7 MINUTES OF THE MEETING OF THE CADDO PARISH COMMISSION HELD ON THE 5 th DAY OF NOVEMBER, 2015 The Caddo Parish Commission met in legal and regular session, on the above date, at 3:30 p.m., in the Government Chambers, with President Johnson, presiding, and the following members in attendance, constituting a quorum: Commissioners Bowman, Cawthorne, Dominick, Epperson, Escude, Gage-Watts, Johnson, Linn, Smith, Thibodeaux, and Williams (11). ABSENT: Commissioner Cox (1). The invocation was given by Mr. Jerald Bowman, and Mr. Lynn Cawthorne led the Commission in the Pledge of Allegiance. CITIZENS COMMENTS Mr. Rob Broussard, 451 Sandefur, Shreveport, reminded the Commissioners that the PARRC test scores were published last week for the local school system. He encouraged everyone to take a look at those scores and see how each school and the district, as a whole, has done. Mr. Broussard stated that the BNA s proposed program is dedicated to helping students prepare for tests and tutoring. He explained that students and parents would not be forced to be in program; it would be a voluntary program for those that truly needed and wanted the help. Mr. Broussard appreciated the Commissioners for at least considering to support this program for It was moved by Mr. Linn, seconded by Mrs. Gage-Watts, to adopt the Regular Session Minutes from October 22, Motion carried, as shown by the following roll call votes: YEAS: Commissioners Bowman, Cawthorne, Dominick, Epperson, Escude, Gage-Watts, Johnson, Linn, Thibodeaux, Smith, and Williams (11). NAYS: None (0). ABSENT: Commissioner Cox (1). It was moved by Mrs. Gage-Watts, seconded by Mr. Linn, to adopt the Special Session Minutes from October 29, Motion carried, as shown by the following roll call votes: YEAS: Commissioners Bowman, Cawthorne, Dominick, Epperson, Escude, Gage-Watts, Johnson, Linn, Thibodeaux, Smith, and Williams (11). NAYS: None (0). ABSENT: Commissioner Cox (1). COMMUNIQUES AND COMMITTEE REPORTS Dr. Wilson came forward to present a special recognition regarding Animal Services and the Spay and Neuter Program. Dr. Wilson stated that Animal Services will give away a Chihuahua named Ching as a free adoption, celebrating their 1,000 spayed or neutered animal from the shelter. Ching will be given away at 4:30 p.m. today. Dr. Wilson stated that every dog or cat is given a voucher to have their animal spayed or neutered once they have been adopted. Animal Services also follows up to make sure the process was completed. If it has not been spayed or neutered, then they retrieve the dog or cat from the owners. Dr. Wilson stated that Standards and Poor s has completed their look at Caddo Parish s financials, and he is proud to announce that we have once again kept out AAA Bond rating. Dr. Wilson provided copy of the report to the Commissioners. Mr. Epperson reported that Mr. Fortune contacted him after Monday s presentation to pass on to the Commissioners that Perspective Intelligence, LLC has signed a contract with the Louisiana State Police to use the LENS software. Answering a question from Mr. Linn regarding whether contract was with Troop G or entire Louisiana State Police, Mr. Epperson stated that it was his understanding it was the State Louisiana Police and not just one Troop. PRESIDENT S REPORT Mr. Johnson stated that he received no information about the press conference held for the Red River Classic and wanted to know if Administration knew anything of the press conference. He also asked that the Sports Commission and the City of Shreveport be contacted and asked why the Commission was not invited. Mr. Johnson requested that the process be explained for instances when a skunk needs to be picked up by Animal Services. Mr. Wilson, Animal Services, Acting Director, stated that traps are brought out and left overnight and the next day trap is checked and usually picked up. Mr. Wilson asked Mr. Johnson to give the citizen his phone number and he would see how they can better resolve the current situation. Mr. Johnson stated that he is getting many property standard problem calls, those mainly being abandoned houses and grass that is not being cut. Mr. Johnson requested Public Works to take a look at the communication process for this problem. 497

8 Commission Minutes November 5, 2015 PUBLIC HEARING ON ORDINANCES The President asked if there was anyone to speak in support of, or in opposition, to the following ordinance: Ordinance No of 2015, to deem property surplus and authorize the donation of surplus property owned by the Parish of Caddo. Ordinance No of 2015, declaring certain adjudicated properties to be surplus and to authorize the Parish Administrator, or a designee, to sell the Parish of Caddo s tax interest in certain surplus adjudicated properties. Ordinance No of 2015, to deem property surplus and authorize the sale of surplus property owned by the Parish of Caddo. There being no one to speak for or against ordinances, the President declared the public hearing on ordinances to be concluded. ORDINANCES (for final passage) It was moved by Mr. Dominick, seconded by Mr. Linn, that Ordinance No of 2015, to deem property surplus and authorize the donation of surplus property owned by the Parish of Caddo be adopted. Substitute motion by Mr. Thibodeaux, seconded by Mr. Linn, to in-globo the foregoing ordinances for adoption: Ordinance No of 2015, to deem property surplus and authorize the donation of surplus property owned by the Parish of Caddo. BY THE CADDO PARISH COMMISSION: ORDINANCE NO OF 2015 AN ORDINANCE TO DEEM PROPERTY SURPLUS AND AUTHORIZE THE DONATION OF SURPLUS PROPERTY OWNED BY THE PARISH OF CADDO, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO. WHEREAS, the Parish of Caddo owns the following equipment and material that is no longer being used or needed: Year/Make/Model License VIN Mileage Ford F FTRX17WX2KC Ford F FTRF17WOXNB Ford F-150 Supercab FTRX12W57NA WHEREAS, the Parish of Caddo no longer needs the above vehicles and said vehicles should be deemed surplus, obsolete or unused for present and future parish needs; and WHEREAS, the Parish of Caddo is authorized to donate movable property determined to be surplus to political subdivisions whose functions include public safety; WHEREAS, the Town of Greenwood and Parish of Caddo are political subdivisions whose functions include public safety; and 498

9 Commission Minutes November 5, 2015 WHEREAS, the Parish of Caddo desires to dispose of the above listed vehicles by donation to the Town of Greenwood; and NOW, THEREFORE, BE IT ORDAINED by the Caddo Parish Commission in due, legal and regular session convened that the above described property is deemed no longer needed for parish public purposes and is declared surplus property. BE IT FURTHER ORDAINED that the items described above shall be donated to the Town of Greenwood on an "as is" basis, without warranty of title or recourse whatsoever. BE IT FURTHER ORDAINED that the Caddo Parish Administrator or his designee shall be authorized to do any and all things and to sign any and all contracts and other documents in a form acceptable to the Caddo Parish Attorney necessary to effectuate the purposes set forth herein. BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this ordinance are hereby declared severable. BE IT FURTHER ORDAINED that this ordinance shall become effective upon adoption. BE IT FURTHER ORDAINED that all ordinances or parts thereof in conflict herewith are hereby repealed. BY THE CADDO PARISH COMMISSION: ORDINANCE NO OF 2015 AN ORDINANCE DECLARING CERTAIN ADJUDICATED PROPERTIES TO BE SURPLUS AND TO AUTHORIZE THE PARISH ADMINISTRATOR, OR A DESIGNEE, TO SELL THE PARISH OF CADDO S TAX INTEREST IN CERTAIN SURPLUS ADJUDICATED PROPERTIES, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO WHEREAS, the hereinbelow described properties are no longer needed for public purposes and should be declared surplus properties; and WHEREAS, the Parish of Caddo has received offers to purchase its tax interest in the hereinbelow described properties as indicated below. NOW, THEREFORE, BE IT ORDAINED by the Caddo Parish Commission in due, legal and regular session convened, that the hereinbelow described properties are no longer needed for public purposes and are surplus properties. WHEREAS, the Parish of Caddo has a tax interest in the hereinbelow described properties which have been adjudicated for the non-payment of Parish property taxes; and BE IT FURTHER ORDAINED, that the Caddo Parish Commission does hereby authorize the sale of its tax interest in the hereinbelow described properties. This is an expansion (Unit No. 7) of Lakeside on Long Lake. The applicant has a companion subdivision case SP on this Agenda for approval of a preliminary and final plat. This plan has 28 single family residential lots. The east end of Abbie Glenn Lane, which currently is a dead end, will be extended 540 for five (5) new lots. There is a T junction on Abbie Glen Lane for the new street, Mirabella Circle, which will create access to the new development. The street will have a cul-de-sac on the southwest end. Zoning to the north west is R-1B (PUD). Zoning to the east, south and west is R-A. REMARKS: All street right-of- way is 60 with a front building setback of 35. Lot sizes range from acres to acres. Typical lot size is 100 ft. X 200 ft., or 20,000 sq. ft. Minimum lot size in R-1B is 12,000 sq. ft. As this site is currently located in the Parish the residential rear setback is 25. However should this area be annexed into the City the rear residential setback will be 15. All of the streets will be publicly dedicated as part of the subdivision platting process. STAFF R ECOMMENDATION : As this zoning request is a compatible and logical extension of the adjacent subdivision staff recommends app roval of this application, as submitted. PUBLIC S ASSESSMENT There was no opposition present. BOARD S DECISION The Board voted 7-0 to recommend that the Parish Commission approve this application since it is a compatible and logical extension of the adjacent subdivision. The information stated herein is the result of discussion by a staff review team. The Board members will use all information made available to them in making their decision. A Planning Commission approval is a use approval only. The applicant is still responsible for complying with all other applicable Zoning Ordinance requirements and obtaining all necessary permits and approvals from other departments or agencies. 58 ORDINANCE NO OF 2015 BY CADDO PARISH COMMISSION: AN ORDINANCE AMENDING THE BUDGET OF ESTIMATED REVENUES AND EXPENDITURES FOR THE GENERAL FUND FOR THE YEAR 2015 TO PROVIDE AN ADDITIONAL APPROPRIATION OF $42,000 FOR LEGAL FEES, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO WHEREAS, it is the policy of the Caddo Parish Commission to indemnify Parish officials or officers from any loss due to attorney fees, court costs, monetary awards, etc. arising out of any claim, demand, suit or judgment if the officer or official was acting in the discharge of his or her duties and within the scope of his or her employment and any damages did not result from the intentional wrongful act or gross negligence of the official or officer; and WHEREAS, in the case of Stonecipher v. Caddo Parish, et al; all Commissioners, the Parish Administrator & CEO, and the Director of Finance & HR were dismissed individually from the lawsuit; and WHERAS, the Caddo Parish Commission would like to appropriate an additional $42,000 for legal fees to reimburse the Caddo Parish Commissioners, Parish Administrator & CEO, and the Director of Finance & HR for legal fees these individuals incurred as a result of the aforementioned case; and WHEREAS, it is necessary to amend the 2015 Budget in order to appropriate the additional funds for legal fees. 79 ORDINANCE NO OF 2015 BY THE CADDO PARISH COMMISSION: FOR THE PURPOSE OF ECONOMIC DEVELOPMENT, AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE PARISH OF CADDO AND CITY OF SHREVEPORT AND APPROPRIATIONG FUNDS FOR A LOAN TO SARI & COMPANY OR ITS DESIGNEE AND TO AUTHORIZE THE ADMINISTRATION TO EXECUTE A LOAN AGREEMENT BETWEEN THE PARISH OF CADDO AND SARI & COMAPANY OR ITS DESIGNEE, AND OTHERWISE PROVIDING WITH RESPECT THERETO. WHEREAS, Article VI, Section 20 of the Louisiana Constitution of 1974 provides that a political subdivision may exercise and perform any authorized power and function, including financing, jointly or in cooperation with one or more political subdivisions, either within or without the state, or with the United States or its agencies; and WHEREAS, Sari & Company has presented plans to redevelop Petroleum Tower located in Shreveport, Caddo Parish and has requested from the Parish of Caddo and the City of Shreveport certain loan proceeds necessary to partially fund the complete renovation, rehabilitation, and development of a mixed-use economic development project in downtown Shreveport; and WHEREAS, the amount requested from each entity is $600, for a total of $1.2 Million Dollars ($1,200,000.00); and WHEREAS, in an effort to participate in the aforementioned economic development project, provide greater economy and efficiency in the administration thereof and to fulfill the public purposes set forth herein, the City of Shreveport and the Parish of Caddo desire to enter into this Intergovernmental Agreement and provide a loan in the aforementioned amount; and WHEREAS, the Caddo Parish and the City of Shreveport recognize that completion of the redevelopment of Petroleum Tower will provide jobs and ultimately property tax revenue to the Parish of Caddo and City of Shreveport; and NOW, THEREFORE, BE IT ORDAINED, by the Caddo Parish Commission in due, legal and regular session convened, that $600, is appropriated to fund one half of the $1.2 Million Dollar loan to Sari & Company or its designee, contingent upon the City of Shreveport making an equal appropriation. BE IT FURTHER RESOLVED, by the Caddo Parish Commission, in due, regular, and legal session convened that the Parish Administrator is hereby authorized to execute, for and on behalf of the Parish of Caddo, an Intergovernmental Agreement with the City of Shreveport relative to the funding of loan proceeds to be used for a downtown development project. BE IT FURTHER RESOLVED that the Administrator is hereby authorized to execute, for and on behalf of the Parish of Caddo, loan documents with Sari & Company or its designee. for the purpose of lending up to $600, toward the completion of the downtown project referenced herein. 80 RESOLUTION NO. 58 OF 2014 BY THE CADDO PARISH COMMISSION: A RESOLUTION OF SUPPORT FOR THE RENOVATION OF THE PETROLEUM TOWER BY SARI & COMPANY AND OTHERWISE TO PROVIDE WITH RESPECT THERETO WHEREAS, the downtown area has a number of buildings that are currently not occupied and which are a unique and important resource; WHEREAS, Sari & Company has proposed to renovate the Petroleum Tower Building at 425 Marshall Street for residential use; WHEREAS, Sari & Company has proposed to construct a parking garage as a part of the project which will provide needed parking spaces; WHEREAS, the construction contract will be approximately $13 million with an economic impact of $13 million to $19.5 million; WHEREAS, the property is not currently on the tax rolls; WHEREAS, the project will create 130 apartments which will be leased at market rates and will create a ground level retail space; project; WHEREAS, certain economic development measures area available to support this WHEREAS, those economic development measures will abate the property taxes from the property for a determinate period following which the property will go on the tax rolls with a significant assessed value; and WHEREAS, Sari & Company desires the support of the Parish of Caddo, including financial support in the form of a loan of up to $750,000. NOW, THEREFORE, BE IT RESOLVED, by the CADDO PARISH COMMISSION, in due and legal session convened that it goes on record as supporting the Petroleum Tower project of Sari & Company in renovating the Petroleum Tower Building for residential use in downtown Shreveport; BE IT FURTHER RESOLVED that if any provision or item of this Resolution or the application thereof is held invalid, such invalidity shall not affect other provision, items or applications of the Resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable. 81 MINUTES OF THE WORK SESSION OF THE CADDO PARISH COMMISSION HELD ON THE 2 nd DAY OF NOVEMBER, 2015 The Caddo Parish Commission met in a Work Session, on the above date, at 3:30 p.m., in the Government Chambers, with Mr. Lyndon B. Johnson, President, presiding, and the following members in attendance, constituting a quorum: Commissioners Bowman, Cawthorne, Cox, Epperson, Escude, Gage-Watts, Johnson, Linn, Smith, Thibodeaux, and Williams (11). ABSENT: Commissioner Dominick (1). The invocation was given by Mr. David Cox, and the Pledge of Allegiance was led by Mr. Mike Thibodeaux. VISITORS Mr. Robert Fortune and Mr. Russell Sarpy, Co-founders, Perspective Intelligence, LLC, stated that they appreciated Mr. Epperson inviting them to come before the Commission and share their company vision on law enforcement and intelligence. Perceptive Intelligence, LLC is a Shreveport based company, focused on providing intelligence information to law enforcement agencies in the area and around the country. Mr. Fortune stated that he had eighteen years law enforcement with the FBI, and his partner Russell Sarpy served twenty years with the Shreveport Police Department. Their information system called LENS, the Law Enforcement Networking System. This system will allow law enforcement agencies to share information files throughout the country, thereby protecting officers and the general public at the same time. Mr. Fortune believes LENS will compel all agencies to get on one system, making it easier to share information at any law enforcement level. Mr. Russell Sarpy pointed out that with this system they believe they can help reduce number of inmates at CCC along with utilizing this program to help reduce juvenile inmates at the Juvenile Detention Center. This system would make parents aware of when their child has been stopped by an officer and where they may be transported to for pickup. Mr. Sarpy pointed out that there is no system like LENS in the U.S. today. Mr. Sarpy is asking the Caddo Parish Commission to take a look at this system and support it with their backing as they move to engage local law enforcement agencies. Mr. Fortune stated that they are currently working to finalize contracts with the Desoto Parish Sheriff s Office and Centenary Police Force; they should begin training in the next month or so. They are working with the Caddo Parish Sheriff s Office and the Louisiana State Police hammering out language and other contract issues, but believe both those agencies will be part of the system in the coming months. Mr. Williams said that with the state of America relating to traffic stops, he believes this system would not only protect citizens, but our brave officers that work the streets on a daily basis. He also believes this system might be one that our local entrepreneurial group could help in getting established and this system could be helpful in our juvenile court system. Mr. Williams stated that it was a shame the first contract came from the Desoto Sheriff s Office first and not Caddo Parish Sheriff s Office or City of Shreveport Police Department. Mr. Linn stated that he agreed with Mr. Williams that we should see if this program would benefit by being looked at by the Entrepreneurial Assistance Program in Caddo Parish. Mr. Linn asked Mr. Fortune what he thought the Parish s part would be in this program. Mr. Fortune stated that they mainly need the support of the various governing bodies to help show other agencies that this program is well thought of and is something useable by all law enforcement agencies. Mr. Escude stated that he is familiar with the program and believes that this is definitely a useable program by all the various agencies in the area. He believes it would be prudent for them to do a presentation to the Shreveport City Council in the near future. Mr. Escude also believes it might be important for the Caddo Commission to pass a resolution supporting this company and their use by the various local law enforcement agencies. Mr. Epperson stated that he will be providing contact information concerning the Police Jury Association and the National Association of Counties to help build a data base of contacts for their program. Mr. Johnson stated that he is interested in how this program might be utilized in relation to juvenile services. Mr. Johnson stated that anyway to help in keeping juvenile crime numbers down, he would support. Mr. Thibodeaux stated that he understands the program and he also knows Mr. Fortune s family, so he is comfortable with a program he is touting. Unfortunately, Mr. Thibodeaux stated, he probably will not be around to vote on this program in the future.

82 Work Session Minutes November 2, 2015 Page 2 ADMINSTRATION REPORT Dr. Wilson reminded the Commissioners that on November 16 th, Administration will hold its final budget meeting to allow Commissioners to ask any final questions regarding the 2016 Budget before the public hearing on the November 19 th. Mr. Williams is concerned with the new City Council Ordinance on horses and would like Parks and Recreation to look at possible locations for a horse park or trail ride area. Mr. Williams believes it is wrong to prohibit the use of horses in the City where they have always had horses in prior years. Dr. Wilson reminded the Commissioners that the Parish has horse trails available at Eddie Jones Park in south Caddo Parish. Answering a question from Mr. Cox regarding whether the City of Shreveport involved Animal Services concerning this horse ordinance, Mr. Chuck Wilson stated that Animal Services along with Dr. Wilson have been involved during the process. Mr. Wilson stated that Animal Service will have to enforce the ordinance as written, not the City of Shreveport Police Department. Dr. Wilson stated that the City Council introduced and passed the horse ordinance to address the housing of horses on property within the city and implementing certain size and fencing regulations to meet the needs of these animals and citizens. Dr. Wilson stated that during these meetings they stressed that there could be a problem with the Parish housing impounded horses and the costs associated with that task. Answering a question from Mr. Cawthorne regarding authorship of discussed ordinance, Dr. Wilson stated that this is a City of Shreveport ordinance that addresses the housing and adequate care of horses, not riding horses within the city limits. Mr. Johnson pointed out that horses have been housed and used throughout the City for decades. All of a sudden the City Council decided to pass an ordinance to limit this use without consulting the very agency that would be needed to enforce the ordinance, he said, and in a sense, it would be putting an unfunded mandate on the Parish by the City. Mr. Johnson stated that he believes the City Council and Parish need to sit down and come to a better ordinance that both groups can live with in the future. Mr. Escude agreed with Mr. Johnson on this issue, he does not understand how the City would pass an ordinance that would have to be enforced by the Parish, but not provide on how the City would pay for the increased costs. Mr. Escude believes a meeting of the two bodies is needed to correct this situation. Answering a question from Mr. Bowman relating to the City Council looking and adopting the new Animal Ordinances, Ms. Frazier stated that those ordinances have been sent to the city for their review but the horse issue was not included; those ordinances have not been sent to full council for ratification. Answering a question from Mr. Epperson regarding fees to take care of this new ordinance, Dr. Wilson stated that there may be some charges for boarding horses, but he remembers a problem with asking for supplemental money from the City of Shreveport a few years ago when trying to put more ACO s on the streets. Mr. Cox believes there were boarding fees put into our ordinance back in 2008 and those fees should cover those costs. Mr. Cox suggests that the City and Parish sit down and come up with a reasonable compromise. Mr. Williams does not want to see the costs of this ordinance be a burden for the Parish of Caddo and not shared by the City of Shreveport. Mr. Williams believes the Commission and the City Council needs to sit down and work this situation out amicably. may have. He stressed that there has to be some way for the Parish and City of Shreveport to work together and come up with programs to utilize that piece of property. An empty stadium not being used is a shame and it s time to come up with something that would benefit city and parish children. NEW BUSINESS

Substitute motion by Mr. Thibodeaux, seconded by Mrs. Gage-Watts to en-globo the foregoing ordinances for introduction at Thursday s Regular Session. Ordinance No of 2015, adopting the budget of estimated revenues and expenditures for the Shreve Memorial Library for the year Ordinance No of 2015, amending the 2015 budget of estimated revenues and expenditures for the detention facilities fund to increase the appropriation for prisoner medical care by $350,000. Ordinance No of 2015, amending the 2015 budget of estimated revenues and expenditures for the oil and gas fund to reduce the appropriation for oil royalties by $695,000 At this time, Mr. Thibodeaux s motion carried, as shown by the following roll call vote: AYES: Commissioners Bowman, Cawthorne, Cox, Escude, Gage-Watts, Johnson, Linn, Smith, Thibodeaux, and Williams (10).
