Hmnan Treasurer PLAINFIELD CHARTER TOWNSHIP Manager MINUTES OF THE PLANNING COMMISSION The regular meeting of the Plainfield Charter Township Planning Commission was held at Township Hall on June 8, Members present: Chair Marie Kessler, Vice Chair David Ridout, Secretary Ray Holland; Commissioners Gary Gerber, Charles Jylha and George Pawlowskir Also present was Peter Elam, Staff Planner. Members Absent: Commissioner Jack Hagedorn Approve Agenda Commission Ridout, with support from Commissioner Jylha, moved to approve the agenda subject to switching the order of items 3. and 4. Consent Agenda Commissioner Jylha, with the support of Secretary Holland, moved to approve the consent agenda. Consider Ordinance to Amend Zoninq Ordinance, Accessory Structures ~ Public Hearing Mr. Elam introduced the proposed ordinance which amends the Zoning Ordinance to increase the maximum allowable size of accessory buildings and to require that portable accessory structures be located in the rear yard, behind the principle building Belmont Avenue * Belmont, Michigan * Phone (616) * Fax (616) * wwwplain?eldchartertwp.org

2 0 Chair Kessler announced the public hearing and opened the?oor for public comments. No public comments were made. Chair Kessler closed the public hearing portion of the meeting. Vice Chair Ridout asked Mr. Elam about the maximum number of accessory buildingsthat can be constructed on a parcel. Mr. Elam explained that a property owner can have a total of three accessory structures, one attached and up to two detached. The only exception is for parcels ten acres in size or greater. These larger parcels may have one attached and up to three detached accessory structures. Mr. Elam further explained that the maximum allowable size of all accessory structures combined is based on lot size as detailed in Section 3.02 of the Zoning Ordinance. Vice Chair Ridout asked Mr. Elam to clarify the interpretation of "behind the principal residence" for portable accessory structures. Mr. Elam explained that these structures can be in the side yard, but behind the rear line of the structure. Commissioner Pawlowskiasked how existing portable accessory buildings would be addressed. Mr. Elam stated that many existing portable accessory structures may continue to remain as legally existing nonconforming structures. Vice Chair Ridout, with support from Commissioner Jylha, moved that the Planning Commission fontvard a favorable recommendation to the Township Board to approve the ordinance to amend the regulations for accessory structures as proposed. Consider Special Use Permit and Site Plan Approval ~ Public Hearing Secretary Holland introduced the application that has been submitted for a special use permit and site plan approval to allow a change in the sign area of nonconforming billboards. The applicant is Grand Rapids Outdoor; contact person is Randy Disselkoen; property address ~ 4306 Abrigador Trail, Comstock Park, MI Mr. Terry Heiss, attorney representing Mr. Disselkoen, provided a brief description of the project and stated that he agrees with and accepts the conditions of approval in staff's recommendations. Mr. Elam stated that staff is recommending the Planning Commission grant a special use permit for the modi?cation of the existing billboards located at 4306 Abrigador Trail subject to the conditionsprovided in Mr. Fischer's report.

3 rv Chair Kessler announced the public hearing and opened the?oor for public comments. Mr. BillParris, 5131 Pleasant Creek, stated that he serves on the Comstock Park Downtown Development Authority's Board and he believes that Mr. Disselkoen's billboards would be a good place for public fundraising advertisements. Mr. Disselkoen, applicant, stated that a digital sign advertisement can be done locallyand it makes the board more attractive. Chair Kessler closed the public hearing portion of the meeting. Secretary Holland read the following conditions of approval for the Special Use Permit: 1. The billboards shall be consistent withthe terms represented in the document labeled Supplemental Page 1 and 2" provided by Terry Heiss, Authorized Agent dated May 10, 2010 (attached to application). The modi?cation of the billboards shall be limitedto, with the exception of the other conditions of approval. reducing the number of billboards from three to two and reducing the total sign display area from 632 square feet to 548 square feet. The applicant shall modify the existing structure.subject to minor structural reinforcements as approved by the Community Development Department. The modi?cations may include the conversion of the sign areas from static displays to digital subject to the other conditions herein. The billboards may not contain any visible moving parts. alternating or moving messages or have the appearance of having moving parts or messages. Under no circumstances may the billboardscontain a message or display that appears to?ash, undulate, pulse, move, or portray explosions.?reworks,?ashes of light, or blinking lights or otherwise appears to move toward or away from the viewer, expand or contract, bounce, rotate, spin, twist or make other comparable movements. The display or message on the billboards, of any type, may change no more frequently than once every eight seconds, with a transition period of one second or less. The billboards must have installed an ambient light monitor which shall continuously monitor and automatically adjust the brightness level of the display based on ambient light conditions.

4 0 8. Maximumbrightness levels for the billboards may not exceed.2 (two tenths) foot-candles over ambient light levels measured within 150 feet of the sign. Certi?cation must be provided to the Township demonstrating that the sign has been preset to automatically adjust the brightness to these levels or lower. Re-inspection and recalibration shall be annually required by the Township, in its reasonable discretion, at the perrnittee s expense to ensure that the speci?ed brightness levels are maintained at all times. 9. Brightness of digital billboards shall be measured as follows: 0 At least 30 minutes following sunset, a foot candle meter shall be used to obtain an ambient light reading for the location. This is done while the sign is off or displaying black copy. The reading shall be made with the meter aimed directly at the sign area at the pre-set location. 0 The sign shall then be turned on to full white copy to take another reading with the meter at the same location. 0 If the difference between the readings is 0.2 foot candles or less. the brightness is properly adjusted. Commissioner Gerber, with the support of Commissioner Jylha, moved to approve the Special Use Permit for Grand Rapids Outdoors subject to the nine conditions as read by Secretary Holland. Motioncarried unanimously. Secretary Hollandread the additionalconditionof approval for the Site Plan Approval: 1. The applicant must install landscaping as approved by the Community Development Department. Commissioner Jylha, with the support of Vice Chair Ridout, moved to approve the Site Plan Approval to allow changes to a non conforminguse subject to the condition as read by Secretary Holland.
