SUPPLEMENTAL PROTOCOLS DILLARD S TEST PROTOCOL FOR One Time Use Products **Fair Packaging and Labeling Act OR All Other Products **Uniform Packaging and Labeling Regulations F.P. & L. Act (16 CFR 500) OR NIST Uniform Laws and Regulations Handbook Manufacturer, Packer, or Distributor s Name & Address (City, State & Zip) Product identification Net quantity of contents shall be expressed in terms of weight or mass, measure, numerical count, or combination so as to give accurate information to facilitate consumer comparison (U.S. and metric units). **Country of origin marking 19 CFR Shall indicate country of origin legibly, permanently, and in comparable size and close proximity to any mention of country other than country in which the article was manufactured or produced. Must be visible at point of purchase. Use labeling Claim verification - level 2 * CA Prop 65 CPSD-AN-PTCL USA -- The sample should be reviewed against the requirements of California Proposition 65 to determine if additional testing or labeling is required. Note: Additional cost, sample size & TAT may be required if testing to 1 or more supplemental protocols is necessary. Please refer to the above referenced supplemental protocol(s) for additional information. LABELING CPSD-GB CPSD-GB Use / care instructions that are clear and understandable shall be provided in language appropriate to destination countries. All Examine the retail packaging (or submitted artwork). Record each objective (factual) claim which can be substantiated by the testing within the protocols and rate accordingly. Record testing that extend beyond existing net quantity / dimensional testing on this protocol. Record all other objective (factual) and subjective (opinion) claims as NT and rate as DATA. 2 Labeling review: fiber 16 CFR 300/303 1 Must be visible at point of sale. If label is not visible through packaging, fiber content must be repeated on packaging. Generic fiber name must be used and the contents spelled correctly and listed in descending order of predominance. Note: To determine the actual percentage, please refer to the physical characteristics section for Fiber Content AATCC 20/ 20A/ ASTM D629). If lab analysis does not match claimed, then the label will fail. Labeling review: RN# or WPL # or company name 16 CFR 300/303 1 Must be visible at point of sale. Report actual. When a company name is labeled instead of RN# or WPL#, one of the following can be used: the name of the foreign manufacturer / importer / wholesaler / distributor or ultimate retailer. Note: Company name cannot be a trademark, trade name, brand, label or designer name unless the name is also the name under which the company is Labeling review: flammability of large carpets and rugs Labeling review: flammability of small carpets and rugs doing business. 16 CFR When the carpet or rug has one dimension > 1.83m (6ft.) and a surface area > 2.23 sq. m (24 sq. ft.) If product has had a fire-retardant treatment or is made of fibers which have had a fire-retardant treatment, it shall be labeled with the letter T pursuant to conditions established by the Consumer Product Safety Commission. 16 CFR Small dimensions lesser than or equal to 1.83 m (6 ft) and a surface area lesser than or equal to 2.23 m² (24 ft²). If a product does not meet the flammability criteria for acceptance, product must be permanently labeled as follows: Flammable (Fails U.S. department of commerce standard FF 2-70): Should not be used near sources of ignition. If product has a flame retardant finish or is made of fibers which have a flame retardant treatment, the product must be labeled with the letter "T". Page 2 of 6

3 EPA registration EPA 735-F If claimed Anti-microbial or Anti-bacterial, documentation must be submitted with EPA registration number or FIFRA exemption statement must be listed. FIFRA exemption statement: Claims for treated articles or substances are limited to the following statement, "This product contains a preservative (e.g., fungicide or insecticide) built-in or applied as a coating only to protect the product. An example of an acceptable label statement would be: Antimicrobial properties are built-in to inhibit the growth of bacteria that may affect this product. The antimicrobial properties do not protect users or others against bacteria, viruses, germs, or other disease organisms. Always clean and wash this product thoroughly before and after each use. Treated kitchen accessories or other food contact articles such as a cutting board, high chair, or conveyor belt that may come in contact with food should carry an appropriately qualifying statement, such as: This product does not protect users or others against food-born bacteria. Always clean and wash this product thoroughly before and after each use. Treated products such as bed pans and potty seats that involve potential human contact with bodily fluids or excrement (e.g., blood, vomit, saliva, urine, or feces) should carry an appropriate qualifying statement, such as: This product does not protect users against bacteria, viruses or other disease organisms. In addition, it should be noted that: The treated articles exemption is available only for the protection of the product and not for public health uses.
