ADOPTION OF MINUTES.1 Regular Meeting of Council Minutes - July 8, 1996 Moved by Councillor Robertson, seconded by Councillor Funk, that the minutes of the Regular meeting of Council held July 8, 1996, be adopted. R41O-96 CARRIED..2 Public Hearing Minutes - July 8, 1996 Moved by Councillor Boyes, seconded by Councillor Warawa, that the minutes of a Public Hearing held July 8, 1996, be received. R CARRIED.

Fry, 736 Columbia Street - Amendment No. 1 to Development Variance Permit No (D96-18) Report No. DEV dated July 10, 1996, from the Assistant Planner, recommended approval of Amendment No.1 to Development Variance Permit No to allow for the construction of a garage 55 m in height, rather than the maximum permitted height of 5.29 m. The owners have agreed to the contents of the permit and surrounding owners and occupiers were notified that they may comment on this proposal. There were no comments or questions. Moved by Councillor Boyes, seconded by Councillor Sweeney that, as recommended in Report No. DEV dated July 10, 1996, from the Assistant Planner, Amendment No.1 to Development Variance Permit No for the L. and A. Fry property at 736 Columbia Street, be approved for issuance. R CARRIED and B. Regier, 2771 Lock Street - Development Variance Permit No (D96-22) Report No. DEV dated July 10, 1996, from the Assistant Planner, recommended approval of Development Variance Permit No to allow for the construction of a single storey broiler/breeder barn 15.2 m from the southern interior lot line, rather than the required 30 m. The owners have agreed to the contents of the permit and surrounding owners and occupiers were notified that they may comment on this proposal. Correspondence dated July 9, 1996, from 1. and P. Hildebrand, 2615 Lock Street, expressing opposition to the proposed variance, was read into the minutes. The letter was signed by adjacent neighbours, who also opposed the variance. The letter is attached to, and forms part of, these minutes. There were no further comments or questions.

3 :35 p.m. in the Matsqui Centennial Auditorium Page 3 Moved by Councillor Boyes, seconded by Councillor Funk that, as recommended in Report No. DEV dated July 10, 1996, from the Assistant Planner, Development Variance Permit No for the J. and B. Regier property at 2771 Lock Street, be approved for issuance. One Council member believed that a variance requires concurrence of affected parties, and that the correspondence from the neighbours indicated that they are obviously opposed to this variance. Another noted that the barn will be 50 feet away from the property boundary and felt that was ample separation. It was pointed out that there were two separate issues to be dealt with: the variance and the matter of farming practices, which the Ministry of Agriculture or the Farmers' Peer Group should address. The Manager, Current Development, said that it was possible to construct the barn elsewhere on the property without a variance. One of the rationales behind the variance is to keep the barns sufficiently away from one another to prevent the spread of disease between farms. She indicated that, if the barn was moved further west, it may be a potential hazard to a watercourse. The motion was then put and R CARRIED. Opposed: Councillors Robertson and Wiebe.3 Yucatna Holdings Ltd., 34204, 34214, 34224, and Fraser Street - Development Variance Permit No (3020ID96-19) Report No. DEV dated July 8, 1996, from the Deputy Approving Officer, recommended approval of Development Variance Permit No to reduce front setback requirements for four single-family residential lots at 34204, 34214, 34224, and Fraser Street. The applicant is seeking the variance in order to construct homes on higher portions of the lots in order to take advantage of views to the south. The Manager, Current Development advised that, under the new Zoning By-law, the City has the ability to control the visual massing of a building through setback, height, and floor space ratio provisions.

4 :35 p.m. in the Matsqui Centennial Auditorium Page 4 Moved by Councillor Sweeney, seconded by Councillor Wiebe that, as recommended in Report No. DEV dated July 8, 1996, from the Deputy Approving Officer, Development Variance Permit No. 1054, for property at 34204, 34214, 34224, and Fraser Street, be approved for issuance. Moved by Councillor Peary, seconded by Councillor Funk, that the motion be amended to include the floor space ratio, height restrictions, and massing requirements of the new Zoning By-law as additional conditions for approving the setbacks. R CARRIED. The original motion, as amended, was then put and R CARRIED. 4. DELEGATIONS.1 M. Vertin, Garibaldi Drive - Request for Left-turn at Signal Gladwin Road and South Fraser Way Moved by Councillor Boyes, seconded by Councillor Wiebe, that M. Vertin, Garibaldi Drive, be allowed to address Council regarding a left-turn signal at the intersection of Gladwin Road and South Fraser Way. R CARRIED. M. Vertin, Garibaldi Drive, requested that a left-turn signal, going south on Gladwin Road, be installed. She suggested that, as a temporary measure, Gladwin Road be marked similar to Trethewey Street, with two lanes going north and two lanes going south, and each having a left-turn signal. Moved by Councillor Sweeney, seconded by Councillor Warawa, that the delegation of M. Verdin, requesting installation of a left-turn signal, south on Gladwin Road, at the intersection of Gladwin Road and South Fraser Way, be received.

5 00051{) 7:35 p.m. in the Matsqui Centennial Auditorium Page 5 It was explained that when the vacant lot bordering the intersection is developed, the longterm plan is to construct three northbound lanes. A left-turn lane heading south, without the extra lane, would create heavy congestion in the area. The motion was then put and R CARRIED. 5. CONSENT AGENDA 5.0 BY-LAWS TO BE ADOPTED.1 By-law No , Siskin Drive Road Exchange and Dedication By-law, Authorizes Transfer of Land and Dedication for Highway Purposes Moved by Councillor Robertson, seconded by Councillor Wiebe, that By-law No , cited as "Siskin Drive Road Exchange and Dedication By-law, 1996", now be adopted. R CARRIED. 5.1 MINUTES AND CORRESPONDENCE TO BE RECEIVED Moved by Councillor Boyes, seconded by Councillor Robertson, that the following minutes and correspondence be received:.1 Minutes of the Fraser Valley Regional Library Board of Directors meetings held June 26, 1996;.2 Correspondence dated July 8, 1996, from the Office of the Ombudsman, providing a summary of cases for the period April 1 to June 30, 1996, for the City of Abbotsford;.3 Correspondence dated July 4, 1996, from the HongKong Bank of Canada inviting nominations for the 1996 British Columbia Senior Award;

6 :35 p.m. in the Matsqui Centennial Auditorium Page 6.4 Correspondence dated June 28, 1996, from the Air Force Association of Canada 861 Wing regarding the handicap access at the Air Cadet building;.5 Correspondence dated July 2, 1996, from the Dasmesh Punjabi School expressing appreciation for Council's letter to the Agricultural Land Commission supporting the school;.6 Correspondence dated July 4, 1996, from the United Way of the Fraser Valley thanking City employees for contributing to the United Way Campaign;.7 Correspondence dated June 28, 1996, from "The Council" requesting that August 17, 1996, be proclaimed "National Homeless Animal's Day";.8 Information Bulletin dated June 28, 1996, from the B.C. Environmental Assessment Office advising that a review of B.C.'s salmon aquaculture industry will proceed this summer, with completion slated for March 1997;.9 Project Enviro-Health 1995/96 Final Report;.10 Third Annual Report of the B.C. Treaty Commission;.11 Development Services Building Report to June 1996; and.12 Memo dated July 12, 1996, from Staff Sergeant Tucker, advising of the status of photo radar on Highway No. 1. R CARRIED. With reference to item , which was added to the agenda, there was general agreement that Council should have been apprised of the installation of photo radars on Highway No. 1. One member felt that Council was misled to believe that the photo radar program was a community-driven project. Another agreed, but cautioned that the City does not have the resources to assume responsibility for, and policing of, the freeway.

BY-LAWS.1 By-law No , Abbotsford Official Community Plan By-law, Establishes an Official Community Plan for the City Moved by Councillor Robertson, seconded by Councillor Sweeney, that By-law No , cited as "Abbotsford Official Community Plan By-law, 1996", now be read a second time, as amended. R CARRIED. Moved by Councillor Peary, seconded by Councillor Funk, that By-law No , cited as "Abbotsford Official Community Plan By-law, 1996", now be read a third time. R CARRIED. 8. NEW BUSINESS.1 Sumas Mountain Aggregate Resource Mining and Reclamation Plan Study - Tender ( / SRP#5) Report No. ENG 96~ dated July 7, 1996, from the Manager of Engineering Services, recommended that consulting services for the Sumas Mountain Aggregate Resource Mining and Reclamation Plan study be awarded to Levelton Associates Ltd. for the proposed fee of $30,250, plus G.S.T., with financing from soil removal revenues to a maximum of $33,000. Moved by Councillor Boyes, seconded by Councillor Sweeney that, as recommended in Report No. ENG 96~ dated July 7, 1996, from the Manager of Engineering Services, consulting services for the Sumas Mountain Aggregate Resource Mining and Reclamation Plan study be awarded to Levelton Associates Ltd. for the proposed fee of $30,250, plus a.s.t.

8 :35 p.m. in the Matsqui Centennial Auditorium Page 8 One Council member questioned the study's usefulness, and opposed using general revenues as a source of funding. Staff explained that the soil removal industry contributes in excess of $1.1 million per year, through removal fees, to general revenue. It was pointed out that the purpose of the study is to provide information on gravel extraction relative to decision-making, so that, in the future, extraction can be done without having to deal with each application individually. Regret was expressed that the Regional District would not be taking part in this study, and it was hoped that the Ministry of Energy, Mines and Resource would participate. The motion was then put and R CARRIED. Opposed: Councillor Funk.2 Emergency Response Plan ( ) Report No. FIR dated June 28, 1996, from the Fire Chief, recommended that Golder Associates be retained to provide a hazard, vulnerability, and risk assessment study and design and develop an Emergency Response Plan for the City. Moved by Councillor Robertson, seconded by Councillor Sweeney that, as recommended in Report No. FIR dated June 28, 1996, from the Fire Chief, Golder Associates be retained to develop an Emergency Response Plan for the City. The Fire Chief clarified the tender process, including the review criteria, involvement of the associations, volunteers groups, and departments in the City in the process, including police, search and rescue, ham radio operators, Emergency Social Services, and the hospital. He also explained that the emergency plans of the former Districts of Matsqui and Abbotsford, which were developed in-house, were obsolete. Some Councillors felt that the fire department had the resources and manpower to develop an emergency plan in-house. The motion was then put and R CARRIED. Opposed: Councillor Funk

Sidhu property at 5038 Riverside Street was deferred.. 4 Central Fraser Valley Fairs Association - Banner ( ) Moved by Councillor Warawa, seconded by Councillor Gibson that, as requested in correspondence dated July 11, 1996, from the Central Fraser Valley Fairs Association, permission be granted to erect a banner advertising Agrifair from July 16 to August 6, R CARRIED. 9.
