1 MINUTES OF THE MEETING OF THE CADDO PARISH COMMISSION HELD ON THE 5th DAY OF JULY, 2018 The Caddo Parish Commission met in legal and regular session, on the above date, at 3:30 p.m., in the Government Chambers, with President Dominick, presiding, and the following members in attendance, constituting a quorum: Commissioners Atkins, Bowman, Cawthorne, Chavez, Dominick, Gage-Watts, Louis Johnson, Lyndon B. Johnson, Linn, Middleton, and Smith (11). ABSENT: Commissioner Jackson (1). The invocation was given by Mrs. Gage-Watts, and Mr. Linn led the Commission in the Pledge of Allegiance. VISITORS Independence. Mr. Ken Krefft came before the Commission and recited the Declaration of SPECIAL RESOLUTIONS It was moved by Mr. Dominick, seconded by Mrs. Gage-Watts, to approve Special Resolution of Recognition to Nick LeBrun, 2018 Boater Division T-H Marine BFL All-American Champion. Motion carried, as shown by the following roll call votes: AYES: Commissioners Atkins, Bowman, Cawthorne, Chavez, Dominick, Gage-Watts, Louis Johnson, Lyndon B. Johnson, Linn, Middleton, and Smith (11). NAYS: None (0). ABSENT: Commissioner Jackson (1). ABSTAIN: None (0). RESOLUTION OF RECOGNITION TO NICK LEBRUN WHEREAS, the Caddo Parish Commission is always pleased to observe and enjoy the accomplishments of those Northwest Louisiana sons and daughters who have gone forth to attain success and distinction in the various endeavors they pursue in national and world arenas; and WHEREAS, on June 2, 2018 Caddo Parish native NICK LEBRUN moved into the ranks of fishing's elite by capturing the top spot in the Boaters Division of the prestigious T-H Marine BFL All- American on Cross Lake. For the former North Caddo Magnet High School and BPCC student, the T-H Marine BFL All-American title is his first $100,000 championship and his third tournament win of his career; and WHEREAS, the BFL All-American win also earned for LeBrun a coveted spot in the 2018 Forrest Wood Cup on Lake Ouachita in Hot Springs, Arkansas, beginning August 10 th where he will join fellow top anglers. Nick s entry into the Forrest Wood Cup competition provides the Bossier-Caddo area the rare distinction of having a local professionals compete in this prestigious tournament; and WHEREAS, Nick has always loved fishing. He yearned for the day he could turn his hobby into a professional career; with his earnings this year and the success he has had on the water, it appears Nick s dreams are finally coming true to not only be a professional angler but to be a successful professional angler. NOW, THEREFORE, BE IT RESOLVED, by the Caddo Parish Commission, meeting in legal and regular session this 5th day of July, 2018, that it does hereby declare and proclaim to be: 'NICK LEBRUN DAY' in Caddo Parish, Louisiana, in recognition and admiration of his notable achievements in the sport of professional angling. ADOPT REGULAR SESSION MINUTES FROM JUNE 7, 2018 It was moved by Mr. Dominick, seconded by Mrs. Gage-Watts, to adopt the Regular Session minutes from June 21, Motion carried. COMMUNIQUES/COMMITTEE REPORTS Dr. Wilson brought forward Mr. Rusty Scarborough to present Walter B. Jacobs Park s bald eagle. He said that Walter B. Jacobs Nature Park has been a raptor rehabilitation site for many years. This eagle came to the Parish about 8 years ago as a juvenile eagle. She has a deformed wing, which will not allow her to fly. Due to her deformity, she cannot be released back into the wild, so she is now an animal ambassador at the nature park. He said that bald eagles could live for about 50 years. 604
2 Answering a question from Mr. Lucky regarding her wingspan, Mr. Scarborough stated that it would be about 6 feet. Answering a question from Mr. Dominick regarding the number of animals at Walter B. Jacobs, Mr. Scarborough stated they have several animals including six birds of prey. Attorney Frazier provided a listing of the NGOs who have received their cooperative endeavor agreements. Mr. Linn announced that the Running with the Bulls event is scheduled for July 14 from 8:00 a.m. until 1:00 p.m. He said the event is to bring awareness to pitbull breeds. Robinson s Rescue will also be at the event to encourage spaying and neutering of pets. 2:00 p.m. Mr. Bowman announced that the Animal Services Committee would meet on July 16 at PRESIDENT S REPORT Mr. Dominick thanked everyone who attended the Independence Day Festival. He said that the Caddo Parish Commission was a sponsor of the event. PUBLIC HEARING ON ZONING ORDINANCES & CASES Mr. Dominick asked if there was anyone to speak in support of or in opposition of the following zoning ordinance: Ordinance No of 2018, in regards to Zoning Case P-12-18, amending the zoning of property located on the end of Singleton Road 1,025 feet south of Pine Hill Road, Caddo Parish, LA, from R-MHP, Residential Manufactured Home Park District to R-1-5, Single Family Residential District, and to otherwise provide with respect thereto There being no one to speak in favor of or in opposition of this zoning ordinance, the President closed the public hearing on zoning ordinances. ZONING ORDINANCES (for final passage) It was moved by Mr. Lyndon B. Johnson, seconded by Mr. Atkins, that Ordinance No. Ordinance No of 2018, in regards to Zoning Case P-12-18, amending the zoning of property located on the end of Singleton Road 1,025 feet south of Pine Hill Road, Caddo Parish, LA, from R-MHP, Residential Manufactured Home Park District to R-1-5, Single Family Residential District, and to otherwise provide with respect thereto be adopted. Motion carried, as shown by the following roll call votes: AYES: Commissioners Atkins, Bowman, Cawthorne, Chavez, Dominick, Gage-Watts, Louis Johnson, Lyndon B. BY THE CADDO PARISH COMMISSION: ORDINANCE NO OF 2018 AN ORDINANCE TO AMEND VOLUME II OF THE CODE OF ORDINANCES OF THE PARISH OF CADDO, AS AMENDED, THE CADDO PARISH UNIFORM DEVELOPMENT CODE, BY AMENDING THE ZONING OF PROPERTY LOCATED ON THE END OF SINGLETON ROAD 1,025 FEET SOUTH OF PINE HILL ROAD, CADDO PARISH, LA., FROM R-MHP, RESIDENTIAL MANUFACTURED HOME PARK DISTRICT TO R-1-5, SINGLE FAMILY RESIDENTIAL DISTRICT, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO BE IT ORDAINED by the Caddo Parish Commission in due, legal and regular session convened, that Volume II of the Code of Ordinances of the Parish of Caddo, as amended, the Caddo Parish Uniform Development Code, is hereby amended and re-enacted to read as follows, to wit: The official Zoning Map of the Shreveport Metropolitan Planning Area of Caddo Parish, Louisiana, be amended by rezoning property located on the end of Singleton Road, 1,025 feet South of Pine Hill Road, Caddo Parish, LA, more particularly described below, be and the same is hereby amended from R-MHP, Residential Manufactured Home Park District, to R-1-5, Single Family Residential District: 605
3 A tract of land located in the Southeast Quarter of the Southwest Quarter of the Northeast Quarter of Section 1, T18N, R15W, Caddo Parish, Louisiana, being a portion of Lot 1, Elizabeth Attaway Partition, and being more particularly described as follows: begin at the on the center line at the south end of Singleton Road as per Book 1340, Page 532, Conveyance Records of Caddo Parish, Louisiana, also being the northwest corner of Lot 1, Brandon Place Subdivision as recorded in Book 700, Page 245, Conveyance Records of Caddo Parish, Louisiana, also being the Point of Beginning of the tract herein described; thence South West a distance of feet along the west line of Lot 1, said Brandon Subdivision; thence North West a distance of feet; thence North East a distance of feet; thence South East a distance of feet to the west of right of way line of said Singleton Road; thence along the boundaries of said Singleton Road the following two courses: South West a distance of feet; South East a distance of feet to the Point of Beginning; said tract herein described containing acres, more or less, Caddo Parish, Louisiana. BE IT FURTHER ORDAINED, that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this ordinance are hereby declared severable. BE IT FURTHER ORDAINED that this ordinance shall become effective ten (10) days after publication in the official journal. BE IT FURTHER ORDAINED, that all ordinances or parts thereof in conflict herewith are hereby repealed. It was moved by Mr. Lyndon B. Johnson, seconded by Mrs. Gage-Watts, that the Work Session Minutes from July 2, 2018 be approved. Motion carried. RESOLUTIONS It was moved by Mrs. Gage-Watts, seconded by Mr. Bowman, to englobo and adopt the foregoing Resolutions: Resolution No. 47 of 2018, to relocate polling place for Precinct No. 2 from Lakeview United Methodist Church, 5550 South Lakeshore Drive, Shreveport, LA to Willow Point Baptist Church, 5500 South Lakeshore Drive, Shreveport, LA Resolution No. 48 of 2018, to relocate polling place for Precinct No. 111 from Bilberry Recreation Center, 1902 Alabama Avenue, Shreveport, Louisiana 71109, to Shreveport Job Corps Center, 2815 Lillian Street, Shreveport, Louisiana Mrs. Gage-Watts and Mr. Lyndon B. Johnson ask that signage of the new locations be placed in advance to let the citizens know the polling place has been moved. Mr. Lyndon B. Johnson pointed out that the Registrar of Voters sends out notices to the citizens in the area advising them of the polling place changes. At this time, Mrs. Gage-Watts motion carried, as shown by the following roll call votes: AYES: Commissioners Atkins, Bowman, Cawthorne, Chavez, Dominick, Gage-Watts, Louis Johnson, Lyndon B. Johnson, Linn, Middleton, and Smith (11). NAYS: None (0). ABSENT: Commissioner Jackson (1). ABSTAIN: None (0). BY THE CADDO PARISH COMMISSION: RESOLUTION NO. 47 OF 2018 A RESOLUTION TO RELOCATE POLLING PLACE FOR PRECINCT NO. 2 FROM LAKEVIEW UNITED METHODIST CHURCH, 5550 SOUTH LAKESHORE DRIVE, SHREVEPORT, LA TO WILLOW POINT BAPTIST CHUCH, 5500 SOUTH LAKESHORE DRIVE, SHREVEPORT, LA 71119, AND OTHERWISE PROVIDING WITH RESPECT THERETO. WHEREAS, the established polling location for Precincts No. 2 is located at Lakeview United Methodist Church,5550 South Lakeshore Drive Shreveport, Louisiana 71119;and WHEREAS, the church is closed; and 606
4 WHEREAS, Willow Point Baptist Church, 5500 South Lakeshore Drive, Shreveport, Louisiana is approximately.1 miles driving distance from Lakeview United Methodist Church and located on South Lakeshore Drive which is serviced by Sportran, the city transit system; and WHEREAS, the proposed polling place meets all requirements for polling places. NOW, THEREFORE, BE IT RESOLVED by the Caddo Parish Commission in due, regular and legal session convened, that the Caddo Parish Commission does hereby change the polling location for Precinct No. 2 from Lakeview United Methodist Church, 5550 Lakeshore Drive, Shreveport, Louisiana to Willow Point Baptist Church, 5500 South Lakeshore Drive, Shreveport, Louisiana BE IT FURTHER RESOLVED that notice of this change shall be published in the official journal of the parish in accordance with La.R.S. 18:535. BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable. BE IT FURTHER RESOLVED that this resolution shall take effect immediately. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed. BY THE CADDO PARISH COMMISSION: RESOLUTION NO. 48 OF 2018 A RESOLUTION TO RELOCATE THE POLLING PLACE FOR PRECINCT 111 FROM BILBERRY RECREATION CENTER, 1902 ALABAMA AVENUE, SHREVEPORT, LOUISIANA 71109, TO SHREVEPORT JOB CORPS CENTER, 2815 LILLIAN STREET, SHREVEPORT, LOUISIANA AND OTHERWISE PROVIDING WITH RESPECT THERETO. WHEREAS, the established polling location for Precinct No. 111 is located at Bilberry Recreation Center, 1902 Alabama Avenue, Shreveport, Louisiana 71109; WHEREAS, the City of Shreveport has begun a construction project to improve and renovate Bilberry Recreation Center and Park and that project will interfere with its use as a polling place; WHEREAS, the Shreveport Job Corps Center, 2815 Lillian Street, Shreveport, Louisiana has agreed to serve as a polling place; and WHEREAS, the distance between the current location of the polling place for Precinct No. 111 and the proposed location is.3 miles; and WHEREAS, the proposed polling place has been reviewed and meets all requirements for polling places. NOW, THEREFORE, BE IT RESOLVED by the Caddo Parish Commission in due, regular and legal session convened, that the Caddo Parish Commission does hereby change the polling location for Precinct No. 111 from Bilberry Recreation Center, 1902 Alabama Avenue, Shreveport, Louisiana to Shreveport Job Corps Center, 2815 Lillian Street, Shreveport, Louisiana 71109,. BE IT FURTHER RESOLVED that notice of this change shall be published in the official journal of the parish in accordance with La.R.S. 18:535. BE IT FURTHER RESOLVED if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this resolution are hereby declared severable. BE IT FURTHER RESOLVED that this resolution shall take effect immediately. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed. NEW BUSINESS It was moved by Mrs. Gage-Watts, seconded by Mr. Bowman, that the confirmation of changes to the Caddo Parish Personnel Policy as recommended by Administration be adopted. 607
5 Substitute motion by Mr. Atkins, seconded by Mr. Dominick, to approve all sections with the exception of Section 301 Sick Leave and remand Section 301 Sick Leave to the Personnel Policy Committee. Mr. Atkins stated that he has some concerns regarding sick leave. He would like to discuss it and clarify it further in committee. Mr. Dominick agreed. Mr. Lyndon B. Johnson asked for more clarification. Mr. Atkins would like all employees to be vetted before they roll into the sick leave program. He explained they can enroll into the sick pool after 90 days, but their probationary period is for six months. He feels that those timelines should meet up with one another. Mr. Atkins would like this section to be discussed further to get a better understanding of it. Mrs. Bryant explained that an employee starts accruing sick time the day they start working for the Parish. They have a six-month probationary period to determine whether they remain employed. She said that the change being requested in this policy is related to the donated sick leave pool, where an employee can donate time to a sick pool. In order to participate in the pool, an employee has to donate 8 hours. The change is to make the donate pool process more stringent and used only for a major medical situation, not an intermittent medical situation. She also explained that an employee has to have at least eight hours to donate in order to use the sick pool. Mr. Atkins pointed out that there is some confusion regarding this policy. His ask is to delay the vote just on this section to get clarification on it. Substitute motion by Mr. Lyndon B. Johnson, seconded by Mr. Chavez, to postpone all sections for final adoption after the Personnel Policy Committee meets and discusses Section 301. Mr. Atkins stated that it is not his point to open all of the policies back up. He would just like to discuss and clarify Section 301 Sick Leave. Mr. Chavez pointed out that Mr. Lyndon B. Johnson s motion is to only send Section 301 back to committee and vote on the policies as a whole. At this time, Mr. Lyndon B. Johnson s motion carried, as shown by the following roll call votes: AYES: Commissioners Atkins, Bowman, Chavez, Dominick, Lyndon B. Johnson, Linn, and Smith (7). NAYS: Commissioners Louis Johnson and Middleton (2). ABSENT: Commissioners Cawthorne, Gage-Watts, and Jackson (3). ABSTAIN: None (0). It was moved by Mr. Louis Johnson, seconded by Mr. Middleton, to confirm appointment of Ms. Susan Tuberville to the Caddo Parish Fire District No. 3 Board to fill the unexpired term left vacant by the death of Mr. David Tree Burks. Mr. Louis Johnson stated that all three candidates are qualified for the appointment, but he has only received information on Ms. Tuberville. He asked that the Commission support his motion. Mr. Chavez agreed with Mr. Louis Johnson, and stated that Ms. Tuberville was the only one who sent a resume. At this time, Mr. Louis Johnson s motion carried, as shown by the following roll call votes: AYES: Atkins, Bowman, Cawthorne, Chavez, Dominick, Gage-Watts, Louis Johnson, Lyndon B. Johnson, Linn, Middleton, and Smith (11). NAYS: None (0). ABSENT: Commissioner Jackson (1). ABSTAIN: None (0). COMMUNIQUES AND COMMITTEE REPORTS Mr. Louis Johnson discussed the Personnel Policy. He suggested having the employees input regarding the Personnel Policy. Mr. Cawthorne asked Mr. Travis Clark, Animal Services Director, to come forward regarding raccoons. Mr. Clark said that they could trap nuisance raccoons. Mr. Linn said that raccoons are the friendliest of the badger family, but everyone should let Animal Services handle them. Answering a question from Mr. Cawthorne regarding the Safe Summer Program, Mr. Henri Wesley, Parks & Recreation Director, stated that the program has already kicked off. If anyone has a program, then the information needs to be sent to Mr. Wesley. concern. Mr. Chavez commended Mr. Stephen Jean, MPC, for all of his help regarding a citizen There being no further business to come before the Commission, the Regular Session adjourned at 4:13 p.m. 608
