No Man is an Island Certification-holders have extensive industry knowledge and many years of experience, yet it s unlikely that any one individual would be willing to state that they are adept at every aspect of our industry. However, collectively our CCDAPP certification holders offer hundreds of years of practical application and expertise in all facets of the drug and alcohol testing industry. 2 OSHA Publishes New Regulations B la nket po st -accid ent test in g no w p ro hib it ed Have you or your clients faced any challenges as a result of this new law? Join the discussion on our expert-help forum: In May 2016, the Occupational Safety and Health Administration (OSHA) published new regulations regarding the tracking of workplace injuries (81 FR 29624, 5/12/16). The preamble to the regulation notified employers that blanket post-accident drug and alcohol testing would no longer be permitted. This means that employer policies can no longer state that post-accident drug testing will occur any time there is an injury requiring medical treatment away from the scene of accident or a particular dollar amount of damage associated with the accident. The potential civil penalty (fine) for violations is $12,471. The implementation date of the regulation was delayed twice as a court challenge progressed. Logos of varying sizes can be added to websites, signatures and printed material to demonstrate an employer s commitment to hiring and retaining individuals holding the highest level of certification available within our industry. To obtain the new logo buttons for CSAPA and CDAPA certification holders, visit: DOT Published Notice of Proposed Rule Making (NPRM) On January 23, 2017 the DOT published an NPRM that would add four opioids to the drug-testing panel and update several testing program provisions. While the addition of hydrocodone, hydromorphone, oxycodone and oxymorphone to the testing panel has been anticipated for quite some time, but a few of the other program provisions contained within the NPRM may not have been on our radar: Removal of the requirement for employers and C/TPAs to submit blind specimens to the labs Requirement for collectors, MROs, STTs, BATs and SAPs to subscribe to the DOT s list-serve Removal of the list of approved SAP certification organizations from Part 40 (list will be maintained on DOT s website) Addressing what a collector must do when a specimen is questionable and the donor is unable to provide a second specimen Prohibiting service agents from using the DOT logo and branding to represent endorsement from the agency View the full NPRM here: 3
4 A new specimen for drug testing? Don t hold your breath! In January of 2015, The Journal of Chromatography B published the findings of researchers from the Department of Laboratory Medicine at the Karolinska Institute, Sweden, who had developed and validated drug testing using exhaled breath. The principle behind the breath test is that aerosol particles become contaminated with the drugs from the fluid lining the airways as they are exhaled. These aerosol particles are then collected onto a filter by a sampling device. The filter containing the particles is then used for testing in the laboratory by mass spectrometry. The researchers tested and validated this new method in routine drug testing. They used a total of 1096 samples over a period of 12 months for detection of amphetamine, methamphetamine, 6- acetylmorphine, morphine, benzoylecgonine, diazepam, oxazepam, and tetrahydrocannabinol. The study describes the fully validated method of drug testing and further applies it to routine measurement on samples that were sent for drug testing. The study also reports for the first time on the levels of drug present in 39 positive samples derived from breath testing. The authors report that this method of breath testing has potential for a wide variety of uses, ranging from clinical applications where urine sampling is more difficult, and compliance testing during drug addiction treatment, criminal justice applications, workplace drug testing, and accident investigations. The researchers are also planning to develop a test for therapeutic drug use by exhaled breath; testing for this is currently underway.
