High court of Chennai on dated which was further upheld by Hon ble Supreme court of India on dated On directives of Ministry Information &Broadcasting and Prasar Bharati, the Director General, All India Radio issued order no.8/8/2006-s-iv(a)/part-1/07 dated 11/3/2014 (Copy enclosed) granted pay parity to Technicians with Lighting Assistants from to by giving notional pay fixation and with arrear the pay parity of Technician with Lighting Assistant was restored in the Scale of Rs The pay party of Technician with LA was once again disturbed as Lighting Assistants payscale was revised to Rs w.e.f (pre-revised) vide High Court of Delhi judgment dated in WP no 6544/2007. The ministry of I&B granted approval for implementation of the order by extending the benefit of higher pay-scale Rs to Lighting Assistants vide order no. 501/03/2011-BA(E) dated and order no. 515/65/2012-BA (E) dated While considering the merit of case, CEO Prasar Bharati has taken a decision in the meeting held on dated 22/04/2014 in Prasar Bharti Secretariat that the parity of Technician with Lighting Assistant is already ensured by the Apex court and it is decided in the meeting that DG(AIR) will prepare a proposal with all justifications and also prepare full financial implication which includes immediate and Annual financial implication while extending benefit of Rs pay scale (pre-revised) to Technician w.e.f. 1/1/1996 to maintain parity with Lighting Assistants as decided by the Hon ble Supreme Court. After approval of DG(AIR) and Prasar Bharati the proposal will be sent to Ministry of Information & Broadcasting for their approval. Brief Facts 1 The Lighting Assistants was having pay parity with Asstt. Cameraman which was disturbed on and restored as per verdict of Hon ble Supreme Court of India. The pay scale of Lighting Assistants was revised from to through order no A-1401/1/80-S1/TV(A) dated of Ministry of I&B in pursuance of Hon ble Supreme Court order dated The Technician of AIR and DD was having pay parity with Lighting Assistants till And their parity was disturbed when the Lighting Assistant got the revised pay scale of Rs after court verdict. 3 The Technicians and Seiner Technicians were also demanded the parity with Lighting Assistants and Ministry of I & B granted them the parity from and place them equal to Lighting Assistant Gr.II and Gr.I as recommended by Vth Pay commission.

2 4 The Technician and senior Technician agitated as their parity was restored from and their claim from was ignored by Ministry. 5 The agitated Technicians & Senior Technicians belongs to two different associations namely ARTEE and ADTEA, approached the court and ultimately the Hon ble Supreme court gave the pay-parity to Technicians and Senior Technician with Lighting Assistants by granting notional pay fixation to these two categories of employees from As the pay of Lighting Assistant was revised to Rs w.e.f (pre-revised) as per the judgment dated of High Court of Delhi in WP(C) no.6544/ The pay of Technicians was revised to Rs as per the judgment dated of Hon ble High Court Chennai as the Lighting Assistants was drawing the same pay scale on that date. 8 Due to further revision order the pay-scale of Lighting Assistants was revised from in pay scale of Rs The parity between Technician/Sr. Technician and Lighting Assistant which was restored by Hon ble Supreme Court once again disturbed. Prasar Bharati through a communication to Hon ble Ministry of I & B dated (enclosed as Annexture-II) byaccepting and honouring the decision of Hon blesupreme Court justified the pay- parity and send the proposal of Rs Technician for approval. The proposal of granting pay of Rs to Technician at par with Lighting Assistant is in consonance of the decision of Hon ble Supreme Court and also as per the decision of CEO taken in Prasar Bharati Secretariat on dated Financial Implication both one time and annual are calculated and being placed with the proposal for kind approval of DG(AIR) and Praasar Bharati.
