REQUEST FOR COUNCIL ACTION AGENDA ITEM Premises Permit Application for Chanticlear Pizza Grill and Lookout Supper Club 5B AGENDA ITEM CITY ADMINISTRATOR APPROVAL \ 1 r,i"+n 1 U \ RECOMMENDED COUNCIL ACTION: Motion to direct the City Attorney to draft findings and decision denying/approving the application by the Northwest Area Jaycees for Premises Permit Applications for Chanticlear Pizza Grill and Lookout Supper Club. COMMENTS: The Northwest Area Jaycees ("Jaycees") have submitted an application to the City to expand lawful gambling in Maple Grove from two to four sites. Currently the Jaycees conduct lawful gambling at JC's Bar & Grill and at Broadway Bar & Pizza. The application is to expand to Chanticlear Pizza Grill and Lookout Supper Club. Eligibility for gambling permits in Maple Grove is governed in part by City Code , adopted February 16, 2010, which provides: Sec Authorized organizations. An organization making application as required by Minn. Stats , subd. 2, or any other law, shall not be eligible to conduct lawful gambling in the City of Maple Grove unless it meets the qualifications in Minn. Stats , subd. 2, and also meets at least one of the following conditions: (1) The physical site for the organization's headquarters or the registered business office of the organization is located within the City of Maple Grove at least two years immediately preceding application for a license; or (2) The organization owns real property within the City of Maple Grove and the lawful gambling is conducted on the property owned by the organization within the City of Maple Grove; or (3) The physical site where the organization regularly holds its meetings and conducts its activities, other than lawful gambling and fund raising, is within the City of Maple Grove and has been located within the City of Maple Grove for at least two years immediately preceding application for a license; or (4) The organization is a fire relief organization that provides fire protection services to the City of Maple Grove.

2 Premises Permit Applications April 4, 2016 Page Two Criteria (4) plainly does not apply and we have not been advised that the Jaycees own real property within the City, so criteria would not apply. With respect to criteria (1), it appears from public information that the applicant's registered business office is in Corcoran, not in Maple Grove. So in order to be eligible as an "authorized organization" under (1), the NW Area Jaycees would have to show that the "physical site for the organization's headquarters" is within Maple Grove. The term is not defined in City Code or the referenced statute. The common meaning of headquarters is "a center of operations or the chief administrative office of an organization." Thus, absent some physical location housing staff or books and records, an applicant cannot meet this definition and cannot obtain approval under (1). Nothing has been provided which shows that there is a "headquarters" within Maple Grove. That leaves (3). Under that subsection, an applicant is an "authorized organization" if the "physical site where the organization regularly holds its meetings and conducts its activities, other than lawful gambling and fund raising, is within the City of Maple Grove and has been located within the City of Maple Grove for at least two years immediately preceding application for a license." To qualify under this section, the physical site of both regular meetings and other activities must be in the City of Maple Grove. If that criterion is met, then the issues become whether the meetings and activities within Maple Grove must be at a site other than where it conducts lawful gambling. So the council has to determine (1) are meetings and activities held in Maple Grove; and (2) do those activities and meetings have to be at a location other than where lawful gambling is conducted. Based on information provided, the Jaycees hold meetings in Maple Grove, but in the same locations as it conducts lawful gambling. With respect to activities, staff inquired and was provided with an attached to this report. In addition, staff reviewed and has printed portions of the Jaycees' website which describes their organization and their activities. The Jaycees have also been invited to the Council meeting to provide other information that they want the Council to consider. The role of the Council will be to review in the information presented and determine whether or not Maple Grove Code has been met, in particular (3) above. Following discussion there should be direction to the City Attorney to prepare findings and a decision to either approve the permits or deny them for consideration at the next or later meeting. Part of the discussion will be to determine the regulatory intent, based on the language and context. What does seem clear from the language, is that qualifying "activities" within the City do not include lawful gambling or fund raising because of the limiting phrase "... activities, other than lawful gambling and fund raising". So in order to meet this criteria, the Jaycees will need to demonstrate to the satisfaction of the Council that activities other than "gambling and fund raising" have occurred within the City for at least 2 years before the application. With respect to "meetings", two issues are presented (1) are meetings held "regularly" within the City; and, (2) do the regular meetings have to be at a site other than where lawful gambling and fundraising are held. Based on information provided by the Jaycees meetings are held within the City, and rotate between the two lawful gambling sites. Assuming regular meetings can be established, the issue is whether the phrase "... other than lawful gambling and fund raising" modifies the physical site for meetings. If it does, then the Jaycees would not meet the "meeting" criteria.

Corcoran Country Daze is a place where families can come for affordable and free entertainment; a softball tournament and city-wide festival to celebrate the country roots of the Corcoran area and unify the community. The NW Area Jaycees (JC's), then known as the Corcoran Area JC's, brought the idea to the City of Corcoran in With their support and that of the Corcoran Police Department and many area businesses, Corcoran Country Daze was born and has become something to celebrate our great rural, yet suburban community. The best part is, all proceeds go back to the surrounding communities through the many events the NW Area JC's support, including hardship donations, children's events, scholarships, food shelf donations etc. Events including the Inflatable Toddler Zone, Face Painting, Pony Rides, Build-a Bird Feeder, Rock Climbing Wall, Euro Bungee Jumper, Police, Fire and Rescue Exhibits, bands & more are all FREE because of Charitable Gambling.
