1 MINUTES OF THE MEETING OF THE CADDO PARISH COMMISSION HELD ON THE 17 th DAY OF OCTOBER 2013 The Caddo Parish Commission met in legal and regular session on the above date at 3:30 p.m. in the Government Chamber with Ms. Lindora Baker, President, presiding, and the following members in attendance, constituting a quorum: Commissioners Baker, Bowman, Cox, Dominick, Epperson, Escude, Linn, Lynch, Smith, Thibodeaux and Williams (11). ABSENT: Commissioner Johnson (1). Mr. Jim Smith. The invocation was led by Ms. Stephanie Lynch, and the Pledge of Allegiance was led by It was moved by Mr. Dominick, seconded by Mr. Linn, to adopt the minutes of the Regular Meeting held on October 3, Motion carried. CITIZENS COMMENTS Mrs. Shirdell Simmons, 266 East Linden Street, Shreveport, representing the Community Pride Cookout, relocated to Shreveport about a year-and-a-half ago. She and her family has tried to participate in community activities and organizations as much as possible, but one of the problems she has encountered is the disconnection between these organization s services and the people in need of those services. Mrs. Simmons and others have created the Community Pride Cookout to bridge the gap between those service organizations and their community users. Mrs. Simmons said that the cookout will provide a Louisiana style meal with local entertainment on Saturday, October 19 th from 11:00 a.m. until 2:00 p.m. She invited the Commissioners and the Caddo Parish citizens to attend. Ms. Simmons provided flyers to the Commissioners for more information. community. Mr. Williams thanked Ms. Simmons for the fresh and new ideas she has brought to the Mr. Bowman stated that he would attend Saturday s event, and he is proud to see this new program for the community. SPECIAL RESOLUTIONS It was moved by Mr. Williams, seconded by Mr. Bowman, that Special Resolution of Remembrance for Mr. James Kojo Livingston, local activist and community leader, be approved for reading. Motion carried. COMMUNIQUES AND COMMITTEE REPORTS Ms. Baker commended all those who participated in the Economic Development Summit that was held last week. Ms. Baker stated the seminar was very informative and helpful. Mr. Thibodeaux provided handouts to each Commissioner to evaluate the Parish Administrator and the Commission Clerk. He asked that those evaluations be completed and returned to Mr. Thibodeaux by the next Work Session scheduled for November 4, Mr. Williams stated that although Mr. Randy Lucky is not evaluated by the Commission, he is a very helpful part of the Administration s connection to the Commissioners. Anytime Mr. Williams needs help, Mr. Lucky works to come up with a solution. Mr. Williams wishes he could say that about all of the department directors, but unfortunately does not believe that they are all as solution oriented as Mr. Lucky. Mr. Epperson announced that the Veterans Weekend Celebration Committee will hold a news conference on Friday, October 18 th at 2:00 p.m. at the Salvation Army Boys and Girls Club on Greenwood Road. Mr. Epperson stated that the events are falling in order for the celebration slated for November 10 th at 2:00 p.m. He also invited all veterans from any conflict to participate in this year s parade. The number of sponsors for this year s event is growing, and he looks forward to the community seeing this celebration take place. The next meeting for the Committee will be held on Friday, October 25 th at 10:00 a.m. Mr. Epperson did not say much during the presentation from the animal groups last Monday. He did want to remind everyone that the animal shelter and the employees have come a long way over the years. The construction of a new shelter on Monty Street, along with other improvements, has happened over the years due to an effort with the Commission and citizens working together for change. Mr. Epperson also stated that he has had no complaints in his district over the past few years; he has heard only good things about our officers and staff until Monday. Mr. Epperson would like everyone to remember where Animal Services started and the progress that has been made to move forward to build a bright future for that department. Ms. Baker announced that an Animal Services Committee would be created to research the current ordinances and directives at the shelter. She also said that the following Commissioners would serve on the Committee with Jerald Bowman as chairman: David Cox, Matthew Linn, Ken 557

2 Epperson, Michael Williams and Mike Thibodeaux. Mr. Thibodeaux congratulated Ms. Baker on the successful Economic Development Summit that was held last Tuesday. He said that it was the first conference he has attended that was worthwhile and added the type of knowledge that was truly useable for the present and future where local economic development was concerned. Mr. Linn agreed with Mr. Thibodeaux on the Economic Development Summit that the brain power in the room surpassed most other conferences he has attended. PUBLIC HEARING ON ZONING ORDINANCES ZONING CASE APPEAL P in regard to Ordinance No of 2013, (8700 Block Simpson Road) property located beginning at the intersection of Simpson and Brossette, on both east and west sides of Simpson Road extending 2,600 feet north) KAT DEVELOPMENT, APPLICANT/APPELLANT. Request to rezone property located beginning at the intersection of Simpson and Brossette, on both east and west sides of Simpson Road extending 2,600 feet north, from R-A Residential Agriculture District to R- MHS Residential Mobile Home Subdivision District, Caddo Parish, Louisiana for a proposed mobile home subdivision or other uses within this zoning classification. The Metropolitan Planning Commission denied the applicant s request and they are appealing that decision. Daniel Keith Howard, 6124 Dillingham Avenue, Shreveport, representing KAT Development LLC., understands that the opponents are concerned about their property values, but Mr. Howard pointed out that these homes would be manufactured homes and not trailer houses. He also pointed out that the opposition resides approximately a mile-and-a-half away from the development and not directly next to it. Mr. Howard also said that there are currently over seventy-five mobile homes or manufactured homes within a mile radius of the opponents residences. Mr. Howard stated that there were concerns about the sewer system to these homes, but he informed the Commission that each home would have their own individual sewer system that would not be tied on to a community system. He also pointed out that he has a permit from DHH to drill to water wells to provide water for the proposed development. Mr. Howard also said that the opposition does not want a subdivision, but he is going to build a subdivision in this location; the only question is, will they be manufactured homes or stick built homes? Mr. Howard stated that the MPC turned down his request because they felt he was not following the Master Plan and that it was not conducive to the neighborhood. He disagrees with their decision because, as he pointed out earlier, seventy-five percent of the homes in that area are trailer houses or manufactured homes. He also stated that these homes will run from $150,000 to $175,000 and will have subdivision covenants. Mr. Howard said that he would appreciate any suggestions the Commission may have, and asks for their support on his appeal today. Aimee and Steve Aaron, 9040 Simpson Road, Shreveport, stated that they live a few hundred feet where this subdivision is being constructed. Mrs. Aaron said that they have been remodeling their home for a few years and is concerned anytime mobile homes are being proposed in large numbers that close to their property. She said anytime the homes are mobile and can be moved in twenty-four hours, it creates a situation where the people are more transient and less connected to the neighborhood. The Aarons are also concerned about their property value should they try to sale their home. John Miglicco, 7242 Whispering Pines, Shreveport, is opposed to the proposed development. Mr. Miglicco stated that they came to the MPC with a united front of signed petitioners against this subdivision; and they still stand against allowing this zoning change. He said that the neighborhood is strongly opposed to the type of development KAT Development is offering. He also pointed out that the MPC unanimously turned down this zoning change after hearing both sides, and asks that the Commission uphold the MPC s decision and the community s wishes. Ralph Parker, 8059 Shirley Francis Road, Shreveport, asks that all those in opposition stand up so the Commissioners could see the numbers against the development that are in attendance. (Approximately 25 stood in opposition). Bill Hale, 8025 Shirley Francis Road, Shreveport, stated that he could not say it any better than Mr. Miglicco comments, so he yields to those comments to save time. Vicki Hunter, 8051 Shirley Francis Road, Shreveport, stated that the community is together in opposition of this development and overturning the MPC s decision. Ms. Hunter also pointed out that people moved to the country for wildlife and less traffic and this type of development would only bring problems. She hopes the Commission will uphold the MPC s earlier decision. John Washington, 9311 Bullard Road, Shreveport, stated he echoed Mr. Miglicco comments given earlier. 558

3 There being no one else to speak in favor or in opposition to Ordinance No of2013, public hearing for that zoning ordinance was concluded. ZONING CASE APPEAL BAP-12-12, property located at 3456 Villa Avenue on the west of the south end of Villa Avenue, AUDRA JOWERS and JOEY CORSENTINO, APPLICANTS. Request to rezone property located at 3456 Villa Avenue, west of the south end of Villa Avenue, for a Special Exception in an R-1D, Urban One Family Residence District, to permit an extension of the time limit for a temporary secondary residential structure (mobile home) on Lot 2, M.M. Reagan Subdivision. The applicant was given a one year extension which has expired and is requesting a second extension Audra Jowers, 3456 Villa Avenue, Shreveport, stated that approximately a year ago she was granted an extension to have a mobile home on their property while repairs were being done to their home due to damage by a tornado. She also informed the Commission that they have been in litigation with the contractor since last year so the home has not been completed. They are now asking for an extension on the original extension. Walter White, 111 Freestate Boulevard, Shreveport, attorney representing Ms. Jower s litigation, stated that their case is expected to go to trial and hopes to have it resolved within a year. He understands that these cases sometimes take longer. Lita Smith, 3444 Villa Avenue, Shreveport, stated the tornado struck in 2009 and the trailer has been there ever since with no progress being made. She stated that they do not mind the house, but they want the trailer gone. Ms. Smith asked that the Commission not grant anymore extensions on the trailer. Ethel Kelly, 3454 Villa Avenue, Shreveport, stated she was glad to hear Mr. Williams say that he worked for her, and now it is time the Commission worked for her as well and deny any extension on the trailer house at 3456 Villa Avenue. Ms. Kelly stated that she has lived there for twenty-five years and would like to be able to see the lake again. There being no one else to speak in favor or in opposition to Zoning Case Appeal BAP public hearing was concluded. PUBLIC HEARING ON ORDINANCES Ordinance No of 2013, amending the Budget of Estimated Revenues and Expenditures for the Economic Development Fund and the Oil and Gas Fund in the amount of $500,000 to fund the Biomedical Research Foundation s Entrepreneurial Acceleration Program (EAP) for the year 2013 Ordinance No of 2013, to change the name of G.M. Boulevard to Antoine Boulevard, and to otherwise provide with respect thereto for the year 2013 Ordinance No of 2013, declaring certain adjudicated properties to be surplus and to authorize the Parish Administrator or a designee to sell the Parish s tax interest for the year 2013 There being no one else to speak in support of or in opposition to the ordinances, President Baker declared the public hearing on ordinances to be concluded. ZONING ORDINANCES: (For final passage) It was moved Mr. Epperson, seconded by Mr. Williams, to uphold the ruling of the Metropolitan Planning Commission in regard to P Mr. Epperson stated that he met with both parties on this issue and found it ironic that this has been a concern for him during his seven years as a Commissioner. In his opinion, there is always a problem when you have an area with nice stick-built homes, then someone tries to construct a mobile home park or a concentration of manufactured homes. Mr. Epperson stated that the Commission should be inviting people to move to Caddo Parish whether they are stick-built homes or manufactured homes, but they have their place in the community. On this particular issue, he sides with the MPC s decision and the citizens of the area. Mr. Williams agrees with Mr. Epperson. He believes that manufactured homes are available for those that cannot afford stick-built homes. Mr. Williams understands that this proposed development is not in the right place, but it could fit in other areas of the parish. Answering a question from Ms. Lynch related to the difference of manufactured housing and mobile homes, Mr. Howard stated that these homes will not be single wide homes which are defined as mobile homes. These homes will be double and triple wide homes which under HUD qualify as manufactured homes. They also put subdivisions restrictions that will keep the neighborhood nice. 559

4 Answering a question from Ms. Lynch related to use by right, Ms. Dara Sanders stated that mobile homes were taken out as use by right and put under special exceptions for review. Ms. Sanders also said that future use designation utilized by the Master Plan would be to manage those type of properties in an effort to preserve some of the natural aspects of the area in question. Ms. Sanders stated that the size of the lots could be subdivided in the future; and instead of 250 homes you could see 500 homes, which would not be consistent for future plans. Ms. Lynch stated that she will be voting to uphold the MPC decision. Answering a question from Mr. Escude on the area of notification for zoning cases, Mr. Jean stated that the MPC notifies those citizens that are within five hundred feet of the outer boundary of the property being considered for a zoning change. Mr. Jean also said that this area is approximately two miles from the city limits of Shreveport. Answering a question from Mr. Escude on placement of these homes, Mr. Howard stated that runners of concrete are poured to match the beams for the home. Mr. Howard also said that the homes would be about 2,400 square feet. Mr. Escude stated that he understands what we recently did with the changes in our ordinances, but what we are telling people is that they better move beyond the 5 mile area to be able to do with their property as they see fit. Mr. Escude stated that he will support upholding the MPC s decision, but would like the citizens to understand what they might end up with, which is in his opinion, is less desirable than the original request. Mr. Cox stated he agreed with Mr. Escude s comments. He also cautioned the opposition group to understand what could happen if this decision is upheld, and Mr. Howard decides to build thousand square foot homes with one car garages. ORDINANCE NO OF 2013 AN ORDINANCE TO AMEND CHAPTER 51 OF THE CODE OF ORDINANCES OF THE PARISH OF CADDO, AS AMENDED, THE CADDO PARISH ZONING ORDINANCE, BY AMEDNING THE ZONING OF PROPERTY LOCATED BEGINNING AT THE INTERSECTION OF SIMPSON & BROSETTE, ON BOTH EAST & WEST SIDE OF SIMPSON ROAD EXTENDING 2,600 FEET NORTH, CADDO PARISH, LA, FROM R-A, RESIDENTIAL/AGRICULTURE DISTRICT, TO R-MHS, RESIDENTIAL MOBILE HOME SUBDIVISION DISTRICT AND TO OTHERWISE PROVIDE WITH RESPECT THERETO BE IT ORDAINED by the Caddo Parish Commission in due, legal and regular session convened, that after having previously been considered and denied by the Metropolitan Planning Commission, that Chapter 51 of the Code of Ordinances of the parish of Caddo is hereby amended and re-enacted to re as follows, to wit: The official Zoning Map of the Shreveport Metropolitan Planning Area of Caddo Parish, LA, be amended by rezoning property located at the intersection of Simpson & Brossette Roads on both the east & west sides of Simpson extending 2,600 feet north, from R-A, Residence-Agriculture District to R-MHS, Residence Mobile Home Subdivision District legally described as: The W/2 of W/2 of the SW/4 of Sect 5, T16N, R15 W, less & except road, Caddo Parish, LA, containing acres, M/L, more particularly described as: Commence at a cotton spindle found at the SW corner of said Sect 5, thence run S E along the south line of said Sect 5 for 30.0 feet, thence run N E parallel to the west line of Sect 5 for 40.0 feet to a ½ inch iron pipe set for corner at the intersection of the north R/W line of Brossette Road with the east R/W line of Simpson Road as dedicated & the POB of the tract herein described, thence continue N E along the east line of Simpson Rd feet to a ½ inch iron pipe set for corner, thence leaving said R/W, run thence S E along the old occupation fence existing for the north line of said SW/4 of Sect 5 for feet to a ½ inch iron pipe set for corner, thence run S W feet to ½ inch iron pipe set for corner on the north R/W line of Brossette Rd, thence run N W along the said north R/W feet to the POB. BE IT FURTHER ORDAINED that the rezoning of the property described herein is subject to compliance with the following stipulations: 1. Development of the property shall be in substantial accord with a revised site plan indicating a connected street design that eliminates the long cul-de-sac street. This plan shall be submitted to and approved by the Planning Director. Any significant changes or additions shall require further review and approval by the Planning Commission. No permits shall be issued until the revised site plan and/or replatting of lots has been approved by the MPC Director of the Planning Commission. 2. Development of the property shall begin within a period of two (2) years from the date of the adoption of this ordinance and the failure to comply with such stipulation will cause the rezoning herein described to become null and void, and the zoning classification will automatically revert to R-A. BE IT FURTHER ORDAINED, that if any provision or item of this ordinance or the which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this ordinance are hereby declared severable. BE IT FURTHER ORDAINED that this ordinance shall become effective ten (10) days after publication in the official journal. BE IT FURTHER ORADAINED, that all ordinances or parts thereof in conflict herewith are hereby repealed P KAT DEVELOPMENT LLC At this time, Mr. Epperson s motion carried; as shown by the following electronic vote: AYES: Commissioners Baker, Bowman, Cox, Dominick, Epperson, Escude, Linn, Lynch, Smith, Thibodeaux and Williams (11). NAYS: None. ABSENT: Commissioner Johnson (1). It was moved by Mr. Dominick, seconded by Mr. Linn, that ZONING CASE APPEAL BAP-12-12, property located at 3456 Villa Avenue on the west of the south end of Villa Avenue, AUDRA JOWERS and JOEY CORSENTINO, APPLICANTS be given a one year extension and come back to the after that one year period expires and is not complete. Answering a question from Ms. Lynch on the stage of completion on the home in question, Ms. Jowers stated that experts surveyed their home and said they must go back to slab and start over to fix the problems the contractor created. Ms. Jowers stated that home is 2,800 square feet under roof and 3,000 square feet including patios. Answering a question from Ms. Lynch on the extension, Mr. Jean stated that original extension was for two years, but was modified by the Commission. Answering a question from Mr. Cox, Ms. Jowers stated that there has not been any new construction because they are still in litigation. Mr. White stated that litigation will remain until the last judge signs off on this issue. He also said that the litigation is with the insurance company and the construction company. Mr. Cox suggested looking to move the trailer to another location and have the repairs done after the litigation is finished. Answering a question from Mr. Thibodeaux on tearing the home down, Mr. White stated that his clients do not have the money to tear it down since they are litigation with both the insurance company and contractors. Mr. Thibodeaux suggested that the maker of the motion or substitute motion be made in a way that the issue come back to the Commission and not the MPC. Mr. Escude believes the Commission should give them time to let due process move forward. Mr. Escude supports giving Ms. Jowers an extension. 561

6 Answering a question from Ms. Baker, Ms. Smith stated that she is tired of all of this and is asking that the Commission to go by what they originally said that they would give a one year extension and after that six month period, the trailer would be gone. Ms. Smith is asking that an extension not be made for the Ms. Jowers. Answering a question from Ms. Baker, Ms. Jowers stated that she sued Ms. Kelly for an order cease and desist because she was trying to disconnect their sewer service; they had no other option. Ms. Jowers stated that the contractors did not perform repairs in an acceptable manner, so they had to sue them and their insurance carrier. It was moved by Mr. Williams, seconded by Mr. Dominick, to call for the question. Motion carried; as shown by the following electronic vote: AYES: Commissioners Baker, Bowman, Cox, Dominick, Epperson, Escude, Linn, Smith, Thibodeaux and Williams (10). NAYS: Commissioner Lynch (1). ABSENT: Commissioner Johnson (1). At this time, Mr. Dominick s motion failed; as shown by the following electronic vote: AYES: Commissioners Dominick, Escude, Linn, Smith and Williams (5). NAYS: Commissioners Baker, Bowman, Cox, Lynch and Thibodeaux (5). ABSTAIN: Commissioner Epperson (1). ABSENT: Commissioner Johnson (1). ORDINANCES: (For final passage) ORDINANCE NO OF 2013 AN ORDINANCE AMENDING THE BUDGET OF ESTIMATED REVENUES AND EXPENDITURES FOR THE ECONOMIC DEVELOPMENT FUND AND THE OIL AND GAS FOR THE YEAR 2013 TO PROVIDE AN APPROPRIATION OF $500,000 TO FUND THE BIOMEDICAL RESEARCH FOUNDATION S ENTREPRENEURIAL ACCELERATION PROGRAM AND TO OTHERWISE PROVIDE WITH RESPECT THERETO WHEREAS, the Biomedical Research Foundation of Northwest Louisiana was established to enhance the scientific capacity and economic development of Northwest Louisiana; and WHEREAS, the mission of the Biomedical Research Foundation is to pioneer a knowledge-based regional economy by cultivation and attracting life science enterprises and related technologies; and WHEREAS, the Biomedical Research Foundation will launch an Entrepreneurial Acceleration Program (EAP); and WHEREAS, the EAP is a comprehensive plan to solicit and evaluate innovative ideas and products, form and coordinate investors, and provide seed funding and mentoring to move these ideas to the marketplace; and WHEREAS, the Caddo Parish Commission would like appropriate funds for the EAP not to exceed $500,000 per year contingent on the City of Shreveport appropriating funds for the EAP; and WHEREAS, Caddo Parish Commission will match the appropriations from the City of Shreveport on a two to one ration. NOW, THEREFORE, BE IT ORDAINED, by the Caddo Parish Commission in due, legal and regular session convened, that Budget of Estimated Revenues and Expenditures for the Economic Development Fund and the Oil and Gas Fund for the year 2013 is hereby amended as follows: Economic Development Fund Budget Increase (Decrease) Entrepreneurial Acceleration Program $500,000 Transfer From Oil and Gas $500,000 Oil and Gas Fund Transfer to Economic Development $500,000 Fund Balance ($500,000) BE IT FURTHER ORDAINED, that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or application which can be given effect without the invalid provisions, items or applications, and to this end the provisions of this ordinance are hereby declared severable. 562

7 BE IT FURTHER ORDAINED, that this ordinance shall take effect upon adoption. BE IT FURTHER ORDAINED, that all ordinances or parts thereof in conflict herewith are It was moved by Mr. Linn, seconded by Mr. Escude, that Ordinance No of 2013 amending the Budget of Estimated Revenues and Expenditures for the Economic Development Fund and the Oil and Gas Fund in the amount of $500,000 to fund the Biomedical Research Foundation s Entrepreneurial Acceleration Program (EAP) for the year 2013 be postponed until the first of Motion carried; as shown by the following electronic vote: AYES: Commissioners Bowman, Cox, Dominick, Epperson, Escude, Linn, Lynch, Smith and Thibodeaux (9). NAYS: Commissioners Baker and Williams (2). ABSENT: Commissioner Johnson (1). It was moved by Mr. Epperson, seconded by Mr. Williams, that Ordinance No of 2013, to change the name of G.M. Boulevard to Antoine Boulevard, and to otherwise provide with respect thereto for the year 2013 be adopted with the change not occurring until the first of Mr. Epperson stated that General Motors was in the community for thirty plus years and the name fit. Since they are no longer there, he believes it will make more sense to change the name to Antoine Loop since West Antoine Loop is in the general area. Mr. Epperson asked for Commissioners to support this change. Answering a question from Mr. Thibodeaux, Mr. Epperson stated that there is one business that will have to change their address. Because of this, he would like to wait for the change to take effect until the first of Mr. Cox believes in putting it off until a later date, and perhaps seeing what transpires with the changes in the area may be a better option. Mr. Cox encourages Commissioners not to approve Ordinance No at this time. Mr. Epperson stated that this name goes with Antoine Loop and not C.C. Antoine the individual. Mr. Epperson asks that Commissioners support this ordinance. ORDINANCE NO OF 2013 AN ORDINANCE TO CHANGE THE NAME OF G.M. BOULEVARD TO ANTOINE BOULEVARD, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO WHEREAS, the Parish of Caddo is the owner of certain property currently named G.M. Boulevard in Caddo Parish, Louisiana; and WHEREAS, the Caddo Parish Commission desires to formally re-name the road to Antoine Boulevard in honor of C.C. Antoine. NOW, THEREFORE, BE IT ORDAINED, by the Caddo parish Commission in due, regular and legal session convened, that the Caddo Parish Commission does hereby re-name the abovedescribed road in the to the Antoine Boulevard. Mr. Epperson stated that there are 794,805 citizens in Louisiana that would have access to affordable care and it is important to make this information available to all citizens of the state. Mr. Epperson also said that this is not making anyone do anything, it is just asking that providers public and private make the information available. Mr. Escude stated he will support this resolution just because it is providing information to citizens on this issue. Mr. Escude has never felt real comfortable when it comes to insurance and the games they play and the costs involved. Mr. Williams stated that it is good that the Affordable Healthcare Act is now taking effect and providing insurance for millions of Americans. Mr. Cox stated that families need to discuss the different options available before signing up to ensure that they procure a plan that suits the family and is affordable. Ms. Lynch stated that the sign-up period is for six months, not just until November Ms. Lynch suggested that citizens utilize Healthcare.gov for additional information. 565
