1 Department of Health and Human Services Policies, Procedures and Protocols Section C: Compliance Policy No. MDHHS-X-XX: Title: Vending Machine Beverage and Snack Foods Policy SUBJECT: Vending Machine: Beverage and Snack Foods Policy Guidelines APPLICABILITY AND PURPOSE The purpose of this policy is to provide Health and Human Services (HHS) departmentwide guidelines for all snack and beverage vending machines and selections offered at all county sites. This policy covers all machines designed to dispense food and beverages located in any County owned, leased or operated space or facility and applies to all members of the HHS workforce. It is the intent of this policy to support efforts to promote health for visitors and staff at all county sites and to comply with all current state and federal vending regulations and nutritional guidelines. Wherever possible, the County will undertake efforts or measures to prevent chronic disease and promote better health by providing access to healthy products in vending and snack machines on county premises and by communicating information regarding nutrition content and healthy selections provided and developing clear procedures for monitoring and maintaining machines. This policy and its procedures will be reviewed at least biannually by HHS Leadership Council. 2 3.0 Forms and Other Attachments References Contacts Approvals POLICY It is the policy of the Department of MDHHS that 75% of all snack and beverage items sold in vending machines located in buildings where Marin DHHS programs operate shall meet the nutritional standards and terms set forth below. 1.1 Definitions Term 1: Beverages: Beverages offered in each vending machine shall meet all the following criteria: No sodas/diet sodas/sugary drinks will be allowed. 1.) Drinking water without added sweeteners, artificial coloring agents or flavorings; 2.) 100% fruit/vegetable juice; 3.) Fruit-based and vegetable-based drinks that are at least 50% fruit or vegetable juice without added caloric sweeteners and do not exceed 12 fluid oz. 4.) Milk products including one-percent, two-percent low fat, non-fat, soy, rice and other similar nondairy drink containing no added caloric sweetener or Bovine Growth Hormones. 5.) No greater than 12 ounces except for water or approved no/low cal beverages. Term 2: Snacks Snack food items offered in each vending machine shall meet all the following criteria for each individual package: 1.) No more than 250 calories; 2.) No more than 35% of calories from fat (with the exception of legumes, nuts and seeds, natural nut butters, eggs and cheese packaged for individual sale). Snack mixes, of which nuts are a part, must meet the 35% standard; 3.) No more than 10% of calories from saturated fat (excluding eggs and cheese packaged for individual sale); 4.) No artificial trans fats; 5.) No more than 35% total weight from sugar and caloric sweeteners except for fruits and vegetables that have not been processed with added sweeteners or fats. 3 6.) No more than 360 mg of Sodium per serving. 7.) At least 10% of items in all machines must meet FDA definition of low sodium (less than 140 mg of sodium per serving for a snack). Term 3: Advertising/Promotion Term 4: Pricing Promotions/advertising for vending products shall only promote items that meet the nutritional standards outlined above. Items that meet nutrition standards shall meet vending contract terms established for pricing and not be priced higher than the items that do not meet the standards. Provide signage on each vending machine to guide customers on how to select healthy choices. B. Provide visual coding system for each product in vending machine that meets healthy nutrition guidelines indicated in policy. C. Provide calorie/nutrition content for all products provided per current FDA regulations. D. Provide written quarterly product sales/commission reports to DHHS on the 15 th of July, October, January and April that identifies by location, quantity/price of Effective Date: July 1, 2012 Page 3 of 6

4 all products sold by category and commission. E. Provide quarterly sales analysis of best and least popular items by site and replace low choice with higher value healthy products that are responsive to consumer choices. Collaborate with MDHHS to promote/advertise healthy choices available at MDHHS vending sites. Provide at least semi-annual taste testing of products and any new products to introduce to staff at all vending sites. 2.2 MDHHS Director Responsible for policy development and overall implementation, monitoring and communication Including; A. Enters into and approves all MOU s/contracts B. Approves procedures and implementation of policy 2.3 MDHHS Division Directors C. Oversees staff/department head communication D. Oversees allocation of funds received to Community Health and Prevention Services for monitoring and maintaining standards and updated information. Responsible for dissemination, implementation and compliance with this policy for all vending machines located within their workplace, including; A. Shall monitor vending machine compliance within their workplace. Shall contact Community Health & Prevention Services to report feedback or non-compliance. B. Shall provide communication/feedback as to product requests that meet guidelines and other suggestions by their site. 2.4 MDHHS Community Health & Prevention Services Responsible for monitoring the policy overall, including: A. Conducting annual review to determine if substantial changes have been made to nutrition standards referenced in the Policy Guidelines above or other current recommendations that would warrant amending the nutrition guidelines established in this policy; B. Act as liaison with vending company in maintaining a list of products and nutrition information that meet the criteria as listed in the Policy Guidelines above. This list shall be updated at least annually and be available on the Effective Date: July 1, 2012 Page 4 of 6
