6 METROPOLITAN PLANNING COMMISSION STAFF REPORT - FEBRUARY 3, 2016 Agenda Item No: 21 em CASE NO. P-1-16: ZONING REQUEST AND SITE PLAN District: 2/Johnson Applicant: MOHR & ASSOCIATES, INC. Owner: Location: Barbara Jane Bowman Carter & Daniel Glenn Bowman Testamentary Trusts 5706 North Market St. (North side of Market St., 3,040 East of Roy Rd. Ext.) Existing Zoning: R-A Request: R-A to B-3 & Site Plan Approval Proposed Use: Zaxby s Chicken Restaurant DESCRIPTION : The applicant is requesting a rezoning from R-A to B-3 and site plan approval to allow for the construction of a 3,985 s. f. Zaxby s Chicken restaurant with a drive-thru window on a acre lot. Restaurants with drive-thru windows are allowed by right in B-3 districts. The applicant has also submitted a re-plat application to separate this new lot from a larger parcel and absorb a triangle-shaped portion of the adjacent lot owned and occupied by Trejos Restaurant (SAP ). The application is being handled administratively. There are no prior applications at the site. REMARKS: The site is bordered on both sides by two B-3 zoned properties, including a Trejos s Restaurant (P-1-14), and sits across the street from a number of commercial properties (B-1, B-2 and B-3 zoning). Directly across the street from this property is a bank with B-1 zoning (P-17-07). Further north along North Market St., there are a handful of commercial establishments with B-2 and B-3 zoning, including a Taco Bell (P-4-11), a Johnny s Pizza House (BAP ), fitness center and Subway restaurant (P-15-08) within a strip center (P-23-07), Sonic drive-thru (P-19-07), and a proposed Walmart (P-15-13), among others. While there are a couple of residences south of this property on North Market St., the site is primarily surrounded by undeveloped R-A property. As the area is gradually transitioning from agricultural to commercial uses along this portion of the corridor, especially toward higher intensity commercial uses (B-2 & B-3), the current request seems appropriate given the development trend. The site currently contains a single-family residence, which will be demolished prior to construction. Elevation drawings indicate that the restaurant will feature a combined brick veneer and EIFS façade. As proposed, the site meets both the height and setback requirements, per sec & The proposed development requires 40 parking spaces, and 49 have been provided on the site plan. The 12 wide drive-thru will allow for the stacking of 9-10 vehicles. A 35 shared access driveway is the only access at the site and will allow one-way circulation throughout the lot. The adjacent lot is currently undeveloped, however, was approved (P-20-14) for an automotive center, which to date has not been constructed. Per the site plan, the applicant has indicated a shared access driveway, which is also shown on the aforementioned re-plat (SAP ). As the site is located on N Market/ LA Highway 1, LADOTD has re-quired additional information regarding trip generation projections, auto-turn movements and adjustments to the driveway s throat distance to assess the appropriateness of the access. These items will need to be resolved to the satisfaction of DOTD and provided on a revised site plan for the review and approval of the Executive Director prior to the issuance of any permits. An 8 tall brick enclosure surrounds the garbage dumpster. Per the site plan, the detention area will be located at the rear of the site. A pylon sign of an undetermined size and facade is located at the main entry. Both items will need to be shown on a revised plan. The required 5 landscaping strip along the street frontage has been provided and meets the requirement regarding the amount of trees, and presence of all three plant materials, per sec With regard to the parking area, the site requires 1,225 s. f. of landscaped area, per sec The site exceeds the requirement with 1,625 s. f. and includes all required plant materials. STAFF RECOMMENDATION : Staff recommends approval of this application subject to the provision of a revised site plan indicating: (1) the dimensions and elevations of the pylon sign at the entry, and (2) resolution of all issues relating to the driveway to the satisfaction of LADOTD, for review and approval by the Executive Director prior to the issuance of any permits. BOARD S DECISION The Board voted 9-0 to recommend that the Parish Commission approve this application subject to compliance with a revised site plan indicating: 1. The dimensions and elevations of the pylon sign at the entry 2. Resolution of all issues relating to the driveway to the satisfaction of LADOTD, for review and approval by

7 the Executive Director prior to the issuance of any permits. The information stated herein is the result of discussion by a staff review team. The Board members will use all information made available to them in making their decision. A Planning Commission approval is a use approval only. The applicant is still responsible for complying with all other applicable Zoning Ordinance requirements and obtaining all necessary permits and approvals from other departments or agencies. This shall include, but not be limited to the requirements of the Zoning Administrator, building permits, liquor licenses, the parish health unit, and Certificates of Occupancy.

19 ORDINANCE NO OF 2016 BY THE CADDO PARISH COMMISSION: AN ORDINANCE TO AMEND CHAPTER 54 OF THE CODE OF ORDINANCES OF THE PARISH OF CADDO, AS AMENDED, THE CADDO PARISH ZONING ORDINANCE, BY AMENDING THE ZONING OF PROPERTY LOCATED ON THE NORTH SIDE OF MARKET STREET, 3040 FEET EAST OF ROY ROAD EXTENSION, CADDO PARISH, LA, FROM R-A, RESIDENCE-AGRICULTURE DISTRICT, TO B-3, COMMUNITY BUSINESS DISTRICT WITH SITE PLAN APPROVAL, AND TO OTHERWISE PROVIDE WITH RESPECT THERETO BE IT ORDAINED by the Caddo Parish Commission in due, legal and regular session convened, that Chapter 54 of the Code of Ordinances of the Parish of Caddo is hereby amended and re-enacted to read as follows, to wit: The official Zoning Map of the Shreveport Metropolitan Planning Area of Caddo Parish, Louisiana, be amended by rezoning property located on the north side of Market Street, 3040 feet east of Roy Road Extension, Caddo Parish, LA, more particularly described below, be and the same is hereby amended from R-A, Residence-Agriculture District to B-3, Community Business District with site plan approval: A tract of land located in Section 31, T19N, R14W, Caddo Parish, LA, consisting of Lots 1 & 2, Maurice Place (less the front 10 feet +/- for R/W), & a triangular portion of Lot 1, Aria Subdivision, said triangular portion more fully described as: From the SE corner of Lot 1, Aria Subdivision (said point being on the west line of Lot 1, Maurice Place, run N W along the north R/W of N Market Street (LA Hwy 1) for feet, thence run N E feet to a point on the west line of Lot 1, Maurice Place, thence run S W along said west line feet to the POB. 20 RESOLUTION NO. 8 OF 2016 BY THE CADDO PARISH COMMISSION: A RESOLUTION URGING AND REQUESTING LOUISIANA S CONGRESSIONAL DELEGATION TO SUPPORT THE FUNDING OF THE RED RIVER SEDIMENTATION & HYDRAULIC SURVEY WHEREAS, the Red River Watershed experienced a historic flood in May and June 2015; and WHEREAS, a major issue that was identified was the difference between actual crest and projected crest, along with an additional concern that the Base Flood Elevation shown on current Flood Insurance Rate Maps (FIRM) published by FEMA, used to regulate development located in Special Flood Hazard Areas (SFHA s), are not accurate and must be updated; and WHEREAS, the local Flood Technical Committee has met with the Corp of Engineers, Vicksburg District and FEMA and indicated that it is not possible to determine the reasons for these discrepancies and provide corrective actions without a $1.5 million Sedimentation and Hydraulic Survey; and WHEREAS, monies appropriated for FY 2016 Civil Works Program, which provided an opportunity to obtain these was not utilized to address the survey requested instead using those funds for mitigation and recreation programs; and WHEREAS, the belief is that this is a serious and possible catastrophic problem for Caddo Parish and other local communities along the Red River. NOW, THEREFORE, BE IT RESOLVED by the Caddo Parish Commission in due, regular and legal session convened that it urges and requests the Louisiana Congressional delegation to support the funding of the Red River Sedimentation & Hydraulic Survey and to be presented to Congress for approval and funding. BE IT FURTHER RESOLVED that if any provision or item of this Resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications which can be given effect without the invalid provisions, items or applications, and to this end the provisions of the Resolution are hereby declared severable. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict thereof are hereby repealed.

21 RESOLUTION NO. 9 OF 2016 BY THE CADDO PARISH COMMISSION: A RESOLUTION SUSPENDING THE EFFECTS OF CHAPTER 4 AND CHAPTER 54 OF THE CADDO PARISH CODE OF ORDINANCES RELATIVE TO ALCOHOLIC BEVERAGES AND ZONING REGARDING 2400 EAST 70 TH STREET, SHREVEPORT, LOUISIANA AND OTHERWISE PROVIDING WITH RESPECT THERETO WHEREAS, 2400 East 70 th Street, Shreveport, Louisiana has been the location of restaurants selling high and low alcoholic content beverages for consumption on premises for over 30 years; and, WHEREAS, the Caddo Parish Code of Ordinances, Chapter 54, provides that the sale or dispensing of beverages of high or low alcoholic content is a special exception use requiring approval of the Zoning Board of Appeals; and, WHEREAS, that section of the Code of Ordinances, Section , also provides that approval of any alcoholic beverage use which ceases to operate or is discontinued for any period of time shall be null and void and shall not be reestablished without further approval by the Zoning Board of Appeals; and, WHEREAS, the previous establishment located at this address closed approximately two years ago; and, WHEREAS, a new restaurant has been opened at that location; and WHEREAS, the restaurant, LaRouge Steak and Seafood, has made application for a permit for sale and dispensing of high and low alcoholic content beverages for consumption on premises; and WHEREAS, there has been alcoholic beverage sales for consumption on the premises at this location for a lengthy period of time; and WHEREAS, there are other locations in the near vicinity which sell alcoholic beverages; and WHEREAS. the proprietors of LaRouge Steak and Seafood have made application for a special exception use to permit them to sell and dispense high and low alcoholic beverages for consumption on premises; and WHEREAS, the hearing on their application will occur within several months; and WHEREAS, the sale and consumption of alcoholic beverages is an important adjunct to the sale and consumption of fine food; and WHEREAS, the success of local business establishments such as LaRouge Steak and Seafood is important to the area s economy; WHEREAS, a short term suspension of the zoning and alcoholic beverage ordinances to the extent necessary for that business to begin selling and dispensing alcoholic beverages for consumption on premises is appropriate and reasonable. NOW, THEREFORE, BE IT RESOLVED by the Caddo Parish Commission in due, regular and legal session convened that Chapter 4 and Chapter 54 of the Code of Ordinances are hereby suspended relative to the sale of alcoholic beverages at 2400 East 70 th Street, Shreveport, Louisiana allowing for the sale of alcoholic beverages at this location during the pendency of the process for review and approval of an

22 application for a special exception and an application for an alcoholic beverages permit(s). The suspension of Chapter 4 shall only be to the extent necessary to allow issuance of a permit for consumption on premises of high and low alcoholic content beverages. All other provisions of that chapter regarding the manner and method of the sale, dispensing, and consumption of alcoholic beverages shall remain in effect. BE IT FURTHER, RESOLVED that all other provisions of Chapters 4 and 54 of the Code of Ordinances having no application on the sale of alcoholic beverages at this location shall remain in full force and effect. BE IT FURTHER RESOLVED that if any provision or item of this 'resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items or application, and to this end, the provisions of this resolution are hereby declared severable. BE IT FURTHER RESOLVED that this resolution shall become effective immediately on adoption. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed. 23 RESOLUTION NO. 10 OF 2016 BY THE CADDO PARISH COMMISSION: A RESOLUTION URGING AND REQUESTING THE LOUISIANA LEGISLATURE TO OPPOSE ANY REDUCED FUNDING RELATIVE TO UNIVERSITY HEALTH OR LSU HEALTH SHREVEPORT SCHOOL OF MEDICINE, AND OTHERWISE PROVIDING WITH RESPECT THERETO; WHEREAS, University Health Shreveport had more than 70,000 visits to their emergency department and nearly 400,000 outpatient clinic visits in More than 65% of their patients were those most financially in need or covered under Medicaid; and WHEREAS, University Health Shreveport is home to the only level 1 Trauma Center within 100 miles; WHEREAS, any reduction in University Health Shreveport funding will jeopardize essential hospital services and budget cuts would likely lead to a reduction in services to the citizens of Caddo Parish; WHEREAS, any reduction in the LSU Health Shreveport School of Medicine would jeopardize not only the research and teaching facility but would also be detrimental to the quality of care to citizens and the economy of Caddo Parish; NOW THEREFORE BE IT RESOLVED by the Caddo Parish Commission in due, regular and legal session convened, that it does hereby: Oppose any reduced funding or budget cuts to the University Health Shreveport or LSU Health Shreveport School of Medicine. BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this resolution are hereby declared severable. BE IT FURTHER RESOLVED that this resolution will be forwarded to the Caddo Parish delegation for both the 2016 special and regular sessions. 24 RESOLUTION NO. OF 11 of 2016 BY THE CADDO PARISH COMMISSION: A RESOLUTION PRELIMINARILY SUSPENDING THE CADDO PARISH ADMINISTRATOR, AND OTHERWISE PROVIDING WITH RESPECT THERETO. WHEREAS, the Caddo Parish Administrator, Dr. Woodrow Wilson, Jr., is not in compliance with Ordinance 5735 of 2013, which requires the Caddo Parish Administrator and certain other Parish employees to reside within Caddo Parish; WHEREAS, the evidence showing that the Caddo Parish Administrator is not in compliance with Ordinance 5735 is as follows: 1) Administrator Wilson still maintains a homestead exemption on a home in Bossier Parish, Louisiana; 2) Commissioner Matthew Linn visited the residence in Caddo Parish claimed by Administrator Wilson and found the residence to be empty; 3) Commissioner Matthew Linn has been told that the Caddo Parish residence claimed by Administrator Wilson has always been empty and appears to be a display apartment used for showings to potential residents; (All information provided to the Commission is attached as Exhibit A to this resolution) WHEREAS, Administrator Wilson is registered to vote in Caddo Parish, and this registration appears to contradict the maintenance of a homestead exemption in Bossier Parish; WHEREAS, Administrator Wilson was asked during his employment evaluation in June of 2015 whether he resided in Caddo Parish, to which he responded affirmatively, thus appearing to intentionally mislead Parish Commissioners as to his residency. WHEREAS, it appears that Administrator Wilson is not in compliance with the requirement of his employment that he reside in Caddo Parish, and thus should be removed from the office of Caddo Parish Administrator in accordance with the following procedure: Sec Removal. The commission may remove the parish administrator from office in accordance with the following procedures: (1) The commission shall adopt by affirmative vote of two thirds of the entire membership of the commission a preliminary resolution which must state the reasons for removal and may suspend the administrator from duty for a period not to exceed forty-five (45) days. A copy of the resolution shall be delivered promptly to the administrator. (2) Within five (5) days after a copy of the resolution is delivered to the administrator, he may file with the commission a written request for a public hearing in accordance with procedures established by the commission. This hearing shall be held at a commission meeting not earlier than fifteen (15) days nor later than thirty (30) days after the request is filed. The administrator shall file with the commission a written reply no later than five (5) days prior to the hearing. (3) The commission may adopt a final resolution of removal, which may be made effective immediately, by affirmative vote of two thirds of its entire membership at any time after five (5) days from the date when a copy of the preliminary resolution was delivered to the administrator, if the administrator has not requested a public hearing, or at any time after the public hearing if the administrator has requested one. The administrator shall continue to receive his salary until the effective date of a final resolution of removal. NOW, THEREFORE, BE IT RESOLVED by the Caddo Parish Commission in due, regular and legal session convened, that the Caddo Parish Commission does hereby preliminarily remove Dr. Woodrow Wilson, Jr. from the office of Caddo Parish Administrator and suspend him from that office. BE IT FURTHER RESOLVED that Mr. Randy Lucky is hereby appointed interim Caddo Parish

25 Administrator. BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this resolution are hereby declared severable. BE IT FURTHER RESOLVED that this resolution shall take effect immediately. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed. WHEREAS, the Parish of Caddo seeks to ensure that the broadest pool of potential candidates for public employment are invested in the community in which they live and with the government which employs them; and WHEREAS, the Parish of Caddo seeks to ensure operational efficiency and effectiveness by having employees who are aware and knowledgeable of the needs of the community, and are readily available and accessible to respond to the needs of the community, especially in emergencies; and WHEREAS, the Parish of Caddo seeks to ensure that its employees have a greater personal stake in the progress of the parish, including, but not limited to enhancing the parish s tax base; increasing the population of the parish, improving the school system, and reducing unemployment/underemployment. NOW, THEREFORE, BE IT ORDAINED by the Caddo Parish Commission in due, regular and legal session convened, that the Parish Personnel Policy be and is hereby amended to read as follows, to-wit: Sec RESIDENCY a. Effective February 1, 2014, employees permanently hired, appointed, or promoted to any of the following listed positions shall be residents of Caddo Parish within one year from the date of commencement of employment, appointment, or promotion and throughout the course of their employment with the Parish: Parish Administrator/CEO, Assistant Parish Administrator, Parish Attorney, Department Director, Commission Clerk; b. As a condition of hiring, appointment, or promotion to the positions listed in subsection (a), parish employees will be required to show proof of residency within the guidelines established by the Human Resources Department and which complies with Section 106(Q) of the Parish Personnel Policy. Falsifying, materially misrepresenting, misleading proof of residency could be cause for disciplinary action, up to and including termination. c. All external and internal employment applications for the positions listed in subsection (a) shall require a statement thereon indicating that residency is a required condition. d. All parish employees hired, appointed, or promoted to the positions listed in subsection (a), prior to February 1, 2014, except the Parish Administrator/CEO, are not subject to the requirements of this ordinance, as long as said employees maintain the position held as of February 1, e. The current Parish Administrator/CEO shall have until July 1, 2015 to comply with the requirements of this ordinance. Sec. 101 DEFINITIONS Q. Resident - a person shall be a resident of Caddo Parish provided (1) the employee s principal residence is in Caddo Parish (2) if the employee owns the residence, the employee s principal residence is so designated with parish tax assessor (3) the employees principal residence is designated as his or her legal address and legal residence for voting. The fact that a person is domiciled in Caddo Parish will not, by itself, satisfy the requirement of principal residency hereunder. R. Supervisor B shall mean a fairly highly responsible position designated to supervise a particular unit within a department and direct the work of other employees on a daily basis to include input in the hiring process, assigning work, conducting performance appraisals, recommending merit increases, and the discipline of employees. S. Temporary/Seasonal Employee B shall mean any person hired or appointed to a position (regardless of hours per week requirements) of a short-term duration. Examples are Seasonal Pest Control Officers, Summer Youth Program Workers, COE Students, individuals hired through temporary agencies, and individuals hired in a temporary replacement situation.

27 T. Unclassified Employee B shall mean those persons who are specifically exempted from classified status by the Caddo Parish Home Rule Charter. BE IT FURTHER ORDAINED, that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions; items or applications which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this ordinance are hereby declared severable. WHEREAS, the Parish seeks to authorize commissioners and their dependents to participate in group medical benefits and life insurance plans offered by the Parish to its classified and appointed employees; NOW, THEREFORE, BE IT ORDAINED by the Caddo Parish Commission in due, regular and legal session convened, that Section 2-30 of the Code of Ordinances be and is hereby amended and reenacted to read as follows, to-wit: Sec Commission insurance participation.
