Owner Ben Rauschenbach, Chairman, called the meeting to order. Buster Constanzi gave the invocation, and Art Schuldt led in the pledge of allegiance. (A) Lynda Davis, secretary, called the roll and stated a quorum was present, which consisted of Buster Constanzi, James Harris, Brett Mattison, Donnie McDaniel, D. J. Mills, Ben Rauschenbach and Art Schuldt. (B) APPROVE AGENDA Marsiglia stated #4, C has been delayed by the applicant, but it was a public hearing, so anyone present for that case can speak. Schuldt asked that C be discussed first. Motion was made by Art Schuldt, seconded by James Harris, to approve the agenda, as amended. Motion carried unanimously. (C) PUBLIC HEARING/ACTIONS 4. C A public hearing to consider the application of Barry D. King for a zoning amendment to change the zoning classification of a tract of land located on a portion of Lot 17, Waller Subdivision, Bossier City, LA, from B-2, Limited Business District, to B-3, General Business District, for a hotel. (just west of Patricia on Old Minden Rd.) (City Council District 3)
2 March 9, 2009 Page 2 Ken Kruithof, BPSB Superintendent, was present to voice concerns for the hotel being right across the street from Rusheon Middle School. He stated 200 children walk to school and asked the MPC to consider the safety issue for them. Roger Moore was present to represent First United Methodist Church of Bossier. which is adjoining the proposed hotel property. It will back up to the area where the church is going to build a family life center and parking. Their other concerns are that the hotel will devalue property; the traffic it will cause and the safety of the church daycare children every day. There being no further opposition, motion was made by Buster Constanzi, seconded by D. J. Mills, to delay C Motion carried unanimously. Schuldt asked if all the property owners would be notified again? Marsiglia said they would be. 1. C (P-36-08) A public hearing to consider Amending the Off- Premise Sign Ordinance, Article 9 of the Unified Development Code. (MPC) Marsiglia said this is close to completion, but was asked last week to open up the RFD to off-premise advertising. There has been none since There have been enough mixed comments to call for a workshop before working on that part of the ordinance. Harris asked if he had a date for the workshop? Marsiglia suggested Tuesday, March 31 st at 4:00 pm. Schuldt said to delay the ordinance further would not be fair to the community. Marsiglia said he talked with the attorney and he suggested lifting the moratorium for all areas not concerned with the RFD. Constanzi asked if it s worked out at the 31 st workshop, would the ordinance be on the April agenda? Marsiglia said no, because he would then have to work up the ordinance. Schuldt suggested going forward with the ordinance and hear the changes when they are ready. Mills said allowing signs in the RFD will set a precedent, since it goes all the way to the Jimmie Davis Bridge. Harris asked if this would complete the ordinance? Marsiglia said if everyone comes to an agreement, it will be back on the agenda in May.
3 March 9, 2009 Page 3 McDaniel asked if this goes to the City Council and Police Jury? Marsiglia said it does. Mattison asked if this could be sent through and just amend the RFD later? Marsiglia said no, because it would have to start over. Mattison reminded it s only an amendment. Constanzi said this way it is holding up vendors. Marsiglia said not if the moratorium is lifted except for the RFD. Joe Kane and Trey Bergeret were present to represent Lamar Advertising. Kane stated he met with Marsiglia last week on another issue about amending the storm permits. Marsiglia said it needs to be worked on some. Kane explained they would submit a picture book, with all codes on all their signs. It would go with the application (for the permit) stating all the materials that would be reused, which would be 75-80% of the materials. This will make the process quick and simple and avoid waiting for someone to come in and appraise the sign and damage. Marsiglia said he liked it in theory Kane said he was working with the state on this also. Motion was made to delay C (P-36-08) until after the workshop and to lift the off-premise sign moratorium in all areas not pertaining to the RFD. Motion carried unanimously. Motion was made by Buster Constanzi, seconded by D. J. Mills, to discuss the next 2 cases together. Motion carried unanimously. 2. C A public hearing to consider the application of Bossier Village Lane, LLC/Michael Salter for a zoning amendment to change the zoning classification of a tract of land located in Section 5, T18N-R13W, Bossier City, LA, from B-1, Business Commercial District and B-2, Limited Business District, to B-3, General Business District, for a self-storage facility. (4030 Benton Rd.) (City Council District 5) 3. C Planned Unit Development (PUD), for multiple buildings for climate controlled and mini-storage facility and office space, and a request for a reduction of the compatibility buffer along the north side from 25 to 10 Lot 2 and undeveloped portion of Benton Road Office Park, Unit 1, Bossier City, LA. (Michael Salter) (4030 Benton Rd.) (City Council District 5)
4 March 9, 2009 Page 4 Kurt Nixon was present to represent the applicant and stated the climate control storage facility would be on the west side of the bayou and the self-storage on the east side of the bayou. Schuldt asked which scheme they would use, the one with no required buffer or the one with the buffer? Marsiglia said the one that has no reduction in the buffer on the east side. Nixon said the north side has only one residence sandwiched in between this property and another commercial lot. Schuldt said he didn t see a hardship. Rauschenbach said they could move the storage or reduce the volume of storage. He asked if detention was required? Nixon said no because everything drains into the bayou. Schuldt asked who decides that, with all the concrete that will be in place? Nixon said the City doesn t have an ordinance requiring detention. Mills asked if anything was said to the City Engineer? Nixon said no, because it naturally drains into Benoit Bayou. Mark Hudson, City Engineer, said everything Nixon said is ok. There is no ordinance. He said Nixon is an excellent engineer. He would look at the surface storage and how it runs off into the bayou. Schuldt asked if he would ever develop a detention ordinance? Hudson said everything works well as it is. Nixon said there are 5-breech structures on the property now. They will eliminate 3, which will help all the drainage. Schuldt asked that no lighting face the residential area on the east. Marsiglia said there is an ordinance to prevent any lighting problems. Schuldt asked that the required fencing go in first on the east side. Opposition: Mike Vercher, property owner, 122 Lancashire Dr., was present and stated he lives to the east of this property. This will directly affect 5 properties and 4 others can see it.
5 March 9, 2009 Page 5 Schuldt said the north and east would be fenced. Vercher replied but if trees are planted within the 10 buffer, a lawn mower won t be able to fit in there to maintain the grass. The residential lots are low and already hold water. If they elevate the property for this development it will throw more water on the residential lots. Schuldt commented that this development cannot impact adjoining drainage. Vercher also asked that the lighting not light up his yard and into his windows. He would like for the fence to go up before the building starts. He has concern for the color of the buildings and would like them to blend in with the landscaping or be neutral. He just wants to protect his investment. Nixon said they will have inlets that pick up the drainage. This will improve how it is now. They haven t picked out a color for the buildings yet. McDaniel asked for a neutral color also. Mattison asked about the fencing? Nixon said they would do it before the construction. Harris mentioned it might prohibit drainage. Mike Salter, applicant, suggested it be put up as soon as the dirt work is done. Mattison said after the final grade. Rauschenbach said the good side of the fence should face the residences. There being no further discussion or opposition, motion was made by Art Schuldt, seconded by Brett Mattison, to approve C-77-08, with stipulations that drainage and lighting not impact residences, the buildings be a neutral color and the privacy fence be in place after completion of final grade dirt work. Motion carried unanimously. Also, motion was made by Brett Mattison, seconded by Buster Constanzi, to approve C Motion carried unanimously. 5. C A public hearing to consider the application of CVH Bossier City, LLC/Towne Place Suites for Conditional Use Approval on a B-3 lot, 1005 Gould Dr., Bossier City, LA for an on-premise sign review. (Hampton Hotel site) (City Council District 3) Scott Douglas was present to represent the applicant and explained this request was for a 15 monument sign on an access drive shared by both hotels. Constanzi asked how it would be set up?
6 March 9, 2009 Page 6 Douglas said currently there is a pole sign. The monument sign will be shorter and is on the other side of the drive. Schuldt asked if there would be a pylon sign on site? Scott said no, just a sign on the building. Rauschenbach reminded that the two signs can t exceed the square footage requirement. There being no opposition or further discussion, motion was made by Art Schuldt, seconded by Brett Mattison, to approve C Motion carried unanimously. Motion was made by James Harris, seconded by Brett Mattison to discuss the next 2 cases together. Motion carried unanimously. 6. P-4-09 A public hearing to consider the application of Sligo Farms, LLC for a zoning amendment to change the zoning classification of a 162+ acre tract of land located in Sections 22, 27 & 28, T17N-R12W, Bossier Parish, LA, from R- LD, Residential-Low Density District, to I-1, Light-Industry District, for an industrial park. (west side of Caplis Sligo Rd., south of Red Chute Bayou) (Police Jury District 1) 7. P-5-09 A public hearing to consider the application of Sligo Farms, LLC for a zoning amendment to change the zoning classification of a 454 acre tract of land located in Sections 27 & 28, T17N-R12W, Bossier Parish, LA, from R-LD, Residential-Low Density District, to R-A, Residential-Agriculture District, for a wetland mitigation area. (west side of Caplis Sligo Rd., south of Red Chute Bayou) (Police Jury District 1) Steven Hamm and Joey French were present to represent the applicant. Harris stated that all the issues had been worked out with the Police Jury. French said there was a basic master plan and this won t have any more lots than that did, but some lots may be combined. Marsiglia reminded they would have to come back with the plat. Schuldt stated the plan shows 7 curb cuts and asked why not have just one driveway? Marsiglia said that could be addressed in the platting because it is a major arterial street. French said they laid it out with 7, but they would consider that.
7 March 9, 2009 Page 7 There being no opposition or further discussion, motion was made by James Harris, seconded by Brett Mattison, to approve P Motion carried unanimously. P-7-09 A public hearing to consider the application of Steve Ruff for a Conditional Use Approval on a B-3 lot, 5000 Benton Rd., Ste. 15, Bossier Parish, LA, for on premise consumption of low and high content alcohol at a proposed sports bar. (southern most suite in new strip center) (Police Jury District 6) Steve Ruff, applicant was present. Constanzi asked if this was the required distance from schools, parks, etc.? Marsiglia said it was. Ruff explained it would be a sports bar with 12 T.V. s, a pool table and alcohol. Schuldt asked if they would have music? Ruff said no. McDaniel asked if they would serve food? Ruff said no. Opposition: Susan Caudle, property owner, stated this meets all the requirements, but asked that some type buffering where Teche will not go through be put up, because there is a short street beside this development, Destrahan Dr. that also doesn t go through. But people could cut through from one street to the other. Blocking the two off would eliminate that problem. She also stated that the lighting should not be a problem and the trash dumpster should be locked up. The building is L shaped and this business will be on the south end of the building. Schuldt asked if a fence was required? Marsiglia said this development is 500 from the residential homes. There would probably be future development to the rear of this, and then a fence would be required. Caudle just asked that they block off the two streets or put up a sign to keep people from going through to the subdivision. She said there is a signage limit. Marsiglia said everything meets the code requirements. McDaniel said the dumpster is required to be enclosed.
8 March 9, 2009 Page 8 Marsiglia said that is in the codes. There being no further opposition or discussion, motion was made by Donnie McDaniel, seconded by D. J. Mills, to approve P Motion carried unanimously. (D) OTHER ACTIONS - NONE (E) PRELIMINARY HEARINGS 9. C (P-8-09) A preliminary hearing to consider an amendment to the Unified Development Code (UDC) to remove Aggregate Storage as a use under the Warehouse and Freight use category and place the use within the Waste Related category. (MPC) Marsiglia explained that this issue occurred from a zoning violation by Tinsley Park, using property for the storage of rock. Our attorney said this is now allowed on B-3 property, but is more waste related. It needs to be out of warehousing and freight and into industrial. McDaniel said it needs to be in an I-2 with Conditional Use Approval. Schuldt asked about landscaping businesses that store decorative rock? Marsiglia said when a product like that is used constantly by a business, it s not considered stockpile storage. But when it s stored and trains have to haul it off, it s stockpiled. We just have to look at what s going on. It can be appealed to the Board of Adjustments. Constanzi said it is a needed change. Marsiglia stated that the code just has to be corrected as the needs are found. Mills asked what happens to the operations already out there? Marsiglia said they are already gone. Schuldt asked about the sand and gravel stored in Stonebridge for the golf course? They use it, but it s always stored there. There being no further discussion, motion was made by Donnie McDaniel, seconded by Buster Constanzi, to put this request up for public hearing. Motion carried unanimously. (F) MINUTES Motion was made by Brett Mattison, seconded by Donnie McDaniel, to approve the January and February minutes, as mailed. Motion carried unanimously.
9 March 9, 2009 Page 9 (G) OLD/NEW BUSINESS Marsiglia explained there was a time expiration on a plat approved in 2007, The Perfect Place, Unit 2. He just asked for it to be re-signed. Motion was made by Brett Mattison, seconded by Buster Constanzi, to resign the plat, The Perfect Place, Unit 2. Motion carried unanimously. Marsiglia said the workshop for the sign ordinance pertaining to the RFD will be held in the Barksdale Room at the Civic Center March 31 st. Marsiglia also reported that the Joint Land Use Study has been completed. (H) ADJOURN Motion was made by Art Schuldt, seconded by Brett Mattison, to adjourn the meeting at 3:00 pm.
