1 Page 1 of 9 Minutes of the Planning Board of the Township Of Hanover Chairman Eugene Pinadella called the Work Session Meeting to order at 7:01 PM in Conference Room A and The Open Public Meetings Act Statement was read into the record. Board Secretary, Kimberly Bongiorno took the Roll Call. In attendance were Members: Absent was Member: Also present were: Byrne, Critchley, Deehan, De Nigris, Dobson, Ferramosca, Mayor Francioli, Glawe, Nardone, and Olsen Attorney for the Board Michael Sullivan, Township Engineer Gerardo Maceira, and Township Planner Blais Brancheau. The Chairman reviewed the agenda for the meeting. - Gave an update on Fair Share and COAH. - Hopefully they will have an update in days. Mayor Francioli - Updated the Board on the passing of John Dorsey. - Gave an update on EDAC trying to get stagnant properties on Route 10 to come in and focus on redevelopment. - This is a contract on the Old Ukrainian Church by the same developer who developed Quick Chek on Jefferson Road. - It includes the Church, a bike shop, and an air conditioning company. - Updated the Board that reorganization meeting will be on 1/15/ Reviewed that he asked Blais to put together a lesson plan. - One each work session that will have a tutorial class given by Blais to educate the Board on Board responsibilities.
2 Page 2 of 9 PUBLIC BUSINESS called the Public Meeting to order at 7:30 PM and read the Open Public Meetings Act into the record. The Board Secretary, Kimberly Bongiorno, called the roll. In attendance were Members: Absent was Member: Also present were: Byrne, Critchley, Deehan, De Nigris, Dobson, Ferramosca, Mayor Francioli, Glawe, Nardone, and Olsen Attorney for the Board Michael Sullivan, Township Engineer Gerardo Maceira, and Township Planner Blais Brancheau. I. MINUTES November 20, 2018 December 11, 2018 A motion to approve the minutes as written was moved by Mayor Francioli and seconded by Member Ferramosca. A voice vote was held and all members present voted in favor of approving the minutes. II. PUBLIC HEARING 1) CASE NO APPLICANT/OWNER: RELAP, LLC LOCATION: 155 ALGONQUIN PARKWAY WHIPPANY BLOCK: 6903 LOT: 3 ZONE: I Board Action Date JULY 30, 2019 Applicant is seeking preliminary and final site plan approval and C variance relief in order to modify and rearrange the parking layout to include an additional seventeen (17) parking spaces. The applicant will also be modifying the affected grading and drainage plan, adding light fixtures, and adding a second driveway entrance. APPLICATION CARRIED BY LETTER TO JULY 16, record. The Board Secretary read the letter carrying the case from the applicant s attorney into the A motion to carry the case was motioned by Mayor Francioli and seconded by Member Nardone.
3 Page 3 of 9 Members Critchley, Deehan, Dobson, Nardone, Byrne, De Nigris, Ferramosca, Mayor Francioli, and all voted in favor of carrying the case. 2) CASE NO APPLICANT/OWNER: 2H LLC LOCATION: 500 ROUTE 10 WHIPPANY BLOCK: 7501 LOT: 7 & 8 ZONE: B-10 Board Action Date JANUARY 14, 2019 Applicant is seeking preliminary and final site plan and C variance relief for exterior improvements to the building such as terraces, aesthetic designs and new signage and to provide additional ingress/egress access, add an elevator vestibule for handicap access and restriping and parking lot improvements to have 28 defined parking spaces. APPLICATION CARRIED BY TO FEBRUARY 19, The Board Secretary read the letter from the applicant s attorney carrying the case into the record. A motion to carry the case was moved by Member De Nigris and seconded by Member Ferramosca. Members Critchley, Deehan, Dobson, Nardone, Byrne, De Nigris, Ferramosca, Mayor Francioli, and all voted in favor of carrying the case. 3) CASE NO APPLICANT: NEIGHBORHOOD URGENT CARE OWNER: JK BRUGMAN, LLC LOCATION: 568 ROUTE 10 WEST WHIPPANY BLOCK: 7501 LOT: 2 ZONE: B-10 Board Action Date JANUARY 31, 2019 Applicant is seeking preliminary and final site plan and C variance relief in order to install an internally lit freestanding sign. and Mr. Maceira were sworn in by the Board Attorney. Owner of Neighborhood Urgent Care - Sworn in by the Board Attorney. - Sole member of the LLC. - Medical director of Neighborhood Urgent Care.
4 Page 4 of 9 - The issue with the building is that it sits back 70 ft. from the road and is blocked by the Italian restaurant next door. - Moved from Livingston to this location in December of The Neighborhood Urgent Care and the Infectious Disease Center are sister practices in the same building. - It is a double sided sign. - There is a sample picture of the sign in the application. - Questioned the size of the sign and asked if it was appropriate for visualization. - Would not go below an 8 inch letter size for the sign because it would be too small given the character of Route The sign will go on at 7AM and turn off at 11 PM. - Will follow the town ordinance for hours of illumination. - The practicing hours are from 8 AM to 8 PM. Mr. Maceira - Wants notes added to the plan identifying the colors, and that it is double sided. - Gave an overview of the sign colors. - The Neighborhood Urgent Care will be red with white letters. - The IDCNJ will be blue with white letters. - Will follow up with HSA regarding a service contract. - The sign is set back 9 ft. from the edge of the property. - The edge of the sign is 6 ft. from the edge of the property. - It is harder to set the sign back further and it still be visible. - Moving it west would be closer to the driveway. - A utility pole will obstruct the view and it being too close to the driveway would cause visitors to drive past the entrance. - The sign is internally lit with LED lighting.
5 Page 5 of 9 Mr. Sullivan - Details from sign-o-rama should be added to the plan. - Based on the recent recommendations we think that the flag and the motorcycle should be removed. - The motorcycle will be removed from the property. Mr. Nardone - Questioned what point on Route 10 you would finally be able to see the sign. - Reviewed the photos in his report dated discussing where the sign would first be visible to the traveling public. - You can first see the motorcycle and the flag, which is approximately where the sign will be, when you are passing the Italian restaurant. - Questioned the distance between the restaurant and the American flag on this site. - It is no more than 100 ft. from the restaurant sign to the American flag. - You would probably be able to first see the sign from approximately 200 ft. away. - Questioned the hours and visits per day to each of the practices at this site. - The urgent care is open 7 days a week. - Gave hours of operation. - During the week the hours are from 8 AM to 9 PM and on the weekends the hours are from 9 AM to 5 PM. - It is a walk-in practice so visitors do not need an appointment. - We have about visits a day.
6 Page 6 of 9 - The infectious disease office is by appointment and they are usually in the office 2-3 days per week. - These are patients that are coming there specifically for us. - We have the situation where the proposed sign is 6 times the allowed size. - There is also the issue of there being two businesses on this sign. - One business has significantly more traffic than the other business. - Would you be amenable to changing this so there is just one business on the sign? - Having a sign that is trying to communicate two things at 50 mph is difficult. - Is willing to work and come up with a solution. - The problem is the patients for the IDCNJ are older and often end up going past the building trying to find them. - The urgent care is the practice that needs the sign the most so if it comes to that point they can just have an urgent care sign and work to guide the IDCNJ patients to the location. - Would prefer to have both signs. - It is a safety concern with patrons finding the location. - We made the IDCNJ sign smaller but still noticeable to patients. - Reviewed the sizing of the lettering on the sign regarding visibility. - Generically speaking he would not go below 6 inch lettering. - It should be more in the range of 8-10 inch lettering for visibility. - This would mean that with spacing the sign would be 55 inches total in the vertical dimension. - The proposed vertical dimension here is 60 inches. - The width is 6 ft. wide. - The proposed sign could be reduced by about a foot if you got rid of the IDCNJ sign and it would be around 21 sq. ft. - Gave reasons for wanting the slightly larger sign. - There is no one behind them that this sign would be affecting. - The sign would be a benefit because it is directing IDCNJ patients to them safely. - It does not make much sense to go one foot less on the sign when that foot could be very beneficial for members of the public. - Spoke with the sign company to decide what size would be appropriate for visibility. - The colors on this sign are the same as on the wall mounted sign. Mr. Critchley
7 Page 7 of 9 - Questioned if moving the sign to the west would improve visibility. - It would not. - They are trying to avoid putting signs right on the highway and it will not improve the visibility of the sign. Mayor Francioli - Referred to the planners review. - Feels the building is set way back. - Visibility and legibility are a concern. - Since the flag and motorcycle will be removed and the sign should go in that area. - The sign being one foot bigger will allow for more visibility. - Would like the letters to be 13 inches tall but that would make the sign better. Mr. De Nigris - Thinks that was suggesting 10 inch letters. - Agrees with the sign really needs to be visible to give people time to turn. Opened to the public Charles Jenson VP and COO of the Railway - Their concern is in reference to the sign itself and it blocking the railroad crossing right past this sign. - Wants to make sure that there will be visibility of the railroad crossing red light signals. - The flashing lights are 6-7 ft. high. - The sign is approximately 150 ft. from the railroad crossing lights. - Does not think the proposed sign will not interfere with the railroad crossing signals. 8 Page 8 of 9 - My understanding is that you want to promote your business to the public so they can safely get to your site. - It would still be easier to communicate one point on a sign rather than two. - Wants the Infectious Disease Center of New Jersey on the sign. - Just wants the patients to be able to locate the center easily. - Would like to at least have the logo for the IDCNJ if they cannot have lettering for it as well. - Does not want to lose all identification for the IDCNJ. - If they have to though they will remove it. - Questioned the Board about their thoughts on the identifications on the sign. The Board came to a consensus that allows for both businesses names to be on the sign as proposed. Opened to the public Seeing and hearing none Closed to the public Mr. Byrne - We want successful businesses along Route 10 and that requires decent signage. Mr. Sullivan - Summarized the conditions. - The detail of the sign will be noted on the plan. - Comments 1-4 on Mr. Maceira s memo. - The flag and motorcycle should be removed. - Comments regarding illumination from s memo. - Prior to plans being signed there will be a field visit to make sure the sign is not obstructing views. A motion to approve the application with conditions was moved by Member Byrne and seconded by Member Nardone.
