24 METROPOLITAN PLANNING COMMISSION STAFF REPORT - APRIL 5, 2017 Agenda Item No. 19 mr CASE NO. P-6-17: ZONING REQUEST District: 9/Atkins Applicant: RALEY AND ASSOCIATES, INC Owner: Country Club Estates Number 1, 2, 4 and 5, LLC Location: 2100 Block of Southern Loop (South side of Southern Lp, approx E of Wallace Lake Rd) Existing Zoning: R-A Request: R-A to B-2 and B-2- E Proposed Use: Climate Control led Warehouse and Future Commercial Development DESCRIPTION: The applicant is requesting approval to rezone 4 tracts of land containing acres from R-A to B-2 (Neighborhood Business District) for future commercial development and B-2-E (Neighborhood Business District) with Extended Use Approval limited to a climate controlled warehouse facility. Even though the proposed use is actually a self-storage type operation, the current Parish Ordinance describes such uses as a warehouse, which explains why this type of terminology is being applied in this application. The B-2-E will consist of a acre tract which will be taken from a portion of one of the 4 tracts identified in this application. The remaining acres will be B-2. Running concurrent with this request and part of the MPC consent agenda is a subdivision application (SP-51-17) for the aforementioned acre tract. It should be noted in this report that P-7-17 to rezone an additional acre tract located further to the east of this site is being presented concurrently with this application to help establish what will become a commercial corridor. That subject property is separated by a parcel of land not owned by the applicant. Due to the separation, an additional application was required for that tract. The intent of the applicant is to create a business corridor along the south side of Southern Loop for future commercial development that will enhance and provided needed services for this area. There is existing B-2 zoning (P-8-16) a little further to the east with B-2 at the northwest corner of Southern Loop and Norris Ferry (C-28-14). The property is adjacent to residential property (R-A) to the west and south. Across Southern Loop to the north is the Provenance development which is zoned R-2(PUD) (P-7-04 and C-8-14) allowing for the introduction of limited commercial uses that are deemed appropriate and supportive of a residential area. There is no case history associated with this property. REMARKS: As noted above, the applicant intends to develop a commercial corridor along the south side of Southern Loop eastward. Provenance with its R-1D (PUD) zoning, currently has 300 acres that are earmarked for future residential and commercial development. As Provenance develops, it is logical to conclude that the south side of Southern Loop will become a commercial corridor for the providers of appropriate business services and goods in support of Provenance s population base. Due to topographical issues on the south side of Southern Loop, as illustrated on topo maps provided by the applicant, additional residential development is not feasible because of the significate slopping of the property to the south. Within the Provenance development, there are currently some commercial uses (i.e., restaurants, medical clinic and small offices) that were approved under the PUD approval. There is also a veterinary clinic and fire station located along the frontage of Provenance which is part of the PUD approval C The other B-2 uses within this area consist of a retail pharmacy (C ) and a convenience store & gas station (C-13-08). The most recently rezoned property (P-8-16) will consist of commercial mixed uses that are allowed within the B-2 zoning classification. Since this tract will contain less than 5 acres and will qualify for a SPUD (Small Planned Unit Development), the applicant intends to make that request once the UDC is officially adopted to provide specific uses, landscape components, building layout and design details, and other amenities in a site plan for the future expansion of the climate control warehouse to include outside storage and possible retail outlets. Under the current Parish Ordinance, I-1 zoning is the only district that allows warehouse (storage) facilities as a use-byright which is too intense and not compatible with the surrounding zoning and existing neighborhoods. Since this property is currently located in the Parish, the existing Parish Ordinance does not offer the option of either commercial/mixed use PUD or SPUD zoning at this time. The applicant is also actively seeking annexation into the City. The climate controlled warehouse is the first priority for the applicant so therefore the Extended Use request is being sought as the initial step in his development plans. It is a realistic assumption that with the existing residential development further to the south and the anticipated expansion of Provenance, a storage facility could offer a needed service in this growing market area. Other than the climate controlled warehouse, there is no immediate development plans for the remainder of the property. If this application is approved, the applicant is aware that site plan approval is required prior to the issuance of any building permits. STAFF RECOMMENDATION : Staff recommends approval of the following: zoning request for B-2 Neighborhood Business District for acres and a zoning request for B-2-E Neighborhood Business District with an Extended Use Approval limited to a climate controlled warehouse on acres. A site plan is required to be submitted for the review and approval by the Executive Director prior to the issuance of any permits. PUBLIC S ASSESSMENT There was no opposition present. BOARD S DECISION

25 The Board voted 8-0 to recommend that the Parish Commission approve the following: Zoning request for B-2, Neighborhood Business District zoning for acres and a zoning request for B-2-E, Neighborhood Business District with Extended Use Approval limited to a climate controlled warehouse on acres. A site plan shall be reviewed and approved by the Executive Director prior to the issuance of any permits. The information stated herein is the result of discussion by a staff review team. The Board members will use information made available to them in making their decision. A Planning Commission approval is a use approval The applicant is still responsible for complying with all other applicable Zoning Ordinance requirements and obtain all necessary permits and approvals from other departments or agencies. This shall include, but not be limited to requirements of the Zoning Administrator, building permits, liquor licenses, the parish health unit, and Certificates Occupancy.

There is no case history associated with this property. REMARKS: As noted above, the applicant intends to develop a commercial corridor along the south side of Southern Loop eastward. Provenance, with its R-1D(PUD) zoning, currently has 300 acres that are earmarked for future residential and commercial development. As Provenance develops, it is logical to conclude that the south side of Southern Loop will become a commercial corridor for the providers of appropriate business services and goods in support of Provenance s population base. Due to topographical issues on the south side of Southern Loop, as illustrated on topo maps provided by the applicant, additional residential development is not feasible because of the significate slopping of the property to the south. Within the Provenance development, there are currently some commercial uses (i.e., restaurants, medical clinic and small offices) that were approved under the PUD approval. There is also a veterinary clinic and fire station located along the frontage of Provenance which is part of the PUD approval C The other B-2 uses within this area consist of a retail pharmacy (C ) and a convenience store & gas station (C-13-08). The most recently rezoned property (P-8-16) will consist of commercial mixed uses that are allowed within the B-2 zoning classification. The applicant is also actively seeking annexation into the City. The applicant is aware that site plan approvals are required for any development prior to the issuance of any permits with in any of the proposed B-2 sites. The proposed medical facility or micro-hospital will be open 24 hours a day, and will provide acute care, with ambulance services, but no surgical procedures performed on site. The applicant has also submitted an application for variances in hours of operation and parking, to be heard at the May 17 th ZBA public hearing, and an application for an administrative re-plat has been submitted, to be reviewed and approved by the Executive Director. The applicant has been informed that a site plan application is required for administrative review and approval. The property is surrounded by residential zoning to the north (R-1D), commercial and residential zoning to the east and west (R-1D, R-A, B-1 and B-2), and the Camp Forbing Marketplace development to the south (B-2(PUD)). There are no prior cases for this site. REMARKS: The proposed facility will be a small scale licensed ER and medical hospital, designed to bring quality acute care to south Shreveport. The facility will be equipped to offer the full services of a standard emergency department, including CT scans, bedside ultrasounds, X-Rays, MRIs, and a full clinical laboratory. Staffing will include physicians, registered nurses, radiology and clinical technicians, and managerial and support staff. This facility will focus on a few service lines (ER, medical inpatient, outpatient labs and imaging) in order to provide faster, more streamlined care. The hospital will have a wing with 8-10 beds, when it s necessary to admit a patient for further observation and care. There will be no intensive care unit, and any admitted patients will be stable, with no surgeries required. The average patient stay is less than 5 days. If extensive care or surgeries are required, the patient will be transferred to the nearest or preferred hospital. Per the applicant, The hospital s goal is to contract with the local EMS providers to bring only specific patients to the micro-hospital facility. In our agreement, we ask for ambulances to arrive without lights and/or sirens. There is a chance that some trips, although very few, may not follow this protocol. It s important to note that ambulance services are ancillary to a hospital use. Other services to be offered at this location include employment and school physicals, drug testing, mask fitting, employment training and education. While the property north of Ellerbe Road between Flournoy Lucas Road and E. Bert Kouns Industrial Loop is still primarily residentially zoned, it has begun developing commercially in the past few years, especially with the approval of the Camp Forbing Marketplace (C-62-14), a mixed use planned unit development, located on the southwest corner of Flournoy Lucas and Ellerbe. Other similar zoning requests and site plan approvals in this area include: zoning change to B-1 for a bank (P-6-14; P-5-15); zoning change to B-1 for an office (P-9-06; P-35-07; P ); and a zoning change to B-2 to allow an grocery store (P-29-96). The requested zoning of B-1 is compatible with those properties already rezoned along Ellerbe Road, and a low-intensity medical facility such as the one proposed will provide a necessary benefit to the surrounding neighborhoods. Additionally, the applicant will be providing a 6 screening fence to shield the existing residential properties adjacent to this property from the development, which is required by ordinance. A use approval is required because the applicant is proposing to develop a medical facility more intense than those allowed by right in the B-1 zoning district (clinic, optician, etc.). The applicant s request involves a facility that operates more like a small-scale hospital, in cases such as these, the MPC has the authority to grant approvals for more intense medical uses in the B-1 district, such as a hospital, sanitarium and laboratory. As stated above, the proposed hospital will only provide acute care, primarily outpatient procedures, with the ability for patients to be admitted who are in stable condition. This use approval request is primarily to allow this facility to offer emergency, laboratory and imaging services. STAFF RECOMMENDATION : Staff recommends approval of this application, as submitted. WHEREAS, Explosive Service International has nearly completed its contract to dispose of M6 explosive propellant and Cleaning Burning Igniter in a contained burn chamber at Camp Minden, Louisiana; WHEREAS, other parties and individuals have proposed that the contained burn chamber would remain in operation at Camp Minden following the completion of the M6 disposal; WHEREAS, the ongoing operation of the contained burn chamber at Camp Minden would potentially result in explosive, hazardous, or industrial waste being burned some 25 miles to the east of Caddo Parish; WHEREAS the Caddo Parish Commission is unaware of any definitive study which shows that burning explosive, hazardous, or industrial waste will not result in toxic air emissions; WHEREAS, wind blowing from the east would cause any toxic air emissions from the burn chamber to drift over Caddo Parish and its citizens; WHEREAS, the Caddo Parish Commission believes it is in the best interest of the residents of Caddo Parish that the air emissions from that burn chamber not be blown to Caddo Parish; and WHEREAS, the Caddo Parish Commission, noting that the prevailing winds in this region are predominantly from the north and south, believes that such a restriction would not unduly impact the operations of the burn chamber at Camp Minden, Louisiana.
