2 How This Really Works The author in no way intends to suggest the individuals presented are dishonest. The video clips in this program were selected because they may show behavioral changes in people under stressful conditions. The behavior in the video tape reflects conduct associated with arousal of the autonomic nervous, the fight or flight response originating from stimulation to the sympathetic nervous system. The body may show autonomic nervous system arousal. The body does not reveal the source of the arousal. Participants must evaluate the clips for themselves and draw conclusions about the meaning of behavior while remembering to emphasize the D in the READ System. 2

11 Why Is Difficult To Catch Liars? No original sin: most people choose to believe people are telling the truth Distracts from the conversation Everyone develops the skill to lie by adulthood, but some liars are spectacularly good at it Liars are as sophisticated at lying as listeners are unsophisticated at detecting them Controlled studies show that people are poor intuitive judges of truth and deception... particularly police and so called experts who are highly prone to error. (Kassin & Fong (1999) citing Ekman & O Sullivan.) Page 11

12 Frequent Negative Effect of Training Frightening Facts: Training often biases observers. The higher the confidence, the greater the error. Note the type of error.... (Kassan & Gudjonsson (2004).) Once people form an impression of a person, they sift through the person s behavior for examples that verify their conclusion. Researchers call this behavioral confirmation bias. (Kassin, S. & Gudjonsson, G. (2004).) Example from trial practice. Jurors use behavioral confirmation bias to confirm conclusions about the with which they agree. Page 12

13 Frequent Negative Effect of Training aka, Confirmation Bias Law enforcement is prone to high self-reported accuracy and disbelieving the truth errors. [We] found that a group of policemen judged everyone they saw on videotape as lying, later explaining that everyone lies, especially to the police. (Ekman, Why don t we catch liars? Social Research (Fall 1996).) [W]e don t interrogate innocent people, said Joseph Buckley of Inbau, Reid, Buckley & Jayne. (Kassan & Gudjonsson (2004). ) Page 13

14 Example Of Confirmation Bias The Reid Technique of Interviewing and Interrogation boasts: 95% of respondents reported that using The Reid Technique helped them to improved their confession rate The majority of respondents said they increased their confession rate over 25%. Almost a quarter of respondents said they increased their confession rates as much as 50% 99% of respondents reported that using The Reid Technique increased their ability to identify whether a suspect was truthful or deceptive Page 14

15 Why Is It So Difficult? Nervous People Look Dishonest Part of the problem is that people who stand falsely accused of lying often exhibit patterns of anxiety and behavior that are indistinguishable from those who are really lying. (Kassin & Fong (1999).) No sign of dishonesty emerges across all situations People learn to veil their signs of dishonesty: e.g., the eyes Page 15
