3 Council Report Date: August 5, 2014 File No: PL To: Annette Antoniak, City Manager From: Darryl Haddrell, Planner II Re: 2695 Skaha Lake Road Subject: Approve Development Variance Permit Staff Recommendation THAT Council approve Development Variance Permit PL , a permit to increase the permitted height of a sign from a maximum height of 9.0m to 9.95m and to increase the maximum area of a sign from 15m² to 19m² for Lot 1, District Lot 116, Similkameen Division Yale District, Plan KAP Background The subject property is the Sunshine Shopping Center located on the west side of Skaha Lake Road just north of Brandon Avenue (Attachment A). The property is zoned C4 General Commercial. The property owners are proposing to install a tall freestanding sign, with a large sun on the top (Attachment C ). The City of Penticton Sign Bylaw No permits Freestanding Signs within the C4 zone subject to height and size restrictions. The sign bylaw restricts the height of a freestanding sign to 9m and the area to 15m². The applicant wishes to install a sign that is 9.95m high with a sign area of 19m². As such, a variance to the sign bylaw is required. Proposal The applicant is requesting a development variance permit to vary Sections and of Sign Bylaw No increasing the size of a sign from 15m² to 19m² and increasing the height of a sign from 9m to 9.95m. Financial implication N/A Analysis Approve When considering a variance to a City Bylaw, staff encourages Council to consider whether approval of the variance would cause a negative impact on the neighbouring properties or if the variance request is reasonable.

4 In this case, the applicant argues that due to the size of the center and the number of stores advertising on the sign that the sign needs to be slightly larger and taller than the bylaw permits. It is important to note that under the sign bylaw, the property is eligible to have two or three large freestanding signs. Rather than having multiple large signs, the applicant is proposing a minor increase to the size of one sign. There is already one large sign on the property advertising for the Tim Horton s coffee shop. The addition of two or three more signs may lead to visual clutter of the property. So one sign is preferred. With specific regard to height, the sign face is actually below the maximum height permitted by the bylaw. The piece of the sign that is proposed to be higher than permitted is actually a sun design feature, not advertising area. In design, the proposed sign matches the building well and is relatively consistent in size to other large plaza signs along the big box, commercial strip of Main Street and Skaha Lake Road. Considering the above, staff find that the requested variances reasonable and that approval of the variance will not cause any undue negative impacts on the neighbouring properties. As such, staff recommend that council support the application and direct staff to issue the permit. Deny or Refer Council may feel that the variance is not justified and that the sign should conform to the bylaw. If that is the case, council should deny the variance. Alternatively, Council may wish to support the application, but put a condition on the approval that a covenant be registered against the property not allowing for any additional freestanding signs to be constructed on the property.
