4 NOT PROTECTIVELY MARKED Thefts of alcohol remain constant from off sale premises throughout the Scottish Borders. There were more incidents of violence in the period April to June, with five serious assaults in total, of which four occurred within premises. Securing Public Safety There has been only one incident of poor management, which is a marked improvement from the previous Police report. This relates a premise in Eyemouth and was of a minor nature. There have been two incidents of sexual assault reported. The first relates the owner of a premise in Lauder assaulting a member of staff. The matter was reported to the Procurator Fiscal. The second relates to a premises in Hawick, though the staff were not informed and the incident was reported after the premises had closed for the evening. To date the suspect has not been identified. Disturbances both within and out premises continue to occur, mainly during the weekend and during the dispersal from premises. Officers are deployed through the weekend dispersal plan to monitor the patrons leaving licensed premises. However the levels of intoxication of result in altercations taking place. Officers often intervene prior to these escalating to violence. Page 2 NOT PROTECTIVELY MARKED
5 NOT PROTECTIVELY MARKED Preventing Public Nuisance / Protecting and Improving Public Health Alcohol related anti-social behaviour incidents continue to blight the Scottish Borders in and around licensed premises. Common Ridings and Festivals see an increase in this type of behaviour and one Common Riding in particular caused concern due to the lack of stewarding relevant to the number of intoxicated persons. A series of drunken incidents took place requiring additional resources to be brought to the event. We continue to record positive incidents and of the 46 incidents in both quarters, 2 were identified as being positive in Peebles. However has also been 1 incident that has been identified as having a negative aspect to how they handled by the premise. Protecting Children From Harm Unfortunately there have not been any test purchase operations. There have been 2 reports of alcohol being sold and passed to persons under 18. The first in Hawick, which was a significant incident involving three children being supplied by a family member. The second in Galashiels when a male bought alcohol for local children. Both suspects were identified and reported to the Procurator Fiscal. The prevention of harm from alcohol forms part of the patrols, particularly at weekends and officers engage with youths to deter them from abusing alcohol. When alcohol is found in their possession it is disposed of and the relevant concerns raised with partner agencies. Process We have processed 229 occasional licence applications in the first quarter, 12 were classed as late (less than 7 days notice), 10 were refused and 4 were withdrawn. 361 occasional licence applications were processed in the second quarter, 9 were classed as late, 0 were refused and 2 were withdrawn. There have been 28 personal licence applications in the first quarter and 25 in the second. There were 8 premises licence applications, representations or objections were submitted in relation to three of the applications. All of the applications were granted by the Licensing Board. We have also processed 55 variation applications and no representations were submitted. Page 3 NOT PROTECTIVELY MARKED
